Abstract

The cause of the child ng exploited to serve as the perpetrator of a crime is an internal factor. This internal factor is more directed to a family's situation factor which describes a situation within the individual and the family of a child who is exploited to be a beggar who encourages them to beg. These factors are individual and family poverty, age, formal education, parental permission, low skills and mental attitude. Criminal law policy against perpetrators who send children as beggars can be categorized as perpetrators of criminal acts so that the perpetrators may be subject to criminal or imprisonment sanctions or both at once. The threat of imprisonment is a maximum of 10 (ten) years, while a maximum fine of Rp. 200,000,000.00 (two hundred million rupiah). Criminal liability for the perpetrator who commits the child as a beggar is an act as regulated in the provisions of Article 301 of the Criminal Code and Article 76 I and Article 88 of Law Number 35 Year 2014 About Amendment to Law Number 23 Year 2002 on Child Protection regulates the subject of ordering the child begging the begging is a criminal act and to the perpetrator may be subject to criminal sanctions. Keywords: Children, Begging

Abstract

DPRD is the people's representative which is formed as a forum for the people in the region to share their aspirations. DPRD as a legislative institution in carrying out its functions has rights as regulated and stipulated in Article 159 to Article 160 of the Law Number 23 of 2014 concerning Regional Government, including the interpellation rights as the subject matter of this journal. Based on the background described above, this research will discuss how is the mechanism of the use of the interpellation rights by the Regional People's Representative Assembly of North Sumatra, and how are the interpellation rights and the legal obligations regarding the Regional Government. The reason of the DPRD of North Sumatera in using the authority of the interpellation right is because of the Regional Government's policy regarding BDB in the 2013 APBD. After the interpellation right was carried out, the results of the DPRD for North Sumatra Representatives received the Governor's answer and assumption that the importance of the Lower Assistance fund was to assist the regions in North Sumatra in carrying out the development. The mechanism of the use of the interpellation rights by the DPRD of North Sumatra is proposed by at least 15 (fifteen) DPRD members or more than 1 (one) faction. The proposal is accompanied by a document containing the policy material and the reasons for the inquiry request. The proposal from the DPRD leadership is submitted to the DPRD plenary meeting. The decision to approve or reject an application submitted to the Governor is determined in a plenary meeting of the DPRD. The legal consequences or consequences of the DPRD's interpellation rights largely depend on the facts and the evidence revealed in the investigation process and also on the DPRD members' analysis of the facts and evidence that have been revealed. If the DPRD members judge that the local government's actions are appropriate and correct, the questionnaire committee will provide support for the government's policy. Abstract

This paper discusses the views of international trade law and Islamic law on dumping practices. Dumping is the activity of buying and selling products at below normal prices in countries aimed at exporters for the sole purpose of controlling international market share. Dumping is carried out with the aim of seizing international share by a country, so that this is a high case in international trade. It is a fact that Indonesia is in the top fifth place on dumping charges. Dumping is a trade practice that is dishonest, however dumping is in fact not prohibited in the provisions of the WTO. However, importing countries can apply anti-dumping duties that apply to the WTO for dumping products to prevent or reduce the effects of serious losses on domestic products which are considered substantial. Islam recognizes the term dumping by the term "siyasah al-ighraq" or islam the price. Islamic law is different from international trade law. Which is in the hadith of the Prophet that the practice of dumping is prohibited because it can cause losses that lead to bankruptcy for producers.

Abstract

Bankruptcy is a general confiscation covering all debtor assets for the benefit of all creditors. In other words, bankruptcy is the time when the debtor is no longer able to pay all debts that are due. State-Owned Enterprises (BUMN) is a company in the form of a limited liability company (Persero) which is wholly, mostly or partly owned or managed by the government and directly controlled by the government. Workers or laborers are people who work and receive wages or other forms of remuneration. The research made in making scientific papers is normative legal research. Normative legal research or it can be called library research is research that saya learning in the form of documents, using a variety of secondary data, namely regulations in legislation, court decisions set by judges, and legal theories. The data source used to write scientific papers is secondary data sources. This secondary data source takes data that comes from existing journals, established laws and regulations. Secondary data also logged all documents that were informed.

Abstract

Banking has an important role in the development of a country's economy. Banking is a business entity that provides services in the payment traffic and circulation of money in the world. Islamic bank is a bank that conducts business activities based on Islamic principles, namely the rules of the agreement based on Islamic law between banks and other parties to finance business activities and / or deposit funds and other activities. The method used in this research is the normative method, namely legal research which is carried out by examining library materials or secondary data using a statutory approach, a conceptual approach and a comparative approach. The sources of data obtained are secondary data sources that come from literature studies by reviewing, analyzing and processing literature, laws and regulations, journals, articles, and writings related to Islamic banks and conventional banks. The results show that there is an urgency for the existence of Islamic and conventional banking in Indonesia in accordance with the interests of society.

Abstract

In general, the goal of a merger is to obtain synergy or added value. The added value in question is more long-term compared to the added value that is temporary. Therefore, there is no synergy of a merger that cannot be seen shortly after the merger occurs. But it takes quite a long time. The synergy that occurs as a result of a merger of business bias in the form of ups and downs of economic questions, and financial synergy in the form of capital increase. The advantage of merger is that the takeover through a merger is simpler and cheaper compared to the other takeovers while the merger's shortcomings are that there must be approval from the shareholders of each company, whereas to obtain the agreement requires a long time. The merger strategy is an alternative to expanding the business.

