Abstract

Masa pandemi Covid-19 banyak masyarakat khususnya kota Palangka Raya sering menggunakan aplikasi shopee sebagai alat dalam bertransaksi jual beli untuk memenuhi kebutuhan mereka, baik itu kebutuhan primer (daruriyat), kebutuhan skunder (hajiyat), bahkan kebutuhan tersier (tahsiniyat). Baru-baru ini muncul inovasi baru metode pembayaran pada salah satu aplikasi jual beli online shopee yaitu yang biasa dikenal dengan shopee paylater. Penelitian ini bertujuan untuk 1. Mengetahui perlindungan hukum terhadap pengguna praktik kredit shopee paylater. 2. Mengetahui tinjauan hukum Islam terhadap praktik kredit shopee paylater. Metode penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian normatif. Berdasarkan hasil penelitian dapat disimpulkan bahwa penggunaan shopee paylater tidak diperbolehkan dalam hukum Islam karena pada fitur paylater memiliki kebijakan untuk menarik keuntungan dari pengguna walaupun tidak ada bunga pada pembayaran sebelum jatuh tempo. Namun tetap saja shopee paylater dikatakan riba karena pada fiturnya sudah menetapkan syarat yang berisi denda yang akan dikenakan pada pengguna jika melewati tanggal tagihan sehingga merugikan pihak konsumen. Perlindungan konsumen diatur dalam Undang-Undang No. 8 Tahun 1999 dan UU ITE. Untuk menyelesaikan permasalahan dalam transaksi di shopee, maka pelaku usaha atau pengguna shopee paylater dapat menggugat ke Pengadilan berdasarkan Undang-Undang No. 11 Tahun 2008 dan juga bisa diselesaikan Non Litigasi, yaitu Mediasi dan Arbitrase.

Abstract

With the emergence of a vast internet network, the 4.0 industrial revolution is transforming human lifestyles from conventional to modern and impacting various aspects of life, such as culture, social, and economy. The Pulang Pisau District Court uses the e-Court application, which consists of four main features: online case registration (e-filing), fee payment (e-Payment), electronic summons (e-summons), and online conference (e-ligation), launched by the Supreme Court on October 13, 2018. Data collected from various sources in this research were gathered through a qualitative literature study approach. The focus of the research is on how the e-Court application can enhance the efficiency and ease of accessing legal services for the community. The research results show that the electronic court system not only speeds up the legal administration process but also enhances the transparency and accountability of the judicial system. By launching this application, the Supreme Court is making a significant change in the reform of Indonesia's judiciary, making the judicial system cheaper, faster, and simpler for all citizens. It is hoped that the e-Court application can meet the global community's needs to face legal challenges in the digital era.

Abstract

This study aims to analyze in depth the concept of employment agreements according to Islamic law and how these principles can be harmonized with the provisions of employment agreements in the Indonesian Manpower Law. This study aims to explore the basic values in Islamic law, such as justice, mutual consent, and prohibition of exploitation, which are the ethical basis for employment relations between employers and workers. On the other hand, this study also examines the provisions of positive law in force in Indonesia, especially after the enactment of the Job Creation Law, to see the extent to which these regulations reflect the principles of justice and protection of workers. In Islamic law, an employment agreement is viewed as an ijarah contract that has elements of agreement, willingness of both parties, and justice in the implementation of rights and obligations. Meanwhile, in Indonesian positive law, an employment agreement is the basis for employment relations between workers and employers which are regulated in writing or verbally with certain provisions. This study uses a library research method with a qualitative normative approach. The results of the study show that basically the principles of employment agreements in Islamic law do not conflict with the Manpower Law, and can even complement each other in terms of justice, protection of workers' rights, and voluntary agreements. Harmonization can be done through adjustments to sharia principles in the implementation of employment contracts and the need to strengthen moral and ethical aspects in employment relationships.

Abstract

This field research in Palangka Raya City revealed that consumer perceptions of the halalness of skincare products vary. Some consumers prioritize safety, skin suitability, and product popularity, while others are highly concerned with halalness as a form of religious observance and choose halal-certified products. The main factors influencing consumer choices are religious beliefs, the influence of family and friends, and the role of social media and influencers. Although halalness is not yet a priority for everyone, awareness of the importance of halal products continues to grow in the community. Data were collected through interviews with two consumers, two skincare sellers, and two religious scholars as informants. The aim was to understand the perceptions and factors influencing the choice of halal skincare products in Palangka Raya City. Semi-structured interviews were conducted directly with informants to freely express their views and experiences and obtain valid data regarding consumer perceptions and factors considered in choosing halal skincare products.

