Abstract

Beringin Village, Tambelangan District, Sampang Regency, Madura, has a unique proposal tradition called alèngkaè sè tua'an. This tradition requires the younger husband-to-be to propose to the older wife-to-be who is not yet married. From the perspective of 'urf, this practice becomes sahih ‘urf if it is done voluntarily, without burdening the prospective groom, and does not become an absolute requirement for marriage. However, it becomes a fasid ‘urf if it is considered obligatory to prevent the older sister from being labeled as an old maid, burdening the groom, or causing social sanctions such as ridicule. From Lev Vygotsky's sociocultural perspective, alèngkaè sè tua'an is more than a ritual, but a social learning process that shapes identity, strengthens family ties and reflects cultural values. This tradition highlights how social and cultural contexts influence the marriage process and its implications for community norms and family harmony.

Abstract

The concept of nafkah (financial support) in marriage remains a debated issue, particularly in relation to gender equality and the role of women in the modern era. Law No. 1 of 1974 on Marriage stipulates that the husband is obliged to meet household needs according to his ability. However, some feminists propose a mubadalah (reciprocal) approach to nafkah, emphasizing cooperation between husband and wife. This study aims to explore the concept of nafkah in the mubadalah theory introduced by Faqihuddin Abdul Kodir and its relevance to John Rawls' theory of justice. The article is the result of library research employing a qualitative approach. Collected data was analyzed descriptively using deductive reasoning. The findings indicate that the nafkah concept proposed by Faqihuddin Abdul Kodir offers a more just and proportional approach to sharing family responsibilities, grounded in the principle of reciprocity. It highlights the importance of providing space for women to contribute to family income, ensuring that financial responsibilities are not solely borne by the husband but involve harmonious mutual contributions. Consequently, the role of women, through freedom and opportunity, complements family dynamics, fostering balanced, supportive relationships and strengthening family cohesion. This allows both husband and wife equal opportunities for personal growth while maintaining their essential responsibilities within the family.

Abstract

A Limited Liability Company as a business entity that has a major role in improving the economy, must deal with something that it cannot control such as the death of one of the members of the Company. In this case, the law, becomes the last gate that strengthens the establishment of the Company. Positive law is a provision that applies in a country that often deviates from Islamic values. On the other hand, Islamic law is believed to contain better benefits than other laws. Positive and Islamic law have different provisions regarding the legal consequences of a member of a joint stock company dying. The purpose of this article is to analyze the similarities and differences in the provisions of the legal consequences of a Limited Liability Company because one of the members dies in the review of positive and Islamic law. The type of research conducted is a literature study with documentation as the data collection technique and comparative study as the analysis technique. The results of the study show that positive law and Islam according to the jumhur ulama have similarities in the legal consequences of the death of a member of the Limited Liability Company, which considers the Company to end immediately. The difference is that in positive law the company ends if it is agreed at the beginning of its establishment, except for the type of joint stock company. Meanwhile, according to the Maliki school of thought, the Company is not canceled even without an agreement at the beginning.

Abstract

Regional Regulation (Perda) of Surabaya No. 6 of 2011 concerning the Implementation of Child Protection. It contains provisions regarding children and their obligations, the implementation of child protection, and the obligations of parents, families, communities, and local governments towards them including child labor in informal sector work, community, and private sector participation, Child-Friendly City Task Force, prohibition, guidance and supervision as well as administrative, investigative, and criminal sanctions. The implementation of Regional Regulation related to child protection in Surabaya City, by Regulation No. 6 of 2011 is in accordance with maqasid al-shari'ah based on the five main elements which are the objectives of the legal designation, even though in the regional regulation, hifz al-din and hifz al-mal get a smaller portion of the setting and a different degree of clarity than the other three components. Therefore, there must be a balanced aspect of five legal objectives in the regional regulation of child protection to work optimally. Apart from that, there should also be clearer regulations, especially regarding the protection of religion and children's property so as not to create different interpretations from policy implementers and other interested parties.

Abstract

Regulation of Rape in marriage has reaped pros and cons in its implementation because it is considered contrary to religious values ​​that live in society. This paper aims to examine the regulation of rape in marriage in Indonesia and its suitability to the perspective of Abu Zahra's maslahah. The type of research is a literature review (library research) with a qualitative approach. The results of the study show 3 regulations that regulate rape in marriage in Indonesia, namely the PKDRT Law, the TPKS Law, and the Law on the Criminal Code. The 3 laws are relevant to Abu Zahra's maslahah based on 3 indicators, namely: a.) in terms of quality, the presence of this regulation is a form of darar prevention of a marriage that has the concept of mu'asyarah bi al-ma'ruf, b.) in terms of quantity, the benefits generated from this regulation will be felt by most people, especially victims of domestic violence and law enforcers, c.) from a certain period of time, the benefits of this regulation will provide long-term effects, for example as enforcement of human rights and increasing public security.

