Abstract

Perkawinan merupakan ritual atau perjanjian yang sakral dimana ditandai dengan adanya legalitas hukum untuk menentukan sahnya dengan ijab dan qabul. Perkawinan akan menjadi sah jika syarat dan rukun terpenuhi sesuai peraturan negara dan agamanya. Namun demikian, masih banyak permasalahan sosial dalam pelaksanaan perkawinan sedarah (incest) yang sudah jelas ada larangannya dalam KUHPerdata, UU Perkawinan, dan Hukum Islam. Dampak negatif dari perkawinan sedarah (incest) akan banyak terjadi pada anak hasil perkawinan sedarah (incest) diantaranya adalah hak perwalian, hak pemerliharaan, hak pendidikan dan hak warisan. Maka dari itu, penelitian ini akan meneliti bagaimana hak asasi anak incest dilindungi di Indonesia. Penelitian hukum yuridis normatif dari Undang-undang yang akan digunakan dengan metode pengumpulan data kepustakaan dengan analisis deskriptif dan deduktif. Kesimpulan dalam penelitian ini ialah anak hasil dari perkawinan sedarah (incest) tetap mendapatkan perlindungan hukum di Indonesia yaitu dalam Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010, Undang-undang Nomor 35 Tahun 2014 tentang Perlindungan Anak, Kitab Undang-undang Hukum Perdata Pasal 306, Keputusan MUI di Fatwa No.11 Tahun 2012.

Abstract

The takhrij al-Hadith method is a method used to search for and trace the authenticity of a hadith by explaining in detail about the matan sanad and the quality of the hadith. In this study, the author will discuss hadiths regarding advice on marriage. This research uses literature study as a knife in reviewing, then this research uses a qualitative approach through the takhrij method with descriptive-deductive analysis. The results of this research indicate that the quality of the hadith narrated by Imam Bukhori No. 4702 regarding the recommendation that marriage has quality and is deemed authentic lidzatihi. This happened because no defects were found in the hadith transmitters, the average position of the hadith transmitters was tsiqqoh. The content in the hadith explains that the recommendation for marriage is for someone who is capable (capable here means someone is capable emotionally, socially, financially, role, sexually, spiritually and age) and wants to get married, then he should marry. Meanwhile, for someone who cannot afford it, fasting is recommended to reduce sexual pressure and control vision.

Abstract

This study aims to describe the effectiveness of STEAM-integrated project-based learning in improving elementary school students' creative thinking and collaboration skills. The subjects of this study were at Babarsari State Elementary School, Depok Subdistrict, Sleman Regency, consisting of 14 grade V (five) students, with a composition of 8 male students and 6 female students, selected through purposive sampling technique. The type of research used was Classroom Action Research. Data were collected through interviews, observations, and tests. Data analysis was conducted using qualitative and quantitative techniques. The results showed that applying project-based learning models integrated with STEAM improved students' creative and collaborative thinking skills and learning outcomes. Students' creative and collaborative thinking skills increased from 26% and 28% to 78% and 80%, showing an increase of 52%. In addition, the average completeness of student learning outcomes increased from 21% to 79%, with a specific increase in the social studies learning outcomes of grade V students by 58%. This research highlights the effectiveness of the STEAM approach in improving students' skills and learning outcomes.
