Abstract

Improper management of oil palm plantation waste has the potential to cause environmental pollution and legal violations. Limited awareness and understanding among farmers regarding the legal aspects of waste management remain one of the factors affecting compliance with environmental regulations. This Community Service Program (PkM) aimed to enhance the legal awareness and understanding of oil palm farmers regarding lawful plantation waste management in Nagori Rabuhit, Gunung Maligas District, Simalungun Regency. The program employed an educational and participatory approach through legal counseling, interactive discussions, and question-and-answer sessions. The materials presented covered environmental law regulations, plantation waste management practices, and criminal sanctions for environmental violations. The results indicated an improvement in participants’ understanding of plantation waste types, the impacts of environmental pollution, and legal obligations related to waste management. Furthermore, the program increased farmers’ awareness of implementing responsible and environmentally friendly waste management practices. Legal counseling proved to be an effective preventive measure in supporting environmental protection and the sustainability of smallholder oil palm plantations.

Abstract

Child custody disputes following divorce frequently neglect the fundamental rights and psychological well being of the child, resulting in prolonged legal battles that prioritize parental ego over child welfare. This study aims to extensively analyze the optimization of the mediation process in child custody disputes as a primary and indispensable instrument to realize the legal protection and the best interests of the child. Employing a normative legal research method with statutory, conceptual, and case-based approaches, this study reviews relevant literature, Supreme Court regulations (PERMA No. 1 of 2016), and recent jurisprudential developments. The results indicate that while litigation ends in adversarial win-lose outcomes, mediation provides a collaborative, non-litigation alternative that fosters rational decision-making and sustainable parenting arrangements. Statistical and jurisprudential analysis reveals that successful mediation significantly reduces post-divorce conflict and ensures continuity in child development. This research introduces a novel framework by integrating therapeutic and facilitative mediation models specifically tailored for Indonesian courts, addressing the current gap in mediator competence and psychological intervention. In conclusion, optimizing mediation requires specialized training for mediators in child psychology and a mandatory, structured pre-mediation phase. It is highly recommended that future policies mandate psychological assessment as an integral part of the mediation process to strictly uphold the child's best interests

Abstract

Salah satu bentuk produk hukum daerah yang bersifat pengaturan adalah Peraturan Daerah Kota Binjai Nomor 6 Tahun 2015 tentang Penyelenggaraan Ketertiban Umum dan Ketentraman Masyarakat, beserta Peraturan Wali Kota Binjai Nomor 11 Tahun 2023 tentang Tata Cara Penerapan Sanksi Administrasi terhadap pelanggarannya. Agar produk hukum tersebut diketahui dan dipatuhi oleh masyarakat, sosialisasi menjadi tahap yang tidak dapat diabaikan, dan di titik inilah peran Pemerintah Kota Binjai menjadi krusial. Penelitian ini bertujuan untuk mengetahui peranan Pemerintah Kota Binjai dalam mensosialisasikan produk hukum daerah, mengetahui bentuk implementasi sosialisasinya, serta mengidentifikasi hambatan yang dihadapi dan upaya penanggulangannya. Penelitian menggunakan metode yuridis normatif yang menempatkan norma hukum sebagai objek kajian, dipadukan dengan yuridis empiris melalui data primer di lapangan. Hasil penelitian menunjukkan bahwa peran Pemerintah Kota Binjai tercermin dari keseriusan menyebarluaskan produk hukum daerah melalui Jaringan Dokumen dan Informasi Hukum (JDIH) Kota Binjai. Implementasi sosialisasi dilakukan melalui tiga bentuk utama, yaitu: penyebaran Buku Himpunan Lembaran Daerah dan Himpunan Berita Daerah ke Perangkat Daerah dan Instansi Vertikal; publikasi produk hukum daerah melalui website dan aplikasi JDIH; serta sosialisasi langsung oleh Perangkat Daerah Pemrakarsa kepada seluruh Perangkat Daerah terkait. Hambatan yang ditemukan antara lain rendahnya inisiatif masyarakat untuk mencari informasi hukum daerah dan terbatasnya anggaran yang menyebabkan sosialisasi langsung jarang terlaksana. Upaya mengatasinya dilakukan dengan mensosialisasikan aksesibilitas publik atas produk hukum daerah serta mengalokasikan anggaran khusus agar jangkauan sosialisasi Peraturan Daerah dapat diperluas.

  Abstract                                                                          The background to the problem in this dissertation is related to the practice of identity politics in the 2018 North Sumatra Governor Election with an objective study. The practice of identity politics that can be traced is related to the use of religious and tribal (regional) identities. The 2018 North Sumatra Governor election was attended by two couples, namely Eramas and Djoss. The Eramas couple is Muslim-Muslim while Djoss is Muslim-Christian, as well as in tribal (regional) identity the Eramas couple is identified as a native son while Djoss is perceived as an immigrant even though Sihor Sitorus is from the Batak tribe. Thus, the practice of identity politics in the 2018 North Sumatra Governor Election was analyzed based on the study and approach of Siyasah and Islamic Law. The aim is to find out the background to the emergence of identity politics as well as the views and analysis of Siyasah, Islamic Law, and political parties regarding identity politics. The results of this research are, firstly, the concept of Siyasah can be maximized by Siyasah playing an active role through ta'aruf so that it can minimize the practice of identity politics because ta'aruf leads to understanding and understanding the interests of society while the benefit in the form of the psychological power of goodness is responsibility in the form of unity and eternal and complete unity. Meanwhile, the Islamic Law aspect, emphasizes the ethical-legal concept in the form of the emergence of awareness by all elites and the interest in existing rules that must be obeyed and implemented. Meanwhile, in the political party aspect, more emphasis is placed on cadre education by each party to create militant and enthusiastic cadres. In Siyasah's view, identity politics is a product of siyasah wadh'iyyah which shows failure in carrying out amar ma'ruf or evil in terms of social control in the nation and state.
