Abstract

Lack of research on victims, especially victims of sexual crimes, whereas cases of sexual crimes are increasingly prevalent in the community. Victim protection is urgently needed to address the increasing number of victims who are not immediately noticed as law enforcers pay more attention to the perpetrators, while victims who suffer physically and psychologically, materially and spiritually, are largely ignored. There are two things that make the offer of protection become important for the victim. First, how to make victims for whom the protection is held, they feel that they are given a sense of security and comfort as citizens protected from the evil that constantly lurks. Second, how to ensure that protection institutions can be achieved with adequate social, economic and cultural aspects.This research aims to find two important things: (1). Finding framework and system of victim protection innovation in Semarang (2). Find and understand the most urgent needs of victims for psychological and physical recovery so that victims can reactivate like other citizens. The benefit of this research is to provide scientific information about the opportunities and barriers to the application of innovative protection for victims in the environment. Thus, the institution can be built especially for victims of sexual violence, as well as the preparation of aspirative and compatible programsThe research method used is qualitative research that rely on information from the first hand, both concerning the application of innovation protection and efforts to find the framework of innovation, it will be pursued stages of research stages, ranging from the determination of the object and place of research, the determination of unit analysis and observation unit, to intensive research in the field. Preliminary information was collected through a survey with questionnaires and interview guides. In addition, focus groups will be set up based on the diversity of informants. The deepening of the data is done by combining in-depth interviews and focused discussions.The findings of this research will result in a model of protection that has legitimacy for the community. The protection model is in great demand and beneficial to victims who have not been noticed.

Abstract

This research critically examines the legal safeguards for children facing economic exploitation in three prominent ASEAN countries: Indonesia, Vietnam, and the Philippines. Despite the presence of protective legislation in these nations, the effective implementation of these laws encounters significant obstacles. In Indonesia, diverse regulations intended to shield children from economic exploitation coexist with the persistent issue of child labor. The continued prevalence of child labor is attributed to inadequate enforcement of labor laws and a general lack of community awareness regarding children's rights. Vietnam, while boasting a relatively comprehensive legal framework against child labor, faces challenges in certain rural areas where instances persist due to entrenched issues like poverty, cultural traditions, and limited access to education. Moreover, in the Philippines, the government has implemented measures such as the Child Labor Law and the Anti-Child Trafficking Act to protect children from economic exploitation. However, the effectiveness of these initiatives is impeded by resource constraints, corruption, and limited community awareness. In conclusion, this study reveals that legal protection for children in Indonesia, Vietnam, and the Philippines is hindered by a range of challenges, including deficient enforcement mechanisms, enduring cultural traditions, widespread poverty, systemic corruption, and limited community awareness. Addressing these complex issues requires collaborative efforts from governments, civil society, and communities to ensure the robust protection of children's rights.

Abstract

The rapid evolution of technology, particularly the ubiquitous presence of the internet, has brought about significant societal changes. While technological advancements have brought numerous benefits, they have also introduced new challenges and risks. Among these challenges is the alarming rise of child grooming, a form of sexual harassment perpetrated against minors, facilitated by the online environment. In Indonesia, the incidence of child grooming is increasingly prevalent, with several reported cases highlighting its emergence as a pressing societal issue. However, the absence of specific legal frameworks addressing this crime has posed significant challenges for law enforcement authorities tasked with its prevention and prosecution. The lack of dedicated legislation targeting child grooming underscores the need for a comprehensive legal response to effectively combat this form of exploitation. Currently, law enforcement officials rely on discretion in the absence of specific legal provisions, resulting in ad-hoc approaches to addressing these cases. This paper employs a normative juridical approach, utilizing The Statute Approach, to examine the legal landscape surrounding child grooming in Indonesia. By synthesizing existing literature and statutory regulations, this study aims to shed light on the legal complexities inherent in combating this emerging crime. In conclusion, while child grooming remains a relatively new phenomenon in Indonesia, its detrimental impact on minors necessitates urgent legislative action. By enacting dedicated laws and policies, the Indonesian government can provide law enforcement agencies with the necessary tools to effectively address and mitigate the prevalence of child grooming, ensuring the protection and well-being of the nation's youth.

