Abstract

Implementation of development activities is an absolute thing that must be done by the government in order to realize the goals of national development to create general welfare. because of various development activities aimed at improving the welfare of mankind which often also have an impact on environmental change. the negative impact of the existence of this pemabangunan must be more careful to avoid a damage in the existing environmental order either the environment and social environment. In Indonesia special arrangements on environmental management are contained in Law Number 32 Year 2009. This new approach is very effective to encourage environmental conservation, supervision and conservation. Environmental interests must be considered globally and in the long term for the welfare of the Ummah humans.In its development, environmental order and social environment should always be considered in order not to bring various types of disasters. Therefore, the responsibility of all elements of society in maintaining the environmental and social environment is expected to create a better way of looking at the environment itself. Issues concerning environmental degradation must necessarily start to be taken into consideration in order to provide a new perspective in order to promote the existence of an environmental safeguard so that it can indirectly contribute to avoiding a more severe hazard to the development of human and living beings during this time inhabit the earth and the environment sustainability.Keywords : legal aspect, environmentally, sustainability.

Abstract

Law No. 35 of 2014 concerning protection of children also guarantees the fulfillment of children's rights to survival, growth and development and is entitled to protection from violence and discrimination. Fulfillment of the rights of basic needs and protection for children in the scope of West Aceh has not yet been fully implemented. The process of conducting the socialization was carried out by the method of exposure and discussion of legal counseling materials about the role and obligations of the Government in providing legal protection to children who need legal assistance. The participation of all parties in paying attention to the protection of children is one thing that is very urgent. Given cases involving children in conflict with the law both as perpetrators and victims, often ignoring the rights of children who should be protected by laws and regulations. This is what needs to be done by all parties to encourage the West Aceh District Government to immediately give birth a Qanun on Child Protection. So that with regulations specifically related to child protection, children's rights are guaranteed by law.

Abstract

Start at the most prestigious and prospective profession. Advocates have an important place in the business world. Apart from being a law enforcer, Advocates are also the only consultants who are relied on and trusted in solving a case at trial. In the provisions of the laws and regulations on Advocates, it is stated that the advocate profession is a profession that is tasked with providing legal services for clients. The activities and scope of activities carried out by Advocates on a daily basis require that Advocates have public speaking skills. Because the ability of an advocate to defend his client is also very much determined by his verbal / speaking skills (Public Speaking). The purpose of implementing this activity is for participants to understand the role and function of Advocates, Advocate code of ethics and the function of additional skills such as public speaking to Advocates. The implementation method is used through the socialization of the Advocate Law, the Advocate's code of ethics and the public speaking function in carrying out the role of an Advocate. The results of the implementation achieved were that participants understood the role, authority and position of an advocate, the scope of the advocate and indicators of public speaking and the use of public speaking.

Abstract

The development of environmental concept is a sustainable development, which optimally takes advantage on natural and human resources by synchronizing human activities with the sources of natural resources for monitoring and environmental sources. As the implementation of the Environmental Act, it is expected to be similar with its real condition. In terms of keeping environment sustainability, the implementation of the Environmental Act is very effective in improving environment quality in a state. The eco development in Aceh Barat District is expected to be able to respect on environment by more focusing on ethics and the knowledge on environment in a view that is held by people and government. The research shows that in the sustainable development, the Government of Aceh Barat has made an effort in accordance with the Act of Environment but due to the limit of human resources and tools that are not able to support the program has caused the environment development that is having orientation on environment becomes a hurdle and it is prone to be stopped. Based on the fact above, this research poses two problems are: 1. How is the effort of Aceh Barat in realizing the management of environmental development with the concept of environment? 2. How is the implementation of the Act of Environment in Aceh Barat District? This research applies descriptive analysis, it is expected might be able to describe and analyze a phenomenon that exists in the reality. The method applied is by juridical empirical research approach. The effective management system of environment needs to be developed seriously and effective based on environmental law.

