Abstract

Artikel ini merupakan hasil penelitian yang mengkaji dualisme kewenangan antara peradilan umum dan peradilan agama dalam penyelesaian  sengketa  perekonomian  syariah  pasca  berlakunya Undang-Undang Nomor 3 Tahun 2006 dan UU Nomor 21 Tahun 2008. Bahkan ketika UU N omor 21tahun 2008 tersebut di ajukan Judicial Review ke Mahkamah Konstitusi dan telah berkekuatan hukum tetap dengan Nomor 93/PUU-X/2012 dalam putusan tersebut telah dinyatakan bahwa Penjelasan Pasal 55 (2) tersebut tidak memiliki kekuatan hukum mengikat. Sehingga choice of forum untuk menyelesaikan sengketa kewenangan mengadili ekonomi syariah tetap menjadi kewenangan absolut pengadilan agama. Kendati demikian sampai pada pertengahan 2016  masih saja tetap ada orang yang menyerahkan sengketa ekonomi syariah pada pengadilan negeri. Penelitian ini akan mencari tahu mengenai factor-faktor yang mempengaruhi kecenderungan masyarakat yang memiliki sengketa ekonomi syariah dalam memilih pengadilan yang akan menyelesaikan sengketa tersebut. Penelitian yang digunakan bersifat kualitiatif dengan pendekatan yuridis empiris. Penelitian ini menggunakan metode studi kasus dengan purposive sampling yaitu penanganan kasus sengketa ekonomi syariah yang ada di Pengadilan Negeri dan Pengadilan Agama Surakarta dan Sukoharjo, dengan jumlah responden sebanyak 40 orang terdiri dari para narasumber yang bersinggungan langsung dengan perkara ekonomi syariah seperti: hakim, baik hakim poengadilan negeri dan hakim pengadilan agama, para pihak yang bersengketa dalam kasus ekonomi syariah maupun pihak perbakan syariah. Dari responden diatas data yang valid dan dapat dijadikan sebagai sumber data ada 37 responden sedangkan 3 responden dinyatakan tidak dapat diproses karena tidak lengkapnya jawaban tersebut. Dari hasil penelitian didapat identifikasi kecenderungan masyarakat dalam penyelesaian perkara sengketa ekonomi syariah setelah berlakunya UU No. 3 Tahun 2006 dan analisis efektifitas penerapan Undang-undang tersebut. Pembahasan hasil penelitian dihasilkan simpulan yaitu Pengadilan Agama lebih berhak menyelesaikan kasus sengketa ekonomi syariah, meskipun Pengadilan Negeri masih diperbolehkan menyelesaikannya melalui hukum acara perdata. Namun karena masalah ekonomi syariah memerlukan kemampuan syariah atau hukum Islam yang cukup kuat untuk menyelesaikannya, maka Pengadilan Agama akan lebih tepat untuk mengadilinya. Sementara itu  dari Hasil Wawancara terhadap 37 responden, dapat disimpulkan bahwa lebih banyak yang mempercayai Pengadilan Agama daripada Pengadilan Negeri untuk menyelesaikan sengketa ekonomi syariah karena Faktor Lingkungan, Faktor Agama, dan faktor ekonomis.

Abstract

This study aims to analyze sharia fintech on the implementation of investing in technology-based lending and borrowing services. How is the sharia fintech mechanism for the acceptance of potential investors as lenders in the company by applying the principle of recognizing customers as regulated by the Financial Services Authority Regulation, the principle of recognizing customers that is applied in sharia fintech is the same as other financial service providers who do not run their services with the help of digital technology. The process, which is easy, fast and only through communication means, requires sharia fintech to apply the principle of prudence in accepting customers, including identifying potential investors who will buy investment products. This aims to prevent all kinds of financial crimes that could be committed by investors. Abstrak: Penelitian ini bertujuan untuk menganalisa fintech syariah terhadap pelaksanaan berinvestor dalam layanan pinjam meminjam uang berbasis teknologi. Bagaimana mekanisme fintech syariah terhadap penerimaan calon investor sebagai pendana dalam perusahaannya dengan menerapkan prinsip mengenali nasabah yang diatur Peraturan Otoritas Jasa Keuangan, prinsip mengenali nasabah yang diterapkan dalam fintech syariah sama terhadap penyedia jasa keuangan lainnya yang tidak menjalankan pealayanannya dengan bantuan teknologi digital. Prosesnya yang mudah, cepat dan hanya melalui alat komunikasi, mewajibkan fintech syariah menerapkan prinsip kehati-hatian dalam menerima nasabah termasuk juga mengenali calon investor yang akan membeli produk investasi. Hal ini bertujuan untuk menghindarkan segala macam kejahatan keuangan yang bisa saja dilakukan oleh investor.