Abstract

Kementerian Pendidikan dan Kebudayaan mengeluarkan kebijakan baru terkait Merdeka belajar-Kampus Merdeka (MB-KM) yang ditindaklanjuti dengan Keputusan Rektor UIN Sunan Ampel Surabaya No. 729 Tahun 2021 yang menjadikan Peraturan Rektor UIN Sunan Ampel Surabaya No. Un.07/1/PP.00.9/SK/809/P/2016 sebagai salah satu landasan hukumnya. Penelitian ini merupakan penelitian lapangan bertujuan untuk mengetahui implementasi kebijakan kesetaraan dan pengarusutamaan gender UIN Sunan Ampel Surabaya di bidang pendidikan dan pengajaran, faktor pendukung dan penghambat serta dampaknya. Data yang terkumpul kemudian diolah dan dianalisis dengan teknik deskriptif analisis dengan pola pikir deduktif. Hasil penelitian menyimpulkan bahwa Kebijakan kesetaraan dan pengarusutamaan gender telah diimplementasikan dengan beragam cara pada Fakultas Syariah dan Hukum, yaitu dengan membuat mata kuliah gender secara mandiri, memasukkan dalam RPS dan menerapkan metode pembelajaran sensitif gender. Akan tetapi, dalam hal ini, prodi belum melakukan review dan redesain kurikulum berperspektif gender secara berkala dan menguatkan kemitraan dengan berbagai pemangku kepentingan dan lembaga di masyarakat serta tidak secara penuh melaksanakan pengarusutamaan gender pada mata kuliah yang mengintegrasikan komponen pendidikan, penelitian dan pengabdian kepada masyarakat. Terdapat faktor pendukung dan penghambat, baik internal maupun eksternal, beserta dampak positif atas pengimplementasian kebijakan tersebut.

Abstract

Mengingat begitu banyaknya hal yang akan berpengaruh dari dicatatkannya suatu perkawinan, maka tak heran jika pencatatan perkawinan menjadi perhatian bagi masyarakat hingga pemerintah. Pemerintah yang memiliki wewenang dalam membuat suatu peraturan juga turut ikut andil dalam mengefektivitaskan suatu pencatatan perkawinan dalam masyarakat, salah satunya adalah di Indonesia. Di Indonesia sendiri telah diatur tentang bagaimana prosedur pencatatan perkawinan yang telah termuat dalam Peraturan Menteri Agama Nomor 20 Tahun 2019 tentang Pencatatan Pernikahan. Hal ini menjadi bukti bahwa pemerintah Indonesia berusaha untuk menjaga hak-hak konstitusional rakyatnya. Hal serupa juga diterapkan oleh negara tetangganya, yakni Malaysia. Di Malaysia terdapat suatu peraturan yang mengatur tentang prosedur pencatatan perkawinan, yakni dalam Akta Undang-Undang Keluarga Islam (Wilayah-Wilayah Persekutuan) 1984. Hal ini membuktikan bahwa kedua negara tersebut turut memberikan perhatiannya terhadap pentingnya pencatatan sebuah perkawinan. Tujuan dari penelitian ini untuk membandingkan seperti apa prosedur pencatatan perkawinan dari kedua negara tersebut. Metode penelitian yang digunakan oleh peneliti yaitu Library Research atau studi pustaka. Salah satu persamaan dari kedua peraturan tersebut adalah sama-sama menyatakan bahwa pencatatan perkawinan bukan merupakan syarat sah suatu perkawinan, akan tetapi merupakan bentuk legalisasi hukum bagi perkawinan itu sendiri. Selain itu, keduanya juga memiliki perbedaan dalam mendaftarkan kehendak nikah, yang mana di Indonesia dilakukan selambatnya 10 hari sebelum pernikahan, sedangkan di Malaysia 7 hari sebelum pernikahan.

Abstract

Abstract: Marriage in Islam is encouraged, especially for those who are able, but there are some conditions where single parents prefer to be celibate by delaying remarriage, such as single parents in Sawotratap Village. From a fiqh perspective, there are no rules that specifically discuss whether single parents can delay remarriage or not, and there are only general rules about the law of marriage. Therefore, further research is needed to determine why single parents in Sawotratap Village delay remarriage and how maqāṣid al-sharī'ah views the decision. This article is a field research whose data is collected through interviews and documentation. The analysis technique used is descriptive with an inductive thinking pattern. The results show that single parents in Sawotratap Village postpone remarriage for various reasons, such as focusing on caring for children, not being ready to take on household responsibilities again, trauma in undergoing relationships, not being able to move on from previous partners, and being blocked by children's blessings. In fiqh, this decision can be permissible or not, depending on the condition of the single parent. However, the decision is still in accordance with maqāṣid al-sharī'ah, which is to protect religion, soul, mind, offspring, and property. Abstrak: Pernikahan dalam Islam dianjurkan terutama bagi mereka yang mampu, namun ada beberapa kondisi di mana single parent lebih memilih untuk membujang dengan menunda menikah lagi, seperti single parent yang ada di Desa Sawotratap. Dalam perspektif fikih, belum ada aturan yang secara khusus membahas tentang single parent dapat menunda pernikahan lagi atau tidak, hanya ada aturan umum tentang hukum pernikahan. Oleh karena itu, diperlukan penelitian lebih lanjut untuk mengetahui alasan single parent di Desa Sawotratap menunda menikah lagi serta bagaimana pandangan maqāṣid al-sharī’ah terhadap keputusan tersebut. Artikel ini merupakan penelitian lapangan yang datanya dikumpulkan melalui wawancara dan dokumentasi. Teknik analisis yang digunakan adalah deskriptif dengan pola pemikiran induktif. Hasil penelitian menunjukkan bahwa single parent di Desa Sawotratap menunda menikah lagi karena berbagai alasan seperti fokus merawat anak, belum siap untuk mengemban tanggung jawab dalam rumah tangga lagi, adanya trauma dalam menjalani hubungan, belum dapat move on dari pasangan sebelumnya, hingga terhalang restu anak. Dalam fikih, keputusan ini bisa dibolehkan atau tidak tergantung pada kondisi single parent. Meskipun demikian, keputusan tersebut tetap sesuai dengan maqāṣid al-sharī’ah, yaitu menjaga agama, jiwa, akal, keturunan, dan harta.

