Abstract

Article 21 paragraph 2 of law number 5 of 1990 concerning living natural resources and their ecosystems. Violation of the provisions of article 21 paragraph 2 is regulated in article 40 of law number 5 of 1990. However, the reality that occurred in the Pulau Banyak sub-district was resolved through customary law that grew within the community and the community still violates the provisions of customary law that exist in society. The type of research method is empirical juridical using primary data through interview data, literature study of written materials such as books and documents. The results of this study say that in the Pulau Banyak District area there are still violations of customary law provisions that live in the community, so that people still violate customary law regarding turtle protection. Based on the case of turtle meat hunting, customary law cannot provide a definite resolution, so it is contrary to the law, therefore it must be resolved through positive law.

Abstract

Kegiatan pertambangan membawa dampak besar bagi lingkungan. Oleh karena itu untuk menjaga keberlanjutan lingkungan dalam kegiatan pengelolaan tambang mewajibkan perusahaan untuk melakukan reklamasi dan pascatambang. Namun sebagaimana diatur dalam Undang – Undang Nomor 3 Tahun 2020 Tentang Perubahan atas Undang – Undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara. Hadirnya ketentuan UU Minerba yang baru tersebut mengatur mengenai reklamasi dan pascatambang yang memiliki izin konsensi tambang (IUP) untuk melaksanakan reklamasi dan pascatambang dengan tingkat keberhasilan wajib mencapai 100% dan adanya penerapan sanksi pidana bagi perusahaan yang memiliki IUP apabila tidak melaksanakan ketentuan tersebut. Penelitian ini bertujuan untuk memberika gambaran dan jawaban tentang bentuk - bentuk tanggung jawab perusahaan pemegang IUP dalam melaksana reklamasi dan pascatambang yang harus mencapai tingkat keberhasilan 100%, kemudian kendala yang dialami perusahaan tambang tersebut serta upaya pemerintah dalam mengawasi jalannya tanggung jawab oleh perusahaan pemegang IUP dalam melaksanakan reklamasi dan pascatambang yang berwawasan lingkungan berdasarkan prinsip good mining practice. Penelitian ini menggunakan metode normatif-empiris. Hasil penelitian menunjukkan ada berupa kewajiban pemberian uang jaminan reklmasi dan pascatambang yang dihitung dari luas area yang terkena dampak pengelolaan pertambangan dan berupa tujuh bentuk tanggung jawab yang lainnya yang diatur melalui Peraturan Pemerintah Nomor 78 Tahun 2010 Tentang Reklamasi dan Pascatambang dan Keputusan Menteri Energi dan Sumber Daya Mineral Republik Indonesia Nomor 1827 K/30/MEM/2018 Tentang Pedoman Pelaksanaan Kaidah Teknik Tambang Yang Baik. Abstract

The purpose of this study is to determine the implementation of Aceh Qanun Number 8 of 2016 on the Halal Product Assurance System (The Aceh Qanun on Halal Label) on Micro, Small, and Medium Enterprises (MSMEs) and to understand the supervision of the implementation of the Aceh Qanun on Halal Label in West Aceh Regency. The study method used is empirical juridical, producing descriptive data regarding implementing the Aceh Qanun on Halal Label towards MSMEs in the West Aceh Regency. This study is important because data from the Health Office of West Aceh Regency shows that 30 MSMEs have obtained halal certificates. In comparison, 64 MSMEs do not have halal certificates for their marketed food products. Based on the data, this fact does not comply with the provisions of Article 4 of Law Number 33 of 2014 on Halal Product Assurance (hereinafter referred to as the Halal Product Guarantee Law 2014), which obliges all products traded in Indonesia to have halal certification. This provision is in line with Article 4 of the Aceh Qanun on Halal Label, which states that the Halal Product Assurance System aims to provide protection, peace of mind, and legal certainty to the community in consuming and using Halal and hygienic products for physical and spiritual health. The assurance of halal products refers to legal certainty regarding the halal status of products, proven by halal certificates, halal registration numbers, and halal labels. Many MSMEs in West Aceh do not have halal product certificates, so the objectives of the Aceh Qanun on Halal Label have yet to be well implemented. The suboptimal supervision also influences the suboptimal implementation of the Aceh Qanun on Halal Label. This supervision involves various West Aceh Regency Local Government institutions, such as the Ministry of Religious Affairs and the Health Office. The main constraint is the limited funds allocated for such supervision, resulting in suboptimal halal product supervision for MSMEs in West Aceh.

Abstract

Engagement as a stage before marriage is expected to proceed as it should. However, along the way, various problems arise that lead to the dissolution of the engagement. If it is broken, sanctions will certainly be imposed. The purpose of this paper is to examine the implementation of customary sanctions for prospective brides and grooms in the termination of engagement in Meurandeh Village, Lembah Sabil District, Southwest Aceh Regency. The research method used is the empirical juridical method. The results of the study indicate that the implementation of sanctions is carried out according to the form of the sign given during the engagement. If the sign given in the engagement is gold, then the gold is returned to the groom (if the guilty party is a woman). However, if the guilty party is the man, then the gold is forfeited (remains the property of the woman), the man no longer has any rights to the gold. If the sign given in the engagement is a sum of money, and the guilty party is a woman, then the money given must be returned to the groom twice as much. However, if the guilty party is the man, then the money that has been given is forfeited and becomes the property of the woman. It is recommended that village customary officials strengthen the delivery of information regarding sanctions during engagements, so that prospective brides and grooms are committed to carrying out the engagement until the marriage contract and marriage.
