Abstract

This research effort to search the contents president power restriction in achieving constitutional governmant in Indonesia. The restriction power of president related to restriction of president authority. In other sides restriction of president power can be viewed thorought functional relation among president with House of representative council (DPR), representative people assembly (MPR), Local Representative Council (DPD), and functional relation among president with Supreme of court (MA) and Constitutional Court  (MK).The result of research shown that the restriction content of president power can be viewed not only restriction the time of president’s office but also restriction of content presiden authority, i.e restriction to choose state officers and restriction in law making. And restriction of content president power can be viewed in functional president relation with legislative and constitutive  institutions.

Abstract

Norma kegentingan yang memaksa dapat digunakan sebagai dasar penetapan keadaan darurat berdasarkan ketentuan Pasal 22 UUD 1945, yaitu dasar untuk membuat peraturan perundang-undangan (extraordinary rules), dan bukan untuk melakukan tindakan darurat (extraordinary measures) yang dinamakan Peraturan Pemerintah sebagai Pengganti Undang-Undang atau lazimnya disebut Perpu. Unsur penting yang membentuk pengertian keadaan bahaya yang menimbulkan kegentingan yang memaksa, yaitu: (1) unsur ancaman yang membahayakan (dangerous threat);(2), unsur kebutuhan hukum yang mengharuskan (reasonable necessity); dan, (3), unsur keterbatasan waktu (limited time). Ketentuan Pasal 22 UUD 1945 lebih menekankan aspek-aspek kegentingan yang memaksa, yaitu unsur reasonable necessity dan limited time serta tidak menekankan sifat ancaman bahaya (dangerous threat).

Abstract

The principle of legality is the most fundamental principle in the administration of government, including in the administration of village governance. All mechanisms of governance and policymaking must be based on and aligned with the relevant laws and regulations. In the current implementation of village governance, numerous legal violations still occur, such as abuse of authority, corruption, and other misconducts, all of which stem from the failure to uphold the principle of legality. Therefore, it is deemed necessary to conduct legal education aimed at enhancing the understanding of village government officials regarding the importance of comprehending and applying the principle of legality in village governance. This is essential to ensure that the implementation of governance and any policies made do not lead to legal problems. The methods used in this legal outreach include lectures, discussions, and legal consultations. This study concludes that village government officials have not yet fully understood the principle of legality. Through this legal education, it is expected that they will gain a clearer understanding of the concept and be able to implement it effectively in the administration of village governance.

Abstract

Penelitian ini bertujuan untuk melakukan komparasi kewenangan Presiden Indonesia dan Amerika Serikat dalam Pembentukan Undang-undang. Penelitian ini dilaksanakan dengan mengaplikasikan metode penelitian hukum normatif, dengan menggunakan pendekatan PerUndang-undangan, konseptual, dan perbandingan. Dari hasil penelitian menunjukkan bahwa terdapat perbedaan kewenangan yang dimiliki antara Presiden Indonesia dan Amerika Serikat dalam Pembentukan Undang-undang. Kewenangan yang dimiliki oleh Presiden Indonesia dalam pembentukan Undang-undang sangatlah luas karena diberikan kewenangan oleh UUD 1945 untuk dapat mengajukan, membahas serta mengesahkan Rancangan Undang-undang, sementara Presiden Amerika serikat hanya diberikan kewenangan oleh Undang-undang Amerika serikat berupa hak Veto. Akan tetapi Presiden Amerika serikat juga tetap bisa mengajukan Rancangan Undang-undang kepada Senate atau House of Representative melalui konsep Eksecutive Communications serta dapat ikut memberikan kritik dan masukan terhadap Rancangan Undang-undang yang dibahas melalui konsep Public Hearings. Meskipun Rancangan Undang-undang tersebut menjadi milik Senate atau House of Representative akan tetapi hal tersebut merupakan bentuk pemisahan kewenangan yang tegas antara eksekutif dan legislatif di Amerika serikat.

Abstract

This study critically examines the mechanism of appointing the Acting Governor of Nusa Tenggara Barat (NTB), focusing on its alignment with the principles of a democratic legal state. Utilizing a normative legal research methodology, the study employs legislative and conceptual approaches, drawing from primary and secondary legal materials. The analysis incorporates descriptive analytical, prescriptive, and argumentative data analysis techniques. Findings reveal that the current mechanism, governed by the Ministry of Home Affairs Regulation No. 4 of 2023, mandates adherence to democratic legal state principles. However, it faces significant challenges in ensuring optimal public participation and safeguarding human rights (HAM). Although the process involves multiple stakeholders, including optional non-ministerial government agencies, the final decision remains centrally with the president. This centralistic tendency undermines direct public participation in political decision-making, a core tenet of democracy. Additionally, the mechanism lacks clear legal procedures for termination, posing a risk of violating HAM principles and affecting the legitimacy and continuity of the appointed official. The study recommends enhancing public and representative body involvement to better reflect democratic participation principles. It also suggests regulatory changes to mandate broader stakeholder involvement and establish clear termination mechanisms, thereby improving transparency, accountability, and legal certainty while upholding human rights protection. These improvements are crucial for bolstering the mechanism's democratic legitimacy and efficacy in NTB's governance.Highlights Centralized Authority: The president's ultimate decision-making power limits public involvement.
