Abstract

Inequality is one of the recent problems in Indonesia. Difference in Gini ratio in some provinces in the country is due to many factors, one of which is ICT. This study is analyze effect of ICT on Gini ratio in high and low inequality area in 2012–2018. Panel data regression is used as the analysis method. Results showed that in areas with high inequality, percentage of households that own or able to use computers had a positive and significant effect while the percentage of households accessing internet had a negative and significant effect on Gini ratio and in the areas with low inequality, the percentage of households accessing internet had a negative and significant effect on Gini ratio.

Abstract

Dalam hukum dasar perkawinan, menyegerakan perkawinan bagi pasangan yang telah mampu (istiṭā’ah) dan memiliki bekal (al-bā’ah) merupakan anjuran. Oleh karena itu, memberi kemudahan dalam proses pernikahan menjadi harapan banyak pihak, baik otoritas penyelenggara perkawinan maupun keluarga mempelai. Kantor Urusan Agama, sebagai pihak yang melaksanakan sebagian tugas Kementerian Agama dalam pelaksanaan pencatatan pernikahan, berkomitmen untuk menuju harapan tersebut. Dengan memanfaatkan perkembangan teknologi, KUA meluncurkan aplikasi SIMKAH (Sistem Informasi Manajemen Nikah) sejak 08 November 2018. Artikel ini hendak menelaah tentang pemahaman masyarakat Kecamatan Driyorejo Kabupaten Gresik terhadap aplikasi SIMKAH. Penelitian ini adalah bagian dari penelitian lapangan (field research), dengan sumber data dari 17 responden berupa pemahaman masyarakat Kecamatan Driyorejo Kabupaten Gresik terhadap Aplikasi SIMKAH. Metode penelitian dilakukan dengan wawancara dan dokumentasi. Hasil penelitian menunjukkan bahwa dari 15 responden, 7 responden (46 %) di antaranya belum dan baru pertama kali mengetahui tentang Aplikasi SIMKAH, 5 responden (33%) pernah mendengar namun belum begitu memahami Aplikasi SIMKAH, dan 3 responden (21%) mengaku memahami dan bisa menggunakan Aplikasi SIMKAH. Penelitian menyimpulkan bahwa pemahaman dan pemanfaatan masyarakat terhadap Aplikasi SIMKAH masih rendah. Peneliti menyarankan agar beberapa pihak, KUA atau Kementerian Agama, unsur masyarakat dan sivitas akademik bisa menjadi unsur pendukung dalam peningkatan pemahaman terhadap Aplikasi SIMKAH. Abstract

Salah satu upaya MCCC Surabaya dalam menigkatkankan ketahanan keluarga pada masa pandemi covid 19 dengan beberapa program yaitu (1) Program preventif dan kuratif adalah program yang memberikan penyuluhan kepada masyarakat tentang bahaya Covid dan penyembuhan terhadap masyarakat yang terkena covid-19 (2) Program lumbung pangan adalah berupa pemberian bantuan kepada masyarakat yang terkena covid -19 berupa sembako murah dan pemberian masker (3) Program pendataan adalah data masyarakat yang terdampak covid-19 (4) Program isolasi mandiri adalah orang yang terkena rapid tes atau sudah positif covid-19 sehingga MCCC ini sudah bekerja sama dengan pemerintah provinsi atau kota. Penelitian ini bermaksud untuk mengetahui Peran MCCC Muhammdiyah Surabaya dalam meningkatkan ketahanan keluarga pada masa pandemi Covid-19 dan analisis peran MCCC Muhammadiyah Surabaya dalam menigkatkan ketahanan keluarga pada masa pandemi perspektif Maqasid Syariah. Penelitian ini menggunakan metode penelitian kulitatif yang datanya diperoleh dari hasil wawancara dan dokumentasi sedangkan jenis sumber data ialah data primer berupa data-data program MCCC Muhamamdiayh Surabaya dan data sekundernya berupa buku, jurnal, dan artikel yang berkaitan dengan hasil peneliatian di PDM Surabaya sesuai dengan judul yaitu Peran Muhammadiyah Covid-19 Command Center (MCCC) Muhammadiyah Surabaya dalam Menigkatkan Ketahanan Keluarga Di Masa Pandemi Covid-19 Persefektif Maqasid Syari’ah. Hasil penelitian ini menujukkan bahwa MCCC Surabaya sangat berperan penting dalam meningkatkan ketahanan keluarga baik dari segi psikologis, ekonomi dan sosial yang sesuai dengan Persefektif Maqasid Syari’ah, terutama pada penjagaan jiwa (ḥifẓ al-nafs), penjagaan pada harta (ḥifẓ al-māl), dan penjagaan pada akal luhur manusia (ḥifẓ al-‛aql). Abstract

