Abstract

The development of the times affects life in society which is marked by increasing crime in society. There are criminals who repeat crimes after the perpetrator is released from his criminal sentence or are known to be recidivists. The research method used is qualitative research, using an empirical legal approach which examines law which is conceptualized as real behavior, as an unwritten social phenomenon, which is experienced by everyone in social life.Research Methods In this research, the author used several research methods to complete this thesis. The first method used is the normative juridical method. Normative juridical is a legal research method carried out by examining library materials or mere secondary materials. The results of research into factors causing recidivism of motorbike theft in the jurisdiction of the Pelabuhan Ratu Police, Sukabumi Regency, namely educational factors, opportunity factors, lack of skills factors, and law enforcement factors. The recidivist modus operandi of motorbike theft in the jurisdiction of the Pelabuhan Ratu Police, Sukabumi Regency is in the form of using a T-lock, pushing the motorbike and hiding it in another place. Efforts to deal with recidivist motorbike theft in the jurisdiction of the Pelabuhan Ratu Police, Sukabumi Regency in the form of repressive and preventive efforts.

Abstract

The study aims to analyze the judgment of a judge against the perpetrators of the violation of the sale of alcoholic beverages in Sukabumi City due to the abundance of the distribution of alcoholics and violations of the prohibition laws on alcoholic drinks. The method used in the research is the normative jurisprudence of the data used in this research is primary data in the form of court rulings and secondary data contained in legislative regulations, books and journals. The results of the research showed that a quick-check justice system was used to prosecute perpetrators of violations of the sale of alcoholic beverages. The judge takes into account legal certainty, justice, and profit when making a decision, but such a decision cannot have a criminal effect on the offender.

Abstract

The development of globalization has led to increased movement of people, goods, and services between countries, making it easier to cross borders for various human activities such as trade, tourism, and industry. While this has positive effects, it also brings negative consequences, such as the emergence of issues related to the legal or illegal movement of people, often accompanied by offenses and crimes, which are commonly referred to as immigration violations. The high number of foreign nationals overstaying their residence permits highlights the need for effective law enforcement to reduce such violations. Law enforcement efforts can be pursued through monitoring and enforcement measures as outlined in the Immigration Act No. 6 of 2011. This study employs empirical juridical research with a qualitative approach, utilizing data collection methods such as literature reviews, interviews, and observations. The study concludes that immigration law enforcement against foreign nationals who overstay their visas is not sufficiently effective, due to factors such as limited human resources in immigration offices and a lack of reports from the local community. To address this, immigration authorities should conduct outreach to educate the public on how to report suspicious activities involving foreign nationals.

Abstract

Ketersediaan tenaga medis psikiatri yang memenuhi standar ideal merupakan komponen penting dalam mewujudkan pelayanan kesehatan mental yang berkualitas, aman dan terjangkau. Namun, permasalahan nasional terkait kelangkaan tenaga medis psikiatri menjadi faktor penghambat utama dalam mewujudkan tingkat kesehatan mental tertinggi, termasuk di Kota Sukabumi yang masih menghadapi keterbatasan ketersediaan psikiater di tengah meningkatnya prevalensi gangguan kesehatan mental. Penelitian ini dilakukan dengan tujuan untuk menganalisis bagaimana peran dan tanggung jawab hukum Dinas Kesehatan Kota Sukabumi dalam memenuhi kebutuhan ketersediaan SDM kesehatan yaitu psikiater berdasarkan peraturan perundang-undangan. Pendekatan yang digunakan dalam penelitian adalah pendekatan hukum normatif empiris dengan metode kualitatif. Data yang diperoleh adalah hasil wawancara dengan kepala SDM kesehatan dan kepala pelayanan kesehatan Dinas Kesehatan Kota Sukabumi, sedangkan data sekunder diperoleh melalui studi literatur peraturan perundang-undangan, buku, jurnal dan artikel ilmiah. Hasil penelitian menunjukkan bahwa ketersediaan psikiater di Kota Sukabumi masih kurang dari standar ideal yang ditetapkan dan Dinas Kesehatan merupakan bagian dari perangkat daerah yang memiliki hubungan hukum fungsional dengan fasilitas kesehatan sehingga hanya berperan dan bertanggung jawab atas fungsi perencanaan,  pembinaan dan pengawasan, evaluasi secara umum.
