Abstract

Digital transformation in land registration in Indonesia triggers a conflict of laws regarding the electronic issuance of deeds by Land Deed Officials (Pejabat Pembuat Akta Tanah / PPAT). This study aims to analyze the disharmony between Government Regulation Number 18 of 2021 and Government Regulation Number 37 of 1998 concerning the prerequisite of physical presence, its implications for personal data protection governance, and to formulate a regulatory architecture through a comparative study. The method employed is normative legal research utilizing statutory, conceptual, and comparative approaches. This study applies a jurimetric instrument through the Legal Reliability Index (LRI) modeling to quantitatively measure the degree of evidentiary reliability of deeds. The results indicate that non-compliance with the physical presence requirement degrades the status of an authentic deed to a private deed (akta di bawah tangan) pursuant to Article 1869 of the Indonesian Civil Code. Simulation of the LRI formula demonstrates that procedural compliance regarding physical presence serves as the primary determinant maintaining the independent validity of the deed, while concurrently limiting the scope of the PPAT's liability from cyber system failure risks at the Land Office under the Personal Data Protection Law. This study recommends the adoption of a hybrid model based on a cautionary approach, drawing from practices in Germany. Physical presence remains mandatory for the substance of rights transfer to validate intent, whereas the archiving of original deeds (minuta akta) is centrally computerized. Amendments to the PPAT Position Regulations are necessary to align technological efficiency with formal civil law certainty.

Abstract

This study aims to analyze the fairness of land acquisition compensation for communities affected by infrastructure development in Indonesia. The main focus of the study is to examine the gap between normative provisions mandating "fair and just" compensation and the reality of implementation on the ground, as well as to identify factors that often cause communities to feel disadvantaged in the land acquisition process. This study uses a juridical-normative method strengthened by an empirical approach. Data were collected through a literature review of laws and regulations, court decisions, and related policy documents, as well as in-depth interviews with affected communities, government officials, and land appraisers at several national strategic project locations. The results show that although the legal framework has regulated the principle of fairness, its implementation still faces various obstacles, including unclear assessment standards, weak transparency and community participation, limited appraisal resources, and minimal assistance for vulnerable groups. Fairness in compensation is not simply measured by nominal values; it must include procedural, distributive, and restorative justice. This study recommends the need for more measured regulatory reformulation, strengthening institutional capacity, and a transformative approach that prioritizes the recovery of the socio-economic conditions of affected communities, so that infrastructure development truly brings prosperity without leaving anyone behind.

Abstract

This study aims to analyze the state's responsibility towards victims of land mafia from the perspective of legal certainty and justice. Land mafia causes serious harm by seizing land rights, weakening legal protection, and reducing public trust in the state. This study uses a normative juridical method with a statutory and conceptual approach. Data were obtained through a literature review of primary, secondary, and tertiary legal materials, then analyzed qualitatively. The results show that the state has a responsibility to prevent, prosecute, and restore the rights of land mafia victims through a transparent land administration system, firm law enforcement, and a fair redress mechanism. Legal certainty has not been fully achieved due to weaknesses in land data validation, official oversight, and slow dispute resolution. From a justice perspective, victims must not only obtain legal recognition but also receive rights restoration, protection from criminalization, and adequate compensation if the state is proven negligent. Therefore, the state's responsibility must be actively realized through improving land governance, strengthening inter-institutional coordination, and providing easy access to justice for victims. This research confirms that protecting land mafia victims is an important part of a state based on law that guarantees legal certainty and justice.

Abstract

Latar Belakang Masalah: Kekerasan Dalam Rumah Tangga (KDRT) merupakan pelanggaran hak asasi manusia yang secara tidak proporsional berdampak pada perempuan dan anak. Tulisan ini bertujuan untuk menganalisis strategi pencegahan serta mekanisme perlindungan hukum bagi korban di Indonesia. Metode Pengabdian: Upaya pencegahan difokuskan pada penguatan ketahanan keluarga, sosialisasi edukatif, dan penghapusan stereotip gender. Sementara itu, mekanisme perlindungan hukum dilakukan melalui implementasi UU No. 23 Tahun 2004 tentang Penghapusan KDRT, yang mencakup penyediaan perlindungan sementara oleh kepolisian, surat perintah perlindungan dari pengadilan, serta layanan pemulihan kesehatan dan psikologis. Hasil Pengabdian: Hasil kajian menunjukkan bahwa keberhasilan penanganan KDRT sangat bergantung pada sinergi antara penegak hukum, lembaga pendukung, dan keberanian korban untuk melapor.

Abstract

Latar Belakang Masalah: Di tingkat tapak/desa, salah satu pemicu utama munculnya sengketa pertanahan adalah masih banyaknya bidang tanah milik masyarakat yang belum bersertifikat atau hanya berlandaskan bukti kepemilikan adat/tradisional (seperti alas hak berupa girik, SKT, atau sporadik) yang rentan terhadap gugatan hukum. Ketidakpastian hak atas tanah ini tidak hanya merugikan masyarakat secara ekonomi karena melemahkan nilai tawar aset, tetapi juga memicu konflik horizontal antarwarga maupun konflik vertikal antara warga dengan pihak swasta atau pemerintah. Kesimpulannya: Masyarakat memperoleh pemahaman baru bahwa hak kepemilikan atas tanah tidak bersifat mutlak, melainkan terikat oleh fungsi sosial dan Rencana Tata Ruang Wilayah (RTRW). Kepatuhan terhadap penataan ruang sangat penting agar pemanfaatan tanah tidak menimbulkan sanksi hukum maupun risiko bencana ekologis di masa depan.
