Abstract

This service is carried out with the title Legal Protection of Geographical Indications of Papua in Maribu Village, Jayapura Regency, an activity carried out for partners with the aim that the community can know and understand the existence of legal protection for Geographical Indications of Papua in Jayapura Regency. The output of this service is to provide an understanding to partners about efforts to map geographical indications carried out to determine the limits of cases of violation of geographical indications so that holders of geographical indication rights can file lawsuits against users of geographical indications without rights, in the form of compensation payments and termination. Use and destruction of geographical indication labels used without rights through registration and publication. Geographical indications are protected as long as the reputation, quality and characteristics that are the basis for granting geographical indication protection to an item are maintained. And protection will be removed if these provisions are not met, and/or are contrary to state ideology, legislation, morality, religion, decency and public order. Therefore, Geographical indication mapping must be arranged in a geographical indication document that can be proven to be true. The procedure for submitting geographical indications and the procedure for registering geographical indications have been identified. Legal protection for geographical indications can be carried out in preventive and repressive forms. Preventive means preventive measures through refusal of registration and repressive payment of compensation.

Abstract

Penyuluhan Hukum dengan topik “Perlindungan Hukum Bagi Pengusaha Kecil Dalam Persaingan Pasar Di Kelurahan Kelapa Dua Entrop Distrik Jayapura Selatan”, dilakukan dengan tujuan untuk mengetahui kriteria, pengaturan pasar dan perlindungan hukum bagi pengusaha kecil dalam persaingan pasar di Kota Jayapura. Kinerja pasar menggambarkan efisiensi dari suatu pasar dalam menggunakan sumber daya yang langka untuk memenuhi permintaan konsumen terhadap barang dan jasa. Perlindungan hukum bagi pengusaha kecil dalam persaingan pasar di kelurahan Kelapa Dua Entrop Distrik Jayapura Selatan dalam berbagai kebijakannya. Kebijakan persaingan atas pasar bersangkutan tidak dilaksanakan melalui pengawasan terhadap struktur pasar dan perilaku pasar berdasarkan analisis terhadap para pengusaha kecil dalam praktek bisnis yang sulit berkembang sepanjang pemerintah Kota Jayapura dan pelaku usaha menengah ke atas tidak memiliki kepedulian dalam memberi ruang tempat usaha bagi pelaku usaha kecil pada pusat-pusat perdagangan yang serba modern, seperti di kompleks Ruko, Mall dan Supermarket.

Abstract

Community service entitled The Dangers of Bullying and Its Prevention was carried out on students of State Catholic Senior High Schools (SMAK) in Keerom Regency on Friday, June 14, 2024. This activity was carried out because students still did not understand the dangers of Bullying and its Prevention. The methods used were lectures and discussions. The output of this community service is an understanding of the importance of preventive measures against bullying. Therefore, it is hoped that every student can avoid bullying, both physically, non-physically and through social media. Because these actions may have been carried out by students and may even have experienced bullying, but they are not aware of it, as well as the forms of bullying. The output of this community service activity is an increase in students' knowledge of the forms of bullying and their prevention, so that students can better understand and avoid bullying.

Abstract

Banking crimes are increasing, and perpetrators do it in various ways that can ultimately harm customers. The purpose of this study is to find out and analyze how related laws protect customers who are victims of ITE crimes in the banking sector and how banks are responsible for these customers. This study uses a normative legal method, which means research in the legal field that uses secondary data. This secondary data includes laws and regulations, court decisions, legal theories, and scholarly opinions. The results of this study indicate that adequate legal protection for victims of crime is a national and international problem. Therefore, the importance of protecting victims of violations is recognized. Legal protection for victims of crime is a protection of human rights or a person's legal interests that should receive special attention. This is important because crime and its victims are increasingly complex along with the progress of today's civilization. Therefore, banking institutions and consumer institutions can work together to create agreement clauses that meet the needs of the parties and do not violate the element of propriety. In addition, banks monitor employee behavior periodically to find indications of violations of the law.

