Abstract

Drug abuse is one of the most serious challenges in modern society, affecting not only individuals who consume drugs but also families, especially children. In Indonesia, Law No. 35/2014 on Narcotics provides a strong legal basis to protect children abandoned by parents who are drug abusers. This study aims to analyze the legal protection provided by Law No. 35/2014 to children who are victims of this situation. Law No. 35/2014 states that children have the right to protection from all forms of violence, neglect and exploitation, including in the context of parents involved in drug abuse. The law stipulates that the government is responsible for providing protection, care and rehabilitation for children affected by drug abuse, and emphasizes that parental drug abuse cannot be used as an excuse to abandon a child. In addition, Law No. 35/2014 also provides a foundation for efforts to prevent drug abuse among adolescents and children, through education and socialization about the dangers of drugs and rehabilitation for drug addicts. Nevertheless, the implementation of this legal protection still faces various challenges. Lack of awareness of children's rights and access to adequate social services are often barriers to providing effective protection for children affected by their parents' drug abuse. Therefore, greater efforts are needed from the government, non-governmental organizations, and society as a whole to improve awareness, access to services, and legal protection for children in this situation.

Abstract

Child Friendly District (KLA) is a program that guarantees and protects children's rights so that they can live, grow, develop and participate optimally in accordance with human dignity and dignity and avoid violence and discrimination. In Indonesia, violations of children's rights are increasingly common. Therefore, by enacting local regulations regarding child-friendly districts in Langkat Regency, in this case, the aim is to uphold children's rights. This study describes the implementation of Regional Regulation No. 3 of 2022 concerning KLA through 5 Clusters. There are still unfulfilled children's rights, such as low school participation, inadequate health insurance, limited infrastructure for children, and cases of child abuse. The results of the implementation of the KLA policy experienced obstacles in several factors, to be precise, the number and quality of human resources had to be expanded, correspondence and collaboration between policy implementers had not yet taken root so that the satisfaction of children's freedom was not optimal and furthermore the local community's understanding of KLA still did not exist. The KLA policy is in accordance with the principles of fiqh siyasa because it can provide benefits to people's lives, especially children.

Abstract

Disputes related to the appointment of village heads are an issue that often arises in the context of village government in Indonesia. This study aims to examine the conflict of closing village heads based on the Decision of the State Administrative Court (PTUN) of Medan Number 43/G/2023, with the approach of Fiqh Siyasah and Village Law Number 6 of 2014. The research uses a case study method with a qualitative and descriptive-analytical (normative-juridical) approach. This article also reviews the legal and social impact of the PTUN decision, as well as provides recommendations for future improvements in village governance. The findings of the study show that the Medan State Administrative Court canceled the decision of the South Tapanuli Regent because it was considered to violate the principles of good governance. In the perspective of Fiqh Siyasah (Qadha'iyyah), this decision is in accordance with the values of justice (al-'adl), legal certainty (al-yaqin), and benefit (maslahah) in the administration of the islamic government.

Abstract

This study aims to analyze the role of mediators in the mediation process of divorce cases at the Sibolga Religious Court and the effectiveness of mediation efforts in minimizing the divorce rate. Based on data from the Sibolga Religious Court, there was a significant increase in the success rate of mediation in 2021 and 2022. In 2021, from a target mediation success rate of 5%, the realization reached 11.36%, more than double the initial target. In 2022, the success of mediation increased again, reaching 20%, aligning with the set target. In addition, the number of divorce cases decreased from 142 cases in 2021 to 127 cases in 2022. This type of research uses qualitative research with data collection techniques through in-depth interviews with mediators and direct observation to the Sibolga Religious Court and relies on legal documents, mediation reports, related laws and regulations, journals, books, and other relevant articles. The results of the study show that mediators have an important role in facilitating communication and negotiation between the parties to the case, helping them reach a peaceful agreement without having to proceed with the divorce. The increase in mediation effectiveness can be attributed to a variety of factors, including mediator training, a more personalized approach, and increased public awareness of the importance of mediation. In conclusion, mediation at the Sibolga Religious Court has proven to be effective in reducing the divorce rate, and with a more intensive strategy, mediation has greater potential to resolve family conflicts.

