Abstract

Pengaturan mengenai kepemilikan hak atas tanah di Indonesia di tandai dengan lahirnya Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria atau yang lebih dikenal dengan Undang-Undang Pokok Agraria (UUPA). Pengaturan tersebut kemudian melahirkan sebuah istilah yang dikenal dengan Sertifikat Hak Milik (SHM) atas tanah yang diatur dalam Pasal 16 ayat (1). Muatan pasal tersebut berupa pengaturan hak-hak atas tanah, diantaranya hak milik, hak guna usaha, hak guna bangunan, hak pakai, hak sewa, hak membuka lahan dan memungut hasil hutan serta hak-hak lain selain hak tersebut yang akan ditetapkan dengan undang-undang dan yang sifatnya sementara. Namun dewasa ini Undang-Undang Pokok Agraria (UUPA) yang seyogyanya menjadi payung hukum akan jaminan dari negara atas kepemilikan sertifikat hak atas tanah nyatanya belum mampu memberikan kepastian hukum, hal ini ditandai dengan masih sering ditemukan dalam masyarakat adanya kasus-kasus pertanahan seperti sertifikat ganda, sertifikat yang tidak sesuai, pengurusan sertifikat yang alot, serta kasus pertahanan lainnya. Sehingga dalam kasus tersebut diharapkan peran negara sebagai sebuah entitas masyarakat yang akan memberikan kepastian hukum sehingga melahirkan keadilan dan ketentraman di dalam masyarakatnya.Kata kunci: Peran Negara, Kepastian Hukum, Undang Undang Pokok Agraria (UUPA), Sertifikat Hak Milik (SHM).

Abstract

The purpose of this study is to examine the basis of the World Trade Organization (WTO) decision in favor of the European Union over Indonesia in the case of a ban on nickel ore exports by the Government of Indonesia and the appeal efforts that can be taken by the Indonesian government against the decision. This study uses normative legal research methods with conceptual and statutory approaches. The results of the study show that the basis of the WTO ruling in favor of the European Union over Indonesia in the case of the Indonesian Government's Nickel Seed Export Ban is that the Nickel Processing and Refining policy in Indonesia is proven to violate the provisions of WTO Article XI.1 GATT 1994 and cannot be justified by Articles XI.2 (a) and XX (d) GATT 1994. Indonesia is also deemed to be conducting a prohibited subsidy scheme under Subsidy and Countervailing Measures Agreement Article 3.1 through Minister of Finance Regulation (PMK) No. 76 Year 2012. The appeal has been taken by the Indonesian government officially in December 2022 and is still waiting for the formation of the WTO Appellate Body. Indonesia has a great opportunity to win a dispute at the WTO if Indonesia can prove the existence of national laws governing international trade, especially in the mining sector.

Abstract

Indonesia, as a country with potential natural resources such as coal, faces major challenges in tackling the negative impacts of unlicensed coal mining, including weak post-mining land reclamation. This research aims to examine government policies to overcome the problem of reclamation of unlicensed coal mines in Indonesia. The research method used qualitative research with a focus on analyzing regulations and cases of unlicensed coal mining. The results show that various government policies related to mine reclamation are regulated in laws and regulations. Still, the reclamation of unlicensed mines or illegal mines is not clearly regulated. However, it can be prosecuted as corruption crimes because it is considered detrimental to the state or becomes the responsibility of the government if the perpetrator is unknown; this adds to the problem of carrying out reclamation considering the large number of coal mining pits so that the government is difficult to carry out reclamation. Not only that, law enforcement against the implementation of unlicensed mining is still not optimal; existing regulations emphasize criminal sanctions and fines more than reclamation responsibilities. These findings indicate the need for government policies in the coal mining sector that emphasize legal certainty regarding the responsibility of coal mining actors who do not have permits or the government’s responsibility in carrying out reclamation needs to be strengthened by adding policies for reclamation of unlicensed mining land and more effective supervision and application of sanctions that emphasize reclamation responsibilities in order to achieve the goal of environmental sustainability.

Abstract

In light of Law no. 35 of 2014 concerning Child Protection and its application in Case Number 300/Pdt.G/2022/PA.Tg., this study aims to examine the regulation of children's hadhanah rights after divorce. Finding out how the law protects children's rights after a divorce and the obstacles to implementing such protection is the goal of this study. Normative research using a legislative approach and content analysis is the research technique used. Case Number 300/Pdt.G/2022/PA.Tg-related court records and secondary data pertaining to the Child Protection Law will be gathered and analysed. With an emphasis on the maintenance of children's hadhanah rights after a divorce, this study seeks to enhance comprehension of legislative provisions and their implementation in court practice. A solid legislative foundation for safeguarding children's rights after a divorce, with the primary focus being on the child's best interests, is provided by the Child Protection Law, according to the study. As shown in Case Number 300/Pdt.G/2022/PA.Tg., this concept is put into reality by the courts in order to make fair judgements about child custody and maintenance in order to protect the well-being of children after a divorce. But this case study also shows that there are problems with the law's implementation, such as how to determine whether parents can afford it and what the kids need.
