Abstract

Education is an effort to channel knowledge from educators to students through a tiered process. Elementary school students are students at the next level who must obtain extraordinary motivation to support the dream process they have, especially for students at SDN 7 Jeumpa, Aceh Barat Daya District. That way, creating an inspiring class that can give an idea of their dreams in the future will be a form of motivation that is able to push them toward a better future. The method used in this service is by lecturing, sharing sessions, and direct practice in accordance with the profession. The results of the dedication show that very many students at SDN 7 Jeumpa, Southwest Aceh District do not have high motivation in achieving their dreams and also that some of these students are still hesitant in determining their dreams, so they only follow what is conveyed by other students. That way, the results of this service provide a clear picture of the dream they will achieve and good motivation for students to pursue that dream.

Abstract

Start at the most prestigious and prospective profession. Advocates have an important place in the business world. Apart from being a law enforcer, Advocates are also the only consultants who are relied on and trusted in solving a case at trial. In the provisions of the laws and regulations on Advocates, it is stated that the advocate profession is a profession that is tasked with providing legal services for clients. The activities and scope of activities carried out by Advocates on a daily basis require that Advocates have public speaking skills. Because the ability of an advocate to defend his client is also very much determined by his verbal / speaking skills (Public Speaking). The purpose of implementing this activity is for participants to understand the role and function of Advocates, Advocate code of ethics and the function of additional skills such as public speaking to Advocates. The implementation method is used through the socialization of the Advocate Law, the Advocate's code of ethics and the public speaking function in carrying out the role of an Advocate. The results of the implementation achieved were that participants understood the role, authority and position of an advocate, the scope of the advocate and indicators of public speaking and the use of public speaking.

Abstract

Pelayanan publik adalah kegiatan yang berhubungan dengan memberikan pelayanan berupa jasa kepada masyarakat, persoalan yang sering muncul dalam pelayanan belum maksimalnya dengan permasalahan tersebut pemerintah berupaya untuk meningkatkan Pelayanan berdasarkan Peraturan Menteri Dalam Negeri Nomor 4 tahun 2010 tentang Pedoman Pelayanan Administrasi Terpadu Kecamatan (PATEN). Pemerintah Aceh mengeluarkan Instruksi Gubernur Aceh nomor 01/INSTR/2011 tentang penerapan Pelayanan Administrasi Terpadu Kecamatan (PATEN) dalam wilayah Kecamatan Aceh khususnya Penelitian dilakukan tiga (3) Kecamatan Johan Pahlawan, Meureubo dan Arongan Lambalek Kabupaten Aceh Barat. Namun dalam implementasi pelayanan PATEN masih belum terlaksana dengan baik.Metode yang digunakan secara deskriptif kualitatif dengan menggunakan teori implementasi dan pelayanan. Adapun penentuan informan menggunakan teknik non probabillity sampling degan cara purposive sampling hal ini karena dalam penelitian kualitatif penentuan informan melihat kedalaman data. Hasil penelitian menunjukkan bahwa hasil penelitian yang dilakukan di tiga (3) Kecamatan yang menjadi Pilot Project PATEN di Kabupaten Aceh Barat belum berjalan seperti yang amanahkan di dalam UU PATEN.Hal ini terlihat masih ada keluhan masyarakat terkait dengan pelayanan PATEN di tingkat Kecamatan. Selama ini Kecamatan hanya melayani perizinan non perizinan sedangkan untuk perizinan belum dilakukan, bahkan masih ada kecamatan yang belum mengetahui akan program PATEN untuk memudahkan masyarakat dalam mendapatkan pelayanan

Abstract

Compensation for rape victims stipulated in Aceh’s Qanun No. 6/2014 concerning the Law of Jinayat has not been implemented as expected. The initiation of a victim's request and the inability of perpetrators to pay the restitution were considered as the inhibiting factors. This research tried to identify and explain: (1) the basis of Islamic jurisprudence (fiqh) regarding restitution for victims of rape, (2) a fiqh perspective regarding the provisions and procedures for restitution for victims of rape that have been regulated in Qanun Jinayat and Qanun Acara Jinayat, (3) a fiqh perspective on the obligation of the state to assist rape perpetrators who are financially unable to pay the restitution. This type of research is a literature study employing a review of the document. All data were qualitatively analyzed using methods of descriptive analysis and content analysis. The findings revealed that: (1) compensation for victims of rape from a fiqh perspective is part of the basic sentence decided by the judge along with decision of physical punishment, while according to Qanun Jinayat and Qanun Acara Jinayat, compensation is not part of the basic sentence, (2 ) according to a fiqh perspective, a rape victim has the right to receive compensation in the form of mahar misil (dowry) which is paid multiple times according to repeated rape, ursy al-bikarah, or others in accordance with the losses suffered by the victim, whereas according to Qanun Jinayat and Qanun Acara Jinayat, compensation for rape victims is an amount of money or certain assets paid for suffering, loss of property, or compensation for certain actions, (3) from a fiqh perspective, the state is obliged to help the perpetrators of rape to pay off the burden of restitution which cannot be repaid due to financial constraints by distributing for them the right of gharim from the treasury of zakat collected by baitul mal.

