Abstract

Ushul fiqh is the foundation of legal knowledge that lies between text and reason. The main focus of this research is to explain how ushul fiqh functions as a method of istinbath to address various new issues that arise in society. This research uses qualitative literature study. Furthermore, the secondary data collected were analyzed using descriptive analysis methods with a contextual approach. This study shows that the epistemology of ushul fiqh remains relevant and adaptive in facing various issues that develop over time due to the combination of revelation (textual) and reason (rational).

Abstract

Bekerja bagi seorang muslim adalah suatu upaya yang sungguh-sungguh, dengan mengerahkan seluruh aset, fikir, dan dzikirnya untuk mengaktualisasikan atau menampakkan arti dirinya sebagai hamba Allah yang harus menundukkan dunia dan menempatkan dirinya sebagai bagian dari masyarakat yang terbaik (khoiro ummah) atau dengan kata lain dapat juga kita katakan bahwa hanya dengan bekerja manusia itu memanusiakan dirinya. Dalam penelitian ini menggunakan metode analisis deskriptif kualitatif yang berusaha menjelaskan tentang bagaimana etos kerja dalam pengembangan ekonomi Islam dan Agama. Dimana semua informasi yang didapatkan berupa penjelasan mengenai hasil dari riset. Teknik pengumpulan informasi menggunakan pendekatan literature riset atau jurnal online serta kajian pustaka yang berkaitan dengan kajian tersebut. Hasil penelitian ini adalah tingginya etos kerja dapat berpengaruh terhadap kemajuan ekonomi Islam. Jika rakyat dalam suatu negara masing-masing berusaha dan bekerja tanpa ada yang bermalas-malasan, maka negara tersebut akan maju dengan ekonomi yang sangat memadai. Tingginya etos kerja juga dapat mengangkat derajat agama Islam dengan tidak mengesampingkan urusan dunia walaupun yang paling utama tentunya adalah urusan akhirat. Keduanya akan sempurna jika dilaksanakan secara bersamaan karena agama Islam juga memberikan pengaruh positif terhadap etos kerja.

Abstract

Prolonged agricultural land pawn practices in indigenous communities often create structural inequalities and recurring disputes due to unclear legal boundaries. This article examines the dynamics of customary land rights (hak ulayat) in agricultural land pawn practices and the resolution of related disputes within the indigenous community of Lebung Jangkar Village. Land is perceived as ancestral heritage with strong social and cultural significance, making pawn practices socially accepted as temporary economic instruments without transferring ownership. However, extended pawn periods and the continuous utilization of pawned land by pawn recipients frequently result in unequal power relations and latent agrarian disputes. Focusing on rice field pawn disputes, this study analyzes the relationship between customary land rights, pawn practices, and dispute resolution through traditional elders (kriye). Using a qualitative normative-empirical approach through interviews, observation, and document analysis, the study finds that dispute resolution through the kriye functions as an effective living law grounded in deliberation, social harmony, and substantive justice, substantively aligning with the Islamic legal principles of ṣulḥ and rahn. Nevertheless, the absence of written documentation and the weak integration of Article 7 of Law Number 56 of 1960 indicate the need for greater normative harmonization to ensure legal certainty and equitable protection for customary landholders.

Abstract

This study examines the practices of ‘iddah and iḥdād as well as the fulfillment of women's rights after divorce through the lens of maṣlaḥat al-Ṭūfī. The research is motivated by a phenomenon in Soki Village, Belo Subdistrict, Bima Regency, where many women perceive ‘iddah merely as a prohibition against remarriage, without understanding the broader Islamic legal provisions governing it; some are entirely unfamiliar with the concepts of ‘iddah and iḥdād. Contributing factors include low levels of education, economic hardship, limited religious knowledge, and social influences. This research is a field study using an empirical or case study approach. Primary data were collected through interviews with local women and religious figures, while secondary sources include the Qur’an, Hadith, the Compilation of Islamic Law (KHI), Law No. 1 of 1974 on Marriage, academic journals, and al-Ṭūfī’s writings on the concept of maṣlaḥat. The findings reveal that the local practice of ‘iddah and iḥdād deviates from Islamic legal norms due to those influencing factors. Women who remarry during the ‘iddah period are considered to have committed acts categorized as mafsadat, which are legally impermissible. However, in cases where such actions stem from ignorance or emergency conditions such as financial pressure or the responsibility to support children these may be understood as forms of maṣlaḥat ḍarūriyyah, aimed at preserving life (ḥifẓ al-nafs), one of the primary objectives of Islamic law (maqāṣid al-sharī‘ah).
