Abstract

In Indonesia, religion and state are two different entities, and each has its own autonomy, where there is an area that is completely “belonging to” religion, the state cannot enter it and there is also an area that is fully the competence of the state, so religion is not can participate in it. So that the formation of laws will reflect the configuration of power and political interests. In the actualization of political power and interests, sometimes there is a clash between the interests of fragmatism and those that are permanent and in favor of the benefit of mankind. This means that the interests of ideological values that live and develop in society can be configured with the interests of political power fragmatism. Therefore, first, the legislative program for several aspects of the modernization of Islamic family law politics in Indonesia, namely starting with the history of legislation on marriage in Indonesia, one of which is the Dutch East Indies Government circulating the Draft Ordinance on Registered Marriage, which includes the principle of monogamy and the prohibition of imposing divorce out of court. Then from the point of view of the meaning of the ideal law, the presence of KHI is a series of historical national laws that can reveal the various meanings of the life of the Indonesian Muslim community. Second, before the birth of Law no. 1 of 1974 in Indonesia various marriage laws apply for various groups of citizens and various regions. in the Indieche Staats Regeling (ISR), namely the Indian constitutional regulations. After independence, the Indonesian government has established a number of Islamic marriage regulations. Among them are Law Number 22 Year 1946 concerning Registration of Marriage, Divorce and Reconciliation.

Abstract

Dalam perkembangan Hukum Nasional Indonesia, keberadaan hukum Islam sangat penting, selain sebagai materi bagi penyusunan hukum nasional, hukum Islam juga menjadi inspirator dan dinamisator dalam perkembangan hukum nasional. Di samping itu, kajian tentang sejarah hukum Islam di Indonesia juga dapat dijadikan sebagai salah satu pijakan bagi umat Islam secara khusus untuk menentukan strategi yang tepat di masa depan dalam mendekatkan dan “mengakrabkan” bangsa ini dengan hukum Islam. Tidak dapat dipungkiri bahwa umat Islam di Indonesia adalah unsur paling mayoritas. Dalam tataran dunia Islam internasional, umat Islam Indonesia bahkan dapat disebut sebagai komunitas muslim paling besar yang berkumpul dalam satu batas teritorial kenegaraan. maka ada beberapa pengidentifikasian masalah mengenai hal itu yaitu bagaimana perkembangan serta karakteristik Hukum Islam pada zaman penjajahan Belanda dan Jepang. Oleh karena itu karakteristik hukum Islam di Indonesia pada zaman penjajahan Belanda, para ahli sejarah hukum membaginya menjadi dua periode: pertama, periode penerimaan hukum Islam sepenuhnya atau yang biasa disebut reseption in Complexu. Kedua, periode penerimaan hukum Islam oleh hukum adat yang biasa disebut teori receptie. Karakteristik hukum Islam di Indonesia pada zaman penjajahan Jepang yaitu mengenai posisi hukum Islam dalam system hukum nasional pada masa kolonial Jepang tidak ada perubahan yang berarti dari periode sebelumnya. Hanya merubah nama-nama lembaga yang ada pada masa penjajahan Belanda ke dalam bhasa Jepang.

Abstract

Democracy as a constitutional concept when used as a state ideology has many meanings and names, this is due to the many implementations of democratic values which seem to be the obsession of the world community. In our constitutional system, some basic values of constitutional democracy can no longer be questioned, because the amendments to the Constitution are contained in Article 1 paragraph (3), which states that Indonesia is a constitutional state and not based on mere power and uses a constitutional system. The existence of the Constitutional Court as one of the state institutions that exercises judicial power is a power that is independent from all kinds of extra-judicial influences and is responsible to the people through the administration of the Constitutional Court based on the principles of good and clean governance through and its decisions in accordance with the constitution, the will of the people and democratic ideals.Keywords: Democracy, Independence, Constitutional Court

Abstract

Financial institutions and banks provide financing for consumers, leasing, factoring. They generally use the procedure of the agreement which includes a fiduciary guarantee for fiduciary security objects. In practice, financial institutions provide movable goods requested by consumers. Consequently the debtor surrenders to the creditor in a fiduciary manner. Implementation of the executorial title by PT. Mandiri Tunas Finance is not through a court decision or fiduciary guarantee certificate, but only based on a power of attorney and agreement made by the collector . The sale of fiduciary collateral objects carried out by PT. Mandiri Tunas Finance does not go through public auctions but through separate sales; and Underhanded sales are not based on the agreement of both parties, the agreement is only based on PT. Mandiri Tunas Finance so that it harms the consumer. Actions taken by PT. Mandiri Tunas Finance does not provide legal certainty to both parties. The act of execution was carried out solely to safeguard assets regardless of legal certainty of the rights of consumers / debtors contained in fiduciary security objects in the form of car vehicles. Legal constraints of not registering the agreement are that execution cannot be carried out, based on Article 3 of the Minister of Finance Regulation No. 130 / PMK.010 / 2012 stating that finance companies are prohibited from withdrawing fiduciary objects in the form of motorized vehicles if the Fiduciary Registration Office has not issued a guarantee certificate fiduciary and hand it over to the finance company. With these provisions, PT. Mandiri Tunas Finance cannot execute if it does not register fiduciary collateral objects because without the registration of fiduciary collateral objects the fiduciary guarantee certificate cannot be issued.

