Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana sistem pengelolaan arsip dan cara penyimpanan arsip di Sekretariat Kota Bitung. Jenis penelitian ini menggunakan metode penelitian kualitatif. Teknik pengumpulan datanya adalah observasi, wawancara, dan dokumentasi. Dengan menggunakan indikator Sistem dan Metode. Hasil penelitian menunjukkan bahwa sistem pengelolaan arsip menggunakan sistem yang sederhana, yaitu dengan sistem penanggalan dan penguraian. Hal ini berdampak pada kebingungan dalam proses pengarsipan. Kemudian hasil penelitian juga menunjukkan bahwa cara penyimpanan yang digunakan juga menggunakan cara yang sederhana yaitu dengan buku agenda, pengarsipan di komputer dan di lemari arsip. Hal ini menimbulkan permasalahan korupsi arsip apabila tidak ditangani dengan baik dan dibiarkan menumpuk secara kasar dalam jangka waktu yang lama, serta menyebabkan proses penemuan kembali arsip tersebut akan memakan waktu lama.

Abstract

This study aims to investigate the flexing phenomenon on social media, exploring its position between financial education and ostentatious displays of wealth, with a focus on its implications in criminal law aspects in Indonesia. The research employed a qualitative methodology, utilizing interviews with key stakeholders, focus group discussions, analysis of social media content, and a comprehensive literature review. Additionally, the study incorporated comparative analysis with other Southeast Asian countries to provide regional context. The results reveal a complex interplay of social, legal, and educational factors surrounding the flexing phenomenon. Key findings include: (1) a significant divergence in perceptions of flexing among different stakeholders, with influencers viewing it as inspirational while legal experts express concerns about potential legal scrutiny; (2) the effectiveness of flexing as an educational tool when balancing success stories with practical financial advice; (3) a notable knowledge gap among social media users regarding the legal implications of their online behavior; (4) growing concerns about the use of social media evidence in financial crime investigations; (5) the emergence of "aspirational flexing" among younger users, raising ethical and potential legal issues; and (6) a shift in public perceptions of wealth and success due to constant exposure to luxury displays on social media. The study concludes that while flexing can serve as a powerful educational tool, it also presents significant legal risks and societal challenges that require a balanced approach to address effectively

Abstract

This study examines the regulation of hate speech crimes in elections in Indonesia, focusing on the mechanism of action against such crimes. The type of research used is normative legal research using a legislative approach. The results of the study show that although there are laws and regulations, there is no consensus on what is meant by hate speech in elections, which causes law enforcement to be inconsistent and ineffective. The mechanism for dealing with hate speech includes campaign supervision, public reports, investigations, decision-making, sanctions, and further legal processes. Clarity in hate speech regulations is essential for effective and fair law enforcement.

Abstract

Praktik perkawinan sedarah yang masih terjadi di kalangan masyarakat adat Polahi, Gorontalo, menimbulkan polemik antara pelestarian budaya lokal dan penerapan hukum nasional. Penelitian ini menggunakan pendekatan yuridis normatif dengan analisis terhadap Undang-Undang Nomor 16 Tahun 2019 tentang Perkawinan, serta prinsip-prinsip hak asasi manusia dan kesehatan masyarakat. Ditemukan bahwa praktik tersebut, meskipun mengakar secara kultural, berpotensi melanggar hukum dan menimbulkan risiko medis terhadap keturunan. Kajian ini menekankan pentingnya pendekatan edukatif dan dialogis dalam upaya harmonisasi antara hukum negara dan nilai-nilai adat, dengan tetap memperhatikan perlindungan terhadap hak individu dan kesehatan masyarakat.

Abstract

This research discusses the problems faced in the implementation of interfaith marriages in Indonesia by reviewing the extent to which national legal provisions are in line with or contradict the principles of Human Rights (HAM). The focus of the research is an evaluation of the legal framework governing interfaith marriages and whether the legal arrangements are in accordance with the principles of human rights and how they impact on the fulfillment of everyone's rights. The research method used is normative legal research with a statutory approach and a case approach. Data were collected through a literature study of primary legal materials such as the Marriage Law, Population Administration Law, and international human rights instruments, as well as secondary legal materials such as journals and court decisions. Data analysis was conducted qualitatively to identify gaps between national law and human rights principles. The results show that the provision of Article 2 Paragraph (1) of the Marriage Law that requires religious equality creates discrimination and legal uncertainty for couples of different religions. Although several court decisions have accommodated interfaith marriages, Supreme Court Circular Letter No. 2 of 2023 has tightened the restrictions. This study recommends the revision of the Marriage Law to accommodate a religion-neutral civil registration mechanism, as well as harmonization with international human rights instruments such as the Universal Declaration of Human Rights and the Covenant on Civil and Political Rights.

Abstract

Evidence plays an important role in evidence in the settlement of cases in court proceedings in civil cases. In civil law and litigation, evidence is very important because civil procedural law seeks formal truth only based on the evidence submitted by the parties in litigation in court. With technological advances, it also affects the applicable legal order, one of which is the addition of evidence, namely electronic evidence such as electronic information and electronic documents. The Civil Code even in its acar law book does not clearly regulate this electronic evidence, the regulation of electronic evidence is clearly regulated in the Electronic Information and Transaction Law (ITE). So that there are still many questions about the position and strength of electronic evidence in the settlement of cases in court such as civil cases.

Abstract

Marital rape is a form of sexual violence that remains a controversial issue in Indonesia. The traditional view that considers sexual relations within marriage as a wife's obligation has hampered the recognition and enforcement of marital rape cases. This study aims to analyze the recognition and regulation of marital rape in Indonesian positive law and to identify the main factors that cause these cases. The research method used is normative legal research with a descriptive analytical approach, which focuses on the analysis of relevant laws and legal theories. The results of the study indicate that the regulation of rape in national law still experiences inconsistencies. The old Criminal Code (KUHP) does not recognize marital rape as a crime, while new recognition appears in Law Number 23 of 2004 concerning the Elimination of Domestic Violence (PKDRT Law) and Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (TPKS Law). However, the provisions in the PKDRT Law that make marital rape a complaint-based offense still hinder victims in obtaining justice. The 2023 Criminal Code (KUHP) has included marital rape as a crime, but retains its complaint-based nature, indicating weak legal protection for victims. The main factors contributing to marital rape include power imbalances within the household, the wife's economic dependence on her husband, a patriarchal culture that assumes the husband has absolute rights over his wife's body, and a lack of legal awareness and protection mechanisms for victims.
