Abstract

Penyelesaian sengketa internasional merupakan hal yang kompleks dan menantang dalam dunia bisnis global. Arbitrasi internasional telah menjadi alternatif yang populer untuk menyelesaikan sengketa antara perusahaan multinasional dan negara-negara. Penelitian ini menganalisis penggunaan arbitrase internasional sebagai mekanisme penyelesaian sengketa internasional dengan fokus pada dua kasus yang menarik, yaitu Pertamina vs Karaha Bodas Company (KBC) dan PT Newmont Nusa Tenggara. Kasus Pertamina vs Karaha Bodas Company melibatkan konflik dalam perjanjian produksi gas di Indonesia. Sementara itu, kasus PT Newmont Nusa Tenggara melibatkan sengketa antara perusahaan tambang asal Amerika Serikat dengan pemerintah Indonesia terkait perjanjian investasi. Melalui pendekatan kualitatif, penelitian ini menggali proses arbitrase internasional dalam menyelesaikan dua kasus tersebut. Hasil analisis menunjukkan bahwa arbitrase internasional memberikan keuntungan dalam penyelesaian sengketa internasional, seperti netralitas, kepercayaan, dan efisiensi. Namun, juga terdapat tantangan seperti biaya yang tinggi dan kekurangan transparansi. Perkembangan hukum internasional dan praktek arbitrase internasional yang terus berkembang menjadi kunci bagi keberhasilan mekanisme ini. Penelitian ini memberikan wawasan tentang pentingnya arbitrase internasional sebagai alternatif penyelesaian sengketa internasional. Implikasi temuan ini dapat digunakan oleh perusahaan multinasional dan pemerintah dalam merancang perjanjian dan mengelola sengketa internasional dengan lebih efektif. Selain itu, penelitian ini juga memberikan kontribusi untuk pemahaman lebih lanjut tentang penggunaan arbitrase internasional dalam konteks kasus-kasus tertentu di Indonesia.

Abstract

Corruption has become increasingly pervasive in society, necessitating solutions to combat it. One such solution involves the collaboration of witnesses, known as Justice Collaborators. This study aims to determine the criminal liability of Justice Collaborators involved in corruption crimes. This study adopts a normative juridical method, which involves examining library materials comprising primary, secondary, and tertiary legal sources. The data for this study is derived from literature, existing research, as well as relevant laws and regulations. The findings indicate that Justice Collaborators can be held criminally liable by applying the concept of strict liability, as they fulfill the elements of a criminal offense, namely actus reus and mens rea. However, it is important to note that even though a Justice Collaborator may be convicted, they are still entitled to their rights and may be granted leniency.

Abstract

Pelayanan publik telah menjadi isu kebijakan yang penting karena dampaknya yang terbatas terhadap transformasi masyarakat. Artikel ini mengeksplorasi berbagai layanan publik yang diselenggarakan oleh pemerintah Indonesia berdasarkan Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik, serta standar dan prinsip yang mengatur layanan tersebut. Pasal 20 dari undang-undang tersebut menetapkan standar yang harus dipenuhi oleh pemerintah dalam memberikan layanan publik. Standar ini merupakan pedoman yang mengikat untuk memastikan pelayanan yang efektif, efisien, dan berkualitas kepada masyarakat. Dengan demikian, pemerintah ditekan untuk memastikan bahwa pelayanan publik yang disediakan tidak hanya memenuhi kebutuhan dasar, tetapi juga berkontribusi pada peningkatan kesejahteraan masyarakat secara keseluruhan. Penelitian yang dilakukan merupakan penelitian hukum normatif yang mengandalkan data sekunder untuk mengatasi permasalahan tersebut. Temuan penelitian menunjukkan bahwa pelayanan publik dapat dibedakan menjadi dua jenis, yaitu pelayanan barang publik dan pelayanan administrasi yang diatur dalam Pasal 5 Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik. Standar pelayanan yang diamanatkan oleh pemerintah dapat ditemukan pada paragraf pertama Pasal 20 UU yang sama. Arahan ini memaksa pemerintah untuk memberikan pelayanan publik yang luas untuk meningkatkan kesejahteraan masyarakat Indonesia.

Abstract

The conflict between Russia and Ukraine has adversely affected global stability and triggered crises. Indonesia took the initiative to facilitate the peace mission. This study aims to analyze the concept and application of soft power strategies in Indonesia’s diplomacy related to the peace mission in the Russia-Ukraine Conflict. A qualitative explanatory method is used to explain the reasons underlying this move. Data collection was conducted through a literature study, while data analysis used a qualitative approach. Soft Power Theory was used as a theoretical framework to understand how Indonesia uses its power of attraction in diplomacy, while the First Track Diplomacy Concept became the foundation to understand the government’s direct role in resolving conflicts. The results showed that Indonesia used the first line diplomacy instrument as part of its peace mission in the conflict between Russia and Ukraine. This is realized through the use of dialogue, negotiation, and cooperation efforts made by both countries. This is in line with Indonesia’s Soft Power goals which seek to improve security in the external environment through the projection of an image as a peaceful and attractive country.  KEYWORDS Conflict; Indonesian Diplomacy; Russia-Ukraine; Soft Power

Abstract

This research discusses corporate criminal liability in Indonesia regarding corporate crime perpetrators in positive law. The economic interdependence between nations has increased the need for legal rules related to international trade and business. Corporate crimes have significant negative impacts on society and the environment. This research aims to analyze how corporate criminal liability is established based on positive laws in Indonesia regarding corporate crime perpetrators. This research employs a normative juridical approach, utilizing literature studies encompassing various sources such as books, online media, dissertations, and other relevant literature. The discussion encompasses the concept of corporate accountability in criminal acts and debates about who can be held accountable, the corporate entity or its executives. The results of this research serve as a basis for evaluating and improving the existing legal framework and contribute to developing more effective policies in addressing corporate crimes in Indonesia. The regulations regarding criminal liability for corporate crime perpetrators in Indonesia currently lack clear provisions and are scattered across multiple legislations. Therefore, a new Criminal Code should be promptly enacted to avoid legal loopholes in enforcing corporate criminal acts.

