Law Number 32 Year 2004 About local governance, that further arrangements regarding the village, including the problem of the formation of the rules of the village (the village Regulations) arranged in the form of Regulatory regions of the County. The type of Research used in this study using normative legal research using "approach to legislation, (he was Johan Nasution, 2008:92). Research results show that in drawing up the rules of the village there are limitations that should be used as a general reference in the preparation of paraturan legislation i.e. the clarity of purpose; that each establishment of the legislation must have a clear purpose to be achieved; institutional or organ-forming the right; that any kind of legislation must be made by the institutions/officials forming legislation authorized. Such legislation may be cancelled or annulled by law, when made by institutions/officials who not authorized conformity between the type and material of the charge; can be implemented; navigability and kehasilgunaan; clarity of formulation; that any legislation must meet the openness as well as the establishment of the village Regulations contained in Act No. 10 of the year 2004 on the establishment of Regulations and Law Number 32 Year 2004 About Local governance as well as government regulation Number 72-year 2005 Of the village has not been regulated explicitly and intact.

The state of Indonesia embraces the sovereighty of the people or democracy. The people are the owners of the highest power in the state. The real power comes from the people, by people, and for the people. Even idealized power is held together with the people. Indonesia itself is also a country that adheres to the law. From the opinion of the exparts we can see that the state that follows the rule of law is always related to power. Where power is always limited by the laws that bind it. In other words the sphere of power is limited by the rules that are bound by the rules that have been composed and written and made by the agency that is authoorized to make it.The type of research used is normative juridical research. This study uses “ conceptual approach, legislation approach, and historical approach, in discussing the problems that exist in this research method is a way to perform analysis of data.Political power is the ability to use the source of influence to influence the process of making and executing political decisions so as to benefit itself, the group or society in general. Power is a gekala that always exist in the political process, in Indonesia law is a product of power (politics) so that the character of each legal product will be determined or colored by consideration of force political configuration that gave birthday.

Abstrak Prinsip good governance sebenarnya merupakan prinsip yang mengetengahkan keseimbangan antara masyarakat (society) dengan negara (state) serta negara dengan pribadi-pribadi (personals). Setiap kebijakan public (public policy) harus melibatkan berbagai pihak baik pemerintah, masyarakat maupun sektor swasta dengan aturan main yang jelas. Ciri good governance adalah keputusan tersebut diambil secara demokratis, transparan, akuntabilitas, dan benar. Upaya mewujudkan good governance merupakan suatu prioritas dalam rangka menciptakan suatu tatanan masyarakat, bangsa, dan negara yang lebih sejahtera, jauh dari korupi, kolusi, dan nepotisme. Konsep good governance sebagai salah satu pendekatan yang diandalkan tidak akan menjamin berkurangnya praktek korupsi, jika pejabat pemerintahan di pusat tidak memberikan teladan yang baik kepada pejabat daerah. Hal ini secara rasional dapat dibenarkan karena ekses dari dominasi pusat sebagai pusat kekusaan dan uang.

Abstrak Amandemen Undang-Undang Dasar 1945 merupakan reformasi konstitusi yang telah mengubah struktur kenegaraan Indonesia. Pada cabang kekuasaan yudikatif perubahan ketiga Undang-Undang Dasar 1945 melahirkan lembaga baru yaitu Mahkamah Konstitusi dan Komisi Yudisial. Komisi Yudisial merupakan lembaga yang keberadaannya dijamin oleh Undang-Undang Dasar 1945 yang bersifat mandiri dalam struktur kekuasaan kehakiman yang berwenang mengusulkan pengangkatan hakim dan menegakkan kehormatan, keluhuran martabat serta perilaku hakim. Pembentukan Komisi Yudisial yang diatur dalam Undang-Undang Nomor 22 Tahun 2004 tentang Komisi Yudisial merupakan konsekuensi logis yang muncul dari penyatuan atap lembaga peradilan pada Mahkamah Agung. Tindakan Komisi Yudisial dalam melakukan fungsi pengawasan perilaku hakim tersebut ternyata mendapat tanggapan negatif dari Mahkamah Agung.Kata Kunci : Komisi Yudisial, Pengawasan, Hakim

Terjadinya perbuatan zina dikarenakan faktor Cinta, Mau sama mau, Pemenuhan tuntutan biologis, Mencari kepuasan, Ekonomi, Paksaan atau kurangnya iman. Peranan Hukum Adat dalam Penyelesaian perkara perbuatan zina di Desa Sungai Terap Di Kabupaten Muaro Jambi sebagian besar diselesaikan melalui penyelesaian secara adat di kantor Balai Desa, balai adat atau di rumah kepala desa yang penyelesaian melalui berapatan tenganai nenek mamak atau kabupaten kelurahan. Dilakukan penyelesaian tidak perzinahan melalui cara-cara damai dan kekeluargaan dipegaruhi oleh faktor-faktor penegakan hukum seperti faktor hukum, faktor tersebut, faktor masyarakatlah yang paling berperan, dimana masyarakat sedirilah yang enggan menyelesaikan perkaranya melalui peradilan sehingga memilih upaya damai kekeluargaan Key Note : Perbuatan Zina, Hukum Adat, Desa Sungai Terap Kecamatan Kumpeh Ulu Kabupaten Muaro Jambi

Guru adalah figur manusia sumber yang menempati posisi dan memegang peran penting dalam pendidikan. Ketika semua orang mempersoalkan masalah dunia pendidikan figur guru mesti terlibat dalam agenda pembicaraan terutama yang menyangkut persoalan pendidikan formal di sekolah. Selain tenaga pendidik, peningkatan mutu pendidikan juga menuntut adanya tenaga kependidikan yang memadai. Tenaga kependidikan yang ada dan memerlukan pembinaan dan pengembangannya salah satunya tenaga pengawas. Tenaga pengawas sudah ada dan sudah berfungsi di setiap jenis dan jenjang pendidikan, walaupun pembinaan dan pengembangan secara akademik masih belum terpola dan berkesinambungan. Tulisan ini mengkaji masalah pokok yaitu : Bagaimanakah tugas dan fungsi Pengawas Sekolah dalam meningkatkan profesionalitas guru sekolah dasar dan Bagaimanakah Pelaksanaan Pengawasan melekat oleh pengawas sekolah terhadap guru Sekolah Dasar di wilayah Dinas Pendidikan Kota Jambi.Metode penelitian yang digunakan adalah pendekatan yuridis empiris yaitu penelitian yang dilakukan dengan cara meneliti data penelitian lapangan. Hasil penelitian ini Meskipun berdasarkan jenjang evaluasi yang telah ditetapkan disimpilkan bahwa kurang pengetahuan dan pemahaman terhadap pengawasan melekat disebabkan karena atasan kurang mensosialisasikan dan menjelaskan pengawasan melekat pada bawahannya.Kendala-kendala tersebut adalah :rapat staf untuk mengevaluasi pimpinan tidak berada ditempat, disiplin kerja pegawai masih rendah, hal ini dibuktikan dengan terlambat masuk kerja ataupun pulang lebih awal dari ketentuan yang berlaku dan atasan seringkali tidak memberikan teguran terhadap pegawai/bawahan yang kurang disiplin.upaya-upaya yang dapat ditempuh adalah sebagai berikut :Jadwal rapat staf tidak perlu ditentukan berdasarkan tanggal tetapi cukup berdasarkan mingguan dan setiap atasan memonitoring bawahannya pada setiap jam mulai kerja maupun jam pulang kerja. Kata Kunci : Pengawasan Melekat, Disiplin, Guru, Dinas Pendidikan