Abstract

The development of information technology has produced a significant transformation in election administration mechanisms, including within the City of Palangka Raya. The digitalization of various services and information systems requires the General Elections Commission (KPU) to enhance transparency while simultaneously ensuring the security of voter data and election results. This study aims to examine the key challenges faced by the Palangka Raya KPU in balancing the need for information openness with data protection in the digital era. The research employs a qualitative descriptive method through literature review, direct observation, and structured interviews with KPU staff, election supervisors, and relevant stakeholders. The findings indicate that digitalization improves the effectiveness of public information dissemination, including through the use of Sidalih and Sirekap, yet it also introduces vulnerabilities such as potential voter data breaches, cyberattacks, and the spread of disinformation through social media. Moreover, limitations in human resources with technological expertise serve as constraints in optimizing digital security. Conversely, the implementation of data security standards and improvements in voter digital literacy contribute to strengthening public trust in the election process. Thus, the Palangka Raya KPU needs to reinforce cybersecurity infrastructure, enhance internal technical capacity, and broaden public education programs to safeguard electoral integrity amid increasing transparency demands and digital risks. Collaboration among government, academia, and the community is a strategic element in maintaining the quality of democracy in the digital era.

Abstract

Abstrak Skema Self-Declare dalamkerangka Jaminan Produk Halal (JPH) dirancang sebagai instrumen untuk mempercepat sertifikasi halal bagi Usaha Mikro, Kecil, dan Menengah (UMKM). Namun, implementasinya pada era Halal 4.0 menghadirkan tantangan baru dalam menyeimbangkan kemudahan akses dengan tuntutan kepastian hukum dan akuntabilitas. Penelitian ini bertujuan untuk menganalisis kesenjangan dalam pelaksanaan regulasi Self-Declare serta menawarkan model rekonstruksi regulasi yang ideal dalam konteks sistem jaminan halal nasional. Metode yang digunakan adalah pendekatan hukum normatif-empiris dengan pengumpulan data melalui studi regulasi dan wawancara mendalam dengan Pendamping Proses Produk Halal, pelaku UMKM, serta Badan Penyelenggara Jaminan Produk Halal (BPJPH) di Kota Palangka Raya. Hasil penelitian menunjukkan bahwa pelaksanaan Self-Declare masih menghadapi risiko hukum yang signifikan akibat adanya kesenjangan literasi digital di kalangan pendamping, lemahnya sistem verifikasi terintegrasi, serta mekanisme pengawasan pascasertifikasi yang belum optimal. Kondisi ini berpotensi mengurangi kekuatan pembuktian dan akuntabilitas hukum terhadap status kehalalan produk. Oleh karena itu, penelitian ini merekomendasikan rekonstruksi regulasi Self-Declare yang mengintegrasikan prinsip kepastian hukum, pemanfaatan teknologi digital, serta sistem pengawasan berkelanjutan. Kebaruan penelitian ini terletak pada usulan model rekonstruksi regulasi Self-Declare yang berbasis pada bukti empiris implementasi di tingkat lokal, sehingga menjembatani dilema antara kemudahan akses bagi UMKM dan penguatan pengawasan dalam kerangka Halal 4.0. Temuan ini diharapkan dapat menjadi rujukan strategis bagi para pembuat kebijakan dalam memperkuat tata kelola sistem jaminan produk halal di Indonesia. Kata kunci: Self-Declare, Jaminan Produk Halal, Rekonstruksi Regulasi.   Abstract The Self-Declare scheme within the Halal Product Assurance (JPH) framework was designed as an instrument to accelerate halal certification for Micro, Small, and Medium Enterprises (MSMEs). However, its implementation in the Halal 4.0 era presents new challenges in balancing ease of access with demands for legal certainty and accountability. This study aims to analyze gaps in the implementation of Self-Declare regulations and offer an ideal regulatory reconstruction model within the context of the national halal assurance system. The method used is a normative-empirical legal approach with data collection through regulatory studies and in-depth interviews with Halal Product Process Facilitators, MSMEs, and the Halal Product Assurance Organizing Agency (BPJPH) in Palangka Raya City. The results show that the implementation of Self-Declare still faces significant legal risks due to disparities in digital literacy among facilitators, a weak integrated verification system, and a suboptimal post-certification oversight mechanism. These conditions have the potential to reduce the strength of evidence and legal accountability for product halal status. Therefore, this study recommends a reconstruction of Self-Declare regulations that integrates the principles of legal certainty, the use of digital technology, and a continuous monitoring system. The novelty of this research lies in its proposal of a Self-Declare regulatory reconstruction model based on empirical evidence of local implementation, which bridges the dilemma between facilitating access for MSMEs and strengthening oversight within the Halal 4.0 framework. These findings are expected to serve as a strategic reference for policymakers in strengthening the governance of the halal product assurance system in Indonesia.
