Abstract

Piagam Madinah, yang merupakan perjanjian luhur (high agreement) untuk mengabadikan negara Madinah, adalah konstitusi tertulis pertama yang pernah dibuat. Piagam Madinah berisi gagasan-gagasan dari budaya dunia kontemporer yang prinsip-prinsipnya dapat diterapkan pada etika nasional dan pemerintahan. Berbeda dengan pengertian rechtsstaat, atau negara hukum, yang bersumber dari gagasan dan pandangan hidup bangsa Indonesia, khususnya negara hukum Pancasila, negara Indonesia lebih sesuai dengan pengertian negara hukum baru. Teknik penelitian yang digunakan adalah penelitian hukum normatif, kadang dikenal dengan istilah “penelitian hukum”. Ciri-ciri Hukum Pancasila Negara menggunakan sumber hukum primer, sekunder, dan tersier. Analisis kualitatif merupakan teknik yang digunakan untuk analisis data. Menurut temuannya, negara hukum Indonesia adalah negara hukum Pancasila dengan kekeluargaan yang menjunjung tinggi kepastian dan keadilan, bangsa yang religius, adanya kerjasama hukum sebagai sarana untuk mengubah masyarakat dan hukum, serta dasar pembuatan dan pembentukan hukum berdasarkan asas-asas hukum yang netral dan universal. Penggunaan Piagam Madinah dan Pancasila, sangat diperlukan dalam penerapan aturan etika dalam berbangsa dan bernegara. Nilai-nilai persatuan dan kesatuan haruslah mendasar dalam tatanan Negara Indonesia supaya melahirkan etika berbangsa dan bernegara yang baik untuk masyarakat Indonesia.

Abstract

Intellectual Property Rights (IPR) are exclusive rights granted to individuals or groups for their creative works that benefit society. They protect interests, financial rights, and prevent infringement. This research aims to find out how the regulations in Indonesia and its benefits in the registration of Intellectual Property Rights, especially Patent Rights. This research uses normative juridical research to analyze legal issues using various legal materials. It focuses on positivistic views, principles, doctrine, discovery, systematics, harmonization, comparative studies, and history. The approach includes statutory and conceptual analysis, grammatical and systematic interpretation. Copyright protection in science, art and literature often coincides with creation, where the creator does not register the work. Indonesian copyright law uses principles such as lex posterior derogat legi priori. Islamic jurisprudence emphasizes intellectual property rights and the prohibition of unlawful consumption, the researcher draws from a concept namely Maqashid As-Sharia. The Maqashid as-Sharia approach, which focuses on the benefit of protecting the mind and property, can be used to study intellectual property rights in Islamic law. In this case, it is expected that the creators can register their creations for the sake of the formation of benefits.

Abstract

As a state of law, Indonesia must guarantee legal certainty to its people. This article aims to analyze the considerations of the judges of the Central Jakarta District Court case number 70/Pid.Sus-TPK/2024/PN Jkt. Pst. according to the view of prophetic legal justice, in addition to providing insight to judges so that they can create legal reasoning that supports legal certainty, both from the concept of legislation and the concept of legal justice. This research uses a juridical-normative approach method with data types in the form of primary and secondary data. The results of this study are first, the legal facts show that in this case the panel of judges who examined and tried case number 70/Pid.Sus-TPK/2024/PN Jkt. Pst. did not heed the philosophical, juridical and sociological aspects in accordance with the rules on Corruption Punishment in giving a verdict against the defendant. Second, Indonesia as a state of law adheres to divine justice. The judge's decision number 70/Pid.Sus-TPK/2024/PN Jkt. Pst. with the view of Prophetic Justice, the concept of prophetic justice encourages social, ecological, and spiritual responsibility in every legal policy, including in the natural resource sector.
