Abstract

The purpose of this research was to examine the significance of al-Ghazali's ma?la?ah concept to the development of u??l fiqh and Islamic law. This research method was qualitative with descriptive analytic presentation and the research type was library research. The research result showed that the concept of ma?la?ah al-Ghazali was used in solving problems of Islamic law because the principle in ma?la?ah was maintaining the objectives of Islamic law (maq??id al-syar?‘ah), covering religion, soul, mind, lineage, and property. There were six points of significance of al-Ghazali's ma?la?ah concept in the development of u??l fiqh and Islamic law, namely, the important role of al-Ghazali's ma?la?ah concept in u??l fiqh and Islamic legal thought, al-Ghazali's rejection of the concept of ma?la?ah, al-Ghazali's ma?la?ah had no basis in nas, al-Ghazali's emphasized on preserving the objective objectives of Islamic law, al-Ghazali's ma?la?ah as a tool to weigh the benefits and losses of an action or decision, and al-Ghazali's ma?la?ah determined whether or not an action or decision was permissible. This concept helped the ulama to make decisions that were in line with the principles of Islamic law.

Abstract

The moral decline in the modern era presents a serious challenge to Islamic education, particularly in shaping strong spiritual character towards Allah SWT. Qur’anic verse QS. Al-Baqarah:186 conveys the message of divine closeness that holds deep relevance for moral development. This study aims to analyze the verse using Emilio Betti’s hermeneutic approach to uncover the moral education dimension from historical, linguistic, and contextual perspectives. The research applies a qualitative-descriptive method through textual and philosophical-hermeneutic analysis. The findings reveal that the verse contains not only theological meaning but also universal ethical messages such as spiritual optimism and slot thailand obedience to divine commands. Through Betti’s approach, the study finds that the objective meaning structure of the verse is both transhistorical and contextual. This research offers a synthesis between classical Qur’anic exegesis and modern hermeneutics, contributing practical insights for developing Islamic moral education curricula that are integrative and responsive to contemporary moral challenges.

Abstract

Artikel ini mengkaji ulang relasi gender dalam QS. An-Nisa’ (4):34 yang sering dijadikan legitimasi dominasi laki-laki dalam relasi rumah tangga, melalui pendekatan hermeneutika kritik Muhammad Arkoun. Ayat ini sering dijadikan dasar legitimasi relasi hierarkis antara laki-laki dan perempuan dalam tradisi Islam. Namun, penafsiran-penafsiran tersebut seringkali terjebak dalam konstruksi historis dan ideologis yang tidak sepenuhnya mencerminkan semangat keadilan Islam. Penelitian ini merupakan studi kepustakaan yang mengkaji literatur-literatur, teori hermeneutika kritis, tafsir kontekstual, dan konstruksi sosial gender. Melalui kerangka Arkoun, artikel ini membongkar struktur pemikiran dan wacana dominan yang membentuk tafsir klasik, serta mengusulkan pembacaan alternatif yang lebih inklusif dan kontekstual. Hasil penelitian menunjukkan bahwa ayat tersebut memiliki potensi untuk ditafsirkan secara lebih egaliter dengan mempertimbangkan konteks sejarah dan sosial. Temuan ini memiliki implikasi penting dalam pendidikan Islam serta dapat memperkaya wacana keislaman yang inklusif dan berkeadilan gender.

Abstract

This article examines the lived meaning of mīṡāqan ghalīẓan, the solemn marital covenant articulated in Q.S. al-Nisāʾ [4]:21, among Salafi families in Semarang Regency, Indonesia. Focusing on how these families respond to domestic tensions and economic pressures, the study situates mīṡāqan ghalīẓan at the intersection of Qur’anic exegesis, maqāṣid al-sharīʿah, and everyday marital practice. Based on qualitative fieldwork involving in-depth interviews and participant observation, the article shows that mīṡāqan ghalīẓan is not understood merely as a juridical formula within marriage, but as a moral-spiritual covenant that shapes spousal relations, conflict resolution, and household economic decision-making. The findings reveal that marital disagreements are commonly managed through musyāwarah, ethical self-restraint, and mutual accountability, while economic hardship is interpreted as a spiritual trial requiring patience, cooperation, and shared responsibility. These practices challenge the common assumption that Salafi marital life is inherently rigid, patriarchal, or authoritarian. Instead, they reveal a relational ethic rooted in religious discipline, negotiated responsibility, and moral accountability. Seen from the maqāṣid al-sharīʿah, these practices help protect five essential values in Islam: religion, life, intellect, family lineage, and property. By connecting Qur’anic interpretation with lived marital experience, this study contributes to contemporary debates on Islamic family ethics, Salafi social practice, and Muslim family resilience. It argues that mīṡāqan ghalīẓan operates not only as a theological and legal concept, but also as a dynamic ethical framework for sustaining family resilience in contemporary Muslim societies.
