Abstract

Both fikih, KHI and KHES have their respective concepts of hibah, although it can not be denied that fikih is made the earliest reference by others. In this case, the concept of grant is described in more detail in fikih and KHES than in KHI. Whereas when compared, all three have similarities and differences. In terms of understanding, the three equally interpret the hibah as a gift of property to others without reward. In terms of rukun, both KHI and KHES closer to the opinion of jumhur ulama, with additional witness in KHI and qabd in KHES. In terms of syarat, there are restrictions on the age of the grantor in KHI and KHES. In addition, KHES also justifies iqrar in writing, gestures or actions other than speech. In terms of hibah revocation, all three share similar conditions that allow and prohibit it. On the other hand, fikih explains the legal basis of the hibah and the lesson, KHI describes the implementation of hibah of WNI and KHES explains several ways of hibah.

Abstract

This paper aims to examine the book "Practical Guidelines Towards Sakinah Families" and "Guidelines Towards Islamic Households", which are guidelines for premarital courses regarding importance and effectiveness of marriage. The results of this study explain that the book "Practical Guide to a Sakinah Family" and "Guidelines to an Islamic Household" contain various marriage concepts complemented by verses from the Qur'an, hadith and multiple invocations. This content has observed fiqh because it summarises the books of Fath al-Izar, Fath al-Bari and Fath al-Mu'in. However, the content of both of them differs from the Compilation of Islamic Law in several respects, for example, related to balancing the husband and wife’s position. This is because the Compilation of Islamic Law is not a reference source in two guidelines. Even so, both lead to the same aim, which is forming a sakinah family. Therefore, there is a need for further studies related to the adequacy and appropriateness of the material presented and its sources, as well as the synergy between premarital activities tutors and KUA in implementing premarital guidance to obtain maximum results.   Abstrak: Tulisan ini bertujuan untuk mengkaji dari buku “Pedoman Praktis Menuju Keluarga Sakinah” dan buku “Tuntunan Menuju Rumah Tangga Islami” yang menjadi panduan dalam kegiatan mengaji pranikah, bak dari segi substansi ataupun efektifitasnya. Hasil dari penelitian ini menjelaskan bahwa buku “Pedoman Praktis Menuju Keluarga Sakinah” dan buku “Tuntunan Menuju Rumah Tangga Islami” memuat berbagai konsep mengenai pernikahan yang dilengkapi dengan ayat Alqur’an, hadis dan  berbagai do’a. Muatan tersebut sudah sesuai dengan fikih karena merupakan rangkuman dari kitab Fath} al-Iza>r, Fath} al-Ba>ri> dan Fath} al-Mu’i>n. Akan tetapi, muatan keduanya tidak sesuai dengan Kompilasi Hukum Islam dalam beberapa hal, misalnya terkait konsep keseimbangan kedudukan suami dan istri. Hal ini tidak lain karena Kompilasi Hukum Islam bukan merupakan sumber rujukan penyusunan kedua panduan tersebut. Meskipun begitu, keduanya sama-sama bermuara pada pembentukan keluarga sakinah. Oleh karena itu, perlu adanya kajian lebih lanjut terkait kecukupan dan kesesuaian materi yang disampaikan beserta sumbernya serta adanya sinergitas antara guru pembimbing mengaji pranikah dengan pihak KUA dalam pelaksanaan bimbingan pranikah agar mendapatkan hasil yang lebih maksimal.

