Abstract

The existence of celestial bodies has many functions, such as worship interests as a guide to prayer time. When praying, it is necessary to face the Qibla, the Kaaba. Finding the direction of the Qibla is facilitated by Rashdul Kibla, which is based on observations of celestial bodies, including the Sun and constellations. The Stellarium application is one of the technological developments that can be used as a medium in determining the Qibla direction. This study aims to describe the concept of fiqh and astronomy rashdul qibla and the use of stellarium application as a medium for determining the qibla direction. Through a qualitative approach with descriptive-analytical method, this research describes the fiqh of rashdul qibla, astronomy of rashdul qibla and how to use the stellarium application as a medium for determining the qibla direction. The data source of this research is obtained through documentation of written works of fiqh and astronomy concepts that provide explanations related to rashdul qibla and the stellarium application. The results showed that the determination of the Qibla direction through rashdul qibla will be easier and measurable. The astronomical Qibla direction is part of the form of measuring, comparing and finding the Qibla direction whose accuracy is not in doubt. Stellarium is part of an IT-based application that can be used as a means of determining the Qibla direction whose calculation accuracy can be adjusted to the place where the Qibla direction is sought.

Abstract

ABSTRACT This article aims to interpret Surah An-Nisa (4): 3 linearly and interpret it in an integrated and multidisciplinary manner, as well as to examine the substance of polygamy and its relevance to Indonesian marriage law. The methods used in this study are qualitative research and library research with descriptive data analysis techniques. The conclusion of this study is that the interpretation of verse 3 of Surah An-Nisa, whether from a socio-historical perspective, a gender and feminist approach, or hermeneutics, does not explicitly require the practice of polygamy, but only allows it under strict conditions. As explained by HAMKA, polygamy is permitted if it is in the public interest, and this is in line with Quraish Shihab's interpretation of the social reality of Indonesian society. Similarly, from a gender and feminist perspective, polygamy must be understood in a socio-cultural context so that women in polygamous marriages are not placed in a lower position. Similarly, Muhammad Syahrur's theory of limits provides quantitative and qualitative boundaries. ABSTRAK Artikel ini bertujuan untuk menafsirkan Surah An-Nisa (4): 3 secara linier dan menafsirkannya secara terintegrasi dan multidisiplin, serta mengkaji substansi poligami dan relevansinya dengan hukum perkawinan Indonesia. Penelitian ini merupakan penelitian kualitatif dengan jenis penelitian library research (Studi kepustakaan), Adapun teknik analisis data menggunakan deskriptif analitis. Kesimpulan dari penelitian ini adalah bahwa penafsiran Q.S An-Nisa ayat 3, baik dari perspektif sosio-historis, pendekatan gender dan feminis, maupun hermeneutika, secara eksplisit tidak mewajibkan praktik poligami, tetapi hanya memperbolehkannya di bawah berbagai syarat yang ketat. Seperti dijelaskan oleh HAMKA, poligami diperbolehkan jika demi kemaslahatan umum, dan hal ini sejalan dengan interpretasi Quraish Shihab terkait realitas sosial masyarakat Indonesia. Adapun dari perspektif gender dan feminis, poligami harus dipahami dalam konteks sosio-budaya agar perempuan dalam pernikahan poligami tidak ditempatkan pada posisi yang lebih rendah. Begitupun pendapat Muhammad Syahrur dengan limit theory yang memberikan batasan kuantitatif dan kualitatif.

Abstract

This research was motivated by the juridical problem of interfaith marriage in Indonesia. This problem includes the guarantee of the dimension of family goals. This study aims to analyze the guarantee of the dimension of family goals in the constitution of the Indonesian Marriage Law for perpetrators of interfaith marriages. Methodologically, this research is normative juridical research with a qualitative approach to the concept of family goals (maqasid al-usrah) as an analytical perspective. The data analyzed include the Constitution of the Marriage Law Number 16 of 2019, journal articles, books, and other literature related to the discussion. The results of this study indicate that the Indonesian Marriage Law has not guaranteed the dimension of family goals for interfaith marriage practitioners in Indonesia. This study's implications emphasize that family goals (maqasid al-usrah) can serve as a basis for addressing the juridical problem of interfaith marriage in Indonesia. The contextualization of the Marriage Law's constitution in the form of articles that guarantee the dimensions of family goals for perpetrators of interfaith marriage in Indonesia is necessary.

Abstract

This study aims to examine how the validity of divorce (talaq) is determined when the husband experiences a mental disorder from a transdisciplinary Islamic family law perspective. This qualitative normative legal research employs conceptual, case, and transdisciplinary approaches by integrating Islamic jurisprudence, qawaid al-fiqhiyyah (Islamic legal maxims), maqasid al-shariah (objectives of Islamic law), clinical psychology, psychiatry, and Islamic family law and judicial perspectives. Data were obtained through library research involving classical and contemporary fiqh literature, scientific journals, the Compilation of Islamic Law, mental health literature, and selected religious court decisions concerning mental disorders in divorce cases. The findings indicate that the validity of talaq cannot be determined solely from its verbal pronouncement but requires consideration of the husband's consciousness, reasoning ability, intention, voluntariness, and legal capacity at the time of pronouncement. Mental disorders, including bipolar disorder, schizophrenia, borderline personality disorder, and major depressive disorder, may affect aql (reason), iradah (will), and ahliyyah (legal capacity), although their effects vary according to clinical severity, symptoms, and temporal conditions. Mental disorder therefore does not automatically invalidate talaq. This study concludes that its validity requires a contextual and case-sensitive assessment integrating Islamic legal principles, clinical and psychiatric assessment, judicial considerations, and maqasid al-shariah. The study contributes a transdisciplinary framework for determining legal capacity and talaq validity while protecting individual rights, marital interests, and family welfare.
