Abstract

In the era of financial technology, e-wallets have become a popular payment tool among e-commerce users aged 19-45. However, e-wallets face security issues, such as breach cases that harm users. Regulations such as PBI Number 20/6/PBI/2018 and POJK No. 6/POJK.07/2022 require organizers to ensure security and consumer protection, but their implementation is still in doubt. The purpose of this study is to analyze the legal protection of consumers from the risk of personal data security, the threat of fraud, and circumvention (cybercrime) in the e-wallet payment system. The method used in this research is normative research. Based on the principle of legality, cybercrimes such as data theft have violated the ITE Law, therefore a person's personal data must be protected according to the Ministry of Communication and Information and Bank Indonesia Regulations. According to Philipus M. Hadjon's theory of legal protection to overcome legal problems such as data theft on e-wallets, preventive and repressive measures are needed.

Abstract

Pelayanan kesehatan online, atau yang umumnya dikenal sebagai telekonsultasi, merupakan bagian integral dari kemajuan teknologi dalam bidang kesehatan. Peningkatan inovasi ini mulai menyebar di Indonesia bersamaan dengan dorongan inovasi data, terutama di masa merebaknya virus Corona yang membatasi kerja sama yang erat dan personal. Manfaat dari pengadopsian inovasi ini melibatkan keleluasaan dalam pengaturan waktu, penurunan biaya pertemuan, jangkauan yang lebih luas, serta peningkatan dalam pelayanan kesehatan. Akan tetapi, penerapan layanan konsultasi kesehatan online dapat menimbulkan permasalahan etika dan hukum di Indonesia, seperti kekhawatiran mengenai kerahasiaan dan keamanan data pasien serta legalitas lokasi praktik, izin praktik, dan transaksi terapeutik. Konsultasi kesehatan online saat ini tidak diatur secara spesifik di Indonesia. Oleh karena itu, pedoman yang tegas diharapkan dapat menjamin pemanfaatan inovasi tersebut sesuai dengan moral dan peraturan materiil. Selain itu, penyempurnaan pedoman dan penggunaan peralatan klinis juga perlu terus dilakukan untuk membantu terlaksananya penyelenggaraan pertemuan kesehatan berbasis internet ini. Hal ini penting guna memastikan bahwa pelayanan tersebut tetap memenuhi standar keamanan dan kualitas yang dibutuhkan dalam konteks kesehatan masyarakat.

Abstract

Inadequate building facilities at Puskesmas, as mandated by Permenkes Number 19 of 2024, pose risks to health workers and patients, potentially leading to medical disputes and compromised service quality. This study analyzes the implementation of Puskesmas building facility standards and evaluates the legal protection framework for health workers under Law Number 17 of 2023 and Permenkes No. 19 of 2024. Normative legal research was conducted through document and literature studies, analyzing primary, secondary, and tertiary legal materials. Many Puskesmas fail to meet building standards, with issues like limited-service space, poor room layouts, and inadequate safety facilities, increasing risks for health workers. Legal protections exist but are hindered by implementation gaps, lack of legal education, and insufficient government support and help workers. Strengthening many regulatory enforcement, enhancing legal education, and improving facility compliance are critical to ensuring effective legal and many protections for health workers and quality health services.

Abstract

The use of songs on digital platforms without permission and royalty payments has caused economic losses of up to 1.2 trillion IDR per year for creators, due to weak manual tracking systems and database fragmentation. This study aims to formulate an integrated data bank model based on blockchain, Application Programming Interface, and audio fingerprinting to improve the transparency of royalty distribution in accordance with the Copyright Law and Government Regulation Number 56/2021, as well as fulfilling trade aspects related to intellectual property rights article 14. through a normative juridical approach, this study analyzes the legal gaps between national regulations and global practices and examines the implementation of real-time tracking technology. The results are expected to produce technical policy recommendations for system harmonization, increasing royalty distribution accuracy to 85%, and strengthening law enforcement through digital evidence. This research supports the National Medium-Term Development Plan 2024-2025 target of increasing the contribution of the creative economy by 7% and strengthening Indonesia's position in the global Intellectual Property Rights regime through adaptive and sustainable technology-based solutions.