Abstract

Pemberlakuan SPTJM atau Surat Pertanggung Jawaban Mutlak kebenaran sebagai suami isteri merupakan hasil dari lahirnya Peraturan Menteri Dalam Negeri No. 9 Tahun 2016. Peraturan ini dinilai bukan sebagai suatu penyelesaian dalam percepatan pembuatan akta kelahiran bagi masyarakat Indonesia. Penelitian ini bertujuan untuk mengetahui problematika akibat lahirnya permendagri No. 9 Tahun 2016 sehingga dapat melemahkan otoritas kewenangan Kantor Urusan Agama (KUA) sebagai lembaga pencatatan pernikahan. Dengan menggunakan metode penelitian berdasarkan studi kepustakaan, dengan riset pada Undang-Undang Perkawinan dan Peraturan Menteri Agama serta literatur yang terkait, ditemukan hasil bahwa SPTJM menimbulkan permasalahan krusial, yaitu membuka ruang untuk pernikahan siri, melawan Undang-Undang Perkawinan dan terutama melemahkan otoritas kewenangan  KUA. KUA tidak dapat tidak dapat memproses pencatatan perkawinan dari hasil produk Permendagri berupa Kartu Keluarga bertuliskan “Kawin Belum Tercatat” yang diterbitkan oleh Dinas Pendudukan dan Catatan Sipil. Disisi lain, belum ada trobosan penyelesaian yang diupayakan oleh pembuat kebijakan, setelah mengkaji dalam Undang-Undang Peradilan Agama ternyata memberikan penyelesaian melalui Isbat Nikah.

Abstract

This paper is motivated by controversies among the public in the emergence of the policy of registering unregistered marriages on family cards, leading to. It aims to determine the opinion of lecturers of the Islamic Family Law Study Program at UIN Sunan Ampel Surabaya as the competent party regarding this policy to be analyzed using the problem concept. The study results show that there are differences of opinion among lecturers regarding this policy, some agree based on several reasons for the benefit contained therein, and some disagree based on reasons for the harm that will be raised. Lecturers who agree with the view that the policy of registering marriage on the family card does not conflict with the texts of syara', is in line with the objectives of syara', contains benefits and concerns the interests of the people, in contrast to lecturers who do not agree to have the opposite view.

Abstract

Polygamy is a topic that is still being debated, especially among ulama, including between Siti Musdah Mulia and Yusuf Qardhawi. Both of them have different thoughts regarding the concept of justice in polygamy. This article aims to find out the Islamic legal analysis of the thoughts of these two figures and their comparisons. The type of research used is library research using documentation techniques in extracting data as well as descriptive analysis and comparative studies as analysis techniques. The research results show that Siti Musdah Mulia's thoughts are more in line with contemporary Islamic jurisprudence scholars because they both state that justice in polygamy is not only in the material aspect but also the immaterial. This is different from Yusuf Qardhawi's thoughts, which are more in line with classical jurisprudence scholars because they both state that justice in polygamy is only in the material aspect. The similarity of thought between the two lies in the basic istinbath used, namely surah Al-Nisā' verses 3 and 129 and the hadith narrated by Abu Hurairah. The difference lies in the type of justice that must be fulfilled in polygamy. Siti Musdah Mulia stated that justice is not only material but also immaterial which is impossible for humans to realize so this is the basis for prohibiting polygamy. In contrast to Yusuf Qardhawi who stated that justice is only material because immaterial justice is beyond the limits of human capabilities so it is not mandatory to fulfill it.

Abstract

This paper is motivated by the emergence of news of same-sex marriages that are officially registered at the KUA, causing pros and cons in the community. This study aims to determine the effectiveness of the KUA's role in the practice of recording same-sex marriage in terms of Lawrence M. Friedman's theory of legal effectiveness. This research uses a qualitative approach and data collection using documentation techniques. The results showed that the role of the KUA was not effective according to the theory of legal effectiveness by Friedman M. Lawrence, because the elements of legal culture and legal structure could not run optimally. In the implementation of this legal structure, there is an element of negligence committed by the KUA in carrying out its duties as an authorized institution to carry out marriage registration, which in this case is evidenced by the non-optimal implementation of the document examination stage which results in the recording of same-sex marriages. Meanwhile, in legal culture, the perpetrators have a low level of legal awareness. This is evidenced by their actions to falsify their identity in order to realize their personal desires which are not in accordance with legal and social norms in Indonesia.)

