Abstract

Freedom of expression is the right to seek, receive, disseminate information. Through the recognition of the rule of international law in the Universal Declaration of Human Rights (DUHAM), which in Article 19 states that everyone has the right to freedom to have and express opinions, without interference and to seek, receive and express information and opinions in any way and in the absence of restrictions. Freedom of expression in Indonesia today should be questioned for its implementation considering that there are many problems that occur now, one of which is the silencing of freedom of expression, keep in mind that freedom can basically be limited in accordance with the provisions contained in the human rights law and other provisions.  Changes to a constitution require the right time, namely when the articles in the constitution are felt to be no longer in accordance with the developments and needs that exist in society, and when the community has begun to feel that there is no guarantee of legal certainty. The existence of the concept of human rights, including the right to freedom of expression and opinion, is closely related to the concept of the state of law. Abstract

Majelis Permusyawaratan Rakyat mengalami perubahan kewenangan setelah perubahan Undang-Undang Dasar 1945. Lembaga tertinggi negara pada zaman Orde Baru itu tak lagi memiliki kewenangan untuk menetapkan Garis-garis Besar dari pada Haluan Negara (GBHN), dan lembaga MPR bukan lagi terdiri dari anggota DPR, utusan daerah dan utusan golongan melainkan struktur komposisi baru yakni anggota DPR dan anggota DPD. Setelah perubahan UUD 1945 diberlakukan muncul pula keinginan ketatanegaraan untuk mengembalikan kewenangan Majelis Permusyawaratan Rakyat menetapkan GBHN (baca: PPHN namun saat ini masih berdebat tentang payung hukum Pokok-Pokok Haluan Negara dalam struktur ketatanegaraan Indonesia. Topik ini penting dibuat dalam bentuk artikel dengan dua rumusan masalah, yakni tentang urgensi Pokok-pokok Haluan Negara dan payung hukum Pokok-pokok Haluan Negara pascamendemen UUD 1945 dan masalah tersebut dianalisis dengan metode yuridis normatif pengumpulan data yang digunakan yakni melalui studi dokumen maupun kepustakaan terhadap data-data sekunder berupa bahan-bahan hukum primer, sekunder dan tersier. Dan dianalisis secara deskriptif dan disajikan secara kualitatif, dan dan dapat disimpulkan, yakni PPHN sangat urgen dalam ketatanegaraan Indonesia agar ada acuan dan pedoman dalam pembangunan nasional sehingga pembangunan nasional memang telah benar-benar direncanakan secara matang dan sistematis dalam PPHN, dan payung hukum PPHN sebaiknya dengan mengamendemen UUD 1945, jika berpayung hukum ketetapan Majelis Permusyawaratan Rakyat dan Undang-Undang maka MPR tidak berwenang lagi mengeluarkan Ketetapan MPR setelah perubahan UUD 1945 dan jika dengan Undang-Undang maka tidak dipatuhi oleh Presiden dan sangat rentan mengalami perubahan setiap saat.

Abstract

Tuberculosis is a disease caused by the bacteria Mycobacterium tuberculosis, and approximately 25% of the global population is afflicted with this bacterium. In 2022,The objective of this study is to assess the effectiveness of the Xpert MTB/RIF Molecular Test and Thorax Radiography as diagnostic tools for tuberculosis at PKU Muhammadiyah Bantul Hospital. The research employed quantitative methodologies with a cross-sectional design. The majority of tuberculosis suspects at PKU Muhammadiyah Bantul Hospital were individuals aged 64 years or older, based on age group. In terms of gender, 498 individuals were male. According to the Xpert MTB/RIF molecular test, 89 individuals tested positive for tuberculosis. In contrast, the number of individuals who tested positive for tuberculosis through thorax photo examination was 184. The findings indicate that the majority of patients suspected of having Tuberculosis were males and were primarily in the age category of above 64 years old. Thorax photo radiography yielded a higher number of confirmed positive tuberculosis findings compared to the Xpert MTB/RIF molecular test, based on the evaluation of individuals suspected of having tuberculosis.

