Abstract

Abstract Developer PT Dewata Abdi Nusa (DAN) bankrupted thourgh decision No.. 16/PAILIT/2013/PN.SBY. This ruling resulted in consumers losing money because of not getting its due in accordance Sale and Purchase Agreement. Based on Consumer Protection Act No. 8/1999, losses suffered by consumers to be settled fairly and consumers are entitled to compensation. This paper used a normative legal research by case approach. Case is used by No.16/PAILIT/2013/SBY bankruptcy decision. In this paper the author wants to examine consumer protection Graha Dewata based decision No.16/PAILIT/2013/SBY and legal protection that can be provided to consumers as a result of bankrupted developer PT DAN. The results showed that the consumers have not received the legal protection due to the uncertainty of the law in which the consumers are not getting its due as the Sale and Purchase Agreement. Legal protection that can be given to the consumers can be carried out preventive consumer protection agencies to oversee all matters involving the consumer as well as being consultative mechanism. While the repressive can be seen in the provisions of Law No. 37/2004 on Bankruptcy and PKPU and Consumer Protection Act through litigation and non-litigation. It is also necessary to assess the Bankruptcy Act in the future in order to pay more attention to the interests of consumers and bankruptcy insolvency test as a condition of the debtor in order to avoid bad faith. Putusan ini mengakibatkan konsumen merugi karena belum mendapatkan haknya sesuai Perjanjian Pengikatan Jual Beli. Berdasarkan ketentuan pada Undang-Undang Perlindungan Konsumen No. 8 Tahun 1999, kerugian yang dialami konsumen wajib diselesaikan dengan adil dan konsumen berhak mendapat ganti rugi.  Tulisan ini menggunakan penelitian hukum normatif dengan pendekatan kasus. Kasus yang digunakan berdasarkan putusan pailit No.16/PAILIT/2013/SBY. Penulis ingin mengkaji perlindungan konsumen perumahan Graha Dewata berdasarkan putusan No.16/PAILIT/2013/SBY dan  perlindungan hukum yang dapat diberikan kepada konsumen akibat dipailitkannya pengembang PT DAN. Hasil tulisan menunjukkan bahwa konsumen belum mendapatkan perlindungan hukum karena terjadi ketidakpastian hukum dimana konsumen belum mendapatkan haknya seperti pada  Perjanjian Pengikatan Jual Beli. Perlindungan Hukum yang dapat diberikan kepada Konsumen dapat secara preventif yang dilakukan lembaga-lembaga perlindungan konsumen dengan mengawasi segala hal yang melibatkan konsumen serta menjadi wadah konsultasi. Sedangkan secara represif dapat dilihat pada ketentuan Undang-Undang No 37 Tahun 2004 tentang Kepailitan dan PKPU serta Undang-Undang Perlindungan Konsumen melalui litigasi dan nonlitigasi. Diperlukan juga untuk mengkaji Undang-Undang Kepailitan di masa datang agar lebih memperhatikan kepentingan konsumen dan insolvency test sebagai syarat kepailitan agar menghindari debitor yang beritikad tidak baik.Kata kunci: Perlindungan hukum, konsumen perumahan, kepailitan pengembang

Abstract

Badan Pengelola Keuangan Haji (BPKH) is institution formed based on the mandate of Law Number 34 year 2014 about Hajj financial management. Hajj financial management should be in accordance with Shari’a and Law. The responsibility of BPKH is important to note in order to avoid the harmful things. This research is normative with literature law research method. The approaches are legislation approach and conceptual approach. Based on the results, BPKH shall be responsible if there are errors due to negligence and mistakes made intentionally. Responsibility due to negligence tort lilability is related to the fault of BPKH who do not pay attention to the principles in managing finances properly and correctly. For liability arising from unlawful interfrontal tort liability, the BPKH consists of implementing institution member and supervisory council member shall be proven to have performed financial management that may be detrimental to the pilgrims. UU No. 34 Year 2014 article 53 has governed the BPKH Accountability Mechanism. BPKH is responsible for managing hajj finances which can be done in the form of banking products, securities, gold, direct investment and other investments based on sharia principles and considering the aspects of security, prudence, value of benefits, and liquidity.Badan Pengelola Keuangan Haji (BPKH) merupakan lembaga yang dibentuk berdasarkan amanat Undang-Undang No. 34 Tahun 2014 tentang Pengelolaan Keuangan Haji. Pengelolaan keuangan haji harus sesuai syariat dan Undang-Undang. Tanggung jawab BPKH adalah hal yang penting untuk diperhatikan agar terhindar dari hal-hal yang merugikan. Penelitian ini adalah penelitian normatif dengan metode penelitian hukum kepustakaan. Pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan dan pendekatan konseptual. Berdasarkan hasil penelitian disimpulkan bahwa BPKH wajib bertanggung jawab apabila terjadi kesalahan akibat kelalaian dan kesalahan yang dilakukan dengan sengaja. Tanggung jawab akibat perbuatan melanggar hukum yang dilakukan karena kelalaian (negligence tort lilability) adalah terkait dengan kesalahan BPKH yang tidak memperhatikan prinsip-prinsip dan aspek-aspek dalam mengelola keuangan dengan baik dan benar. Untuk tanggung jawab akibat perbuatan melanggar hukum yang dilakukan dengan sengaja (intertional tort liability), BPKH yang terdiri dari anggota badan pelaksana dan anggota dewan pengawas harus terbukti telah melakukan pengelolaan keuangan yang dapat merugikan calon jamaah haji. Undang-Undang Nomor 34 Tahun 2014 pasal 53 mengatur mekanisme pertanggungjawaban BPKH. BPKH bertanggung jawab mengelola keuangan haji yang bisa dilakukan dalam bentuk produk perbankan, surat berharga, emas, investasi langsung dan investasi lainnya berdasarkan prinsip syariah dan mempertimbangkan aspek keamanan, kehati-hatian, nilai manfaat, dan likuiditas.