Abstract

The purpose of this study is to examine the basis of the World Trade Organization (WTO) decision in favor of the European Union over Indonesia in the case of a ban on nickel ore exports by the Government of Indonesia and the appeal efforts that can be taken by the Indonesian government against the decision. This study uses normative legal research methods with conceptual and statutory approaches. The results of the study show that the basis of the WTO ruling in favor of the European Union over Indonesia in the case of the Indonesian Government's Nickel Seed Export Ban is that the Nickel Processing and Refining policy in Indonesia is proven to violate the provisions of WTO Article XI.1 GATT 1994 and cannot be justified by Articles XI.2 (a) and XX (d) GATT 1994. Indonesia is also deemed to be conducting a prohibited subsidy scheme under Subsidy and Countervailing Measures Agreement Article 3.1 through Minister of Finance Regulation (PMK) No. 76 Year 2012. The appeal has been taken by the Indonesian government officially in December 2022 and is still waiting for the formation of the WTO Appellate Body. Indonesia has a great opportunity to win a dispute at the WTO if Indonesia can prove the existence of national laws governing international trade, especially in the mining sector.

Abstract

This study was conducted with the aim of analyzing, explaining, and understanding the operational risks of banks on the issuance of L/C, identifying the development of crime rates through L/C and law enforcement on the misuse of L/C as a means of payment in export-import transactions. The type of research used is normative juridical, namely to examine legal concepts related to law enforcement on the misuse of letters of credit as a means of payment in export-import transactions. The results of this study reveal that the presence of fictitious documents as a means of disbursing L/C clearly contains evil motives coloring bank break-ins, as a bank that is involved in the international trade area (International track Jurvice), operational risks have certainly been calculated in advance. Risk Management should understand the potential risks. The risks that can occur in connection with the involvement of banks as guarantors and mediators between sellers and buyers from different countries. Of course it is also riskier to provide dual facilities to one customer as an importer and exporter customer at the same time. Therefore, law enforcement on the misuse of letters of credit is the application of the principle of knowing the customer which is the embryo of the principle of maximum prudence in order to minimize crime in the banking sector.

Abstract

This community service was carried out with the title of Legal Counseling on the Special Regional Regulation of Papua Province Number 23 of 2008 Concerning the Customary Rights of Customary Law Communities and the Individual Rights of Customary Law Community Members to Land in Asei Besar Village, East Sentani District, Jayapura Regency, this activity was carried out for partners due to cases from partners regarding their lack of understanding regarding the resolution of customary land disputes based on applicable laws and regulations in order to obtain legal certainty and where the disputing parties do not want to give in or want to win alone so that with the expertise possessed by the servants, they can carry out legal counseling so that the disputing parties both win or achieve a win-win solution. The method of implementing this community service is carried out through lectures and discussions held on Saturday, August 30, 2025, which was held in Asei Besar Village, East Sentani District, Jayapura Regency by providing knowledge to partners regarding land dispute resolution in general there are two types, namely dispute resolution through Litigation and Non-Litigation to obtain legal certainty, this activity begins with preparation and coordination, then presentation of material on how to resolve customary land disputes based on applicable laws and regulations. The output of this community service is to provide an understanding to partners about how to resolve disputes through Non-Litigation channels along with the advantages and disadvantages of resolving these disputes and also provide legal assistance to partners to resolve cases related to customary land disputes.