Abstract

The main problem of this research is how to analyze the juridical pawn agreement at PT Pegadaian (Persero) Maros Branch. The subject matter is further broken down into several subproblems, namely how to implement the lien agreement at PT Pegadaian (Persero) Maros Branch and how the process of resolving the default of the lien agreement at PT Pegadaian (Persero) Maros Branch. This research is a type of qualitative field research. This research will be conducted by interviews with branch leaders, employees of PT Pegadaian (Persero) Maros Branch and customers of PT Pegadaian. This research uses a sociological legal approach, namely direct field research. Data collection is obtained from observation, interviews and questionnaires. Based on the results of the study, it was answered that the implementation of the pawn agreement at PT Pegadaian (Persero) Maros Branch has not been effective because there are still many customers who do not heed the implementation of the pawn agreement so that only 57% is carried out and the implementation of the lien agreement is not carried out 43% of the total percentage of 100%. Meanwhile, the process of resolving the default of the pawn agreement at PT Pegadaian (Persero) Maros Branch is 1) for customers who do not pay credit installments or maturity, PT Pegadaian will reprimand customers by calling, SMS, writing to customers and the last resort taken is by parate execution or auction, 2) regarding the provision of compensation for lost customer collateral by indemnifying them in full or in whole while damaged collateral can be done by paying compensation of 125% of the estimated value of goods listed in SBK or can be more in accordance with the agreement and policy of PT Pegadaian it self.

Abstract

In Indonesia, there has been an increase in the number of hospitals declared bankrupt, which has a significant impact on the implementation of the National Health Insurance (JKN) managed by the Health Social Security Administration. Hospitals as BPJS strategic partners face challenges in fulfilling health service obligations due to financial pressures and Bankruptcy Legal status, which can threaten the rights of participants to obtain decent health services. This situation reflects the urgent need for legal mechanisms that protect the rights of participants and ensure the sustainability of health services in the midst of economic and legal dynamics. This study aims to examine the obligations of health services to BPJS Kesehatan participants in hospitals that are experiencing bankruptcy, and analyze the legal basis that governs it. This issue is important considering that there is a potential conflict of interest between the hospital bankruptcy process and the obligation of sustainable health services to BPJS Kesehatan participants. This study uses normative juridical method by reviewing relevant regulations, such as Law No. 24 of 2011 on BPJS, Law No. 40 of 2004 on National Social Security System, and Law No. 37 of 2004 on bankruptcy and PKPU and conceptual approach to analyze the legal obligations of hospitals in bankruptcy conditions in providing health services and protecting the rights of BPJS Health participants. The results showed that the obligation to provide health services to BPJS Health participants remained based on the principle of protection of the right to health as mandated in the legislation. This study recommends the need for special legal protection mechanisms and coordination between the bankruptcy curator, BPJS Kesehatan, and the government to ensure the continuity of health services in hospitals experiencing bankruptcy

Abstract

Limited access and uneven quality of medical rehabilitation services remain major challenges in improving patients’ quality of life in Indonesia. Many patients, especially in remote areas, face difficulties accessing adequate rehabilitation facilities due to limited human and infrastructure resources. Additionally, a lack of public awareness and insufficient psychosocial support reduce therapy adherence. This study aims to evaluate the barriers and potential solutions within Indonesia’s medical rehabilitation system. The research method employs a qualitative descriptive approach using a literature review technique based on secondary data such as scientific articles, policy documents, and relevant research reports. Findings reveal key obstacles including limited facilities, insufficient health insurance coverage for rehabilitation services, and inconsistent service standards across facilities. The discussion highlights the need for strengthening referral systems, improving public health literacy, and developing integrated rehabilitation models that include psychosocial components. The study concludes that enhancing access, service quality, and active participation of patients and families in the rehabilitation process is essential for accelerating recovery and improving patient outcomes.

