Abstract

Abstract: This study wants to answer two problems: first, the limit where the husband’s rights treat his nuzuz wife; and second, the provision of criminal sanction for the husband who goes beyond the limit of such rights. This research uses the normative research approach. Hopefully, through this approach it can be seen the limit of the husband’s rights in threatening his nuzuz wife and the criminal sanction for the husband who goes beyond the limit of such rights. The result of the research concludes that Islam gives the boundary to the husband’s rights toward his nuzuz wife: first, the persuasive right and physical sanction through the media of mentoring. The next step is through ‘bed separation’ and then physical sanction in the way of beating that does not hurt and injure; second, the right not to give the maintenance; and third is a divorce right. The husband’s action in implementing his rights that exceeds the limit of physical sanctions such as physical violence to hurt, injure, and harm, or psychological violence such as intimidation that causes severe trauma, according to KUHP and Undang-Undang no. 24 tahun 2004, can be subject to criminal sanction. Abstrak: Studi ini ingin menjawab dua permasalahan. Pertama, Sampai di mana batasan hak-hak suami dalam memperlakukan istri yang nusyuz. Kedua, bagaimana ketentuan sanksi pidana bagi suami yang melampaui batas-batas haknya tersebut. Penelitian ini menggunakan pendekatan (teori) normatif research. Diharapkan melalui pendekatan ini dapat diketahui batasan hak-hak suami dalam memperlakukan istri yang nusyuz dan sanksi pidana bagi suami yang melampaui batas-batas haknya. Hasil penelitian menyimpulkan bahwa Islam memberi batasan hak suami pada istri yang sedang nusyuz; pertama, hak persuasif dan sanksi fisik melalui tahapan pemberian nasehat, lalu tahap berikutnya melalui pisah ranjang, lalu kemudian sanksi fisik melalui cara memukul yang tidak sampai menyakiti bahkan mencederai atau melukai,  yang bersifat mendidik dan memberi pelajaran. Kedua, hak tidak memberi nafkah, dan ketiga hak talak. Tindakan suami dalam menggunakan hak sanksi fisik yang melebihi batas seperti adanya kekerasan fisik yang menyakiti, melukai atau mencederai, atau kekerasan psikis seperti intimidasi yang menimbulkan trauma berat, menurut KUHP dan UU No. 23 Tahun 2004, tindakan suami tersebut dapat dikenai sanksi pidana.  Kata Kunci: Hak suami, nusyuz, dan sanksi pidana

Abstract

Abstract: This study focuses to answer the two fundamental questions. First, how is the legal reasoning method used by Hazarin in classifying heirs? and how is the contribution of Hazarin in the Islamic law renewal in Indonesia? This study uses a legal reasoning approach of Islamic law. Through this approach, it can be seen the methodology of legal reasoning used by Hazairin. The study concludes that the legal reasoning method which is used by Hazarin in classifying heirs: first, there is a tendency to use the principles of the legal maxim. They are the bayani and ta’lili method; second, the contributionn of Hazairin’s methodology of the legal reasoning in grouping heirs to the Islamic law is his attempt to uplift the grandson from the lineage of women as heirs who are entitled to participate in the division of inheritance through the institution of substitute heirs. It is according to some Muslim scholars is called zawu al-arham and they do not distinguish about the shape brother.Abstrak: Penelitian ini difokuskan untuk menjawab dua pertanyaan mendasar. Pertama, bagaimana metode penalaran hukum yang digunakan oleh Hazarin dalam mengklasifikasikan ahli waris? dan bagaimana kontribusi Hazarin dalam pembaruan hukum Islam di Indonesia? Penelitian ini menggunakan pendekatan pertimbangan hukum dari hukum Islam. Melalui pendekatan ini, dapat dilihat metodologi penalaran hukum yang digunakan oleh Hazairin. Studi ini menyimpulkan bahwa metode penalaran hukum yang digunakan oleh Hazarin dalam mengklasifikasikan ahli waris: pertama, ada kecenderungan untuk menggunakan prinsip-prinsip ushul fiqh. Ada penggunaan metode bayani dan metode talili; kedua, kontribusi Hazairin dalam metodologi penalaran hukum, yaitu pengelompokan ahli waris dalam hukum Islam dengan upaya untuk mengangkat cucu dari garis keturunan perempuan sebagai ahli waris yang berhak untuk berpartisipasi dalam pembagian waris melalui lembaga ahli waris pengganti. Abstract

Abstract: This article discusses M. Natsir’s and Abdurrahman Wahid’s thought about the relationship between Islam and state. Both of M. Natsir and Abdurrahman Wahid agree that the most realistic system to be applied in Indonesia is a democratic system. They also agree that there is no a rigid political system in Islam as it has existed today. In addition, Islam provides the basic principles of the nation and state namely deliberation, justice, equality, freedom, and togetherness. The fundamental difference between M. Natsir’s  and Gus Dur’s thought in viewing the relationship between Islam and state is  about the two things: first, their respond to secularism, which tries to separate between religion and state; and second, their political thought in addressing democracy and the Pancasila ideology as the fundamental principles of Indonesia.Keywords: Islam, state, M. Abstract