Abstract

As a binding agent in the sale and purchase of land, in principle it is the same as an agreement in general which is subject to the conditions for the validity of an agreement as contained in Article 1320 of the Civil Code. Apart from that, Article 1338 Paragraph 3 of the Civil Code states that the implementation of the agreement must be carried out in good faith. When one of the parties does not carry out the contents of the agreement as they should, that is where a dispute occurs which is an unlawful act, which sometimes ends in a judge's decision and a trial process in court. Based on the background above, the problem can be formulated as follows: First, what is the judge's consideration in deciding cases of unlawful acts resulting from erecting buildings on high heritage land in Decision Number 1/Pdt. G/ 2021/ PN.Solok. Second, what are the legal consequences in deciding cases of unlawful acts resulting from building buildings on high heritage land in decision Number.1/Pdt.G/2021/PN.Solok. In this research, the research specifications are descriptive. The approach method used in this research is a normative juridical approach, namely analyzing the judge's considerations in deciding cases of unlawful acts resulting from building buildings on high heritage land in Decision Number 1/Pdt.G/2021/PN.Solok. The data source used is secondary data. Based on the results of the research and discussion, it can be concluded as follows: First, in decision Number.1/Pdt.G/2021/PN.Solok, the judge gave juridical considerations regarding the elements in Article 1365 of the Civil Code. Apart from that, consideration of the evidentiary strength of documentary evidence, witnesses, and statements from the Plaintiff and Defendant. The parties to the case acted in good faith during the trial, the Plaintiff and Defendant agreed to state that the object of the dispute was high inheritance, and the Defendant admitted and regretted his actions in building a foundation on the land of the object of the case without the permission of the Plaintiff. Second, the legal consequences in deciding cases of unlawful acts resulting from building buildings on land in decision Number.1/PDT.G/2021/PN. Solok, namely the judge, granted the plaintiff's demands, if the decision was inkracht then the contents of the judge's decision were executed in order to restore the plaintiff's rights.Keywords: Judge's considerations, unlawful acts, high inheritance land.

Abstract

This Best Practice writing aims to describe the use of song media to improve students' understanding of the material taught by the teacher. The subjects of this Best Practice writing were 25 students in class IV A of Wirasakti Atambua State Elementary School, West Atambua District. Writing this Best Practice uses a descriptive method. The achievement of Best Practice activities is 100%. This is because all activities have been carried out and the output obtained is in line with expectations. The use of song media to increase student motivation towards the material taught by the teacher is effective. The results of the implementation of Best Practice that have been implemented are: 1). Learning activities using song media related to the material studied every day are effective. 2). The use of song media in learning really helps students' understanding of the material being taught because it can be sung repeatedly both in class and at home. 3). Based on the learning that has been carried out, differences can be felt between students who carry out learning using song media and using the lecture learning model. 4). The activities that have been designed in the RPP (Teaching Module) can be implemented fully in accordance with what has been planned. The increase in students' understanding of the material being taught can be seen from the achievement of student learning outcomes, through the results of the pre-test and post-test that have been carried out by the teacher, where in the pre-test of the total number of students in class IV A, only 7 students or 2.24% who are able to achieve the KKM value. Meanwhile, in the post test results, there was a significant increase, namely 25 students, 7 students or 2.24% achieved the KKM score and 18 students or 92.8% were able to achieve a score above the KKM score.