Abstract

This research aims to analyze the legal position of high inheritance property (harato pusako tinggi) under Minangkabau customary law and the resolution process of disputes arising from the unilateral sale of such property without the approval of the clan, as reflected in Decision Number 893 K/Pdt/2025 in Lubuk Basung District, Agam Regency. This study employs a normative juridical research method using a case approach by examining court decisions, legislation, and relevant legal literature. The results show that harato pusako tinggi is a communal hereditary property passed down through generations and cannot be transferred or sold without the consent of all clan members. The dispute in this case arose because one party sold pusako tinggi land without the approval of the clan, thereby violating Minangkabau customary law. The dispute resolution process was carried out through litigation, beginning from the District Court up to the Supreme Court. In its decision, the court recognized the existence and application of customary law by declaring the actions of Defendant I unlawful and ordering the return of the land rights to the clan through the Mamak Kepala Waris. Furthermore, this research finds that the settlement process did not fully prioritize customary dispute resolution mechanisms based on the Minangkabau principle of “bajanjang naiak, batanggo turun.” Therefore, strengthening the role of customary institutions and ninik mamak, optimizing non-litigation dispute resolution, and harmonizing customary law with national law are necessary to prevent similar disputes in the future

Abstract

Konflik bersenjata antara Israel dan Gaza yang meningkat sejak Oktober 2023 telah menimbulkan korban jiwa dalam jumlah besar, terutama dari kalangan penduduk sipil. Hukum Humaniter Internasional (HHI) hadir sebagai seperangkat aturan yang bertujuan membatasi dampak konflik bersenjata dan memberikan perlindungan terhadap korban perang. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum terhadap korban kejahatan perang berdasarkan HHI serta mengkaji implementasinya dalam konflik Gaza–Israel. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Meskipun berbagai penelitian telah membahas pelanggaran HHI dalam konflik Gaza–Israel, kajian yang secara khusus menelaah kesenjangan antara norma perlindungan korban perang dan implementasinya dalam konflik kontemporer masih terbatas. Hasil penelitian menunjukkan bahwa perlindungan korban perang diatur dalam Konvensi Jenewa 1949 dan Protokol Tambahan 1977 yang menekankan prinsip kemanusiaan, pembedaan (distinction), proporsionalitas, dan kebutuhan militer. Analisis hukum menemukan bahwa pelanggaran terhadap prinsip pembedaan dan proporsionalitas merupakan bentuk pelanggaran HHI yang dominan, yang tercermin melalui serangan terhadap warga sipil, fasilitas kesehatan, serta pembatasan bantuan kemanusiaan. Sebagai novelty, penelitian ini menunjukkan adanya kesenjangan normatif antara pengaturan HHI dan implementasinya di lapangan akibat lemahnya mekanisme akuntabilitas internasional. Penelitian ini berkontribusi pada pengembangan kajian HHI mengenai efektivitas perlindungan korban perang serta memberikan rekomendasi bagi penguatan penegakan hukum internasional dalam konflik bersenjata modern.

Abstract

This research relates to optimizing the role of Medan City Islamic Organization legal aid posts in providing legal assistance to child victims of school violence. It is a socio-empirical legal study in the category of sociological-empirical research using a qualitative approach. The research focuses on social and legal phenomena in society, specifically the role of Islamic mass organization legal aid posts in Medan City in providing legal assistance to child victims of school violence. Data were collected through interviews with the Medan City Islamic Organization Posbakum and analysis of Law Number 23 of 2002 concerning Child Protection, as well as from legal materials providing explanations of primary legal materials obtained through literature studies related to the research problem. The research results show that the implementation of the Aisyiyah Legal Aid Post (Posbakum) in the North Sumatra region can help provide legal assistance for child victims of school violence by offering consultation, legal aid, and advocacy. However, to provide more optimal legal assistance, efforts are still needed to improve the quality and quantity of resources owned by Posbakum Aisyiyah. Furthermore, the active role of all parties, especially the government and society, is crucial to support the optimization of Posbakum Aisyiyah's implementation and enhance legal protection for child victims of school violence.

Abstract

This study aims to analyze the implications of government policy regarding school infrastructure assistance—based on the Regulation of the Minister of Education, Culture, Research, and Technology (Permendikbudristek) Number 22 of 2023—and to examine it from the perspective of Siyasah Dusturiyah (Islamic constitutional governance) within the Ibrahim Mustafawiyah Bersaudara Foundation. The study employs an empirical legal method with a juridical-empirical approach. Data were collected through observation, interviews, documentation, and literature review. The results indicate that the school infrastructure assistance policy has positively impacted the quality of educational facilities and infrastructure while supporting the smooth conduct of the learning process. The availability of adequate facilities contributes to creating a more effective and comfortable learning environment for both students and educators. However, the policy's implementation still faces several obstacles, particularly funding limitations and the unequal distribution of assistance. From the perspective of Siyasah Dusturiyah, the policy reflects the state's responsibility to realize the public interest, ensure justice, and fulfill the community's right to access decent, high-quality, and equitable education.