Abstract

Maraknya judi online sebagai dampak perkembangan teknologi digital telah menimbulkan berbagai persoalan sosial dalam keluarga, termasuk terganggunya pemenuhan hak anak dan hak istri. Fenomena ini juga terjadi di Desa Tenggor Kecamatan Balongpanggang Kabupaten Gresik, di mana praktik judi online berdampak pada keharmonisan rumah tangga, stabilitas ekonomi, dan kondisi psikologis keluarga. Penelitian ini bertujuan untuk menganalisis dampak judi online terhadap pemenuhan hak anak dan hak istri dalam perspektif teori kebutuhan dasar Abraham Maslow dan maqasid al-shari‘ah Jasser Auda. Penelitian ini merupakan penelitian hukum empiris dengan pendekatan socio legal. Hasil penelitian menunjukkan bahwa menurut Maslow, judi online menghambat pemenuhan kebutuhan dasar keluarga, mulai dari kebutuhan ekonomi dan rasa aman hingga kebutuhan kasih sayang dan harga diri. Sementara itu, menurut   perspektif Jasser Auda, judi online menunjukkan kegagalan menjaga maqasid al-shari‘ah, khususnya perlindungan jiwa, akal, keturunan, dan harta, sehingga diperlukan penanganan yang bersifat moral dan sistemik, tidak hanya hukum.

Abstract

The childfree phenomenon has emerged as a complex social issue within modern societies, including Indonesia, where this choice often conflicts with social and religious norms that emphasize the importance of progeny. This study examines the childfree phenomenon through three theoretical perspectives: classical liberalism, human rights, and Islamic law. Employing a normative legal approach, this research aims to analyze the concept of childfree through conceptual and comparative approaches. From the perspective of classical liberalism, childfree is viewed as a manifestation of individual freedom and bodily autonomy that is philosophically protected, insofar as it does not cause harm to others. Meanwhile, the human rights perspective asserts that childfree constitutes a reproductive right and a right to privacy guaranteed by both national and international legal instruments; therefore, this choice must be respected without external interference. In contrast, Islamic law rejects the concept of childfree on the grounds that it contradicts the maq??id al-syar?‘ah, particularly the principle of ?if? al-nasl as a fundamental objective of marriage, except in certain medical emergency conditions. These differing perspectives illustrate contrasting ways of understanding freedom and its limitations in reproductive issues. [ Fenomena childfree telah muncul sebagai persoalan sosial yang kompleks dalam masyarakat modern, termasuk di Indonesia, di mana pilihan ini kerap berbenturan dengan norma sosial dan keagamaan yang menekankan pentingnya keberlanjutan keturunan. Penelitian ini mengkaji fenomena childfree melalui tiga perspektif teoretis, yaitu liberalisme klasik, hak asasi manusia, dan hukum Islam. Penelitian ini menggunakan pendekatan hukum normatif dengan metode konseptual dan komparatif untuk menganalisis konsep childfree. Dalam perspektif liberalisme klasik, childfree dipandang sebagai manifestasi kebebasan individu dan otonomi tubuh yang secara filosofis dilindungi sepanjang tidak menimbulkan kerugian bagi pihak lain. Sementara itu, perspektif hak asasi manusia menegaskan bahwa childfree merupakan bagian dari hak reproduksi dan hak atas privasi yang dijamin oleh instrumen hukum nasional maupun internasional, sehingga pilihan tersebut harus dihormati tanpa adanya intervensi eksternal. Sebaliknya, hukum Islam menolak konsep childfree karena dinilai bertentangan dengan maq??id al-syar?‘ah, khususnya prinsip ?if? al-nasl sebagai tujuan fundamental dalam perkawinan, kecuali dalam kondisi darurat medis tertentu. Perbedaan pandangan ini menunjukkan adanya kontras dalam memahami kebebasan serta batasannya dalam isu-isu reproduksi.]
