Abstract

Penjualan barang sebagai salah satu jenis perjanjian yang sering dilakukan anggota masyarakat. Aplikasi elektronik sebagai media yang sering dipilih oleh penjual dan pembeli dalam melakukan transaksi. Di era digital saat ini, perangkat elektronik dapat digunakan sebagai sarana penunjang terjadinya transaksi jual beli barang, khususnya barang bergerak, yang harus dilakukan beradasar asas kepentingan nasional dan hukum yang berlaku. Prakteknya, barang yang diterima pembeli tidak sesuai dengan yang dipesan, dan harga sudah dibayar. Dalam hal ini pembeli dapat minta peranggungjawaban kepada perusahaan jasa elektronik dan penjual atas kasus yang dialaminya.

Abstract

General background: The selection and appointment of notaries in Indonesia reveal a persistent tension between achieving justice and ensuring legal certainty. Specific background: While existing laws outline clear administrative procedures, they often overlook the meritocratic principles necessary to ensure that notaries possess the competence, integrity, and moral quality required for public trust. Knowledge gap: Previous studies have emphasized educational quality and regulatory inconsistencies but have not addressed the philosophical conflict between meritocracy and legal certainty. Aims: This study aims to examine how the philosophy of justice can guide the integration of meritocracy into the framework governing notary appointments in Indonesia. Results: The findings show that current legal mechanisms prioritize procedural clarity but fail to ensure substantive fairness, resulting in appointments that meet formal criteria yet lack ethical and professional depth. Novelty: This study introduces a philosophical synthesis that harmonizes legal formalism with moral justice by positioning meritocracy as an essential component of legal legitimacy. Implications: The study highlights the need for legal reform to embed transparent, merit-based evaluation systems that uphold justice, strengthen institutional credibility, and align positive law with the ethical ideals of fairness and societal trust. Abstract

This study aims to analyze the interaction of authority between Notaries and Land Deed Officials (PPAT) in the execution of land transaction deeds, emphasizing the aspect of legal certainty and the accountability of public officials. The issue arises due to overlapping authorities in practice, particularly when a Notary simultaneously holds the position of a PPAT in transferring land rights. This dual function often results in differing interpretations regarding the validity of deeds, the legitimacy of the officiating authority, and the resulting legal consequences for the parties involved. In addition, the Indonesian legal system has not yet firmly delineated the jurisdictional boundaries between the Notary and PPAT offices, creating potential uncertainty in the execution of authentic deeds.This research employs a normative juridical method with a combination of statute, conceptual, and case approaches. The statute approach examines the harmonization between the Law on Notary Office and the Regulation on PPAT Office. The conceptual approach interprets legal theories of competence, public responsibility, and legal certainty, while the case approach analyzes five key Supreme Court decisions that deal with the validity of deeds and overreach of authority.The results reveal an urgent need for legal harmonization and the establishment of concrete implementation guidelines that clarify the separation of authority between Notaries and PPATs. Furthermore, the study proposes the strengthening of professional supervision and accountability to prevent authority conflicts and to ensure a consistent standard of legal protection for the public.