Abstract

Purpose of the study :Describe the comparison of Online Prostitution Law in Indonesia and Egypt Methodology :Research methodology is qualilative approach with normative legal research. Therefore, in this study, it is preferable to secondary data collected by literature studies. Data that has been processed for further qualitative analysis Results:The results of this study found that the comparison of the two countries has similarities, namely the lack of legislation on online prostitution and the existence of a police specialty that investigates cases of prostitution in Egypt namely "Good Moral Police" while in Indonesia there is such police available. Novelty/ Originality of this study:The novelty value of this study is the comparison of the law with the specificity of the police who are in the case of prostitution in Egypt.

Abstract

The presence of bitcoin invites many uncertainties, such as concerning its legality and the statement that bitcoin is not an official currency in Indonesia. Objective: This research aims to analyze the bitcoins in the perspective of the Islamic Law. Method: This research uses the literature review method. The literary materials obtained are in the form of scientific papers, online media, books, etc. that concerns the analyzed object. Findings: The circulation of bitcoin in Indonesia as a medium of exchange cannot be regarded as a currency, as it does not fulfill the terms and conditions for something to be called money. The bitcoin’s function does not commensurate with the function of money in the concept of the Islamic economy, as it tends to be a traded commodity rather than a facility of transactional exchange. In the perspective of Islamic law, the speculative use of bitcoins may bring one to the risk of violating the law on gharar (uncertainty, hazard); dharar (a transaction that may bring loss to a party); and qimar (game of chance). No authority guarantees bitcoins, and this causes harm. In conclusion, bitcoins produce more harm than good. Thus, its usage is prohibited by Islamic law. Function: This research provides an explanation of the legality of bitcoins, that may aid the Indonesian society to decide whether or not they can use bitcoins according to the law and th sharia. Novelty: There has not been any researches that study the same topic as that discussed in this article.

Abstract

Law 32 of 2004, regional autonomy, mandates the improvement of community services and regional equity by encouraging community participation. Meanwhile, Law 22 of 2009 on road traffic and transportation mandates the maintenance of traffic infrastructure, particularly The Road Traffic Signaling Devices (APILL) on National Roads, National with Provincial Roads intersection, and National with Regency/City Roads intersection to BPTD–The representative of the Ministry of Transportation. In practice, all maintenances are by Regency/City Transportation Service, including the maintenance of the Traffic Signaling Device (APILL) at National and Provincial Roads intersection with Regency/City Roads. The study aims to evaluate Law 22/2009 and its implementing regulations. Besides, This study also attempts to determine the implementation of Traffic Signaling Devices (APILL), including its procurement and maintenance. The research method was legal research. It involved investigating related regulations to the problem under study. The study concludes the maintenance implementation of traffic signaling devices (APILL) is the best fit for the Regency/City Transportation Service. In addition, it is necessary to revise the governing rules for maintaining traffic infrastructure, the traffic signaling devices (APILL).

