Abstract

Criminal law politics is indispensable in tackling crimes under the guise of electronic investment to overcome the rampant crime in the field of information technology. The Criminal Code, Consumer Protection Law has not been able to overcome information technology crimes, then the government issued Law No. 19 of 2016 concerning Electronic Information and Transactions as an anticipatory step against the negative impact of advances in information technology. The cyber world has great crime potential and is very difficult to catch because most of the people present in cyberspace are fictitious. Countermeasures carried out by the government in tackling crimes under the guise of electronic investment are still oriented towards the criminal justice system, by applying the provisions in Law No. 19 of 2016 concerning Electronic Information and Transactions. Countermeasures faced by law enforcement in tackling crimes under the guise of electronic investment include, lack of law enforcement officers savvy with technology, limited facilities and infrastructure, and lack of public investment skills.

Abstract

Abstract Circulation of expired food and beverages is detrimental to the economy and public health. So it is necessary to be aware of choosing and buying the food and drinks they consume. The purpose of this study is to analyze consumer protection in the community from sellers of expired food and beverage products during the Covid-19 period, analyze the weaknesses of sellers in selling expired food and beverages during the Covid-19 period, and analyze the countermeasures for protection against expired food and beverages. covid-19 period And the type of research used is using consumer protection laws. The data collection technique used is library research with secondary legal materials. Analysis of the data used is prescriptive analysis. The research theory used is the theory of consumer protection, which is an effort or policy to prevent selling expired food and beverages. The regulation of civil action to protect consumer rights is used to protect the public from expired food and drinks during the COVID-19 pandemic. The sale of expired food and beverages harms consumers in many aspects of health and economy. regulations governing expired food or beverage products are regulated in legislation number 8 of 1999 concerning consumer protection of the republic of Indonesia. Abstrak Peredaran makanan dan minuman yang sudah kadaluarsa merugikan perekonomian dan kesehatan masyarakat. Sehingga diperlukan kesadaran memilih dan membeli makanan. Tujuan dalam. penelitian ini untuk menganalisa perlindungan konsumen dalam masyarakat dari penjual produk makanan dan minuman kadaluarsa pada saat masa covid-19, menganalisis kelemahan penjual dalam menjual makanan dan minuman kadaluarsa pada saat masa covid-19, dan menganalisis penanggulangan perlindungan makanan dan minuman kadaluarsa saat masa covid -19. Dan Jenis penelitian yang digunakan yakni menggunakan undang-undang perlindungan konsumen . Teknik dalam mengumpulkan data yaitu menggunakan penelitian kepustakaan dan juga menggunakan bahan hukum sekunder. Dalam hal ini analisis data yang kami gunakan yaitu adalah analisis data preskriptif . teori penelitian yang digunakan adalah teori perlindungan konsumen, yaitu suatu upaya atau kebijakan untuk melakukan pencegahan menjual makanan dan minuman kadaluarsa. Pengaturan tindak perdata perlindungan hak konsumen di gunakan untuk melindungi masyarakat dari makanan dan minuman kadaluarsa pada saat pandemi covid-19.penjualan atas makanan dan minuman kadaluarsa merugikan konsumen dalam banyak aspek kesehatan maupun ekonomi. peraturan mengatur tentang produk makanan ataupun minuman kadaluarsa ini di atur di dalam aturan perundangan undangan yakni No 8 tahun 1999 mengenai perlindungan konsumen di Indonesia.

Abstract

ABSTRAK Di sektor pertanahan, tanggung jawab Badan Pertanahan Nasional mencakup memberikan kejelasan dan perlindungan hukum kepada pemilik tanah sehingga mereka dapat dengan mudah menunjukkan kepemilikan mereka atas hak-hak yang kuat seperti sertifikat. Badan Pertanahan Nasional, yang memiliki wewenang untuk menangani masalah ini, harus mengatasi masalah yang muncul dalam kepemilikan sertifikat tanah ini, seperti adanya beberapa sertifikat pada satu bidang tanah. Bagaimana tugas atau tanggung jawab BPN Medan dalam menyelesaikan permasalahan yang berkaitan dengan sertifikat ganda ini merupakan rumusan masalah yang dipaparkan dalam jurnal magang ini. Tujuan jurnal magang ini di buat yaitu untuk menegtahui bagaimana cara BPN kota Medan dalam menangani kasus mengenai sertifikat ganda. Sebagian sumber data yang diperoleh melalui wawancara oleh salah satu karyawan yang bekerja di Kantor Pertanahan Nasional Medan. Temuan-temuan tersebut menunjukkan bahwa rapat koordinasi, gelar perkara, dan proses mediasi - di mana BPN Medan bertindak sebagai mediator - merupakan cara-cara yang digunakan BPN Medan untuk menyelesaikan sengketa sertifikat ganda. Fungsi BPN sebagai mediator adalah untuk menengahi konflik di antara para pihak dalam upaya untuk mencapai kesepakatan. Kata Kunci: Tanggung jawab, Sertifikat ganda, Penerbitan