Abstract

Indonesia is a country rich in natural resources, yet it continues to face various complex environmental problems. Environmental degradation is not only caused by natural factors but also by irresponsible human actions. In legal terms, environmental protection is regulated under several laws, including Law Number 32 of 2009. However, victims of environmental crimes often do not receive optimal legal protection. The Indonesian criminal justice system remains offender-oriented, placing greater emphasis on the rights of perpetrators rather than victims. As a result, victims' rights are often neglected during legal proceedings. This research aims to examine the existing regulations regarding legal protection for victims in Indonesia and to propose efforts for optimizing such protection, particularly in the context of environmental crimes. The research uses a normative juridical method with a statutory and literature approach. The results of this study are expected to contribute to the improvement of a legal system that is more victim-oriented, especially in environmental crime cases.

Abstract

Penelitian ini membahas pertanggungjawaban pidana atas pelanggaran lalu lintas yang dilakukan dengan kendaraan milik orang lain dalam sistem Electronic Traffic Law Enforcement (E-TLE). Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Sistem E-TLE merupakan digitalisasi penegakan hukum lalu lintas berbasis kamera pengawas. Namun, sistem ini belum mampu mengidentifikasi pelaku pelanggaran secara langsung, sehingga pemilik kendaraan sering dijatuhi sanksi meskipun bukan pelaku sebenarnya. Permasalahan ini menimbulkan konflik dengan asas hukum pidana geen straf zonder schuld (tiada pidana tanpa kesalahan), yang mengharuskan adanya kesalahan individu untuk pemidanaan. Berdasarkan analisis, penerapan sanksi kepada pemilik kendaraan tanpa bukti kesalahan pribadi menyalahi prinsip keadilan dan kepastian hukum. Dalam RKUHP, pemidanaan diarahkan untuk perlindungan masyarakat dan pembinaan pelaku, bukan penghukuman terhadap pihak yang tidak bersalah. Kesimpulannya, sistem E-TLE perlu disempurnakan melalui verifikasi pelaku yang lebih akurat dan mekanisme keberatan yang adil. Penegakan hukum berbasis teknologi harus tetap berlandaskan pada asas keadilan, agar tujuan pemidanaan dalam pembaruan hukum pidana dapat tercapai secara substantif dan tidak menimbulkan ketidakadilan baru.

Abstract

This study analyzes the procedures for designating a justice collaborator within Indonesia’s criminal justice system, using the case of *Sang District Court Decision No. 79/Pid.B/2024* involving convict Muhammad Ramdanu as a case study. The justice collaborator mechanism serves as a critical instrument to overcome evidentiary challenges in prosecuting organized crimes, particularly when conventional evidence is insufficient. The research employs a normative-juridical approach with qualitative analysis of legal frameworks, including Supreme Court Circular Letter (SEMA) No. 4 of 2011, Law No. 31 of 2014, LPSK Regulation No. 2 of 2020 (Witness and Victim Protection Agency), and Satjipto Rahardjo’s progressive legal theory. The findings reveal that the designation process for a justice collaborator involves a written application, verification of formal and material requirements, review by the LPSK, and recommendations for protective measures. Muhammad Ramdanu was deemed eligible as a justice collaborator due to his role as a non-principal perpetrator in the murders of Tuti Suhartini and Amalia Mustika Ratu, his significant informational contributions to uncovering the mastermind (Yosep Hidayah), and credible threats to his safety. This designation aligns with progressive legal principles that emphasize legal flexibility to achieve substantive justice. Implications include reduced sentencing and physical protection for justice collaborators. However, the study identifies regulatory gaps requiring clarification of "non-principal perpetrator" criteria and improved mitigation of retaliation risks. The findings recommend holistic policy integration between legal instruments and enforcement practices to ensure the efficacy of the justice collaborator mechanism without compromising fair trial principles and human rights.

