Abstract

Islamic political power is not always related to Islamic parties. Nurcholish Madjid tried to convey a more substantial view of Islam, not just symbolism. This research uses the library research method. Research carried out using literature, both in the form of primary sources, namely research data sources obtained from original sources that contain this information and secondary sources, namely data sources obtained from books and other literature that discuss the topic of the problem. The data processing techniques in this study using content analysis techniques, namely after the data is collected, the next step is to describe the data completely, sequentially, and regularly, and after that the analysis is carried out by looking at each discussion of the themes discussed. Based on the results of this research, it is revealed that Nurcholish Madjid chose Islam that is more substantial than just symbolism. This is rooted in the universal values of Islam, not just the symbol of the "Islamic party" itself. If we look at the current situation, Nurcholish Madjid's criticism is still relevant because currently the politicisation of religion is generally used to attack political opponents or increase party electability.Kekuatan politik Islam tidak selalu berkaitan dengan partai Islam. Nurcholish Madjid mencoba menyampaikan pandangan yang lebih substansial tentang Islam, bukan sekedar simbolisme. Penelitian ini menggunakan metode penelitian kepustakaan (library reseach). Penelitian yang dilaksanakan dengan menggunakan literatur (kepustakaan), baik berupa dari sumber primer yaitu sumber data penelitian yang diperoleh dari sumber-sumber asli yang memuat informasi tersebut dan sumber sekunder yaitu sumber data yang diperoleh dari buku dan literatur lain yang membahas tentang topik permasalahan. Adapun teknik pengolahan data dalam penelitian ini dengan menggunakan teknik content analisis, yaitu setelah data-data tersebut terkumpul, maka langkah selanjutnya adalah memaparkan data tersebut secara lengkap, urut, dan teratur, dan setelah itu dilakukan analisis dengan mencermati setiap pembahasan tema yang dibahas. Berdasarkan hasil penelitian ini, terungkap bahwa Nurcholish Madjid memilih Islam yang lebih substansial dari sekedar simbolisme. Hal ini berakar pada nilai-nilai universal Islam, bukan hanya simbol "partai Islam" itu sendiri. Jika melihat situasi saat ini, kritik yang dilontarkan Nurcholish Madjid masih relevan karena saat ini politisasi agama umumnya digunakan untuk menyerang lawan politik atau meningkatkan elektabilitas partai.

Abstract

The transfer of the utilization of high inheritance assets in Nagari Muara Panas, Bukit Sundi District, Solok Regency often reaps pros and cons, because basically, high inheritance assets may not be sold or pawned except for four reasons, but the facts often show that high inheritance assets are used for the benefit of personal. This is what causes divisions among the people because of the transition from the utilization of the high inheritance property. The purpose of this study was to analyze the Maqashid al-Shariah review of the transfer of utilization of high inheritance assets in Nagari Muara Panas, Solok Regency. This type of research is field research. Data collection techniques in this study were carried out through interviews and documentation. The results of this study indicate that the form of diversion of the use of high heirlooms that occurred in Nagari Muara Panas, Bukit Sundi District, Solok Regency was carried out by pawning and trading by owners of high heirlooms for reasons of personal gain. Furthermore, Maqashid al-Shariah's review of the transfer of utilization of high inheritance assets in Nagari Muara Panas is permissible in order to preserve the soul in the form of medical treatment and preserve the mind in the form of educational expenses, all of which can be categorized at the dharuriyyat level. and this is at the level of tahsiniyyat.

Abstract

This research is qualitative, using data from library sources. Former convicts are people who have previously committed crimes or criminal acts and have served their sentences. In Islam, a leader must be fair, honest, trustworthy, and have high integrity. Law No. 8 of 2012 concerning Elections allows former convicts to become members of the legislature, but it has received many responses of rejection from the public. This is based on the perception that former convicts are morally compromised and no longer trusted by society. To build a legislature that is credible and can be trusted by the people, its members should have moral integrity, be intelligent (competent), and be statesmen, especially since legislative members represent the people as the holders of sovereignty. In the Quran and Hadith, there are hardly any explicit requirements mentioned for legislative members, let alone the status of former convicts. This study aims to determine the capability of former convicts to become leaders within the framework of Islamic legal philosophy. The results of the study show that, philosophically, Islamic law requires a leader to be just and their sense of justice to be unimpaired, thus it is makruh (discouraged) to grant former convicts the right to become leaders and to be at the level of tahsiniyah.

Abstract

This study delves into the practice of overpayment within Arisan, a traditional community-based financial system, through the framework of Sharia Economic Law. Arisan, known for its role in promoting savings and social solidarity, operates as a rotating savings and credit association where members contribute to a common fund that is periodically distributed among them. However, the issue of overpayment—where some participants pay more than others raises significant concerns regarding its compliance with Islamic financial principles. The research employs a qualitative approach to explore how overpayment practices in Arisan align with or contradict Sharia principles, particularly those prohibiting riba (usury), gharar (excessive uncertainty), and the requirement for fairness and justice in financial transactions. Through a comprehensive analysis of these principles, the study finds that overpayment in Arisan can lead to potential violations of Sharia law, especially when it results in financial inequities or the unjust enrichment of certain participants at the expense of others. The findings suggest that while Arisan can be a valuable tool for economic cooperation and community support, it must be carefully managed to ensure Sharia compliance. The study concludes by recommending specific adjustments to Arisan practices, such as the implementation of standardized payment structures and transparent agreements among participants, to safeguard against overpayment and ensure that the system operates within the ethical and legal boundaries of Sharia Economic Law. This ensures that Arisan continues to serve its purpose without compromising Islamic ethical standards. Â