Abstract

Abstract:The research shows that the management of budget is done by the Secretary of the House of Representative has not been well managed as demanded by the principles of budget drfating that are efficient, not luxurious, effective, based on the rule. It results from the planning of budget by the Secretariat of the House of Representative of Aceh Barat annually is always done by maximal budget approach hence it is not paying attention on proper principle of properness, inability of regional budget, and the ability of output of the working is not balanced to the budget. The implementation of budget by the Secretariat of the House states that the amount of Regional Spending that is budgeted in DPA of the Secretariat of the House is not the highest level for every spending. Thus, the spending of the Secretariat of the House of Representative has not been conducted based on not glamour, not luxury, effective, efficient and in accordance with the legal principles of the law. The monitoring of budget of the House of representative of Aceh Barat as similar as the spending that it has not been well conducted based on the principles of not glamour, cheap, effective, efficient and in accordance with the rules. The monitoring of budget by the House as ruled in Article 42 verse (1) c of the Act Number 32, 2004 has not provided the explanation regarding the power of monitoring done by the Regional/Municipality House of Representative toward the management of regional budget, including the management of budget at the House of Representative, hence in its implementation the House seems to have the power to do monitoring that has technical characteristic that is a part of the power done by the internal governmental monitor, inspector of budget. Abstrak: DPR Kabupaten/Kota mempunyai hak untuk menggunakan anggaran yang ditetapkan dalam APBK dan diadministrasikan oleh Sekretaris DPR Kabupaten/Kota, yang dalam melakukan pengelolaan Anggaran harus berpedoman Peraturan Pemerintah Nomor 21 tahun 2007 Tentang Kedudukan Protokoler dan Keuangan Pimpinan dan Anggota DPRD. Fungsi penganggaran yang dilakukan oleh DPRK Aceh Barat yang meliputi kegiatan perencanaan anggaran, pelaksanaan anggaran dan pengawasan anggaran sering mengabaikan prinsip-prinsip penyusunan anggaran daerah yang baik, yaitu prinsip hemat, tidak mewah, efektif dan efisien. Hal ini dapat terlihat dari besarnya jumlah anggaran yang digunakan oleh DPRK Aceh Barat untuk setiap satu tahun anggaran. Hal ini disebabkan dalam perencanaan anggaran Sekretariat DPRK Aceh Barat setiap tahunnya selalu dilakukan dengan pendekatan anggaran maksimal, sehingga dirasakan kurang memperhatikan asas kepatutan. Pelaksanaan anggaran oleh Sekretariat DPRK Aceh Barat menentukan bahwa jumlah Belanja Daerah yang dianggarkan dalam DPA Sekretariat DPRK Aceh Barat merupakan batas tertinggi untuk setiap pengeluaran belanja. Pengawasan anggaran DPRK Aceh Barat sebagaimana terdapat dalam ketentuan Pasal 42 ayat (1) huruf c Undang-Undang Nomor 32 Tahun 2004 tidak memberi penjelasan yang cukup jelas tentang kewenangan pengawasan yang dilakukan oleh anggota DPRK terhadap pengelolaan anggaran daerah, sehingga dalam implementasinya DPRK mempunyai kewenangan melakukan pengawasan yang bersifat tehnis, sedangkan dalam kenyataannya pengawasan yang bersifat tehnis merupakan kewenangan yang dilakukan oleh aparat pengawas intern pemerintah dalam hal ini adalah oleh Inspektorat. Supaya pengelolaan anggaran dapat berjalan dengan baik maka disarankan agar peraturan perundang-undangan yang berhubungan dengan perencanaan,pelaksanaan dan pengawasan anggaran DPRK dapat dipedomani dengan baik. Abstract

Pelayanan publik adalah kegiatan yang berhubungan dengan memberikan pelayanan berupa jasa kepada masyarakat, persoalan yang sering muncul dalam pelayanan belum maksimalnya dengan permasalahan tersebut pemerintah berupaya untuk meningkatkan Pelayanan berdasarkan Peraturan Menteri Dalam Negeri Nomor 4 tahun 2010 tentang Pedoman Pelayanan Administrasi Terpadu Kecamatan (PATEN). Pemerintah Aceh mengeluarkan Instruksi Gubernur Aceh nomor 01/INSTR/2011 tentang penerapan Pelayanan Administrasi Terpadu Kecamatan (PATEN) dalam wilayah Kecamatan Aceh khususnya Penelitian dilakukan tiga (3) Kecamatan Johan Pahlawan, Meureubo dan Arongan Lambalek Kabupaten Aceh Barat. Namun dalam implementasi pelayanan PATEN masih belum terlaksana dengan baik.Metode yang digunakan secara deskriptif kualitatif dengan menggunakan teori implementasi dan pelayanan. Adapun penentuan informan menggunakan teknik non probabillity sampling degan cara purposive sampling hal ini karena dalam penelitian kualitatif penentuan informan melihat kedalaman data. Hasil penelitian menunjukkan bahwa hasil penelitian yang dilakukan di tiga (3) Kecamatan yang menjadi Pilot Project PATEN di Kabupaten Aceh Barat belum berjalan seperti yang amanahkan di dalam UU PATEN.Hal ini terlihat masih ada keluhan masyarakat terkait dengan pelayanan PATEN di tingkat Kecamatan. Selama ini Kecamatan hanya melayani perizinan non perizinan sedangkan untuk perizinan belum dilakukan, bahkan masih ada kecamatan yang belum mengetahui akan program PATEN untuk memudahkan masyarakat dalam mendapatkan pelayanan