Abstract

General elections in Indonesia have undergone a significant transformation through the adoption of information technology and digitalization. This transformation not only accelerates the voting process, but also has a major impact on the legal regulations governing elections. In this context, the Political Law of Digitalization Policy plays an important role in shaping an effective regulatory framework, especially in dispute prevention. The application of technology in elections should not leave behind some people who are not familiar with digital devices. Therefore, regulations should detail measures to ensure that every citizen has a fair and equal opportunity to participate in the electoral process. Regulations should provide a clear framework for handling complaints, checking discrepancies, and ensuring that election results are acceptable to all parties. Through the adoption of information technology and digitization, it reinforces the political urgency of the policy law. This study aims to determine the contribution of the Election Digitalization Policy in reducing risks and handling potential disputes in general elections. The method used in this research is normative juridical. The results show that the Political Law of Digitalization Policy has a central role in shaping regulations that support modern, inclusive, and dispute-free elections in the digital era. Through this approach, it is expected that Indonesia can move towards more efficient and trustworthy elections. The implementation of election digitization has an impact on increasing transparency and public trust, efficiency and accuracy, accurate data recording, simplifying the electoral process, preventing fraud, and reducing the burden on the Constitutional Court.

Abstract

Sea transportation documents, especially bills of lading, play an important role in regulating the rights and oblig ations of the parties involved. A bill of lading is not only a proof of delivery, but also serves as a contractual instrument, proof of ownership, and a basis for dispute resolution. In addition to bills of lading, there is also a letter of indemnity document which has become a growing issue in the world of sea transportation. This document is used as a guarantee by the shipper to the carrier to replace the bill of lading in certain situations, such as speeding up the delivery of goods or resolving administrative issues more efficiently. However, the use of letters of indemnity also poses various legal challenges and risks that need to be considered by all parties involved. This research aims to analyze the position of the issuance of a letter of indemnity without the submission of a bill of lading and evaluate the Indonesian legal perspective on the practice in sea transportation. The research method used is normative juridical, with reference to legal literature and related legal documents. The results show that the issuance of a letter of indemnity without the submission of a bill of lading can lead to various significant problems, especially related to legal uncertainty. This uncertainty includes aspects of the ownership rights of the goods, the responsibility of the carrier, and the potential for misuse of documents that can harm all parties involved.

Abstract

The change of the ordinary offense to a complaint offense in Copyright Law Number 28 of 2014 has significant legal implications and emphasizes the importance of adjusting the law to protect copyright. This change reflects the need to adapt the law to current realities and demonstrates a commitment to international standards and the interests of copyright holders. However, effective enforcement of these changes faces challenges in identifying and dealing with copyright infringement, which requires collaborative efforts and continuous legal updates. This research aims to analyze the legal implications and urgency of the change from ordinary offense to complaint offense related to Copyright Law (UUHC) Number 28 of 2014.  The results show that treating copyright infringement as a complaint offense (klach delict) can lead to difficulties in law enforcement and an increase in copyright infringement in Indonesia. This is because the authorities cannot take direct action unless there is a complaint first from the injured party, as a result it can have a negative impact on the creative industry and make creators less motivated. This can have a negative impact on the creative industry and make creators less motivated to create original works. In addition, the consequence could be a decrease in tax revenue received by the government.

Abstract

Human Resource Development (HRD) is a key element in enhancing the competitiveness and productivity of an organization or country. Education and training play a central role in this process, as they not only equip individuals with the necessary knowledge and skills but also aid in personal and professional development. This study aims to analyze the basic concepts and definitions of HRD, as well as its vital role in achieving organizational goals. This research is a library research study that seeks to explore and analyze various literature sources related to the concept of Human Resources (HR) and its development within the organizational context. The findings also reveal that well-designed training programs, tailored to the specific needs of both the organization and the individual, are more likely to enhance performance and productivity.

Abstract

Illegal mining, better known as illegal mining, is a complex multidimensional problem. This study uses a phenomenological lens to explore the deep meaning of the experiences of illegal mining actors in the Merangin Regency, Jambi. The findings of this study consistently show that severe economic pressures, combined with limited access to education and job opportunities, are the main drivers of community involvement in illegal mining activities. Informants explicitly stated that they knew their actions' legal and environmental implications but felt trapped in a difficult situation. By adopting a quantum physics lens, this study emphasizes that individuals, like subatomic particles, are often in a state of superposition between various choices, trapped in moral and economic dilemmas. This approach offers an innovative analytical framework for understanding the complexity of contemporary social problems. To overcome this problem, comprehensive efforts involve expanding economic opportunities, developing community capacity, and enforcing fair and community-friendly laws. Overall, this study highlights the importance of understanding the social and economic contexts that underlie community involvement in illegal mining activities. By adopting an interdisciplinary approach combining qualitative methods and quantum physics concepts, this study significantly contributes to developing more effective policies and intervention programs in addressing this problem.
