Abstract

Land disputes are one of the problems that are not easily solved and must be resolved carefully. High inheritance is the common property of a people who have blood ties and are inherited through generations from their earlier ancestors. Buying and selling according to customary law is exchange and is called cash or cash. The problem of ulayat land (high heirloom) can not be traded based on West Sumatra Regulation No. 6 of 2008 concerning ulayat land and its utilization. This study examines what is included in the scope arrangement according to sentence no. 11/Pdt.G/2015/PN. BSK, what factors are the cause of the dispute of high heirloom land and how the settlement of high heirloom land disputes sold is determined by the Batusangkar District Court Data collection techniques using primary data, namely observation and secondary data that is obtained from legislation, books, scientific works related to this research, legal dictionaries, official documents and regulations.

Abstract

supervising public policies, particularly in the context of preventing corruption in village funds. Village funds are a source of development financing that are vulnerable to misuse if not monitored transparently and participatively. Mothers, as part of an active community element that is close to the social dynamics of the village, have great potential to encourage accountability and openness in the management of village funds. This research uses a qualitative approach with in-depth interviews, participatory observation, and documentation studies. The results show that the involvement of women in village deliberation forums, budget socialization activities, and monitoring of physical projects contributes significantly to reducing the potential for corruption practices. Additionally, their role in building collective awareness and having the courage to voice alleged irregularities is an important asset in shaping an anti-corruption culture at the village level. However, challenges remain, such as limited access to information, budget literacy capacity, and resistance from certain individuals. Therefore, capacity building and institutional support are key to strengthening the role of women as public oversight agents at the village level.

Abstract

Fenomena meningkatnya perkara cerai gugat di Indonesia menunjukkan adanya perubahan pola relasi dalam rumah tangga serta meningkatnya kesadaran hukum perempuan dalam memperjuangkan hak-haknya melalui jalur peradilan. Kabupaten Deli Serdang, khususnya wilayah hukum Pengadilan Agama Lubuk Pakam, menjadi salah satu daerah dengan jumlah perkara cerai gugat yang terus mengalami peningkatan sehingga memerlukan kajian hukum yang lebih komprehensif. Penelitian ini bertujuan untuk menganalisis faktor-faktor penyebab meningkatnya kasus cerai gugat, mengidentifikasi dampak sosial dan hukum yang ditimbulkan terhadap keluarga dan masyarakat, serta memberikan rekomendasi dalam upaya pencegahan perceraian. Penelitian menggunakan pendekatan yuridis normatif yang dipadukan dengan pendekatan empiris melalui studi kepustakaan, observasi, wawancara dengan hakim, panitera, advokat, serta pihak penggugat. Data dianalisis secara kualitatif dengan mengintegrasikan ketentuan peraturan perundang-undangan dan fakta empiris di lapangan. Hasil penelitian menunjukkan bahwa perselisihan dan pertengkaran yang berlangsung terus-menerus merupakan faktor dominan penyebab cerai gugat, diikuti oleh kekerasan dalam rumah tangga, faktor ekonomi, dan perselingkuhan. Tingginya angka cerai gugat juga menunjukkan adanya perubahan paradigma perempuan dalam memperoleh perlindungan hukum melalui lembaga peradilan. Dampak yang ditimbulkan tidak hanya memengaruhi pasangan suami istri, tetapi juga perkembangan psikologis anak, ketahanan keluarga, serta meningkatnya beban perkara di Pengadilan Agama. Penelitian ini memberikan kontribusi berupa analisis yuridis mengenai hubungan antara faktor sosial dan implementasi hukum keluarga Islam sebagai dasar penyusunan kebijakan preventif melalui penguatan mediasi, edukasi pranikah, dan perlindungan hukum terhadap perempuan dan anak.

Abstract

Penelitian ini bertujuan untuk menganalisis penetapan asal usul anak sah dan anak tidak sah berdasarkan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dengan studi kasus Putusan Pengadilan Agama Medan Nomor 408/Pdt.P/2024. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus, melalui kajian terhadap peraturan perundang-undangan serta putusan pengadilan yang relevan. Hasil penelitian menunjukkan bahwa Majelis Hakim Pengadilan Agama Medan menetapkan status anak dengan mendasarkan pada keabsahan perkawinan menurut hukum Islam, meskipun perkawinan tersebut belum dicatatkan secara administratif pada saat kelahiran anak. Berdasarkan Pasal 42 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan juncto Pasal 99 dan Pasal 103 Kompilasi Hukum Islam, anak yang lahir dari perkawinan tersebut ditetapkan sebagai anak sah. Penelitian ini menyimpulkan bahwa putusan tersebut mencerminkan penerapan asas kepentingan terbaik bagi anak serta memberikan kepastian hukum dan perlindungan terhadap hak-hak anak dalam konteks perkawinan yang tidak tercatat.

Abstract

The case of PT Asuransi Jiwasraya (Persero) represents one of the largest financial scandals in the history of state-owned enterprises in Indonesia, illustrating the weak implementation of Good Corporate Governance (GCG) principles. The Board of Directors, as the governing organ of the company, plays a central role in corporate management and is required to perform its duties in accordance with the principles of transparency, accountability, responsibility, independence, and fairness. This study aims to analyze violations of GCG principles committed by the Board of Directors of PT Asuransi Jiwasraya (Persero) and their legal implications from a corporate law perspective. The research method employed is normative legal research using statutory and case approaches. The findings indicate that the Board of Directors of PT Asuransi Jiwasraya (Persero) committed serious violations of GCG principles through imprudent investment management, abuse of authority, and disregard for the prudential principle, resulting in substantial losses to the state. Therefore, law enforcement against the Board of Directors is essential as a form of protection for shareholder interests and public trust in state-owned enterprises.

Abstract

The dynamics of employment in the modern retail sector often pit operational efficiency against the protection of workers' normative rights, creating structural vulnerabilities for outsourcing labor. This study conducts a realistic comparative examination of rights fulfillment between outsourcing workers and permanent workers at Indomaret Fresh Medan, focusing on the gaps between state regulations and corporate implementation. The legal framework includes Law No. 13 of 2003 on Manpower, Law No. 11 of 2020 on Job Creation (later revised and re- enacted as Law No. 6 of 2023 on Job Creation), and Government Regulation No. 35 of 2021. The research employs an empirical juridical method with a descriptive qualitative approach. Primary data were obtained through participatory observation and in-depth interviews with respondents at the Indomaret Fresh Rajawali Simpang Gatot Subroto unit. The findings reveal significant disparities in treatment, with rights fulfillment for permanent workers being more adequate compared to outsourcing workers, who remain far below legal compliance standards. Key findings indicate systematic violations of Articles 93 and 85 of the Manpower Law, where neither category receives fixed allowances (meal and transportation benefits), alongside prevalent unpaid overtime practices averaging 4 to 5 hours per day. Additionally, the uncertainty of employment relations due to fixed-term contracts for outsourcing workers contributes to high turnover rates and work demotivation. The study concludes that corporate efficiency policies have overlooked distributive justice principles, necessitating interventions through periodic audit-based labor supervision and internal corporate policy reforms to ensure equitable legal certainty