Abstract

Smoking is one of the activities that are still carried out by individuals at all ages, from teenagers to adults. Many ways can be done in an effort to stop smoking, such as committing, replacing cigarettes by consuming sweets, diverting cigarettes with more useful activities. But now news is circulating about smokers who try to quit smoking using e-cigarettes. propylene glycol, and taste. e-cigarettes contain liquid nicotine, propylene glycol, and glycerin. If all the ingredients are heated the meal will produce nitrosamine compounds and those compounds can cause cancer. Therefore, consumer protection must be strictly enforced. Results of this study said that e-cigarettes and conventional cigarettes have the same danger to their users because they contain nicotine and addictive substances that are harmful to health.

Abstract

The purpose of this research is to analyze the regulation of consumer protection for cosmetics that are not licensed by BPOM. The research method used by the author is secondary research based on library research, laws and regulations, and related journals. The results of the study are the authors can find out that the legal protection process that has been implemented in Indonesia has been carried out properly and in accordance with existing procedures, legal remedies taken by consumers as a form of protest are more contextual because of the rapid development of technology and the role of BPOM in overcoming cosmetic products that have been circulating in the community are complex

Abstract

Kekerasan terhadap anak kerap sekaliterjadi, anak menjadi korban ekploitasi seksual, disuruh menjadi pengamen, pengemis yang mana semua bentuk kekerasan dan eskploitasi terhadap anak akan memberikan dampak buruk terhadap kesehatan fisik maupun mental yang dapat mengganggu tumbuh kembang anak. Penyuluhan ini akan dibahas mengenai perlindungan hukum terhadap anak dibawah umur serta upaya dalam mencegah segala tindakan kekerasan dan eksploitasi terhadap anak. Hasil Dari Penyuluhan ini adalah bahwa setiap anakmemerlukan perlindungan dari semua kalangan sebabanak belum memliki kemampuan untuk melindungi dirinya sendiri dari segala hal, termasuk tindakan kekerasan dan eksploitasi. Adapun penyuluhan ini memberikan pengetahuan kepada anak adanya perlindungan yang mereka dapatkan baik dari orang tua, keluarga, masyarakat maupun pemerintah serta memberikan pengetahuan mengenai bentuk-bentuk kekerasan dan eksploitasi yang biasanya dialami oleh anak sehingga mereka dapat mencegah terjadinya tindakan kekerasan dan eksploitasi atas dirinya.

Abstract

Layanan untuk perbankan digital kini berkembang pesat. Layanan perbankan digital memudahkan masyarakat umum untuk menerima layanan perbankan tanpa harus mengunjungi kantor cabang bank untuk memenuhi kebutuhan layanan nasabah. Termasuk mempercepat dan mempermudah pemberian kredit kepada debitur. Ini adalah terobosan baru dalam industri keuangan. Fintech, atau financial technology, adalah nama dari terobosan ini. Masyarakat kini dapat menggunakan item layanan dengan nyaman dan bebas dalam transaksi online nontunai berbasis teknologi. Fintech hanya dapat digunakan dengan desktop, laptop, dan smartphone (HP), setelah terhubung dengan jaringan internet. Aplikasi pinjaman online juga menawarkan banyak kemudahan kepada peminjam karena yang dibutuhkan hanyalah penyerahan identitas peminjam (KTP), dan tanpa menggunakan agunan apapun atau syarat peminjam membawa pinjaman ke bank atau kantor , yang diperlukan hanyalah akses ke jaringan internet. Rekening debitur. Pengaturan pinjaman eksklusif untuk layanan teknologi keuangan (Fintech) antara peminjam dan pemberi pinjaman (kreditur) (debitur). Banyak orang tergoda untuk mengajukan pinjaman karena persyaratan sederhana untuk melakukannya secara online atau melalui digitalisasi karena setiap orang dapat dengan mudah memperoleh pinjaman dengan cepat hanya dengan foto KTP dan beberapa informasi pribadi dasar. Namun, karena kemudahan itu, debitur berisiko terjerat bunga pinjaman yang selangit. Selain itu, tudingan penggelapan, penyalahgunaan, dan penyebarluasan data pribadi yang menakutkan, serta pengekangan suku bunga pinjaman online, saat ini meresahkan masyarakat. Hal ini karena laporan ini merupakan mayoritas dari laporan yang masuk. Metode penelitian hukum normatif yang merupakan salah satu pengumpulan data berdasarkan penelitian kepustakaan digunakan dalam penelitian ini. Metode ini melibatkan pemeriksaan data sekunder berupa bahan hukum primer, seperti buku-buku ilmiah, peraturan perundang-undangan, dan data lainnya, yang digunakan untuk membuat data sekunder. informasi yang relevan dengan penelitian kami yang dikumpulkan melalui penjelajahan web. Hasil dari penelitian ini adalah bahwa perjanjian itu sah jika sesuai dengan Pasal 1320 KUH Perdata. Selanjutnya, penting untuk mengatur secara ketat hak dan kewajiban kreditur dan peminjam dalam pinjaman online untuk memberikan perlindungan hukum bagi debitur. Otoritas Jasa Keuangan (OJK) juga harus mengawasi lembaga kredit online yang telah terdaftar dan berizin, dan jika terbukti melanggar aturan, maka harus dikenakan sanksi yang berat.
