Abstract

Establishing a statutory regulation as a guide in acting is one of the things that the government needs to do, this is also used as a form of government effort in the welfare of its people. However, it can be seen that the current condition where almost all countries including Indonesia have been hit by the Covid-19 outbreak, which means that the situation or situation of the community is not same like before pandemic era. Covid-19 is an infectious disease where the cause of this disease comes from Severe Acute Respiratory Syndrome Coronavirus 2 (SARS-CoV-2), or a type of coronavirus that was recently discovered. Covid-19 is now designated as a pandemic, where many cases have occurred all over the world. With this pandemi, it certainly has an impact on various fields of life, one of which is the law. Therefore, the flexibility of the law is questioned considering the current condition of Indonesian society is not the same. The purpose of this paper is to answer the formulation of the problem, to describe out the emergencial condition as a basic of the change of the legislation and islamic law in Indonesia during the Covid-19 pandemic.

Abstract

Premarital health tests are a series of tests that couples must undergo before getting married. The procedures for carrying out pre-marital health checks in Surabaya were determined in 2017 according to a circular issued by the Mayor of Surabaya, Tri Rismaharini. This research aims to explore pre-marital health examinations in the KUA Semampir sub-district, Surabaya city, and how the KUA responds to the results of these pre-marital health tests. This research is field research. The results of this research show that (1) KUA does not have a maximum limit on when the test must be carried out. (2) The health test examination is carried out at the health center. (3) The prospective bride and groom will also receive reproductive counseling. (4) If the results of the test show that the prospective bride and groom are unhealthy, the KUA has no right to postpone the marriage. The decision is completely left to the bride and groom.

Abstract

This study aims to examine the position of the mepamit custom in Indonesian marriage law and to understand the views of religious leaders on the implementation of this tradition in the context of interfaith marriage in Petang Village, Badung Regency, Bali. Mepamit is a traditional procession in Balinese Hindu society that functions as a request for spiritual permission to ancestors when someone wants to change religions due to interfaith marriage. This study uses a qualitative approach with case study methods, in-depth interviews, and participatory observation. The results of the study indicate that mepamit has a position as a living customary law and plays an important role in maintaining the continuity of spiritual relationships between individuals and their ancestors. Hindu religious leaders emphasize that this procession is a moral and spiritual obligation, while Islamic religious leaders show a tolerant attitude as long as its implementation does not violate the principles of faith. These findings show that mepamit is a symbol of reconciliation between individual freedom and collective values, and reflects the practice of functional tolerance in a multicultural society. This study contributes to strengthening legal pluralism in Indonesia and provides new understanding of the role of customary law in contemporary socio-religious dynamics.

Abstract

The phenomenon of gamophobia, or excessive fear of marriage, is increasingly observed among Muslim Generation Z due to family trauma, economic uncertainty, and exposure to negative narratives about marriage on social media. This situation creates tension between Islamic teachings that present marriage as a source of sakinah, mawaddah, and rahmah and the perceptions of young Muslims who often associate marriage with risk and emotional burden. This study aims to explore how Muslim Generation Z perceive marriage, identify factors contributing to marriage anxiety, and examine how Qur’anic marriage values are understood and interpreted in relation to these concerns. Employing a qualitative approach within the Living Qur’an framework of Ahmad Rafiq, data were collected through in-depth interviews with ten participants in Surabaya, including students, young professionals, a family counselor, and a religious counselor. The data were analyzed using thematic analysis. The findings indicate that marriage anxiety is shaped by family conflict experiences, economic pressures, social media influence, and limited internalization of Qur’anic marriage values. Although most participants were familiar with concepts such as sakinah, mawaddah, rahmah, mutual support, and responsible partnership, these values were often understood at a cognitive level and had not always been translated into emotional confidence regarding marriage. The study identifies a gap between normative religious understanding and personal readiness for marital commitment. The findings suggest that strengthening reflective and contextual engagement with Qur’anic marriage values may contribute to helping Muslim youth develop more constructive perspectives on marriage. This study contributes to Living Qur’an scholarship by examining how Qur’anic teachings on marriage are interpreted within the context of contemporary marriage anxiety among Muslim Generation Z.

Abstract

The traditional distribution of zakat, which focuses on individual charitable aid to the eight categories of recipients (asnāf), is increasingly seen as less effective at addressing the multidimensional vulnerabilities of modern Muslim families. This socio-legal research underscores the necessity of repositioning zakat from a predominantly consumptive tool into a transformative mechanism for strengthening family resilience. Using Froma Walsh’s Family Resilience Theory as an analytical lens, this study examines the strategic redefinition of the eight asnāf. The research employs a socio-legal approach, combining normative legal analysis of fiqh texts with an examination of contemporary zakat policies and practices to develop an integrative analytical framework. The findings indicate that redefining the asnāf enables zakat distribution to move beyond consumptive assistance toward a more integrated and preventive approach that supports multiple dimensions of family resilience, including economic stability, relational cohesion, and value reinforcement. This study proposes a family-centered zakat distribution framework, in which zakat not only fulfills basic needs but also actively strengthens systemic resilience, in line with the maqāṣid al-sharÄ«”˜ah, particularly the protection of progeny (ḥifẓ al-nasl) and wealth (ḥifẓ al-māl).

Abstract

In the Islamic context, the quality of the relationship between husband and wife is greatly influenced by the husband's character, which is measured based on the hadith "Khiyārukum Khiyārukum Linisāihim," narrated in the Sunan al-Tirmidhi. This study aims to analyze the normative meaning of this hadith, particularly in relation to the husband's character within the family. The research methodology employed is qualitative, using a library research approach and the Takhrīj al-Ḥadīṡ technique to verify the sanad and matn of the hadith, along with a syarah analysis to understand the relevance of the hadith's content to the husband's character in building a sakinah family. The findings of this study indicate that the quality of a husband's faith is reflected in his treatment of his wife, which includes love, justice, responsibility, and gentleness. This discovery contributes to understanding the importance of the husband's character in creating marital harmony and reducing the potential for divorce. In conclusion, this research affirms that this hadith is not only theologically relevant but also practical in establishing a sakinah, mawaddah, and rahmah Islamic family. Future research is expected to further explore the application of the values in this hadith within the context of modern social realities.

Abstract

This study aims to analyze the dual function of this tradition as a mechanism for annulling Javanese marital taboos and an instrument for strengthening social cohesion in Bojonegoro society, employing an anthropological-sociological approach. The research utilized a qualitative case study method through participant observation, in-depth interviews with 14 informants, and document studies. Data were analyzed thematically using an interdisciplinary approach, integrating perspectives from Ehrlich's Legal Anthropology, Merton's Structural Functionalism, and Durkheim's Social Solidarity theory. The findings reveal that Malem Songo functions as a living law, offering a cultural solution for couples facing customary taboos (such as Jilu and incompatible weton calculations), while simultaneously serving as a strategic moment to strengthen bonding and bridging social capital through homecoming (mudik) and mass weddings. It is concluded that this tradition is a self-reinforcing socio-cultural system achieved through the dialectic of its annulment and solidarity functions. The importance of education that balances tradition preservation with a rational understanding of customary values is suggested.
