Abstract

The Special Branch Leadership is a group of Muhammadiyah members and its supporters based in a city or country outside the territory of the Republic of Indonesia. This group is recognized and established by the Central Leadership of Muhammadiyah. The establishment of the Special Branch can be initiated by Muhammadiyah members or supporters in that location, or based on a direct initiative from the Central Leadership of Muhammadiyah.This research aims to understand the views of the Special Branch Leaders of Muhammadiyah in Saudi Arabia regarding Khiyar Aib in the context of marriage, as well as to comprehend what faults may entitle someone to the right of khiyar in marriage. This research employs a qualitative method. Data is gathered through a series of interviews supported by documentation. The subjects of the study include the daily management body and the chairpersons of the special branch leadership council of Muhammadiyah in Saudi Arabia. To collect data, the author utilizes various techniques, including observation, interviews, and documentation. The research is conducted in the city and district of Madinah Al-Munawwarah. According to the leadership of the special branch of Muhammadiyah in Saudi Arabia, the results of this research state that khiyar based on the faults of one's spouse is considered lawful and in accordance with Shariah. The khiyar right can also be brought before the court by both parties, whether male or female. Although this khiyar right remains relevant for application in contemporary times, it is crucial to exercise it with caution and not to use it as a pretext to undermine the sanctity of marriage. Additionally, it is important not to apply it hastily, so as not to create uncertainty in marital relationships.

Abstract

The determination of the beginning of Hijri months in Indonesia reflects significant diversity, particularly in the methods adopted by different Muslim organizations. This study aims to examine the potential conflicts arising from the implementation of the new Imkān al-Ru’yah criteria in Indonesia and to compare them with the criteria used in Saudi Arabia and Malaysia. This research employs a qualitative approach, utilizing in-depth interviews and literature analysis. The collected data is analyzed through content analysis to understand the underlying factors contributing to the differences in Hijri month determination. The findings indicate that the new Imkān al-Ru’yah criteria have intensified long-standing disputes due to variations in crescent visibility in the eastern hemisphere. Key discrepancies arise from differences in hisab criteria, interpretations of Islamic legal principles regarding Ulil Amri, and the symbolic meaning of the crescent moon. The study also reveals that Muhammadiyah’s KHGT criteria align with those of Saudi Arabia, whereas the new Mabims criteria differ from those of Saudi Arabia. This study provides a comparative analysis of Hijri month determination criteria across multiple countries, highlighting the underlying theological and astronomical factors that shape different methodologies. The research offers insights into the complexities of Hijri calendar determination in Indonesia and contributes to discussions on standardizing crescent sighting criteria. The findings may serve as a basis for fostering greater alignment among Islamic organizations and regional authorities.

Abstract

This study investigates the public understanding and practical realization of post-divorce rights for ex-wives and children in Bantaeng Regency, where 379 divorce cases were recorded in 2022. Despite clear legal provisions, many of these rights remain unfulfilled, reflecting a gap between legal rulings and social implementation. The purpose of this research is to examine how the local community perceives and practices the fulfillment of these rights in light of Maqāṣid al-Sharī‘ah, the higher objectives of Islamic law. Despite clear legal provisions, many of these rights remain unfulfilled, reflecting a gap between legal rulings and social implementation. The purpose of this research is to examine how the local community perceives and practices the fulfillment of these rights in light of Maqāṣid al-Sharī‘ah, the higher objectives of Islamic law. The findings reveal a significant disconnect between legal provisions and societal behavior. Although the Bantaeng Religious Court implements Supreme Court Circular (SEMA) No. 1 of 2017, which mandates the inclusion of post-divorce obligations (e.g., maintenance of iddah, mut'ah, and child support) in court verdicts, enforcement remains weak. When fathers neglect their responsibilities, mothers are often unaware of their right to request legal execution of these obligations. This research contributes original insights into the socio-legal dynamics of post-divorce justice in rural Indonesia. It highlights the need for broader legal literacy and institutional support. The study recommends that legal authorities and local governments actively disseminate information about SEMA No. 1 of 2017 to ensure post-divorce rights are properly understood and enforced.

Abstract

This study aims to describe the views of the Mui Fatwa Authority of South Sulawesi Province Number 1 of 2021 concerning the Exploitation and Activities of Beggars on the Streets to Public Spaces from the Siyāsah Shar'iyah Perspective. In answering this problem, the author uses a normative shar`i approach and an empirical juridical approach. The method of data collection is done by way of interviews, observation, documentation, and literature study. The results of the research show that MUI Fatwa Number 1 of 2021 provides guidelines for Muslims regarding procedures for providing assistance to beggars that are more useful and encourage them to get out of the poverty cycle independently and with justice. Furthermore, the exploitation of street begging activities involving violations of laws is not recommended in Islam. From the perspective of Siyāsah Shar'iyah, the MUI fatwa regarding the prohibition of providing assistance to beggars on the streets can be seen from legal and political aspects. Basically, we as citizens who are good and obedient to religious rules should carry out the fatwa rules that have been issued by the Indonesian Ulema Council and should socialize more to the whole community so that the fatwas that have been issued are better understood and implemented in accordance with the regulations that have been made.

Abstract

Unity in determining the Hijri month’s beginning remains a significant issue in the Muslim world, including Indonesia. Muhammadiyah has proposed the Single Global Hijri Calendar (KHGT) as a scientific and integrative solution to standardize Islamic dates worldwide. This study aims to measure the levels of awareness, understanding, acceptance, and readiness of Indonesian Muslims toward the KHGT initiative. Using a descriptive-quantitative approach, data were collected from 300 online respondents via a Likert-scale questionnaire and analysed using descriptive statistics and Pearson's correlation analysis. The results show that all indicators fall within the high category: awareness (3.96), understanding (3.83), acceptance (4.32), and readiness (4.20). The correlation results between variables are significant and positive, with the strongest relationship found between awareness and understanding (r = 0.865). These findings indicate that higher awareness and understanding contribute to greater public acceptance of and readiness to adopt the KHGT. However, the dominance of Muhammadiyah respondents (88.9%) highlights the need for broader cross-organizational outreach. This study provides empirical evidence supporting the diffusion of religious innovations and underscores the importance of communication strategies that combine scientific education and cultural da’wah to promote the global adoption of the KHGT.