Abstract

In Law no. 12 of 1995 concerning pemasyarakatan which became a positive law and must be implemented to achieve the purpose of pemasyarakatan. The guidance given to prisoners has a purpose to enable prisoners to play an active role in natural development and to live fairly as good and responsible citizens after their prison term is completed. Coaching is adapted to the talents and interests of prisoners so that the prisoners understand that all coaching is given for their good that they have the readiness to return with the community when they are free. So the inmates rules and follows every coaching well and without feeling compelled. Penitentiary also provides the rights of inmates as part of the community in accordance with the prevailing provisions so as to create a conducive atmosphere. Guidance given in the form of personality coaching that includes religious and moral coaching, self-help include general skills and special skills. This research uses normative juridical method, that is approach which is done by examining the legislation which relevant with the problem which studied or looking from the aspect of sociology of law. Abstract

The  purpose  of  this  research  is  to  know  and  to  explain  about  the  implementation  of accountability  for  the  management  of  the  budget  in  the  House  of  Representatives  District (DPRK)  Aceh  Barat.  This  research  uses  nomative  juridical method  and  nomative  empirical. Research specifications are descriptive analytical mind. The data source that is used secondary data, through investigations books, official documents and research results of the experts in the form of reports. In addition to the collection of legal materials, also collected primary data that is  done  with  how  to  perform  the  interview.  The  results  of  the  study  showed  that  the DPRK budget  is  a  part  that  is  not  an  inseparable  part  of  the  qanun  Regency  of  Aceh  Barat  about APBK.  The  study  also  follows  the  discussion  of  the  budget  of  other  SKPK  mechanism  and discussed together between a team of Local Government Budget and Budget Committee DPRK. The  realization  of  the  Secretariat  budget DPRK West Aceh  good  enough,  almost  all  planned activities  in 2016 can be  implemented. DPRK budget  supervision of West Aceh done by many parties, which is in addition to direct the Secretary of the DPRK authorities in West Aceh itself, also  done  by  Inspektorat  Jenderal, BPK  district  representatives  of  the  province  of Aceh  and BPKP Aceh Province. It is recommended that the preparation of the Secretariat budget DPRK West Aceh on the future can be more is clarified again to prevent overlapping budget spending to one activity will be but with a different name.  Keywords: Accountability, Budget Management and Planning

Abstract

The Regional People's Legislative Assembly (DPRD) is a form of representative institution of the people of provinces, districts, or cities in Indonesia which is located as an element of local government administration together with the Regional Government. The existence of the Regional People's Legislative Assembly is regulated, among others, in Law Number 27 Year 2009 concerning the People's Consultative Assembly, the People's Legislative Assembly, the Regional Representative Council, and the Regional People's Legislative Assembly. Article 342 of Law Number 27 Year 2009 stipulates that "Regency / Municipal DPRD shall be a regional representative body domiciled as the element of the regional administration of a regency / municipality. In formal juridical, DPRD is the working partner of Regional Head either Governor, Regent, or Mayor. Since the enactment of Law Number 32 Year 2004 regarding Regional Government, the Regional Head shall no longer be responsible to the Regional People's Legislative Assembly, since it shall be elected directly by the people through the election of the Regional Head and Deputy Regional Head. Article 27 Paragraph (2) of Law Number 32 Year 2004 stipulates, among other things, that "the Regional Head has an obligation also to provide reports on the implementation of regional government to the Government, and to give accountability report to the DPRD". Nevertheless, the role of DPRD is enormous in determining regional policy.This study uses the normative juridical method, which is the approach done by examining the legislation relevant to the problem under study or looking from the normative legal aspects. Abstract

Legal metrology tools such as measuring instruments, measurements, scales and equipment used in trade transactions must be calibrated and recalibrated within a certain period of time. The goal is the measurement results using these tools remain correct as they should be. If it is not calibrated or recalibrated, it can cause measurements to be inaccurate, so that it can be detrimental to consumers in trade. This study aims to study further on the regulation of calibration of legal metrology equipment, sanctions, mechanisms or procedures for calibration and recalibration. The research method used is a normative juridical research method. The results of the study indicate that the provisions relating to the calibration of legal metrology equipment consisting of measuring, weighing and complete instruments are regulated in Law Number 2 of 1981 concerning Legal Metrology and Government Regulation Number 2 of 1985 concerning mandatory and free to be calibrated and/or or recalibration for measuring, weighing instruments and their accessories. In this provision, it is determined that there is an obligation to calibrate and recalibrate measuring, and weighing instruments used for public purposes, business purposes, the need for delivery and receipt of goods, determination of the company's final product, mandatory calibration and recalibration. As for the sanctions for business actors who commit acts prohibited by the Legal Metrology Law, they are subject to criminal sanctions in the form of imprisonment for a maximum of 1 (one) year and a fine of a maximum of Rp. 1,000,000 (one million rupiah). Furthermore, the mechanism or procedure for calibration of legal metrology tools includes the owner or user of measuring instruments, measuring, weighing in a clean condition, registering and paying calibration fees, then employees carry out inspections and tests, then the results are posted.