Abstract

Law enforcement against tiger trafficking is a form of tiger protection carried out by the government. In upholding this law, it is necessary to have cooperation between law enforcement officers and the community so that it can minimize the crime of tiger trafficking and can be immediately followed up if someone commits a crime of tiger trafficking in Bener Meriah Regency. This research is an empirical legal reseach which is a reseach using a qualitative approach and descriptive reseach analysis. . As for the purpose of this study is to determine whether law enforcement against tiger trafficking in Bener Meriah Regency has been carried out properly in accordance with the prevailing laws. Law enforcement carried out by the Bener Meriah Regency government is in accordance with the applicable provisions, namely Law Number 8 of 1981 concerning the Criminal Procedure Code and Law Number 5 of 1990 concerning Natural Resources Conservation and in accordance with the international convention cites (Convention on International Trade in Endangered Species of Wild Fauna and Flora).

Abstract

Article 21 paragraph (5) of the Corruption Eradication Commission Law states that the Chairperson of the Corruption Eradication Commission "works collectively", which in the explanation stated that each decision making must be approved and decided together. The main problem of this research is about the pre-trial case of Budi Gunawan which was determined by the suspect by the KPK in the arguments of the petitioner's petition stating that the suspect's determination was not carried out collectively because at that time there was a vacancy of one of the KPK Leaders. Therefore this study aims to examine and examine the decision-making process by the KPK Leaders as the application of Article 21 paragraph (5) of the KPK Law and also determine the scope of tasks that are collectively decided and agreed upon together. This study uses a normative juridical method. The research specifications used are descriptive analytical, using a statute-approach approach, conceptual approach and comparative approach. The results of the study can be summarized as follows: First, the collective decision-making process is carried out in the form of ordinary mechanisms, formal mechanisms and urgent mechanisms. With the decision making procedure carried out by deliberation to reach consensus and use the most votes (voting) as stated in Commission Regulation No. 3 of 2009 concerning the procedures for decision making by the KPK leadership, but in the provisions of Article 7 PK / 3/2009 formulate that decision making can be carried out in less than 3 (three) people (not fulfilling the quorum) in the event of an urgent situation, and meaning the collective "by the KPK is not always interpreted as making decisions in its entirety (the five leaders), then the provision overrides the actual collective meaning based on the principle of working collectively. Second, as for the scope of the collective decision-making tasks by the KPK Leaders regulated in Article 3 CHAPTER III LEADERSHIP Regulation No. 1 of 2015 concerning the Organization and Work Procedure of the KPK, it is stated that the increase in the status of suspects is the scope of tasks decided and agreed collectively with expose procedure. Keywords: komisi pemberatasan korupsi, pengambilan keputusan, keputusan kolektif

Abstract

Politik uang (money politic) menjadi momok dan problem hukum tersendiri ketika konstelasi politik pemilu berlangsung terutama pemilu legislatif, dalam konteks ini pemilih tidak lagi melihat sosok calon legislatif yang pantas atau layak dipilih dengan pertimbangan aspek kompetensi dan kapasitas sebagai representasi rakyat di lembaga legislatif untuk lima tahun ke depan, namun lebih kepada berapa jumlah uang yang diberikan kepadanya. Pengaturan hukum terhadap pelarangan politik uang (money politic) diatur dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilu Pasal 523 ayat 1 dan 2. Undang-Undang Nomor 7 Tahun 2017 Pasal 101 Badan Pengawas Pemilu diberikan kewenangan untuk melakukan pencegahan dan penindakan terkait dengan pelanggaran peraturan perundang-undangan Pemilu serta menyelesaikan sengketa proses Pemilu. Badan Pengawas Pemilu Kabupaten Aceh Barat belum melaksanakan tugas secara maksimal khusus dalam konteks penanggulangan pelanggaran politik uang (money politic) pada pemilu serentak 2019. Hal itu dapat dilihat dengan tidak adanya case yang ditanganinya. Penegakan supremasi hukum (law enforcement) salah satu cara penanggulangan tindak pidana termasuk masalah politik uang (money politic), karena pemidanaan pada prinsipnya bertujuan yaitu sebagai berikut: Sebagai sarana memberikan efek jera pada si pelaku; Memberikan pembelajaran pada orang lain agar tidak melakukan tindak pidana.