Abstract

Background: Tuberculosis (TBC), caused by Mycobacterium tuberculosis, is an infectious disease that is still a global problem. Indonesia has a high burden of pulmonary tuberculosis and is ranked second in the world with the highest number of TBC sufferers after India. Tuberculosis is transmitted through infected droplets when coughing or sneezing, and close contact is very susceptible to the transmission process and other supporting factors. This study aims to determine the risk factors for TBC. Method: This study used a cross-sectional research design with Chi-Square analysis and continued with multivariate analysis and logistic Regression. The sample consisted of 430 respondents obtained using the Accidental Sampling technique. Results: Factors associated with TBC in the Kapanewon Depok area were age (RP: 2.086; 95% CI: 1.247-3.490; p= 0.006), gender (RP: 2.1; 95% CI: 1.302-3.393; p= 0.003), family income (RP: 3.593; 95% CI: 2.322-5.560; p= 0.000), history of household contact (RP: 8.438; 95% CI: 5.737-12.410; p= 0.000), and history of close contact (RP: 3.881; 95% CI: 2.49-6.051; p= 0.000). The factor that has the most influence on the incidence of TBC is a history of household contact with a value of Exp(B)=17.699. Conclusion: Risk factors for pulmonary TBC in the Kapanewon Depok area are age, gender, family income, history of household contact, and history of close contact. A relationship, namely the history of household contact, has the most influence on the incidence of TBC in the Kapanewon Depok area.

Abstract

Background: Tuberculosis (TB) and Diabetes Mellitus (DM) are global problems, especially in countries with high TB endemicity. The relationship between TB and DM is more dominant in developing countries where TB is endemic, and the prevalence of DM is increasing. The risk of death during TB treatment and the risk of relapse after treatment is higher in TB patients with comorbid DM. More than 10% of TB patients are also known to have DM. This study aims to determine the epidemiological picture of TB-DM incidence based on time, place and person. Methods: This study uses a descriptive quantitative design with a case study approach; the analysis used is univariate analysis using proportions. The population of TB-DM patients in 2021-2023 was recorded in medical records, with a purposive sampling technique obtained from 110 people. Results: The epidemiological picture of TB-DM cases based on the characteristics of the person is age ≥ 45 years (80.9%), male gender (71.8%), type of pulmonary TB (98.2%), bacteriologically confirmed TB diagnosis (73.6%), the final result of TB treatment is cured (52.7%), type of DM therapy is insulin injection (76.4%) and high random blood sugar levels > 200 mg/dL (64.5%). Conclusions: The epidemiological picture of TB-DM cases for three years (2021-2023) has an upward trend and the highest cases in 2022; the majority of TB-DM cases are male, aged > 45 years, with the most cases coming from Bantul Regency.

Abstract

Presidential Regulation number 44 of 2016 regulates the list of closed business fields with requirements in the field of investment. The issuance of Presidential Regulation number 44 of 2016 is expected to be implemented effectively and efficiently to the opening of productive employment opportunities for workers in investment activities, especially in the plantation sector in West Sumatera.The issues raised in writing this thesis are: First how the effectiveness of Presidential Regulation number 44 of 2016 on productive employments opportunities for labor in investment activities in West Sumatera. Second the factors that hamper the effectviness of Presidential Regulation number 44 of 2016 on productive employment opportunities for labor in plantation investment activities in West Sumatera. Third how is policy of West Sumatera provincial government related to the effectiveness of presidential regulation number 44 year 2016 in productive employment opportunity for manpower in investment activity in West Sumatera.The research method used in the writing of this thesis is the normative juridical approach supported by empirical juridical approach through interview techniques and date collection techniques by the author at the Office of One Stop Service Integrated Servive Center (DPMPTSP) of West Sumatera Province and the Office of Manpower ang Tranmigration of Sumatera Province West. Based on the results of research and analysis, it can be concluded as follows: First effectiveness Presidential Regulation number 44 of 2016 on productive employment opportunities for labor in plantation investment activities in West Sumatera has been running effectively but still not maximal because it still encountered some obstacles and weaknesses in this Presidential Regulation and its implementation. Second The internal factors included the absence of provisions on the maximum dan minimum limits of plantation land use, business scale, and so forth. External factors included limited land fpr plantations, land with traditional customary community land, low labor human resources, and investment licensing issues that are perceived as inefficient. Third West Sumatera provincial governments have issued regulations stipulated in the Regional Regulation and Governor Regulation which is guided by the provisions of Presidential Regulation number 44 of 2016 and other legislation related to the increase of employment and investment activities, especially the plantation sector in West Sumatera. One of them is Regional Regulation of West Sumatera Province number 2 of 2014 concerning Investment and Regulation of Gubernur of West Sumatera number 70 year 2013 concerning General Plan of Capital Investment of West Sumatera.

