Abstract

Diversion is a critical mechanism in the juvenile criminal justice system in Indonesia, aimed at protecting the rights of children and preventing the negative impacts of formal criminal proceedings. This normative legal study explores the challenges and potential improvements in implementing diversion for juvenile offenders facing sentences over 7 years. The study utilizes secondary data sources, including the Indonesian Juvenile Criminal Justice System Law (Law No. 11 of 2012), Supreme Court Regulation No. 4 of 2014 on Diversion Guidelines, and relevant literature on restorative justice and child protection. The analysis reveals significant barriers, such as legal limitations, cultural factors, and inconsistencies with international standards like the Beijing Rules. The study concludes with recommendations for revising existing legislation to remove the 7-year sentence limitation, enhancing coordination among legal and rehabilitation institutions, providing restorative justice training for law enforcement, and increasing public awareness of the importance of diversion and child rights protection. These steps are essential for ensuring a more just and effective implementation of diversion in Indonesia.

Abstract

The rise in acts of plagiarism of scientific work occurs due to a lack of awareness and understanding of students and academics about the ethics of scientific writing and the consequences of these actions. This research aims to describe the criteria for acts of plagiarism, legal sanctions for acts of plagiarism, efforts to resolve disputes over violations of acts of plagiarism, and strategies for preventing plagiarism in higher education. Type of normative juridical research with a statutory approach. Primary data sources include statutory regulations such as Regulation of the Minister of National Education of the Republic of Indonesia Number 17 of 2010 concerning Prevention and Management of Plagiarism in Higher Education, and Law of the Republic of Indonesia Number 20 of 2003 concerning the National Education System. Secondary data consists of research journals concerned with the legal issue of plagiarism. The research results show that the act of taking or using someone else's creative work without stating the source appropriately and adequately is considered plagiarism. Acts of plagiarism can be subject to administrative sanctions or criminal sanctions. Administrative sanctions include warnings, written warnings, and cancellation of diplomas, while criminal sanctions include imprisonment for a certain period of time and a fine. If an act of plagiarism has occurred, an attempt can be made to resolve it through mediation, but if it cannot be resolved through mediation, then criminal action can be taken. Efforts to prevent plagiarism of scientific works in higher education are carried out through plagiarism-free statements, open access publication of scientific works, and administrative sanctions.

Abstract

Kejahatan (crime) merupakan tingkah laku yang melanggar hukum dan melanggar norma-norma sosial, sehingga masyarakat menentangnya. Dalam konteks sosial, kejahatan merupakan fenomena sosial yang terjadi pada setiap tempat dan waktu. Penelitian yang digunakan adalah penelitian hukum Empiris (yuridis Empiris/non-doktrinal). Selain berpedoman pada KUHAP juga berpedoman pada Peraturan Kapolri (Perkap) No. 8 tahun 2009 tentang Implementasi Prinsip dan Standar HAM dalam penyelenggaraan tugas Kepolisian Negara Republik Indonesia. Penanggulangan terhadap tindak pidana narkotika yang dilakukan oleh wanita di wilayah hukum Polres Demak, yaitu pertama dengan cara melaksanakan himbauan himbauan (Preemtif), yang kedua dengan langkah langkah pencegahan (Preventif), dan yang ketiga adalah Penegakan Hukum (Represif), yakni melakukan proses penyidikan sampai tuntas sebagai langkah akhir.

Abstract

The Juvenile Criminal Justice System in Indonesia prioritizes an approach that educates and rehabilitates children who are facing the law. Restorative approaches, such as diversion and restorative justice, have become very relevant to achieve these goals. This study aims to examine legal protection for the application of restorative justice in handling juvenile crimes and understand diversion and restorative justice as a mechanism for resolving criminal acts outside the formal criminal justice process. This study uses a non-doctrinal method with qualitative descriptive analysis. The data used is sourced from primary, secondary, and tertiary legal documents. The results of the study show that diversion functions as a transfer of the settlement of children's cases from the formal criminal justice process to a mechanism outside the judiciary. This provides opportunities for children to improve themselves and avoid negative stigma due to formal justice. Meanwhile, restorative justice involves all parties affected by criminal acts with the aim of repairing damaged relationships, recovering losses, and preventing the recurrence of criminal acts. Thus, concluding a restorative approach both through diversion and restorative justice is effective in creating a more humane child penal system. This approach can focus on victim recovery and also provide child rehabilitation to perpetrators of crimes to ensure the sustainability of social recovery.