Abstract

Kementerian Pendidikan dan Kebudayaan mengeluarkan kebijakan baru terkait Merdeka belajar-Kampus Merdeka (MB-KM) yang ditindaklanjuti dengan Keputusan Rektor UIN Sunan Ampel Surabaya No. 729 Tahun 2021 yang menjadikan Peraturan Rektor UIN Sunan Ampel Surabaya No. Un.07/1/PP.00.9/SK/809/P/2016 sebagai salah satu landasan hukumnya. Penelitian ini merupakan penelitian lapangan bertujuan untuk mengetahui implementasi kebijakan kesetaraan dan pengarusutamaan gender UIN Sunan Ampel Surabaya di bidang pendidikan dan pengajaran, faktor pendukung dan penghambat serta dampaknya. Data yang terkumpul kemudian diolah dan dianalisis dengan teknik deskriptif analisis dengan pola pikir deduktif. Hasil penelitian menyimpulkan bahwa Kebijakan kesetaraan dan pengarusutamaan gender telah diimplementasikan dengan beragam cara pada Fakultas Syariah dan Hukum, yaitu dengan membuat mata kuliah gender secara mandiri, memasukkan dalam RPS dan menerapkan metode pembelajaran sensitif gender. Akan tetapi, dalam hal ini, prodi belum melakukan review dan redesain kurikulum berperspektif gender secara berkala dan menguatkan kemitraan dengan berbagai pemangku kepentingan dan lembaga di masyarakat serta tidak secara penuh melaksanakan pengarusutamaan gender pada mata kuliah yang mengintegrasikan komponen pendidikan, penelitian dan pengabdian kepada masyarakat. Terdapat faktor pendukung dan penghambat, baik internal maupun eksternal, beserta dampak positif atas pengimplementasian kebijakan tersebut.

Abstract

Abstract: Marriage is a sacred institution regulated by both Islamic law and positive law. Despite these regulations, marriage practices often involve cultural customs, such as using different names during the wedding ceremony at the Rembang District KUA. People frequently request to be married under a name different from their official documentation. This raises an interesting question for examination: the practice of marriage with different names at the KUA and the analysis of the validity of such marriages under Islamic law and positive law. This research employs field research methods with a qualitative approach. Data was collected through interviews and documentation. The collected data is analysed deductively. The results indicate that marriages with different names at the Rembang District KUA follow the marriage registration procedures, from registration to the issuance of the marriage certificate, with the difference lying in the use of names. Local customs, concerns about marital failure, the desire for a harmonious family, and permission from the KUA influence the use of different names. This practice does not conflict with Islamic law because the pillars and conditions of marriage are fulfilled, making the marriage valid under Islamic law. However, this practice contradicts positive law, specifically PMA Number 20 of 2019 concerning Marriage Registration, due to inconsistencies between the names used in the ceremony and those recorded.Keywords: Validity of Marriage; Different Names; Islamic Law; Positive Law. Abstrak: Perkawinan adalah sesuatu yang sakral yang diatur dalam hukum Islam dan hukum positif. Meskipun sudah diatur, praktik perkawinan sering melibatkan budaya masyarakat, seperti penggunaan nama berbeda saat akad nikah di KUA Kecamatan Rembang. Masyarakat sering meminta dinikahkan dengan nama yang berbeda dari dokumen kependudukannya. Hal ini menimbulkan pertanyaan yang menarik untuk dikaji, yaitu terkait praktik perkawinan dengan nama berbeda di KUA tersebut serta keabsahan perkawinan ini dalam pandangan hukum Islam dan hukum positif. Penelitian ini merupakan penelitian lapangan dengan pendekatan kualitatif. Data dikumpulkan melalui wawancara dan dokumentasi. Data yang terkumpul dianalisis seacra deduktif. Hasil penelitian menunjukkan bahwa perkawinan dengan nama berbeda di KUA Kecamatan Rembang mengikuti prosedur pencatatan nikah, mulai dari pendaftaran hingga penyerahan buku nikah, dengan perbedaan terletak pada penggunaan nama. Penggunaan nama berbeda tersebut dilatarbelakangi oleh adat yang berlaku di masyarakat, kekhawatiran kegagalan rumah tangga, keinginan keluarga harmonis, serta izin dari KUA. Praktik ini tidak bertentangan dengan hukum Islam karena rukun dan syarat perkawinan terpenuhi, sehingga sah menurut hukum Islam. Namun, praktik ini tidak sejalan dengan hukum positif, khususnya PMA Nomor 20 Tahun 2019 tentang Pencatatan Pernikahan, karena terdapat ketidaksesuaian antara nama yang digunakan dalam pelaksanaan dan pencatatan.Kata Kunci: Keabsahan Perkawinan; Nama berbeda; Hukum Islam; Hukum Positif.

