Abstract

All typical products regulated the state could be reviewed and tested through legal actions (legal remedies) facilitated by the constitution of the Republic of Indonesia. This mechanism has known as a review action. In addition, the review on the legislation, related to authorization or the right to review it (toetsingsrecht or the right to review) could be consisted of judges and executives and also the legislatives. The authority of judicial review by the constitutional court is a judicial authority of the constitution. The authorization was a result of the third amendment to the Indonesian constitution of 1945. Regarding the developments of the implementation of the judicial authority by the constitutional court, there were increasing trend of judicial reviews year to year. Thus it indicates the number of regulations have problematic issue in term of of quality. Therefore, it is very urgent to critically evaluate the quality of the formulation of laws in order to avoid the cancellation of the law itself through a judicial authority possessed through the constitutional court.

Abstract

Berdasarkan ketentuan UUD 1945 hasil perubahan, disebutkan dengan tegas bahwa negara Indonesia adalah negara hukum. Prinsip negara hukum Indonesia tidak merujuk secara langsung pada dua paham atau aliranberbeda tentang negara hukum, yaitu negara hukum dalam arti rechtsstaat dan negara hukum dalam arti the rule of law. Namun demikian, penerapan prinsip negara hukum Indonesia didasarkan pada unsur-unsur negara hukum secara umum, yaitu adanya upaya perlindungan terhadap hak asasi manusia, adanya pemisahan atau pembagian kekuasaan, adanya pelaksanaan kedaulatan rakyat, adanya penyelenggaraan pemerintahan yang didasarkan pada peraturan perundangundangan yang berlaku dan adanya peradilan administrasi negara. Agar tercapai tujuan negara hukum Indonesiasebagaimana dicita-citakan dalam Pembukaan UUD 1945, maka seluruh unsur dimaksud harus diterapkan secara konsisten.

Abstract

Albeit the absence of standing for ultra petita verdicts, our Constitutional Court has in several rulings issued such verdict. Consequently, citizens’ constitutional rights that initially should be protected by the Court are being deprived of instead. Therefore, the Court shall stop producing ultra petita verdicts until it acquires decent standing.  Walaupun tidak ada payung hukum untuk menaungi pengeluaran putusan ultra petita, beberapa kali Mahkamah Konstitusi memutus secara ultra petita. Sebagai akibatnya, hak-hak konstitusional warganegara yang seyogyanya dilindungi oleh Mahkamah malah dilanggar. Dengan demikian, sudah selayaknya Mahkamah tidak lagi mengeluarkan putusan ultra petita selama dasar hukumnya belum ada.

Abstract

Resolving disputes related to foreign investment is not as straightforward as one might think, as it involves investment disputes that engage two or more legal systems. Therefore, the resolution is not solely determined by the law applicable within the territory of Indonesia, but also takes into account the laws of other countries participating in the convention. When a settlement between the parties cannot be reached, the dispute can be resolved through an arbitration body designated by the parties to facilitate the resolution or through conventional judicial bodies in accordance with their authority as regulated by legislation. Alternative dispute resolution through arbitration will be more efficient and effective as it is achieved through deliberation and consensus or a win-win solution. This research is descriptive in nature, aiming to provide an overview or description of the law on divestment in foreign companies in Indonesia. As a descriptive study, a normative approach is used, focusing on the examination of legal principles, legal systems, vertical and horizontal synchronization of legislation, and legal history. The Bilateral Investment Treaty (BIT) serves as a legal basis that needs to be revised. The initial role of this agreement was to attract investors to enter Indonesia, with the hope of reaching a balanced agreement between the two countries. However, in practice, the BIT has become the foundation relied upon by foreign investors in Indonesia. The recommendation made in this study is that the Government of the Republic of Indonesia, in establishing Bilateral Investment Treaties, must include clear provisions so that the description of the agreement does not overlap with the positive law already established in Indonesia.

Abstract

Otonomi daerah merupakan konsep penting dalam sistem pemerintahan desentralisasi di Indonesia, yang memberikan kewenangan lebih luas kepada pemerintah daerah untuk mengatur dan mengurus urusan pemerintahannya sendiri. Penelitian ini bertujuan untuk menganalisis mekanisme pembentukan peraturan daerah yang responsif oleh DPRD Provinsi Sumatera Utara dalam mendukung pelaksanaan otonomi daerah serta peran DPRD Provinsi Sumatera Utara dalam merumuskan regulasi yang selaras dengan prinsip-prinsip otonomi daerah. Metode penelitian yang digunakan meliputi pendekatan yuridis normatif dengan analisis terhadap peraturan perundang-undangan terkait. Hasil penelitian menunjukkan bahwa proses pembentukan peraturan daerah di DPRD Provinsi Sumatera Utara telah berupaya untuk memenuhi prinsip-prinsip otonomi daerah dengan mengacu pada peraturan perundang-undangan yang dimulai dari tahap perencanaan, penyusunan, pembahasan, penetapan, pengundangan dan penyebarluasan. Namun tidak dapat pula dipungkiri masih terdapat beberapa kendala yang perlu diatasi untuk meningkatkan responsivitas dan efektivitas peraturan daerah dalam mendukung otonomi daerah serta peran DPRD dalam merumuskan Perda yang mendukung otonomi daerah tercermin melalui upaya penyusunan regulasi yang memperhatikan kepentingan masyarakat, dinamika pembangunan daerah, dan semangat kemandirian lokal.

