Abstract

Kebijakan pembangunan keluarga dilakukan melalui pembinaan ketahanan dan kesejahteraan keluarga. Hal ini dilakukan melalui upaya peningkatan kualitas anak dengan berbagai informasi seperti melalui: 1). Akses informasi, 2). Akses pendidikan, 3). Pemberian penyuluhan dan pelayanan (perawatan, pengasuhan dan perkembangan anak). Salah satu usaha intensifikasi dibidang pengasuhan dikenal dengan Sekolah Orang Tua Hebat (SOTH). SOTH ini merupakan sekolah pengasuhan untuk meningkatkan kemampuan orang tua dan sebagai salah satu upaya dalam mencegah stunting pada anak usia dini. Pemerintah Kota Surabaya melalui Ketua TP PKK Kota Surabaya telah membentuk 5 SOTH Bina Keluarga Balita (BKB) percontohan, bekerjasama dengan Universitas Teknologi Surabaya untuk membantu membangun komunikasi antara orang tua dengan anak-anaknya sesuai ilmu dan metode yang benar. Kegiatan SOTH ini dilengkapi dengan kurikulum pendidikan, silabus, pemetaan instruktur, rencana kegiatan pembelajaran, perangkat monitoring, jurnal, absensi peserta, absensi pengelola, buku tamu dan mars SOTH serta evaluasi kegiatan berupa pretest dan posttest. Dengan model pembelajaran yang menciptakan iklim kerjasama yang kolaboratif dan demokratis dalam dimensi mutualis antara dunia perguruan perguruan tinggi dan masyarakat diharapkan tercapainya pembelajaran bagi kepentingan pendidikan serta masyarakat.

Abstract

Presidential Regulation No. 98 of 2021 “Carbon Economic Value” gives the first market-based instrument in the legal politics of Indonesia mitigation of climate change. In relation to this, the regulation hopes to accelerate target emissions. However, it also under climate justice implications in relation to the most vulnerable, specifically Indigenous Peoples (Masyarakat Hukum Adat/MHA). This research aims to dismantle the climate justice within the legal politics of NEK Regulation. This research is based on normative legal research methods where the author employs a statute, a conceptual approach, and a critical approach. This research is concerned with the two pillars of justice: distributive and procedural. The research findings show, first, that the legal politics of NEK distributive justice is to a large degree narrowly defined where the focus is on the ‘money’, ‘distribution’, and ‘rights’, and these ‘rights’ are the corporate permits. Perhaps worse, there are likely neo-disparities in the economic benefit-sharing to the Indigenous Peoples relative to the ecological burden-sharing. Second, in respect to the NEK regulation and procedural justice, particularly around the Free, Prior and Informed Consent (FPIC) concept, procedural justice in its normative assessment sees it as the completion of an administrative ritual. Such representation runs a high risk of becoming tokenism, which co-opts and undermines the real rights of Indigenous Peoples concerning carbon governance. This study finds that the NEK Regulation, as it currently stands, favors the efficiency of markets over justice in a substantive form, which illustrates the need to refocus the legal politics of mitigation on climate justice as a cornerstone.

Abstract

Freedom of expression is a constitutional right of citizens guaranteed within Indonesia’s constitutional system as part of the principles of the rule of law and democracy. However, in practice, this freedom often faces various forms of restrictions that tend to be repressive, including through the criminalization of expression and the practice of political terror. This article aims to critically examine how political terror is used as an instrument of power that results in restrictions on freedom of expression, as well as to assess its compatibility with the principles of constitutional law. This study employs a normative legal methodology using legislative, conceptual, and case-based approaches. The findings of the study indicate that the criminalization of expression whether through regulations open to multiple interpretations or the actions of law enforcement officials has the potential to create a chilling effect that hinders public participation in the democratic sphere. In this context, the politics of terror manifests not only in the form of overt repressive actions but also through legal constructs selectively employed to silence criticism of those in power. This situation highlights a tension between constitutional guarantees and prevailing state practices. Therefore, efforts are needed to reconstruct legal policies that ensure more substantial protection of freedom of expression, as well as to strengthen oversight mechanisms regarding the exercise of state authority so that they align with the principles of constitutional democracy and respect for human rights.
