Abstract

This research explores the legal aspects of non-verbal marriage contracts (akad nikah tunawicara) from the perspectives of Islamic law and the Shafi'i school of thought. The marriage contract is an agreement between two parties who enter into matrimony through the process of ijab (proposal) and qabul (acceptance). Generally, a marriage contract is deemed valid if it meets the necessary conditions and pillars. However, for individuals with special needs, particularly those who are non-verbal, there are specific methods for conducting the marriage contract. The objectives of this research are: 1. To understand the procedures of a non-verbal marriage contract according to Islamic law. 2. To determine the legal aspects of a non-verbal marriage contract according to the Shafi'i school of thought. This research adopts the library research method, involving the examination of relevant books and literature related to the discussed issues. The findings of this study indicate that: 1. Non-verbal marriage contracts, from an Islamic legal perspective, must adhere to the pillars and conditions of marriage, similar to marriages involving individuals who can communicate verbally. Non-verbal communication can be through understandable gestures, writing, or representation by a proxy. If the individual can write, the marriage contract is valid using that written form, just as it is valid using gestures. This opinion has been agreed upon by scholars. 2. Imam Shafi‘i asserts that a marriage contract in written form is valid, provided there is someone who reads it on behalf of the party involved. If no one reads it on their behalf, the contract is considered invalid. Additionally, Imam Shafi‘i deems a marriage contract valid through gestures for those unable to write, although he suggests combining gestures with written representation if possible.

Abstract

This study aims to examine the effectiveness of the implementation of Suscatin in KUA Karossa District, as well as to analyze the supporting and inhibiting factors in its implementation. This study uses a qualitative descriptive method (Field research), with data collection techniques in the form of observation, interviews, and documentation. The research subjects consisted of the head of KUA, Islamic religious extension workers, and course participants. Data analysis is carried out through the process of data reduction, data presentation, and conclusion drawn. The results of the study show that Suscatin at KUA Karossa has been implemented in accordance with technical instructions from the Ministry of Religious Affairs, and has a fairly good effectiveness in providing an understanding of the rights and obligations of husband and wife, communication in the household, and conflict management. This can be seen from the increasing awareness of brides-to-be on the importance of readiness before marriage, and the decrease in divorce rates after the program is carried out regularly. Supporting factors in the implementation of this program include the existence of active religious extension workers, cross-agency cooperation, and community support. Meanwhile, the inhibiting factors are limited facilities, and lack of operational funds.

Abstract

Salah satu alasan yang mendasari putusnya pernikahan adalah gugat cerai yang disebabkan perginya atau menghilangnya suami tanpa keterangan yang jelas, yang menyebabkan tidak jelasnya status pernikahan dan sengsaranya istri yang ditinggalkan. Permasalahan yang akan dibahas mengenai Fiqih Munakahat dan Hukum Positif mengenai suami yang hilang atau mafqud, kemudian di komparasikan terhadap putusan perkara No. 2791/Pdt.G/2021/PA.Kng. Dalam penelitian ini penulis menggunakan metode penelitian kualitatif dengan menggabungkan dua jenis data, yakni data yang didapatkan dengan cara (field research) berupa wawancara dan dokumentasi di Pengadilan Agama Kuningan, juga dengan data kepustakaan (library research) berupa dokumen putusan atau penetapan hakim mengenai perkara gugat cerai ketika suaminya mafqud atau hilang. Data yang telah penulis dapatkan kemudian direduksi, disajikan, dan yang terakhir disimpulkan dengan menggunakan teknik analisis deskriptif-komparatif. Dalam proses penetapan permohonan perkara gugat cerai ketika suaminya mafqud atau hilang hakim menggunakan landasan hukum yang bersumber dari Al-quran, Hadits, dan pendapat para fuqoha, Pasal 19 huruf Peraturan Pemerintah No.9 Tahun 1975, jo. Majelis, serta KHI pasal 116. Hakim menetapkan pertimbangan permohonan perkara gugat cerai ketika suaminya mafqud atau hilang berdasarkan syarat-syarat dan bukti-bukti yang telah ada saat persidangan seperti telah meninggalkan lebih dari dua tahun, serta sudah tidak adanya harapan untuk tetap mempertahankan rumah tangga. Bahwa dalam kasus perkara No. 2791/Pdt.G/2021/Pa.Kng telah sesuai dengan Fikih Munakahat dan Hukum Positif.

Abstract

The Wadiah Yad Adh-Dhamanah contract is one of the contracts used by BMT Talaga in Talaga Wetan Village, Talaga District, Majalengka Regency in its operations. The Wadiah Yad Adh-Dhamanah contract is applied to education savings products, where customers or members of BMT Talaga entrust their assets to the institution, and the institution may utilize the entrusted assets, from which it will fully benefit. The institution may provide bonuses to customers or members that were not previously promised at the time of the contract. However, the exact implementation of the Wadiah Yad Adh-Dhamanah contract in education savings products at BMT Talaga, as well as the Islamic law regarding this contract, is not yet known. This research aims to determine the implementation of the Wadiah Yad Adh-Dhamanah contract in education savings products at BMT Talaga. Additionally, this study also aims to analyze the Islamic legal perspective on the implementation of the Wadiah Yad Adh-Dhamanah contract in education savings products at BMT Talaga. This research is qualitative, utilizing field research methods. The data collection techniques include interviews and documentation. The results of this research are as follows: firstly, the practice of the Wadiah Yad Adh-Dhamanah contract in education savings products, which includes the deposit-taking for education savings and the bonuses provided by the institution. Secondly, the research indicates that the practice of the Wadiah Yad Adh-Dhamanah contract in education savings products at BMT Talaga in Talaga Wetan Village, Talaga District, Majalengka Regency, when viewed from the pillars and conditions of the contract, is in accordance with Islamic law, and the withdrawal system for savings is in line with Fatwa DSN MUI No. 02/DSN-MUI/IV/2000. However, the provision of bonuses for education savings is not in accordance with Fatwa DSN-MUI No. 02/DSN-MUI/IV/2000 because the bonuses for education savings at BMT Talaga are predetermined at the outset.
