Abstract

Differences are a natural thing, but differences of opinion in determining the initial time of dawn need to be reconsidered, because this concerns the human obligation to worship. Therefore, this research was conducted with the aim of discussing various kinds of differences regarding the initial determination of dawn and finding the right conclusions. The research method used is qualitative, by applying library research that uses various kinds of literature to become basic research guidelines. The results of this study indicate that at -20o the light cannot be seen because it is still too far below the horizon, so if at that point the light is seen then it is necessary to ask whether the light comes from dawn or is the light of the zodiac or what is known as the kadzib dawn (dawn false).

Abstract

ABSTRACTBased on the reality that is happening now. Divorce in some cities has increased, especially in Surabaya city. Therefore, the Office of Religious Affairs (KUA) Sawahan runs a secret marriage learning program (BERKAH) with the aim of stabilizing the bride and groom. The program is instructed directly from KUA center to KUA sub-districts with class A status and this research aims to provide supplies to bride and groom couples.This type of research is included in the field research, namely research based on the results of observations and interviews with the head of the KUA Sawahan District regarding the BERKAH program. The researcher collected data directly and interviewed the parties concerned at the KUA Sawahan District, Surabaya City. After the data is collected, the author analyzed using a qualitative method.The results of the research stated that the program was an attempt to provide provisions for the bride and groom. In order for the bride and groom to be more stable in running the household. From the perspective of Maqa>s{id Shari>’ah, the program is very closely related to maintaining religion, maintaining the soul, maintaining reason, guarding offspring and protecting property.Keywords: Consolidation of Brides, BERKAH Program, Maqa>s{id Shari>’ah.

Abstract

الإرشاد قبل النكاح هو ساحة التقديم لمجند الزوجين في بناء العائلة المستقبل. إذا هذا البزنامج مهم جدا لمجند الزوجين ان يشتركواه، ليجدوا علم عن المناكحات، وسوف يتشكلوا عائلة السكينة. منهج الباحث في هذا البحث هو البحث المكتبي يعني جمع الأنشطة المتعلقة بأسلوب جمع البيانات المكتبية والقراءة والكتابة مع عملية المواد البحثية. نتائج هذا البحث، أولا الإرشاد قبل النكاح الذي تطبق في الإدارة شؤون الدينية متعمد يومين, تبدأ من الساعة الثامنة تختم في الساعة الخامسة. يوجد 16 خصص. المتحدثون الذين يبلغون المحاضرة في برنامج الإرشاد قبل النكاح لهم الشهادة من الوزيرة الدينية. و كذلك المشتركون يوجد 16 منجد الزوجين. و الثاني الإرشاد قبل النكاح الذي تطبق في الإدارة شؤون الدينية يستعمل القواعد تنظيم المدير العام لإرشاد المجتمع الإسلامي رقم : 542 سنة : 2013, بزيادة القواعد قرار المدير العام لإرشاد المجتمع الإسلامي رقم 373 عام 2017. و قد وافق على ذلك.الكلمات الأساسية : الإرشاد قبل النكاح، النكاح

Abstract

Establishing a statutory regulation as a guide in acting is one of the things that the government needs to do, this is also used as a form of government effort in the welfare of its people. However, it can be seen that the current condition where almost all countries including Indonesia have been hit by the Covid-19 outbreak, which means that the situation or situation of the community is not same like before pandemic era. Covid-19 is an infectious disease where the cause of this disease comes from Severe Acute Respiratory Syndrome Coronavirus 2 (SARS-CoV-2), or a type of coronavirus that was recently discovered. Covid-19 is now designated as a pandemic, where many cases have occurred all over the world. With this pandemi, it certainly has an impact on various fields of life, one of which is the law. Therefore, the flexibility of the law is questioned considering the current condition of Indonesian society is not the same. The purpose of this paper is to answer the formulation of the problem, to describe out the emergencial condition as a basic of the change of the legislation and islamic law in Indonesia during the Covid-19 pandemic.