A woman (wife) has an obligation to carry out Ihdad, because her husband has died for four months and ten days. This is a condition in which the wife must restrain or mourn. During that time, the wife should express her grief by not decorating and not leaving the house. It aims to respect the death of the husband. If the Iddah period is over, then there is no prohibition for women to decorate themselves, make proposals, and even enter into a marriage contract. But in this era, many women who have work outside to make a living such as career women or civil servants. If Ihdad is implemented, they will automatically be unable to work and will not get income. This is the main problem that will be discussed in this thesis to get a balanced answer. The author focuses the discussion on the main opinion of the elite figure of PC Aisyiah Ngoro, Mojokerto.From the background of the problem the writer formulates the problem into 3. They are 1) How is Ihdad in Islamic Sharia? 2) What is the opinion of the elite figure of PC Aisyiah Ngoro, Mojokerto about Ihdad and its application for civil servants orcareer women? 3) What is the wisdom of applying Ihdad syariah from the perspective of the elite figure of PC Aisyiah Ngoro, Mojokerto? This research is a qualitative research using interview data collection method with the object of the elite figure PCAisyiah Ngoro, Mojokerto and analyzing it using descriptive qualitative analysis of the results of the interview.The results of this study are that women (wives) who have been left by their husbands because of death are obliged to carry out Ihdad for 4 months and 10 days leaving all jewels and not leaving the house, according to the view of the elite figureof PC Aisyiah Ngoro Mojokerto a woman (wife) left by her husband may leave the house in the context of urgent and dhorurah needs, because going out to make a living for women today is part out of necessity, while still paying attention to the problem of decorating, is limited to his needs in his work, so that no man may come near him so that marriage does not occur during his Iddah. The wisdom of Ihdad is as a form of tafakkur and obedience to Allah SWT and His Rasul, maintaining the health of a woman, her temperament and honor before other men, as a form of respect for herhusband and family.

Abstract

The Rebo Wekasan celebration for the Indonesian Muslim community begins with information from parents from generation to generation, teachers to students, and elders to younger generations without mentioning a special event. This culture continues to be sustainable, especially in Javanese society, and Wonoayu Sidoajo is no exception in East Java. This celebration is carried out because of deep concern from the belief that Allah has sent down 320,000 disasters on the last Wednesday of the month of S}afar in the Hijri year, called Rebo Wekasan. The ancient Jahiliyah community, including the Arabs, often said the month of S}afar was the month of Tasa'um or bad luck. Some Muslims still believe this assumption today, including some Indonesians, especially the Javanese people. Based on this phenomenon, how can this tradition be preserved and commemorated, especially in Wonoayu? This question is the focus of attention in this research. This research is a living Qur’an study using a phenomenological and library research approach based on social phenomena in Wonoayu District, Sidoarjo. The results of this study indicate that in the Rebo Wekasan tradition, there is a living Qur’an phenomenon in the form of a practice carried out by carrying out the Sema’an of the Qur’an and reading surah Yasin 3 times with the hope that because of the blessings the community is safe from all kinds of diseases.

Abstract

In family relationships between husband and wife, particularly in times of disagreement, violent behavior often arises and is sometimes misinterpreted as being sanctioned by the Qur'an, such as in Sūrat al-Nisā': 34, where hitting a wife is considered acceptable. However, the historical life of Rasulullah reflects that the Prophet never struck his spouse. This study investigates the hadith reported in Musnad Aḥmad bin Ḥanbal that highlights this aspect of the Prophet's behavior. The research employs a qualitative approach through library research, utilizing the takhrīj hadīs method to examine the isnād and matan of selected hadiths. Additionally, content analysis is applied to interpret the findings within the context of non-violence in family education. The results indicate four authentic hadiths in Musnad Aḥmad bin Ḥanbal, emphasizing that Rasulullah never engaged in physical violence against women, including his wives. This research underscores the Prophet's exemplary conduct and its implications for fostering harmonious family relationships.

Abstract

The practice of polygamy, especially in the form of marriage applications for fourth wives, still raises legal and ethical debates in Indonesian society. The Malang City Religious Court Decision Number 1471/Pdt.G/2024/PA.MLG is an interesting case. Which granted the application. This study aims to analyze the judge's reasoning in the decision through the perspective of Maqāṣid al- Sharī'ah according to Imam al-Syāṭibī, to evaluate the extent to which the decision is in line with the five main objectives of the Shari'ah (al-kulliyyāt al-khamsah). The research method used is qualitative with a normative juridical approach, focusing on analyzing legal documents, court decisions, and relevant literature. The results showed that although the petition was granted formally, not all aspects of maqāṣid, such as the protection of the soul (ḥifẓ al-nafs), offspring (ḥifẓ al- nasl), and property (ḥifẓ al-māl) were fulfilled thoroughly. The application of maqāṣid is still partial and tends toward administrative justification. The implications of this finding emphasize the importance of comprehensively strengthening the maqāṣid al-shari'ah approach in family law considerations so that the policies taken are not only legally valid but also reflect the value of justice and substantial benefit as the main objectives of Islamic law.