Abstract: This article discusses about the essence of the meaning of jihad and its actualization in a modern life. Basically, jihad has two meanings; First, the notion of the propagation of Islam in a polite, tolerant, peaceful way, and away from coercion and violence. Second, the notion of war. Jihad in the first sense to be applied anytime and anywhere, while the second one should only be applied in a very constrained condition because of the definite threat of the enemy. The main purpose of jihad is al-amr bi al-ma'ruf wa al-nahy an al-munkar. Therefore, in today?s modern context, jihad could be interpreted in a more macro and holistic sense, so that any forms of al-amr bi al-ma'ruf wa al-nahy an al-munkar like an attempt to increase the level of education of Muslims, an attempt to increase the welfare of the Muslims weather economically, politically, and culturally. All are included in a category of jihad in Islam, and they are more important than a physical jihad with a war, due to the current context, jihad with those meanings are the most needed by Muslims.Keywords: Actualization, Jihad, modern age

Abstract

Penelitian ini mengungkap tentang kinerja ámil di lembaga zakat Nahdhatul Ulama dan Muhammadiyah di wilayah Surabaya dengan menggunakan metode evaluasi tingkat kinerja, suatu alat pengukur kinerja yang tenar pada abad modern. Signifikansi penelitian ini terletak pada indikator penilai dan melihat kompetensi amil sebagai ujung tombak pengelolaan zakat. Penilaian kinerja ini diperlukan, sebab keberadaan amil dituntut memiliki kompetensi khusus sesuai regulasi. Secara matematis, penelitian ini betujuan untuk mengetahui tingkat kinerja suatu lembaga sehingga data yang terkumpul akan dibandingkan dengan kriteria atau standar tertentu dan peneliti ingin mengetahui tingkat ketercapaian kinerja suatu lembaga. Setelah dilakukan penelitian dengan menggunakn metode kualitatif yang didekati dengan pendekatan evaluasi maka berhasil diungkap temuan yaitu tingkat kinerja dari kedua lembaga amil zakat, LAZISNU Surabaya dan LAZISMU Surabaya adalah sebagai berikut: tingkat kinerja LAZISNU ialah nilai tertinggi dicapai pada kinerja kepatuhan syariah, legalitas dan kelembagaan kemudian kinerja keuangan. Sementara itu, kinerja terendah terdapat pada kinerja program pendayagunaan. Secara keseluruhan, nilai yang di peroleh adalah 5,2 atau BBB+, sedangkan tingkat kinerja LAZISMU ialah diketahui bahwa nilai tertinggi dicapai pada kinerja keuangan kemudian kinerja kepatuhan syariah, legalitas, dan kelembagaan. Sementara itu, kinerja terendah terdapat pada kinerja legitimasi sosial. Secara keseluruhan, nilai yang di peroleh adalah 5,52 atau A-

Abstract

This research aims to reveal how important the position of the state is in managing zakat funds. Little research has been conducted on the repositioning of the state after the state established a representative amil body. The recognition of individual amil was made legal in the Constitutional Court decision in 2012, in addition to the National Amil Zakat Agency as a representation of state amil, private institutions, and individual amil. However, the intervention of state amil is eroding in reality and experiencing a crisis of trust in the community. This reality is worrying, considering that state amil is very urgent and is wajibat al-manziliyah in the management of zakat. Therefore, by using a library research approach (literature research) and emphasizing gronder theory-based content analysis, this research produces important findings, namely first, in the responsibility of Sultan al-ijtimaiyah, the state has full authority to ensure justice in the management of zakat. Second, the state is positioned as ahlu al-halli wa al-'aqdi to make policies and provide sanctions with the intention of management (collection, management, and distribution) of zakat running optimally, and third, the state has mainstreaming in the management of zakat, as an authority that has policies, decisions and rule makers.

Abstract

This research aims to map the waqf asset management strategy at al-Khaibar waqf institution in Malang City. After mapping, it is analysed using the community-based management method. The selection of this method is based on the strategy pattern used by the institution by maximising the community, both managers, markets and partners. We know that until 2024 waqf assets are 2,171,041,349.74 M2 and only 23% are managed. Of the 23%, 71% are mosques, schools and cemeteries, waqf assets have not been able to be managed productively. Therefore, this research seeks to offer a solution to waqf asset management strategies in Malang City. This research is qualitative-descriptive. Data sources were obtained from interviews, and documentation to al-Khaibar waqf institution and BWI Malang City. The research findings show that: the steps of waqf asset development strategy management: 1) finding problems and problem identification; 2) Problem analysis is comprehensive ranging from material content, significance and risk; 3) action planning (class action) with three patterns; programme, risk and risk mitigation; 4) implementation of the term, which consists of short, medium and long term; 5) implementation of programmes at all levels; 6) evaluation is informal and formal. Second, the impacts are: 1) availability of business capital along with business facilities; 2) provision of business goods with qard al-hasan bi al-bay' contract; 3) productive work partners, making all MSMEs as business partners either as distributors, marketing, suppliers or volunteers.

Abstract

Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence is the state's effort to provide legal protection for women victims of sexual violence. However, along the way, several articles were found that were counter-productive, which were allegedly the entry point for the rise in cases of sexual violence occurring amidst strict legal regulations. Departing from this, this article attempts to provide a study regarding the existence of counter-productive articles, ideal deconstruction and policy direction for law enforcement related to these articles. The results of this research are: (1) it was found that several articles were counter-productive because they were considered to be overcriminalization, had the wrong object, were not followed up with implementing regulations, and determined the sentence incorrectly because it was contrary to the principles of punishment; (2) deconstruction of counter-productive articles can be carried out through revision of the normative formulation of these articles and the formulation of more comprehensive implementing provisions; and (3) Law Number 12 of 2022 is directed as the ultimate legal instrument in enforcing the law on criminal acts of sexual violence through preventive and repressive regulations.