Abstract

Agrarian conflicts in Indonesia, including in North Sumatra, are complex problems that often involve various parties such as the community, government, and companies. This study aims to analyze the role of the Regional People's Representative Council (DPRD) as a mediator in resolving agrarian conflicts in North Sumatra. A qualitative approach with a case study method was used to explore the effectiveness of the DPRD's role, the obstacles faced, and the proposed solutions. Primary data was obtained through interviews with key actors, while secondary data came from legal and policy documents. The results show that although DPRDs have a strategic role in resolving agrarian conflicts, this role is often hampered by a lack of understanding of agrarian law, political influence, and limited access to land data. Therefore, capacity building of DPRDs and agrarian policy reform are key to strengthening their role as effective mediators.

Abstract

Land disputes are one of the crucial problems often faced by people in North Sumatra, especially related to land ownership and utilization which have a direct impact on the welfare of residents. The Regional People's Representative Council (DPRD) of North Sumatra has an important role in accommodating community aspirations related to this issue, both through legislative, budgetary, and supervisory functions. This study aims to analyze how the DPRD of North Sumatra plays a role in resolving land disputes and its impact on improving community welfare. Using a descriptive qualitative approach, data were collected through in-depth interviews with DPRD members, community representatives, and related institutions. The results of the study indicate that the DPRD of North Sumatra plays an active role in facilitating dialogue between residents and the government and other stakeholders. However, there are several challenges faced, such as the complexity of agrarian law and weak coordination between institutions, which need to be addressed to optimize the role of the DPRD in improving community welfare. Recommendations for this study include strengthening the role of the DPRD in advocating for community rights and increasing synergy between the DPRD and related institutions in handling land disputes.

Abstract

Breach of contract is an act that harms the other party in various types of agreements, including loan agreements, leading to both material and immaterial losses for the agreed party. Therefore, this journal will examine the legal aspects of breach of contract in loan agreements through a study of Decision Number 686/Pdt.G/2021/Pn Mdn. The analysis focuses on two main research questions: first, the legal consequences arising from breach of contract in this loan agreement; and second, the basis for the judge's reasoning in issuing Decision Number 686/Pdt.G/2021/Pn Mdn. Using a normative approach, this research analyzes the decision based on relevant legislation and jurisprudence. The research findings are expected to provide a deeper understanding of the legal implications of breach of contract in Indonesian judicial practice, particularly regarding loan disputes, and contribute to an understanding of the judge's reasoning process in similar cases.

Abstract

According to Law No. 13 of 2003 on Manpower, fixed-term employment agreements (PKWT) are not applicable in employment relationships. Employers have ignored the highest time limit allowed by Law Number 13 of 2013 on Manpower regarding the working period of fixed-term contracts. In addition, they still have not fulfilled the rights of time workers such as wages, working hours, and labor social security. This violates the human rights of workers, who as Indonesian citizens are protected by the Indonesian Labor Law. One of the obstacles in the implementation of PKWT according to Law No. 13/2003 lies in two factors. First, the rules governing the implementation of non-permanent contracts are not in line with employment needs. Employers cannot recruit employees for something that is not necessary for the continuity of business operations. Most of the types of work required are fixed and belong to the core work of the production process. Thus, in this case, Article 59 of the Labor Law has been violated, as the work prohibited by the statutory provisions on PKWT

Abstract

This research analyzes the compatibility of Article 8 paragraph (2) of KPU Regulation No. 10 of 2023 with Election Law No. 7 of 2017 regarding women's representation in Indonesian politics. PKPU Article 8 paragraph (2) of KPU Regulation No. 10 of 2023 regulates the calculation method that applies rounding down for numbers below 50, potentially reducing the number of elected female legislative candidates and this research also identifies the challenges and obstacles faced in implementing the 30% quota for women's representation, including the lack of sanctions for political parties that do not meet the quota. This research uses the Library Research method to analyze the compatibility between the provisions in Article 8 paragraph 2 of PKPU No. 10 of 2023 with the principles stipulated in Election Law No. 7 of 2017 related to women's representation as well as the challenges and obstacles faced in the implementation of the quota of women's representation in the legislature after the enactment of PKPU No. 10 of 2023.
