Abstract

In the Constitution of the Republic of Indonesia Year 1945 stipulates that Indonesia is adopting a presidential system in the administration of the State. The consequence of this system, as stipulated in Article 4, paragraph 1 of the 1945 Constitution, that the president acts as head of government. In addition, implied by reference in Article 10 to Article 15 of the 1945 Constitution, the president also acted as Head of State, of the provisions of the president has a great power. In the 1945 Constitution besides regulating the system of government also regulates the powers of the president who is usually known as the Right Prerogative but the authors have called for Constitutional Rights. Authorizations are set out in Articles 10, 11, 12, 13, 14 and Article 15 of the 1945 Constitution existence of the special session is not mentioned explicitly in the 1945 Constitution Article 2 paragraph (2) of the 1945 Constitution states that the Assembly convene at least once in five years, however Tap. III / 1978 set for the existence of the special session (SI) to hold the president in the middle of his term.

Abstract

Freedom of expression is the right to seek, receive, disseminate information. Through the recognition of the rule of international law in the Universal Declaration of Human Rights (DUHAM), which in Article 19 states that everyone has the right to freedom to have and express opinions, without interference and to seek, receive and express information and opinions in any way and in the absence of restrictions. Freedom of expression in Indonesia today should be questioned for its implementation considering that there are many problems that occur now, one of which is the silencing of freedom of expression, keep in mind that freedom can basically be limited in accordance with the provisions contained in the human rights law and other provisions.  Changes to a constitution require the right time, namely when the articles in the constitution are felt to be no longer in accordance with the developments and needs that exist in society, and when the community has begun to feel that there is no guarantee of legal certainty. The existence of the concept of human rights, including the right to freedom of expression and opinion, is closely related to the concept of the state of law. Abstract

Asuransi adalah perjanjian antara penanggung dan tertanggung di mana tertanggung berkewajiban membayar premi sedangkan tertanggung membayar ganti rugi atas risiko yang terjadi. Apabila terjadi kesalahan yang menimbulkan kerugian yang disebabkan oleh pihak ketiga, penanggung yang telah membayar ganti kerugian atas benda yang diasuransikan menggantikan tertanggung dalam segala hak yang diperolehnya terhadap pihak ketiga yang telah menimbulkan kerugian tersebut atau disebut subrogasi. Permasalahan dalam penelitian ini adalah 1) Bagaimanakah penerapan hak subrogasi terhadap asuransi kendaraan bermotor di Kota Padang ? 2) Apakah alasan tidak diterapkan hak subrogasi terhadap asuransi kendaraan bermotor di Kota Padang ?. Metode dalam peneletian ini berjenis yuridis sosiologis dengan teknik pengumpulan data dengan wawancara dan studi dokumen, berdasarkan semua data yang diperoleh dari hasil penelitian, baik data primer maupun data sekunder disusun dan dianalisis dengan metode analisis kualitatif. Penelitian yang dilakukan di lapangan ditemukan bahwa : 1) penerapan hak subrogasi terhadap asuransi kendaraan bermotor di Kota Padang tidak diterapkan, karena risiko yang ditanggung telah dihitung dalam pembayaran premi. 2) alasan tidak diterapkan hak subrogasi terhadap asuransi kendaraan bermotor di Kota Padang karena ada kekhawatiran dari perusahaan asuransi terhadap tertanggung tidak jujur dalam mengajukan klaim dan kekhawatiran apabila pihak ketiga tidak ada upaya dalam mengganti kerugian.

Abstract

Abstract: In Law Number 35 of 2009 concerning Narcotics, the use of evidence to determine a suspect's qualifications as a narcotics dealer, owner or abuser does not specifically regulate these qualifications, which has an impact on the use of articles that are suspected of not being given to the perpetrator. This multi-interpretation article means that perpetrators of narcotics crimes (dealers) will take refuge as if they were victims of narcotics crimes. This will have an impact on the imposition of sentences with short sentences, thereby causing injustice in the implementation process. The application of different criminal penalties is very detrimental and does not reflect a sense of justice because a narcotics user before using narcotics is guaranteed to have to own or buy it first and when narcotics have been purchased or owned before being used they have been arrested by the police or BNN so that automatically the results of the laboratory examination of the urine in question will be negative.Keywords: Evidence, Narcotics, Dealers, Narcotics Abusers.

Abstract

MKMK decision Number 2/MKMK/L/11/2023 does not refer to PMK No. 1 of 2023 concerning the Honorary Council of the Constitutional Court, the only sanction for serious violations is dishonorable dismissal and there are no other sanctions as regulated in Article 41 letter c and Article 47 of Constitutional Court Regulation Number 1 of 2023 concerning the Honorary Council of the Constitutional Court. This research is descriptive in nature, namely an attempt to describe the Constitutional Court Regulation Number 1 of 2023 concerning the Honorary Council of the Constitutional Court in the MKMK Decision Number: 2/MKMK/L/11/2023.Keywords: Regulations, Constitutional Court, Honorary Council of the Constitutional Court.

Abstract

Law Number 8 of 1999 addressing Consumer Protection is specifically delineated through Government Regulation (PP) Number 71 of 2019, which pertains to the Implementation of Electronic Systems and Transactions. Conventional business transaction modalities are categorized as electronic transactions, which are defined as legal actions executed via computers, computer networks, and/or alternative electronic media. The transactional framework facilitated by internet technology renders numerous advantages, both for vendors and consumers, as this system possesses inherent benefits that provide enhanced convenience, rapidity, and efficiency. Consequently, it is not unexpected that the current proliferation of internet utilization grounded in electronic commerce (commonly denoted as e-commerce) is experiencing swift growth, notably within the Indonesian context. This advancement simplifies the process for individuals and enterprises to engage in a diverse array of business transactions, particularly in the realm of trade.