Abstract

Tax Avoidance mempunyai spektrum persoalan yang luas, salah satunya adalah transfer harga(transfer pricing). Transfer pricing merupakan salah satu cara yang dipakai oleh wajib pajakperusahaan multinasional untuk melakukan penghindaran pajak. Perilaku transfer pricing initidak dipandang sebagai perilaku yang melanggar norma hukum positif yang berlaku di negarakita. Padahal perilaku ini jelas-jelas telah menggerus pendapatan negara dari sektor perpajakan.Ada gap yang serius antara aras substansi yang menjadi tujuan hukum (doelmatigheid) denganaras kepastian hukum(rechtsmatigheid). Pada aras tujuan hukum bahwa aturan perpajakandimaksudkan untuk pengumpulan pajak, sedangkan pada aras kepastian hukum bahwapenghindaran pajak tidak dikategorikan sebagai perbuatan yang bertentangan dengan aturanperpajakan itu sendiri. Artinya penghindaran pajak bertentangan dengan tujuan hukumperpajakan. Peneliti melihat persoalan ini dari perspektif hukum Islam yang didasarkan padapendekatan normatif argumentatif. Penelitian ini telah menemukan adanya I’tikad tidak baik dariwajib pajak dalam memenuhi kewajibanya membayar pajak.

Abstract

Halal certification for products is the obligation of all business actors (Article 4 UUJPH). MSMEs also need to enjoy the facility of halal certification from local governments, but the number of halal-certified UMKM products in Central Kalimantan tends to be low. This research raises two problems, first, how to facilitate the implementation of halal certification for UMKM products in Central Kalimantan. Second, what is the role of the Central Kalimantan regional government in providing legal protection to MSMEs by facilitating halal certification of food products. This is an empirical or socio-legal legal research that uses primary data and secondary data. The results of this study concluded: 1. The facilitation of halal certification for UMKM products in Central Kalimantan was carried out in the form of, first, socialization and training of MSMEs regarding non-formal halal certification; Second, the budget policy for the cost of halal certification for new MSME entrepreneurs 2018-2019 at the Ministry of Trade and Industry of Central Kalimantan Province, however, is not a priority and has very little quota compared to the number of MSMEs; Third, the realization of certification fee assistance is carried out every year but information and coordination between the Provincial and Regency / City Governments is still weak as a result of limited access to MSMEs. 2. The Central Kalimantan government has played a role in providing preventive legal protection for MSMEs through the facilitation of halal certification in the sector of Industry, Ministry of Industry and Industry of Central Kalimantan and regencies / cities, but this has not been maximally implemented.

Abstract

Spatial Plan has a significant influence on economic development in a region caused by many economic functions related to environmental areas that can be used as a means of investment. The issuance of Regional Regulation No. 5 on year 2015 on Provincial Spatial Plan can potentially arise a limited issue of investing.m This study aims to improve spatial policy in central Borneo and look at its implications for the investment climate. This type of research is empirical juridical research with qualitative-descriptive approach. The data analysis method used is descriptive-qualitative. Based on this research, it can be obtained an overview of the spatial policy direction of Central Borneo Province aimed at realizing the spatial order of agriculture-oriented areas of agribusiness and agro-industry, as well as energy barns and food barns while considering the carrying capacity and capacity of the environment. Based on the data obtained, it can be seen that investment realization from year to year has not increased significantly. Spatial policy has an influence on the investment climate in the plantation sector because this sector must occupy the cultivation area or land user area (Area Penggunaan Lahan/LAND USER AREA) in order to run the company. Abstract