Abstract

Intercontinental traditional health workers are health workers with a scientific basis in traditional Chinese health who perform traditional health services in Indonesia accordance with Health Law No. 17 of 2023. This research aims to conduct an in-depth study of the legal certainty of Intercontinental traditional health workers in Indonesia in relation to rights, authorities and sanctions in the provision of health services and support for National Health Network (JKN) benefits through the Health Social Security Organizing Agency (BPJS). The research is a qualitative research based on normative law in the form of a legal research process that focuses on legal rules or principles sourced from laws and regulations, court decisions, and doctrines from legal experts. The results of the study state that Intercontinental traditional health workers get legal certainty in accordance with the Law and Regulation of the Minister of Health as traditional health workers with authority and can practice in independent practices, community health centers, hospitals, traditional health service facilities and/or health service facilities (Griya Sehat). Intercontinental traditional health workers have not yet received benefit support from the National Health Network through the Social Security Organizing Agency. It is necessary to make regulations for Intercontinental traditional health practitioners that include internationally recognized competency standards, national registration and licensing mechanisms, and residency and work requirements

Abstract

Technological developments and the need for better healthcare services are driving the transformation of health law in Indonesia. This study aims to analyze the impact of Law Number 17 of 2023 concerning Health on legal protection for healthcare workers and patients. The study used a qualitative approach using literature study methods and legal document analysis. Data were collected from laws and regulations, scientific journals, and official health-related documents. The findings indicate that the law strengthens legal protection for healthcare workers by clarifying their rights and obligations, including in anesthesia services and emergency treatment. For patients, the law improves access to equitable healthcare services and ensures the confidentiality of medical records. However, implementation still faces challenges, such as a lack of public awareness and harmonization with previous regulations. This study concludes that Law No. 17 of 2023 provides a strong foundation for a more structured healthcare system, but its success depends on consistent implementation and inter-agency coordination. This study recommends increased training for healthcare workers and public outreach to support the effective implementation of this law.

Abstract

Perkembangan pesat teknologi finansial (fintech) telah menghadirkan layanan pinjaman dengan syarat yang lebih fleksibel dan mudah diakses dibandingkan dengan lembaga keuangan konvensional seperti bank. Namun, kemajuan ini juga menimbulkan berbagai tantangan, terutama ketika debitur mengalami kredit macet. Kreditur dalam upaya menagih utang terkadang menggunakan metode yang agresif atau bahkan melanggar hukum, termasuk pemanfaatan media sosial untuk menekan debitur, yang sering disebut sebagai persekusi digital. Penelitian ini bertujuan untuk menganalisis implikasi hukum dari perilaku kreditur tersebut dalam pinjaman online serta menilai perlindungan yang tersedia bagi debitur berdasarkan regulasi yang ada. Dengan menggunakan pendekatan yuridis normatif dan metode deskriptif, data dikumpulkan melalui studi dokumen dan analisis data sekunder. Analisis kualitatif menunjukkan bahwa sengketa sering muncul akibat klausul kontrak yang tidak jelas atau kurangnya mekanisme penyelesaian sengketa dalam perjanjian pinjaman online. Ketika upaya penyelesaian secara damai gagal, sengketa akan berlanjut ke proses litigasi. Tindakan paksaan oleh kreditur dapat melanggar Pasal 335 ayat (1) angka 1 dan Pasal 368 ayat (1) Kitab Undang-Undang Hukum Pidana (KUHP) yang mengatur larangan persekusi dan pemerasan dengan kekerasan. Selain itu, regulasi seperti Peraturan Otoritas Jasa Keuangan Nomor 77/POJK.01/2016 menekankan prinsip transparansi, keadilan, keandalan, kerahasiaan, dan penyelesaian sengketa yang mudah diakses untuk melindungi pengguna fintech. Penelitian ini menyimpulkan bahwa penegakan hukum yang lebih kuat dan klausul kontrak yang lebih jelas sangat diperlukan untuk melindungi hak konsumen serta mencegah penyalahgunaan dalam sektor pinjaman fintech.   As Wrong One form financial technology (fintech) is impact from progress technology Which offer loan with condition And provision more easy And flexible compared to with institution finance conventional like bank.
