Abstract

Human rights must be implemented by the rules of community life, where each community group has its view and application of the freedom of human rights. The enforcement of human rights for LGBT people with Islamic law in Aceh is opposed by the international community because it is considered a violation of human rights. So the urgency of this research is to find out how far a person's understanding of human rights freedom is and what is the foundation on which they base human rights to exercise. After that, it will be concluded whether religious values continue to dominate society in acting. This study uses a descriptive-analytical method with a normative juridical approach, where the data and information to be collected both in terms of assessment and in terms of management is carried out interdisciplinary and multidisciplinary as well as cross-sectoral. The data and information are then analyzed in-depth normative juridical so that an overview of human rights in Indonesia is obtained. The results show that the concept of human rights applied in Indonesia uses the concept of cultural relativity and will not be relevant if it uses the concept of human rights in western countries which emphasize individual freedom.

Abstract

Traditional medicine is a method of treatment or care using traditional procedures. Both rely on knowledge, experience and skills passed down from generation to generation based on local community traditions (custom). The aim of this research is to analyze consumer protection towards traditional medical practices in the city of Surakarta. This research employs empirical legal research method. The results of this research explain consumer protection in the Consumer Protection Act lies in consumer rights which must be fulfilled in the practice of traditional medicine. Apart from that, a clinical practice permit and drug distribution permit from BPOM must be in place. If there is negligence in the implementation of traditional medicine, civil legal action is taken through a lawsuit for unlawful acts or a lawsuit for default and penal legal action through a police report for alleged malpractice. Actions in the form of health services for traditional medicine must prioritize consumer protection in terms of the competence of therapists or doctors, practice permits, production permits and product distribution issued by BPOM and the Indonesian Health Service which aims to maintain patient security and safety.

Abstract

Health Promotion is a process to empower the society through activities to inform, influence and assist the society to play an active role to support behavioral and enviromental changes and maintain and improve health towards optimal health status. The purpose of this study was to analyze the awareness of the implementation of PKRS based on Permenkes No. 44 of 2018 at Hj. Fatimah Sulhan PKU Muhammadiyah Demak Hospital. This research uses empirical research. The results of this study explain that hospitals in the implementation of PKRS based on Permenkes No. 44/2018 focus on 2 aspects, namely PKRS management and fulfillment of PKRS standards. In the preperation carried out, hospitals must consider the rules of the PKRS guidelines that have been regulated in the regulations. These regulations must not contradict but ini making internal rules, hospitals can add according to the technical needs of PKRS. The hospital has adjusted the PKRS guidelines and work program with the guidelines regulated by Permenkes No. 44/2018

Abstract

Indonesia ratified the Convention on the Rights of Persons with Disabilities (CRPD) and enacted Laws that provide for the right to justice and legal protection for persons with mental disabilities, including the right to own and inherit a legacy. Paradoxically, the same laws legalize actions that undermine their rights. This study examines the legal protection accorded to persons with mental/intellectual disabilities over their inheritance rights as per the Indonesian three-pronged inheritance laws comprising Islamic law, adat law and the civil code. This research is descriptive, using a normative approach with a measure of doctrinal research. Indonesian laws still provide for substituted decision-making for persons with mental disabilities, which legalizes denying their right to legal agency. Ambiguities abound in the laws on important aspects, like how one is declared incapable of making legal decisions. Supported decision-making mechanisms for persons with mental disabilities in Indonesian laws would provide the basis for setting up support centers where persons with mental disabilities can access the necessary support to enable them to make legal decisions. This study can be useful in addressing issues that infringe on the legal rights and protections of people with mental disabilities.

Abstract

Abstrak: Dalam memberikan pelayanan bantuan hukum harus didasarkan prinsip kesamaan di mata hukum. Bantuan hukum sesuai dengan Undang-Undang Nomor 16 Tahun 2011 tentang Bantuan Hukum merumuskan tentang peran paralegal, paralegal diartikan secara legitimasi yuridis dalam tatanan hukum nasional yang tercantum dalam Pasal 9 dan Pasal 10 Undang-undang Nomor 16 Tahun 2011 tentang Bantuan Hukum. Kegiatan pelatihan paralegal dilakukan untuk mengatasi permasalahan sedikitnya jumlah advokat bersertifikat di Kabupaten Ngawi. Dengan adanya pelatihan paralegal, diharapkan dapat meningkatkan jumlah individu yang memiliki pengetahuan dan keterampilan hukum untuk memberikan bantuan hukum yang memadai kepada masyarakat. Pelaksanaan kegiatan berupa pelatihan dan pendampingan paralegal dengan teknik pemberian informasi atau penyuluhan hak hukum masyarakat tentang cara penyelesaian kasus tindak pidana kekerasan seksual. Waktu kegiatan akan dilaksanakan pada tanggal 14-15 Januari 2023 dan dihadiri oleh 50 peserta, termasuk Pimpinan Cabang Nasyiatul Aisyiyah Se-Kabupaten Ngawi dan perwakilan mahasiswa dari kampus di Kabupaten Ngawi dan Karesidenan Madiun. Pemateri kegiatan ini diisi oleh tim pengabdian, dosen Fakultas Ilmu Hukum Univesitas Muhammadiyah Surakarta (UMS) dan anggota Lembaga Perlindungan Saksi dan Korban (LPSK). Hasil dari kegiatan pelatihan paralegal ini menunjukkan bahwa 62,5% peserta memahami konsep dan materi umum tentang keparalegalan serta aspek di dalamnya sehingga peserta dinilai sudah siap dan mampu memberikan pelayanan hukum serta menumbuhkan kesadaran Hukum kepada masyarakat.Abstract: In providing legal aid services must be based on the principle of equality in the eyes of the law. Legal aid in accordance with Law Number 16 of 2011 concerning Legal Aid formulates the role of paralegals, paralegals are defined legitimately juridically in the national legal order listed in Article 9 and Article 10 of Law Number 16 of 2011 concerning Legal Aid. Paralegal training activities are conducted to overcome the problem of the small number of certified advocates in Ngawi Regency. With the paralegal training, it is expected to increase the number of individuals who have legal knowledge and skills to provide adequate legal assistance to the community. The implementation of activities in the form of paralegal training and mentoring with the technique of providing information or counselling on the legal rights of the community on how to resolve cases of sexual violence. The activity will be held on 14-15 January 2023 and attended by 50 participants, including Nasyiatul Aisyiyah Branch Leaders throughout Ngawi Regency and student representatives from campuses in Ngawi Regency and Madiun Karesidenan. The speakers for this activity were the service team, lecturers from the Faculty of Law, Universitas Muhammadiyah Surakarta (UMS) and members of the Witness and Victim Protection Agency (LPSK). The results of this paralegal training activity showed that 62.5% of participants understood the concept and general material about paralegals and the aspects in it so that participants were considered ready and able to provide legal services and foster legal awareness to the community.