Abstract

Sekolah Dasar Negeri (SDN) 3 Wringinanom adalah lembaga pendidikan yang bertempat di Kecamatan Panarukan Situbondo Jawa Timur. Sejak didirikan pada Tahun 1967, sekolah ini tidak memiliki legalitas  tanah dan bangunan. Padahal legalitas merupakan sesuatu yang harus dimiliki sebagai bukti keabsahan dan berkekuatan hukum demi pengembangan sarana dan prasarana sekolah. Pendampingan advokasi legalitas ini diperlukan sebagai bagian dari pengabdian masyarakat untuk mengedukasi beberapa pihak, terutama pihak sekolah dan Perseroan Terbatas Perkebunan Nusantara (PTPN) XI Pabrik Gula Wringinanom, sebagai pihak yang memiliki hak atas tanah sekolah tersebut. Kegiatan pengabdian ini difokuskan pada proses advokasi. Metode pelaksanaan dalam kegiatan ini adalah negoisasi dan lobbiying, dengan jenis non-litigasi, yang terdiri dari 4 tahapan, mulai dari kesadaran masalah, penyusunan dokumen, lobbiying-negoisasi, dan evaluasi. Tujuan dari pendampingan advokasi ini adalah titik temu yang bisa diharapkan antara kepentingan PTPN XI dan SDN 3 Wringinanom. Berdasarkan proses pendampingan ini, komunikasi antara pihak sekolah dan PTPN mulai terjalin setelah bertahun-tahun tidak ada diskusi. Selain itu, advokasi legalitas tanah ini semakin membuat para pihak di SDN 3 Wringinanom sadar hukum, khususnya terkait Undang-Undang Pokok Agraria (UUPA), dan komitmen bersama untuk mewujudkan legalitas tanah dan bangunan demi perkembangan sarana dan prasarana sekolah yang lebih baik.

Abstract

Perceraian merupakan suatu perbuatan hukum yang dapat menimbulkan akibat-akibat hukum turunannya, salah satunya terkait dengan nafkah yang terdapat dalam putusan No.3676/Pdt.G/2018/Pa.Sby. Penelitian ini merupakan penelitian kualitatif dengan pendekatan yuridis normatif dengan mengumpulkan data berupa argumen hakim yang tertuang dalam putusan No.3676/Pdt.G/2018/Pa.Sby, serta sumber-sumber lain yang terkait . Data tersebut dianalisis secara deskriptif kemudian diuraikan dengan jelas dan dilakukan analisa dengan cara menghubungkan pertimbangan hakim dalam penentuan nafkah cerai talak raj‘i dengan kajian-kajian hukum Islam di Indonesia dan fiqh, selanjutnya diambil kesimpulan. Hasil penelitian ini menunjukkan bahwa hakim menggunakan pertimbangan yang berdasarkan pada Kompilasi Hukum Islam Pasal 149 huruf (a) dan (b), Pasal 156 huruf (d), tuntutan istri, kepatutan dan kelayakan, tidak memberatkan suami, lamanya usia perkawinan, lamanya nafkah yang tidak dibayarkan, pekerjaan dan penghasilan suami, kesanggupan suami, dan kewajaran bagi anak. Dasar penentuan nafkah tersebut telah sesuai dengan hukum Islam di Indonesia dan fiqh, terutama dalam Sūrat al-Baqarah; 236, karena lebih mempertimbangkan juga pada kemampuan suami. Abstract

The intersection of religion and culture in Indonesia often provides new patterns in religious practice, including marriage. For example, the islamic marriage of Ahai Vau (cross-social class) in Feer, Kei Besar Selatan, Southeast Maluku. There are three social classs, namely mel-mel (top), riy-riy (middle), and ren-ren (bottom). This cultural prohibition consisted of the term kafā'ah in Islam. This study aimed to determine the practice of Ahai Vau marriage in Per Village and analyzed it from the concept of Kafā'ah (equality) in Islam. This type of research used descriptive-qualitative techniques, with the method of observation and interviews in data collection. The results showed that the practice of Ahai Vau Islamic marriage in Per still placed social class status as a necessity. So crosssocial class marriage was prohibited and considered a violation of customs. In Islam, someplace Kafā'ah is a condition for a valid marriage, but most scholars prefer to place Kafā'ah as a condition of luzum, a condition that must exist. Social class in Ahai Vau marriage is not a requirement for marriage because there are still two choices, cross-social class marriage, while carried out outside the village, and inter-tribal marriage.