Abstract

Abstract: Humans are social creatures, namely creatures that require interaction with other humans. Interaction between humans is not only communication but involves all aspects of life, including the legal aspect. Based on law number 36 of 2014 concerning health workers, it is anyone who devotes himself to the health sector and has knowledge and/or skills through education in the health sector which for certain types requires the authority to carry out health efforts. The purpose of this study was to determine the level of compliance of medical personnel in the implementation of informed consent. In addition, medical personnel understand the role of informed consent in preventing lawsuits and medical disputes. The research method used is a non-doctrinal research method, namely the questionnaire method, direct interviews with medical personnel, and medical record documents, especially informed consent sheets. Problem formulation: 1. How is the compliance of medical personnel with the implementation of informed consent? 2. What is the role of Informed Consent in Medical Dispute Prevention efforts? 3. What is the concept of implementing informed consent in order to prevent medical disputes? The results of the study: "Medical Personnel Compliance with the Implementation of Informed Consent: Study on Prevention of Lawsuits for Medical Disputes at the Central Surgical Installation of PKU Muhammadiyah Sragen Hospital" is that the compliance of medical personnel in the implementation of informed consent has not been carried out in accordance with the existing SOPs, so the role of informed consent consent has not been maximally implemented by medical personnel. The concept of implementing informed consent must be made clearly in accordance with standard procedures that must be filled in completely by medical personnel working in the central surgical installation of PKU Muhammadiyah Hospital Sragen.Keywords: Medical Personnel, Informed Consent, Lawsuits, Medical Disputes.Abstrak: Manusia merupakan makhluk sosial, yaitu makhluk yang  membutuhkan interaksi dengan manusia lainnya. Interaksi antar manusia tidak hanya komunikasi saja tetapi menyangkut seluruh aspek kehidupan, tidak terkecuali aspek hukum. Berdasarkan undang undang nomor 36 tahun 2014 tentang tenaga kesehatan adalah setiap orang yang mengabdikan diri dalam bidang kesehatan serta memiliki pengetahuan dan/atau keterampilan melalui pendidikan di bidang kesehatan yang untuk jenis tertentu memerlukan kewenangan untuk melakukan upaya kesehatan.Tujuan dari penelitian ini adalah untuk mengetahui tingkat kepatuhan tenaga medis dalam pelaksanaan informed consent. Selain itu juga sebagai pemahaman tenaga medis atas peran dari informed consent dalam upaya pencegahan gugatan hukum dan sengketa medis.Metode penelitian yang digunakan adalah metode penelitian Non-Doktrinal yaitu dengan metode quesioner, wawancara langsung kepada tenaga medis, dan dokumen rekam medis, khususnya lembar informed consent.Perumusan Masalah: 1. Bagaimana Kepatuhan Tenaga Medis Terhadap Pelaksanaan Informed  Consent ? 2. Apa peran Informed Consent dalam upaya Pencegahan Sengketa Medis? 3. Bagaimana konsep tentang pelaksanaan informed consent  dalam  rangka mencegah sengketa medis?Hasil Penelitian : “Kepatuhan Tenaga Medis Terhadap Pelaksanaan Informed Consent : Studi Pencegahan Gugatan Hukum atas Sengketa Medis di Instalasi bedah sentral RSU PKU Muhammadiyah Sragen” adalah bahwa kepatuhan tenaga medis dalam pelaksanaan informed consent, belum dilaksanakan sesuai dengan SOP yang ada, sehingga peran dari informed consent belum maksimal dilaksanakan oleh tenaga medis. Konsep pelaksanaan informed consent harus dibuat secara jelas sesuai dengan standart prosedur yang harus di isi lengkap oleh tenaga medis yang bekerja di Instalasi bedah sentral RSU PKU Muhammadiyah Sragen.Kata Kunci : Tenaga Medis, Informed Consent, Gugatan Hukum, Sengketa Medis.

Abstract

Background: The use of technology in the financial sector greatly supports its productivity. Including the use of Artificial Intelligence or Artificial Intelligence that makes activities in the financial sector faster and more efficient. PT. Bank Central Asia also implemented Artificial Intelligence technology by launching a chatbot feature called VIRA. Although this vira provides various conveniences this feature has a disadvantage of this feature is that the account can be accessed without using a pin, but only with a card number and OTP code. Aim: This research aims to look at the legal protection of the use of VIRA chatbots in BCA customers' banking activities. Method: This research is included in the type of empirical juridical legal research with library research and vira application observation. Findings: The results showed that BCA customers can only access personal data using VIRA. The main facilities of chatbot VIRA are more general information services and promotions for customers. In addition, the account is not automatically logged out, so when the phone is lost others may be able to access the account of the mobile phone owner through VIRA.

Abstract

The phenomenal of forest destruction in Bima NTB is motivated by various factors, including agricultural factors, policy factors and inter-regional timber trade systems, business development and timber trade is carried out in unlawful ways such as falsification of forest product documents, logging and timber management without a permit. The purpose of this study is to find out the general description of illegal logging crimes in Bima, prevention efforts and the model of accountability for business actors involved in illegal logging crimes in Bima. The method used in this research is empirical legal research with a socio-legal approach and a case approach (legal approach). Types and sources of data in the form of primary data and secondary data. The results of this study indicate that the model of responsibility imposed on business actors who carry out illegal logging, transportation and processing of wood, in the form of imprisonment and additional penalties, if unable to pay the tax, it will be replaced with imprisonment. This can be seen in the decision of the Raba Bima District Court with the number: 231/Pid. B/LH/2020/PN RBI dated 17 June 2020 in the first alternative indictment the Raba Bima District Court sentenced the defendant TF for violating the provisions of chapter 88 verse 1 letter a Jo. Chapter 16 of law no. 18 of 2013 concerning the prevention and eradication of forest destruction.

Abstract

The right to control from the state is a right that at the highest level is controlled by the state as an organization of power for all the people. This right gives the state authority as stated in Article 2 paragraph (2) of the UUPA. However, these various regulations and policies at the level of implementation do not harm the principles of the rights of the Indonesian people. The presence of the Job Creation Law which regulates land acquisition for development is considered pragmatic, more oriented towards investment and economic interests so it is considered to ignore the ideals and rights as well as the spirit of agrarian reform that favours the interests of farmers. The right of control of this state builds relations between the state and the nation, namely a kind of customary rights relationship that is raised at the highest level, namely the level that affects the entire territory of the country. The meaning of being controlled by the state contained in Article 33 of the 1945 Constitution is not explicitly formulated in its explanation. This allows the emergence of various interpretations of the meaning of this service trying to socialize land acquisition policies in the context of agrarian reform.