Abstract

According to Law No. 13 of 2003 on Manpower, fixed-term employment agreements (PKWT) are not applicable in employment relationships. Employers have ignored the highest time limit allowed by Law Number 13 of 2013 on Manpower regarding the working period of fixed-term contracts. In addition, they still have not fulfilled the rights of time workers such as wages, working hours, and labor social security. This violates the human rights of workers, who as Indonesian citizens are protected by the Indonesian Labor Law. One of the obstacles in the implementation of PKWT according to Law No. 13/2003 lies in two factors. First, the rules governing the implementation of non-permanent contracts are not in line with employment needs. Employers cannot recruit employees for something that is not necessary for the continuity of business operations. Most of the types of work required are fixed and belong to the core work of the production process. Thus, in this case, Article 59 of the Labor Law has been violated, as the work prohibited by the statutory provisions on PKWT

Abstract

A doctor's misdiagnosis can cause harm to the patient. Hospitals as health service institutions have legal responsibility for doctors' misdiagnoses. This study aims to analyze the legal responsibility of hospitals for doctors' misdiagnoses of patient illnesses based on Law no. 17 of 2023, analyzes patients' legal efforts against misdiagnosis from a juridical and practical perspective. The research results show that patients can take legal action through administrative, civil and criminal channels. And research shows that hospitals have legal responsibilities for doctors' misdiagnoses, including compensation and restoring the patient's health. Article 193 of Law Number 17 of 2023 concerning health provides a strong legal basis for enforcing hospitals' legal responsibility for doctors' misdiagnoses.

Abstract

The Social Security Organizing Body for Employment is a public program that provides protection for workers to address certain socio-economic risks, and its implementation uses a social insurance mechanism. The purpose of this research is to understand the responsibility of PT Gojek towards Gocar drivers who experience work-related accidents based on Law Number 24 of 2011 concerning the Social Security Organizing Body for Employment. Furthermore, this study aims to examine the mechanism used to file a BPJS Ketenagakerjaan (Social Security for Employment) claim for Gocar drivers who experience work accidents. The research method used in this study is juridical-normative legal research. The data collection method applied in this study involves library research, which includes gathering data from available legal materials in legal literature, regulations, legal journals, books, articles, scholarly opinions, legal cases, jurisprudence, dictionaries, bibliographies, theses, and other materials relevant to the research problem, within the scope of monodisciplinary research. The responsibility of PT Gojek towards Gocar drivers who experience work-related accidents is closely linked to the partnership relationship between Gojek and its drivers, which is not considered an employment relationship due to the absence of the elements of wages and orders.

Abstract

Agreement is one of the most important sources of engagement in civil law. In practice, agreements become the legal basis for parties to regulate mutual rights and obligations. As in credit agreements where credit agreements are one of the most common forms of agreements in banking practices and financing activities in Indonesia. This agreement becomes the legal basis for the relationship between creditors and debtors in the context of providing loan facilities. This article discusses the juridical aspects of credit agreements, starting from the elements of a valid agreement, the principles that underlie it, to the legal consequences that arise in the event of default or unlawful acts by one of the parties. The research was conducted using a normative juridical method that focuses on analyzing laws and regulations, especially the Civil Code and the Banking Law. The results of the study show that credit agreements are not only civilly binding, but also contain potential criminal law consequences in the event of misuse. Therefore, it is important for the parties to understand the contents and legal consequences of the credit agreement thoroughly.

Abstract

Contract service providers are often in a weak position in the implementation of construction service contracts, especially when the main contractor commits a breach of contract, such as through work delays or work that does not meet specifications. Therefore, this study aims to examine the forms of legal protection for contract service providers who suffer losses due to contractor default and examine the legal remedies that can be taken by these service providers. The research method used is a normative juridical approach with qualitative analysis techniques of laws and regulations, legal doctrine, and a case study of the Dolok Sanggul Siborong-borong asphalting project. The results show that legal protection for contract service providers can be carried out preventively through detailed contract agreements, performance guarantees, and business certification. As for repressive protection, protection is provided through efforts to summons, lawsuits for breach of contract, contract termination, and reporting to supervisory institutions. In the context of work delays, service providers can also take litigative and non-litigative routes such as mediation, arbitration, and court. Therefore, it is important for contract service providers to fully understand the contents of the contract and legal procedures to protect their rights fairly and proportionally.

Abstract

the duties and authorities of the Balai harta peninggalan as regulated in law Number 37 of 2004 concerning bankrupty and the civil code are to carry out a settlement of the debtor’s bankrupty assets. The main problem and this research is How the duties and authority of the Balai Harta Peninggalan in carrying out bankrupty astate clearance and what are the obstacles faced when carrying out bankrupty estate clearance?. The method used is the normative juridical-empirical method, where the data and also the information studied in this study are based on laws, books and also based on the results and discussions obtained are where the duties and authority of the Balai harta peninggalan in center in carrying out bankrupty assets are by dividing the proceeds from the sale of bankrupty assets that have been sold and distributed to creditors bassed on the possition of the creditors starting from highest to lowest, and also the obstacles faced in dealing with debtor bankrupty assets.