Mu’āmalah is a matter that is constantly evolving following the progress of the times, including the ijārah contract and the ijārah muntahiya bi tamlik contract. It is necessary to study sociological and philosophical perspectives to obtain a deep meaning regarding the contextual aspects. This research was normative research that examines the norms and principles of Islamic law as well as developing doctrines that are relevant to the theme of the study. The approach was a conceptual approach which intended to analyze the concepts in Islamic law to find out the meaning. Ijārah is a contract for the transfer of usufructuary rights over an item or service and ijārah muntahiya bi tamlik is a lease agreement with the option of transferring ownership rights. The legal basis of the ijārah agreement and the ijārah muntahiya bi tamlik was found in the Qur'an, Hadith and several regulations. Sociological studies of the ijārah and ijārah muntahiya bi tamlik contracts include that the ijārah and ijārah muntahiya bi tamlik aim to facilitate humans in carrying out their lives and can synergize with each other to meet the needs of life. And containing orders to fulfill individual rights can also bring prosperity and peace to those who implement it. From a philosophical point of view, it contains values sourced from the Qur'an and hadith in the form of values of justice and universal principles and has the goal of benefiting mankind and avoiding harm.

Abstract

Regulations regarding transaction of telecommunication devices have been clearly regulated. However, the circulation of illegal products is still rife, especially devices that International Mobile Equipment Identity (IMEI) is not officially registered. This can potentially be detrimental to consumers. This research is normative research with the legal research method of literature. The approach used is a statutory approach and a conceptual approach.  It can be concluded that the protection that can be done against consumers is preventive protection that is preventive and repressive protection that is done if the consumer has suffered a loss. Preventive preventive legal protection is contained in the provisions of Law No. 8 of 1999 on Consumer Protection and also contained in government efforts through Regulation of the Minister of Communication and Informatics No. 1 of 2020.Repressive legal protection can be resolved through litigation and non-litigation litigation.Violation of product requirements rules may result in businesses being subject to administrative sanctions.

Abstract

The link between corruption, law enforcement, economic progress, and foreign direct investment (FDI) in Indonesia is the subject of an experimental inquiry in this article. When elements like trade openness, human capital, and infrastructure development are considered, such as their effects on economic growth and FDI inflows, the study employs multiple regression analysis to examine the influence of crime and law enforcement on these two variables. The study's findings show that law enforcement and corruption significantly impact Indonesia's FDI inflows and economic growth. Law enforcement has a favorable effect on both economic growth and FDI inflows, while sin has the opposite effect. The findings suggest that reducing crime and bolstering law enforcement are essential to promoting economic growth and enticing foreign investment in Indonesia.

Abstract

Hukum perlindungan konsumen memainkan peran penting dalam melindungi hak dan kepentingan konsumen dalam interaksinya dengan pelaku usaha. Dalam konteks produk pangan, perlindungan konsumen menjadi lebih signifikan karena dampaknya yang langsung terhadap kesehatan masyarakat. Penelitian ini berfokus pada Kabupaten Sukabumi di Indonesia dan mengkaji implikasi undang-undang perlindungan konsumen terhadap hak asasi manusia, khususnya dalam kaitannya dengan perlindungan konsumen pada produk pangan. Pendekatan metode campuran yang menggabungkan wawancara, survei, dan analisis hukum digunakan untuk mengumpulkan data. Temuan-temuan yang diperoleh menunjukkan adanya kekuatan dan kelemahan dalam kerangka kerja perlindungan konsumen, termasuk tantangan dalam penegakan hukum dan kesenjangan dalam kerangka kerja peraturan. Penelitian ini juga mengidentifikasi dampak perlindungan konsumen terhadap hak asasi manusia, khususnya hak atas kesehatan, informasi, makanan yang cukup, dan ganti rugi. Tantangan dan area untuk perbaikan diidentifikasi, seperti penegakan hukum yang tidak memadai, sumber daya yang terbatas, dan kurangnya kesadaran konsumen. Rekomendasi dibuat untuk memperkuat kerangka kerja perlindungan konsumen, meningkatkan keamanan pangan, dan melindungi hak-hak konsumen. Penelitian ini menyoroti perlunya perubahan kebijakan, peningkatan investasi, dan peningkatan koordinasi di antara para pemangku kepentingan untuk mencapai perlindungan konsumen yang efektif di Kabupaten Sukabumi.