Abstract

Polygamy as a controversial issue is always interesting to discuss, including in novels. Novels themselves are undergoing transformation along with advances in technology, from non-digital to digital, one of which is Wattpad which opens up access for users, both as readers and story writers, so that they can become a dynamic place to share and enjoy various stories from various points of view. Writers can freely convey their ideologies or opinions to readers - who inevitably, whether consciously or not - have appreciated and even guided them. In Indonesia itself, polygamy has been regulated in detail in positive law. So whether the concept of polygamy presented in the Wattpad novel is relevant to the provisions on polygamy in positive law is important to study. This study is library research with documentation techniques as the data collection technique. Three novels were chosen based on the finished story, Islamic boarding school setting, and number of readers, namely: Menjadi Yang Kedua, Antara Dua Hati dan Kenapa Sesakit Ini? The previously collected data was then analyzed using descriptive techniques with a deductive mindset. The study results show that the concept of polygamy presented in two of the three novels is not fully relevant to the provisions of polygamy in positive law, especially regarding the stages of marriage registration that must be fulfilled. At the same time, the relevance of the remaining one cannot be known because there is no clear picture of the implementation of the marriage. Justice, which is a condition for allowing polygamy, ultimately cannot be realized in the domestic life of the three novels studied.

Abstract

Islamic law and Hindu law have set up various issues regarding inheritance. But in fact, not all of the rules are regularly followed by both of Muslim and Hindu communities, especially those in district Krembung, region Sidoarjo. In the case of inheritance practice, both of these communities prefer to use customary law than religious law. Starting from this issue, this research focuses to answer the two fundamental questions, namely: (1) how the implementation of the law of inheritance in Muslim and Hindu communities in district Krembung, region Sidoarjo is, and; (2) what the similarities and differences in the implementation of the laws are. This is a field research which uses a descriptive-comparative method. The results of the research show that although the Muslim communities in district Krembung, region Sidoarjo do not implement Islamic inheritance law, but the practice of distributing inheritance on the basis of a mutual agreement is in line with the spirit of Islamic law itself, it is al-sulhu. As for the Hindu communities in district Krembung, region Sidoarjo, although they do not likely practice Hindu inheritance law, they have implemented the spirit of which in the form of a local tradition. [Hukum Islam dan hukum Hindu telah menjelaskan berbagai aturan mengenai warisan. Namun pada kenyataannya, tidak semua aturan secara teratur diikuti oleh kedua Muslim dan Hindu masyarakat, terutama di Krembung, Sidoarjo. Dalam kasus praktek warisan, kedua komunitas ini memilih untuk menggunakan hukum adat dari pada hukum agama. Penelitian ini berfokus untuk menjawab dua pertanyaan mendasar, yaitu: (1) bagaimana pelaksanaan hukum waris di masyarakat Muslim dan Hindu di Krembung, Sidoarjo adalah, dan; (2) apa persamaan dan perbedaan dalam pelaksanaan hukumnya. Penelitian ini adalah penelitian lapangan yang menggunakan metode deskriptif-komparatif. Hasil penelitian menunjukkan bahwa meskipun komunitas Muslim di Krembung, Sidoarjo tidak menerapkan hukum waris Islam, namun praktek mendistribusikan warisan atas dasar kesepakatan bersama ini sejalan dengan semangat hukum Islam itu sendiri, yaitu al-sulhu. Adapun masyarakat Hindu di Kabupaten Krembung, Sidoarjo, meskipun mereka tidak mengikuti praktik hukum waris Hindu, mereka telah menerapkan semangat yang berupa tradisi lokal.]