Abstract

Abstract: Legal Protection for Consumers in Buying and Selling Lightroom Preset Applications on the Instagram Account @pwstore 1818, which can be achieved in two ways, through litigation or through court and non-litigation (outside court). For consumer disputes that occur with the owner of the Instagram account, they are resolved non-litigation, namely there is a verbal agreement from both parties, where the owner of the Instagram account returns the money of consumers who have purchased problematic Lightroom presets, so that both parties reach a win-win solution. The obstacle faced by consumers in resolving disputes over the sale and purchase of Lightroom preset applications on the Instagram account @pwstore1818 is related to the case of goods not matching the picture experienced by consumers Jupiter and Vie Kesuma when purchasing Lightroom presets on the Instagram account @pw.store1818. Consumers have submitted complaints but the business actor has not responded. Then the consumer filed a complaint again, in which the complaint received a reply from the business actor who advised consumers to choose a good photo, but the consumer felt that the product they had purchased did not match their expectations. Abstract

Abstract: Article 1238 of the Civil Code states that a debtor is considered negligent in fulfilling his obligations. Breach of a waarmeking agreement is regulated in Article 15 Paragraph (2) letter b of Law Number 2 of 2014 concerning the Position of Notary. There are times when a waarmeking agreement gives rise to problems in terms of breach of contract, thus harming one of the parties to the agreement, such as the case decided by the judge with decision number 240/Pdt.G/2021/PN.Mdn. The formulation of the problem in this thesis is: First, How does the judge consider in deciding the case of breach of contract against the case of breach of contract waarmeking in Decision Number 240/Pdt.G/2021/PN.Mdn? Second, What are the legal consequences of Decision Number 240/Pdt.G/2021/PN.Mdn in the case of breach of contract waarmeking? This research is descriptive in nature. The approach used is a normative juridical approach, conducting in-concreto legal research on Decision Number 240/Pdt.G/2021/PN.Mdn. The data used is secondary data obtained through library research or document studies. The data is then analyzed qualitatively and presented in qualitative descriptive form. From the results of the research and discussion, it was concluded that, First, the judge's consideration in deciding the case of default against the default case agreement that was waarmeking based on Decision Number 240 / Pdt.G / 2021 / PN. Mdn, namely legal considerations based on evidence of letters submitted by the Plaintiff in the form of a Debt Acknowledgement Letter that had been Waarmerking Number: 1868 / W / 2021 dated March 2, 2021 at the Notary Office of San Smith, S.H in Medan. However, the Defendant neglected his obligations to the Plaintiff. In addition, there is also evidence of 2 (two) witnesses Joni Iskandar and witness Khairul Rahman, who knew about the debt problem between the Plaintiff and the Defendant. Second, the legal consequences of the decision Number 240 / Pdt.G / 2021 / PN.Mdn in the case of default on the agreement that was waarmeking, namely the judge's decision must be implemented if the parties do not make an appeal to the High Court. The judge's decision in this case is that the Defendant pays all his debts starting from January 5, 2019 until now amounting to Rp. 4,000,000,000,- (four billion rupiah) in cash to the Plaintiff according to the Debt Acknowledgement Letter that has been Waarmeking Number: 1868 / W / 2021 dated March 2, 2021 at the Notary office of San Smith, S.H in Medan and the Defendant pays the court costs determined by the Medan District Court in the amount of Rp. 560,000.00 (Five hundred and sixty thousand rupiah).