Abstract

Premarital health tests are a series of tests that couples must undergo before getting married. The procedures for carrying out pre-marital health checks in Surabaya were determined in 2017 according to a circular issued by the Mayor of Surabaya, Tri Rismaharini. This research aims to explore pre-marital health examinations in the KUA Semampir sub-district, Surabaya city, and how the KUA responds to the results of these pre-marital health tests. This research is field research. The results of this research show that (1) KUA does not have a maximum limit on when the test must be carried out. (2) The health test examination is carried out at the health center. (3) The prospective bride and groom will also receive reproductive counseling. (4) If the results of the test show that the prospective bride and groom are unhealthy, the KUA has no right to postpone the marriage. The decision is completely left to the bride and groom.

Abstract

In family relationships between husband and wife, particularly in times of disagreement, violent behavior often arises and is sometimes misinterpreted as being sanctioned by the Qur'an, such as in Sūrat al-Nisā': 34, where hitting a wife is considered acceptable. However, the historical life of Rasulullah reflects that the Prophet never struck his spouse. This study investigates the hadith reported in Musnad Aḥmad bin Ḥanbal that highlights this aspect of the Prophet's behavior. The research employs a qualitative approach through library research, utilizing the takhrīj hadīs method to examine the isnād and matan of selected hadiths. Additionally, content analysis is applied to interpret the findings within the context of non-violence in family education. The results indicate four authentic hadiths in Musnad Aḥmad bin Ḥanbal, emphasizing that Rasulullah never engaged in physical violence against women, including his wives. This research underscores the Prophet's exemplary conduct and its implications for fostering harmonious family relationships.

Abstract

This study aims to examine the position of the mepamit custom in Indonesian marriage law and to understand the views of religious leaders on the implementation of this tradition in the context of interfaith marriage in Petang Village, Badung Regency, Bali. Mepamit is a traditional procession in Balinese Hindu society that functions as a request for spiritual permission to ancestors when someone wants to change religions due to interfaith marriage. This study uses a qualitative approach with case study methods, in-depth interviews, and participatory observation. The results of the study indicate that mepamit has a position as a living customary law and plays an important role in maintaining the continuity of spiritual relationships between individuals and their ancestors. Hindu religious leaders emphasize that this procession is a moral and spiritual obligation, while Islamic religious leaders show a tolerant attitude as long as its implementation does not violate the principles of faith. These findings show that mepamit is a symbol of reconciliation between individual freedom and collective values, and reflects the practice of functional tolerance in a multicultural society. This study contributes to strengthening legal pluralism in Indonesia and provides new understanding of the role of customary law in contemporary socio-religious dynamics.

Abstract

Penelitian ini bertujuan untuk mengetahui tingkat penerimaan masyarakat terhadap hukum Islam. Metode penelitian yang digunakan dalam penelitian ini adalah metode kepustakaan (library research). Studi pustaka atau kepustakaan merupakan suatu kegiatan yang berkaitan dengan langkah-langkah pengumpulan data dengan cara pustaka atau berdasarkan data yang sudah ada, membaca dan mencatat serta mengolah bahan penelitian. Hukum Islam diterima dengan baik oleh masyarakat Indonesia, yang mana Indonesia merupakan negara dengan mayoritas penduduk beragama Islam. Meskipun pada kenyataannya hukum Islam tersebut tidak dilaksanakan secara keseluruhan bahkan oleh muslim itu sendiri, tetapi nilai-nilai dalam hukum Islam tersebut sudah mempengaruhi cara pandang dan kehidupan sehari-hari masyarakat. Hukum Islam yang dimaksud di sini bukan berarti hukum yang benar-benar harus tertulis dan tertuang di dalam peratuuran perundang-undangan, melainkan hukum yang dapat dilakukan dengan bebas oleh masyarakat muslim, selama hal tersebut saling berjalan beriringan dengan hukum yang berlaku di Indonesia.

Abstract

This study aims to explore a model for measuring the sakinah level of a family. The research method used in this research is library research. literature study is an activity related to the steps of collecting data by means of the library or based on existing data, reading and recording and processing research materials. The results of this study are the proposed form of the method used to measure the level of sakinah families in Indonesia based on the applicable laws and regulations. The results of this study indicate that there are 4 aspects that must be used to measure based on indicators from the Ministry of Religion regarding the Sakinah Family Movement, namely aspects of legality of marriage, spiritual aspects, physiological aspects and aspects of affection.