Abstract

The Science and Technology Application Program in the form of legal counseling on "The Culture of Shame as Anti-Corruption Education for Students in Keerom Regency" was conducted with the objectives of (1) identifying and understanding the correlation between the culture of shame and the prevention of corrupt behavior, and (2) identifying and understanding efforts to prevent corrupt behavior through the culture of shame among students in Keerom Regency. The activity was conducted through a lecture approach with material presentation techniques accompanied by case examples from the community, utilizing two-way communication techniques. Through this communication technique, the level of interest and understanding of the counseling material presented to the counseling participants could be directly measured through feedback in the form of a question-and-answer discussion during the activity. The legal counseling activity for students in Keerom Regency was conducted at the State Islamic Senior High School (Madrasah Aliyah Negeri) in Keerom Regency. This activity is very beneficial in developing students who are physically and mentally prepared to face challenges as the nation's next generation of quality. Similar activities need to be carried out continuously in other schools and also in the general community to foster the ability to think and act ethically in everyday interactions, fostering the habit of implementing anti-corruption behaviors within the family, play environment, and school. ABSTRAK Program Penerapan Iptek dalam bentuk Penyuluhan hukum tentang “Budaya Malu Sebagai Pendidikan Anti Korupsi Bagi Pelajar Di Kabupaten Keerom” dilakukan dengan tujuan (1) untuk mengetahui dan memahami korelasi antara budaya malu dan pencegahan perilaku koruptif, dan (2) untuk mengetahui serta memahami upaya pencegahan perilaku koruptif melalui budaya malu pada kalangan pelajar di Kabupaten Keerom. Kegiatan dilakukan melalui metode pendekatan yang berbentuk ceramah dengan teknik presentasi materi disertai contoh kasus yang terjadi di masyarakat dengan menggunakan teknik komunikasi dua arah (Two-Ways-Communication). Melalui teknik komunikasi tersebut maka materi penyuluhan yang disampaikan kepada para peserta penyuluhan dapat langsung diukur tingkat ketertarikan dan pemahaman peserta melalui umpan balik (feedback) berupa diskusi tanya jawab selama kegiatan berlangsung. Kegiatan penyuluhan hukum bagi pelajar di Kabupaten Keerom dilaksanakan di Madrasah Aliyah Negeri Kabupaten Keerom. Kegiatan ini sangat bermanfaat guna membentuk pelajar yang siap secara fisik dan mental dalam menghadapi tantangan sebagai generasi penerus bangsa yang berkualitas. Perlu dilakukan kegiatan sejenis secara continue (berkesinambungan) di sekolah-sekolah lainnya dan juga perlu dilakukan pada masyarakat umum lainnya sehingga dapat terbentuk kemampuan berpikir dan bertindak yang etis dalam pergaulan sehari-hari guna terciptanya kebiasaan menerapkan perilaku anti korupsi baik dilingkungan keluarga, lingkungan bermain maupun di lingkungan sekolah.

Abstract

This study aims to examine the implementation of the collection of Land and Building Acquisition Tax in Jayapura Regency. To examine the obstacles that arise in the implementation of the collection of Land and Building Acquisition Tax in Jayapura Regency. The research method is sociological juridical, namely a legal research approach that examines law not only as a formal rule, but also as a social phenomenon that has an influence and is influenced by society. This approach uses qualitative research methods, such as interviews and observations, to understand how the law is applied and how society interacts with the law. The results of this study reveal that the implementation of the collection of Land and Building Acquisition Tax in Jayapura Regency is when there is a transfer of land and building rights due to a sale and purchase with a transaction value lower than the market price, the transaction value will be determined by DPPKAD officers based on the market price and a survey of the relevant taxable object, whereas the provisions of Article 87 paragraph 2 of Law Number 28 of 2009 and Article 7 of Jayapura Regency Regional Regulation Number 2 of 2011 state that the basis for imposing BPHTB tax on the acquisition of sale and purchase rights with a transaction value lower than the market price, then the basis for imposing BPHTB tax is the Taxable Object Sales Value (NJOP) of Land and Building Tax.

Abstract

The use of artificial intelligence (AI) in legal, economic, and social decision-making has created significant legal implications in the realm of civil law. The shift from human-based decisions to autonomous algorithmic decisions raises the question of who should be held responsible when AI decisions cause harm. In the context of Indonesian law, this issue is increasingly complex because the civil legal framework still relies on the paradigm of fault-based liability as formulated in Article 1365 of the Civil Code, while AI is not recognized as a legal subject. This study aims to examine the normative framework for regulating artificial intelligence in the Indonesian legal system and analyze the construction of civil legal liability for AI-based decision-making. The research method used is normative legal research with a limited statutory, conceptual, and comparative approach. The results show that Indonesian positive law still experiences a normative vacuum in regulating accountability, standards of responsibility, and protection mechanisms for victims of AI decisions. This study confirms that the application of the concept of fault-based unlawful acts is difficult to implement effectively due to the autonomous and non-transparent nature of AI. Therefore, this study recommends the reconstruction of civil legal responsibility through the application of strict liability and risk-based liability, mapping the chain of responsibility, and strengthening the principle of prudence and victim protection to realize legal certainty and substantive justice in the era of artificial intelligence.