Abstract

This article comprehensively analyzes the Indonesian Constitution as a crucial foundation and solid bulwark for strengthening Environmental Criminal Law. Given the alarming global ecological crisis, characterized by massive deforestation, uncontrolled pollution, biodiversity loss, and excessive resource exploitation, reforming the criminal law framework to be adaptive, responsive, and progressive is urgent. This research firmly argues that the Constitution isn't just a general, declarative legal umbrella; it intrinsically embodies fundamental constitutional values and principles. These include every citizen's right to a good and healthy environment and the state's obligation to protect it, which must be actively interpreted, internalized, and expanded into all norms and practices of Environmental Criminal Law enforcement. Using a normative-juridical approach focused on analyzing legal texts, doctrines, and court decisions, this article systematically examines how in-depth constitutional interpretation and creative elaboration of principles can catalyze stronger, more comprehensive, and ecologically just environmental criminal regulations. The discussion identifies and critically analyzes structural and substantive weaknesses in current environmental criminal law enforcement, such as evidentiary challenges, weak sanctions, and limited scope of legal subjects. Furthermore, this article explores the Constitution's potential to legitimize overcoming these obstacles. This includes strengthening criminal sanctions for proportional deterrence, expanding the definition of environmental crimes to encompass new and complex ecological offenses, and enhancing more effective corporate accountability mechanisms. Ultimately, this article affirms that reforming and developing Environmental Criminal Law, firmly rooted in constitutional values and principles, is an absolute prerequisite for building a holistic and sustainable environmental protection system. This step is essential in preventing further ecological degradation, restoring the balance of nature, and effectively guaranteeing environmental rights for current and future generations.

Abstract

The purpose of this study is to determine the role of the prosecutor against recidivist child offenders in Decision Number 23/Pid.Sus-Anak/2024/PN Smg. The research method uses an empirical and sociological juridical approach that examines the effectiveness of the application of law through analysis of regulations, social values, and the practice of handling children's cases. The results of the study explain that the role of prosecutors in the juvenile criminal justice system against recidivist child offenders in the Semarang District Attorney's Office is very important and takes place thoroughly from the investigation stage to prosecution. Prosecutors not only carry out the prosecution function, but also actively examine the completeness of case files, evaluate the results of the litmas from Bapas, and consider psychological, social factors, and the potential for child recidivism. Prosecution is carried out proportionally with a restorative and rehabilitative justice approach, paying attention to the principle of the best interest of the child, and applying disparity in charges between recidivist and non-recidivist child offenders. Obstacles in the form of time constraints and lack of family support are challenges, but case resolution is still pursued quickly, fairly, and in favor of the protection and social recovery of children. These findings indicate the urgency of improving the handling of recidivist child offenders, which requires a more comprehensive and adaptive update of the SPPA Law, as well as the issuance of prosecutor regulations as official guidelines based on restorative justice and the principle of the best interests of the child.

Abstract

Sistem Peradilan pidana di Indonesia sendiri telah banyak mengalami banyak perkembangan dalam beberapa dekade terakhir salah satunya ialah muncul konsep Restorative Justice. Lembaga kejaksaan republik Indonesia sebagai bagian dari sistem peradilan pidana telah menerapkan konsep Restorative Justice secara berjenjang sebagai penyelesaian tindak pidana di luar persidangan hal ini dapat dilihat dengan dikeluarkannya Perja No 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif. Penelitian ini mengkaji tentang Efektivitas dari penerapan restorative justice secara berjenjang di kejaksaan. Penelitian ini memakai metode penelitian Yuridis Normatif dengan mengkaji peraturan dan norma hukum yang berlaku sebagai dasarnya. Hasil dari penelitian ini ialah penerapan restorative justice secara berjenjang di kejaksaan dapat dikatakan berjalan secara baik jika dikaji di dalam Dimensi Hukum dan Dimensi sosial.