Abstract

Adanya wabah Corona virus Disease (Covid-19) di Indonesia membawa dampak bukan hanya di sektor kesehatan tetapi juga pada sektor ekonomi. Lumpuhnya kegiatan ekonomi akibat adanya physical distancing untuk menekan penyebaran virus, menyebabkan pertumbuhan ekonomi menjadi terhambat, sehingga mengakibatkan kegiatan bisnis perbankan menjadi macet atau bermasalah terutama dalam menjaga kolekbilitas kreditnya. Kondisi seperti ini akan berimbas pada menurunnya kemampuan membayar para debitur dari suatu Bank. Ketidak mampuan atau menurunya kemampuan dari debitur untuk membayar angsuran kreditnya adalah merupakan gejala awal dari timbulnya suatu kredit bermasalah dalam dunia perbankan. Untuk mengatasi hal ini maka pemerintah mengeluarkan kebijakan yang dinamakan Restrukturisasi Kredit. Restrukturisasi kredit adalah upaya perbaikan yang dilakukan bank dalam kegiatan perkreditan terhadap debitur yang mengalami kesulitan untuk memenuhi kewajibannya yang diatur dalam Peraturan Otoritas Jasa Keuangan No.11/POJK.03/2015 dan PBI Nomor 14/15/PBI/2012. Restrukturisasi adalah program sebagai suatu upaya perbaikan yang dilakukan dalam kegiatan perkreditan terhadap debitur yang mengalami kesulitan untuk memenuhi kewajibannya.

Abstract

Law Number 8 of 1999 addressing Consumer Protection is specifically delineated through Government Regulation (PP) Number 71 of 2019, which pertains to the Implementation of Electronic Systems and Transactions. Conventional business transaction modalities are categorized as electronic transactions, which are defined as legal actions executed via computers, computer networks, and/or alternative electronic media. The transactional framework facilitated by internet technology renders numerous advantages, both for vendors and consumers, as this system possesses inherent benefits that provide enhanced convenience, rapidity, and efficiency. Consequently, it is not unexpected that the current proliferation of internet utilization grounded in electronic commerce (commonly denoted as e-commerce) is experiencing swift growth, notably within the Indonesian context. This advancement simplifies the process for individuals and enterprises to engage in a diverse array of business transactions, particularly in the realm of trade.

Abstract

Abstract: Financing institutions are one form of business in the field of non-bank financial institutions. The activities of this financing institution are carried out in the form of providing funds or capital goods without directly withdrawing funds from the public. One form of financing institution in Indonesia is Venture Capital. Venture capital is directed to help small businesses that are experiencing capital difficulties in their business activities or small businesses in the process of growing their business scale. The purpose of this study is to find out about the concept of venture capital as a financing institution in Indonesia. The approach method used is the Juridical approach. The concept of venture capital is basically not the same as ordinary capital participation. Banks that carry out bad credit in other companies by converting it into equity participation are not venture capital, likewise ownership of a company's share capital through the capital market cannot be classified as a venture capital business. However, a bank that finances a company can use the concept of venture capital. Venture capital institutions in Indonesia currently still do not fully use the concept of pure venture capital as is done by venture capital companies abroad. The institutional structure of venture capital that exists at this time is not separated from the legal entity of the venture capital fund on the one hand with the management of venture capital on the other.Keywords: Concept, venture capital, financing institutions.

Abstract

Seeing the success that PT. Dagadu Aseli and Joger as iconic brands that are characteristic of Yogya and Bali, Kadai Tangkelek has also tried to follow the same path. The main target market for Kadai Tangkelek is tourists who make these products as souvenirs to be brought to their home areas. Especially after the earthquake in 2009, the city of Padang was crowded with volunteers from various parts of Indonesia, including neighboring countries who also sent aid. The business concept promoted by Tangkelek is creativity that elevates Minangkabau culture as a culture rich in positive values ??of life. The term Minangkabau itself describes a culture. Minangkabau culture, especially the language is used in most parts of West Sumatra and is used in several other areas where Minangkabau migrants are located. Minangkabau is spoken in West Sumatra Province, in several areas on the border of Jambi Province (along the Batanghari River), in Kampar District, Riau Province, and is used by Jamee groups (West Aceh), and in Negeri Sembilan (Malaysia). So that the Minangkabau culture and language itself has been known and spread in various regions.

Abstract

Perkembangan teknologi keuangan (financial technology/fintech) khususnya pada layanan pinjam-meminjam uang berbasis teknologi (fintech lending) memberikan kemudahan akses pembiayaan bagi masyarakat. Namun, kemajuan tersebut juga memunculkan persoalan hukum perdata yang cukup signifikan, terutama terkait penggunaan klausula baku dalam kontrak elektronik antara penyelenggara dan konsumen. Klausula baku umumnya disusun sepihak oleh penyelenggara tanpa memberi ruang negosiasi bagi peminjam. Dalam praktiknya, klausula tersebut sering memuat syarat-syarat yang memberatkan, seperti klausula eksonerasi yang mengalihkan tanggung jawab kepada konsumen atau membatasi hak-hak mereka. Hal ini menimbulkan ketidakseimbangan posisi tawar dan berpotensi melanggar prinsip keadilan dalam hukum perjanjian. Kajian ini berupaya menganalisis kedudukan klausula baku dalam perspektif hukum perdata Indonesia dengan menitikberatkan pada keterkaitan antara asas kebebasan berkontrak, Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, serta Peraturan Otoritas Jasa Keuangan (POJK) Nomor 77/POJK.01/2016 tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi. Hasil analisis menunjukkan bahwa meskipun kebebasan berkontrak tetap menjadi dasar dalam pembentukan perjanjian, klausula baku yang merugikan konsumen dapat dinyatakan batal demi hukum. Selain itu, penyelenggara fintech dapat dikenakan sanksi administratif oleh OJK jika terbukti melanggar prinsip transparansi dan perlindungan konsumen. Oleh karena itu, penguatan regulasi, pengawasan, serta peningkatan literasi hukum masyarakat menjadi kunci penting dalam menciptakan hubungan hukum yang seimbang dan berkeadilan di era digital.