Abstract

 Taxes are a compulsory contribution to a country that is indebted by an individual or a coercive body under the Act with no direct remuneration and used for the purposes of the state for the greatest possible prosperity of the people. The provision indicates that the position of the state or in other words referred to as the fiscal gets a very special place to regulate all arrangements concerning taxation and this is also marked by the nature of the inherent force to the taxpayer to pay off the tax debt. As regulated in Law Number 16 Year 2009 (hereinafter referred to as UU KUP), Article 21 paragraph (1) which reads "The State has the prior right to tax debt on goods belonging to the tax penanggungan". The purpose of this study is to examine how the introduction of the provision of State Owned Rights to tax debt by taxpayers. The method used is normative juridical approach method with descriptive analytical research specification. The result of the research shows that based on the analysis done by the writer on the Decision of Supreme Court Number 168 PK / Pdt.Sus / 2012 in the case of bankruptcy, asserted that not necessarily the provision of Article 21 paragraph (1) UU KUP gives space as big as to the state as the body having a privileged position to receive tax deductible by the taxpayer.Keywords: Preferen, Tax, Tax Debt, Tax Colection

Abstract

Act number 51 of 2009 concerning the second amandement to Act  Number 5 Year 1986 concerning the State Administrative Court governing the implementation of Decision of State Administrative Court based on the awareness of State Business Officials/Officers with hierarchical stages of hierarchy as stipulated in Article 116 of Act Number 5 Year 1986, was not effective enough to fource the State Admnistrative Officers to carry out the Decision of the State Admnistrative Judge. This is evident form some decisions that are not implemented by the State Admnistratin Officer. Therefore, the amandement to Act Number 5 of 1986 concerning the State Administrative Court brought significant chages to this matter, namaely Article 116 paragraph (4) of Act Number 9 of 2004 and the second amandement of Act Number 51 Year 2009 states that “In the event that has obtained permanent legal force, the official concerned shall be subjected to a forced attempt in the form of payment of sum of forced and/or admnistrative sanctions. But in the curse of the implementation of the forced effort is also not fully implemented because it creates various obstacles. The purpose of this paper analyzes and examinis the implementation of forces efforts in the execution of state admnistrative court decisions to state admnistrative officials. The method used is normative juridical research specification used is descriptive analytical, that is trying to describe or describe the problems associated with the object of reasearch. The result of thi reasearch is the application of the forced effort is an additional punisment that is as “condemnatoir”. It is intended that this additional punishment may fultill the implementation of the forced effort that imposes the admnistrative officer of the state to pay a sum of money and is subject to admnistrative senctions not yet fully enforceable because there is no further regulation concerning the payment of the amount of money, the amount, who is entitled to determine payment and/or admnistrative sanctions and payment mechanisms. Suggestions form the result of this study are to recommend to the Supreme Court to make operational guidelines or Juknis about further rules on forced efforts. Recommend to the state admnistrative bodies/official in issung state administrative decisions should be more careful and follow all decisions issued by the Admnistrative Court so that the dignity of the Institute can be  maintained.Keywords : state administrative courts, forced effort, dwangsom

Abstract

The existence of Indonesia as a form of unitary state has recognized and respected customary law community units and their traditional rights as long as they are still alive and in accordance with the development of society. One of them is regarding the specificity of customary institutions in the province that have certain and special powers such as the Tuha Peut Aceh institution and the West Sumatran Nagari Customary Council (KAN), this study will examine the similarities and differences in the authority of the two traditional institutions in the area. along with the position in the institutional structure of government in the village. This study aims to examine the position of Aceh's Tuha Peut Institution and West Sumatra's Nagari Adat Density Institution and to describe the differences and similarities in authority between the two institutions. The research method uses normative research or library research with a statutory approach and a comparative approach. The results of the study show that the authority for formulating village budgets, formulating village regulations, as well as supervision carried out by the two traditional institutions on the village government will have a positive impact on everyone, where any legal problems that can still be resolved in traditional institutions can still use traditional institutions. existing in an area.
