Abstract

The Special Branch Leadership is a group of Muhammadiyah members and its supporters based in a city or country outside the territory of the Republic of Indonesia. This group is recognized and established by the Central Leadership of Muhammadiyah. The establishment of the Special Branch can be initiated by Muhammadiyah members or supporters in that location, or based on a direct initiative from the Central Leadership of Muhammadiyah.This research aims to understand the views of the Special Branch Leaders of Muhammadiyah in Saudi Arabia regarding Khiyar Aib in the context of marriage, as well as to comprehend what faults may entitle someone to the right of khiyar in marriage. This research employs a qualitative method. Data is gathered through a series of interviews supported by documentation. The subjects of the study include the daily management body and the chairpersons of the special branch leadership council of Muhammadiyah in Saudi Arabia. To collect data, the author utilizes various techniques, including observation, interviews, and documentation. The research is conducted in the city and district of Madinah Al-Munawwarah. According to the leadership of the special branch of Muhammadiyah in Saudi Arabia, the results of this research state that khiyar based on the faults of one's spouse is considered lawful and in accordance with Shariah. The khiyar right can also be brought before the court by both parties, whether male or female. Although this khiyar right remains relevant for application in contemporary times, it is crucial to exercise it with caution and not to use it as a pretext to undermine the sanctity of marriage. Additionally, it is important not to apply it hastily, so as not to create uncertainty in marital relationships.

Abstract

The growth of Islam in Papua has an impact on the people's customs and culture, particularly marriage practices. This research's central issue is subdivided into a number of substance-related issues, including: 1) What is the common description of Papuan Muslim marriage in Kaimana Kota Village? 2) According to Islamic law, how does kafa'ah apply to marriages between Papuan Muslims? Researchers employed descriptive qualitative research with field research methods, two research orientations, namely the social and theological-normative (syar'i) approaches. Al-Qur'an, hadith, and a number of indigenous Papuan Muslim communities in the Kaimana Kota Subdistrict serve as the data sources for this study. In addition, observation, interviews, documentation, and reference tracking were employed for data gathering. Then, the data is processed and examined in three steps, namely data reduction, data presentation, and conclusion. The findings of this study indicate that the description of Papuan Muslim marriages in Kaimana Kota Village is identical to that of Indonesian weddings in general, with the addition of a number of customary rules that bind the process, including mate selection, igiigree, nuhijna wafen, nobune muere, measuring noses for girls, consent and qabul, and nobune muere virnee naare. The valid kafa'ah consists of two major components: genealogy and religion. In terms of its application to Islamic law, the idea of kafa'ah is subject to two divergent perspectives. First, the situation in which nasab kafa'ah (huuree) is applied determines whether or not it is compatible with Islamic law. From the perspective of Islamic law, the prevalent religious kafa'ah appears harmonious.--Perkembangan Islam yang baik di tanah Papua turut mempengaruhi aspek adat dan budaya masyarakatnya, termasuk urusan pernikahan. Pokok permasalahan penelitian ini dibagi menjadi beberapa substansi permasalahan, yaitu: 1) Bagaimana gambaran umum pernikahan antara muslim Papua di Kelurahan Kaimana Kota? 2) Bagaimana penerapan kafa’ah dalam pernikahan antara muslim Papua ditinjau dari segi hukum Islam? Peneliti menggunakan jenis penelitian kualitatif deskriptif dengan metode field research (penelitian lapangan), dua pendekatan penelitian yaitu pendekatan sosial dan teologi-normatif (syar’i). Adapun sumber data penelitian ini adalah Al-Qur'an, hadis, beberapa masyarakat muslim Papua asli di Kelurahan Kaimana Kota. Selanjutnya, metode pengumpulan data yang digunakan adalah observasi, wawancara, dokumentasi serta penelusuran referensi. Kemudian, data diolah dan dianalisis dengan tiga tahapan, yaitu reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian ini menunjukkan bahwa gambaran pernikahan muslim Papua di Kelurahan Kaimana Kota sama dengan pernikahan masyarakat Indonesia umumnya kemudian ditambah dengan beberapa aturan adat yang mengikat prosesinya, di antaranya pemilihan jodoh, igiigree, nuhijna wafen, nobune muere, ukur hidung bagi anak perempuan, ijab dan qabul, dan nobune muere virnee naare. Kafa’ah yang berlaku terdiri dari dua poin utama yaitu nasab dan agama. Konsep kafa’ah dalam penerapannya dalam perspektif hukum Islam terbagi menjadi dua pendapat. Pertama, kafa’ah nasab (huuree) bisa selaras dan kurang selaras dengan hukum Islam sesuai dengan situasi penerapannya. Kedua, kafa’ah agama yang berlaku tampak selaras menurut perspektif hukum Islam.

Abstract

This study examines in depth various TikTok monetization strategies from an Islamic legal perspective. It analyzes methods such as live streaming with virtual gifts, brand endorsements, affiliate marketing, and direct sales through TikTok Shop to determine whether these methods are ethically and legally permissible under Sharia. The study is qualitative with a library research approach based on primary Islamic sources (the Qur’an and Hadith) and contemporary scholarly interpretations. The analysis is guided by classical Islamic contract frameworks like ju’ālah (reward-based contract) and ijārah (service-for-hire contract), as well as the higher objectives of Islamic law (maqāsid al-sharī’ah). Findings suggest that TikTok’s monetization features have the potential to align with Islamic principles, but only with proper ethical safeguards. Income from live streaming is considered halal if the shared content is beneficial, ethical, and non-manipulative. Endorsement and sponsorship agreements can be accepted under ijārah as long as they involve halal products and honest disclosure practices. Similarly, affiliate marketing aligns with ju’ālah principles if conducted transparently and truthfully. Transactions on TikTok Shop generally meet Sharia criteria as long as they adhere to the pillars (rukun) and conditions of a valid sale (bay’), including clear pricing and the sale of lawful goods. The study emphasizes the importance of clear ethical guidelines, public education, and platform policies that uphold Islamic values while fostering digital economic innovation. It also provides theoretical and practical contributions for content creators, regulators, and academics to build a responsible and Sharia-compliant online marketplace.

Abstract

This article examines how Islamic jurisprudence engages with transgender rights through two landmark fatwas in Egypt and Iran: Sheikh Muhammad al-Tantawi’s 1988 fatwa and Ayatollah Ruhollah Khomeini’s 1987 fatwa. Using qualitative methods—document analysis, hermeneutics, and comparative case studies—the study analyzes how religious authorities interpret sex reassignment surgery (SRS) within Islamic law. Al-Tantawi permits SRS only for intersex individuals, reinforcing binary gender norms and sustaining legal ambiguity and social stigma in Egypt, though his ruling nonetheless inspired activism for more inclusive interpretations. In contrast, Khomeini’s fatwa employs theological principles such as aṣālat al-ibāḥa (original permissibility) and taslīṭ (personal authority) to allow SRS for transgender individuals diagnosed with gender dysphoria, shaping Iranian state policy through formal medical protocols and insurance coverage. However, tensions remain, as this recognition coexists with the criminalization of homosexuality. The study shows that while medical diagnostics are central to legitimizing contemporary fatwas in both countries, such reliance also reinforces the pathologization of gender variance. By foregrounding this tension, the article demonstrates how medicalization both enables and constrains Islamic legal reasoning. It argues that applying maqāṣid al-Sharīʿa—particularly justice, welfare, and human dignity—offers a more compassionate and ethically responsive framework. The findings highlight the need for expanded ijtihād that incorporates non-binary and intersectional identities to support a more inclusive, human-centered Islamic legal approach.
