Abstract

Abstract This study examines the implementation of terrorism prevention policy through a counter-radicalization program carried out by the Coordination Forum for the Prevention of Terrorism of East Java (FKPT East Java). The theoretical framework used is the theory of implementation of public policy with street-level bureaucracy approach fronted by Michael Lipsky to see how lower-level bureaucracy such as FKPT East Java implement policies on preventing terrorism in regional case studies, and Community Engagement Program (CEP) to see how FKPT East Java build networks and collaborate with various stakeholders in East Java to implement policies agreed upon at the National Meetings (National Working Meeting/Rakernas). The research method used is qualitative. The data collection techniques were done through in-depth interviews with several FKPT East Java board members. As well as observations of the implementation of counter-radicalization programs in East Java. Discourse Analysis is used as a data analysis technique to see whether the discourse in the regulations conforms with the interpretation of each of the FKPT East Java board members that have been interviewed. This research will produce an assessment to see whether the interpretation of the interview result conforms with the implementation in the field. The findings of this study indicate that in implementing terrorism prevention policies, FKPT East Java still depends on BNPT despite the efforts to involve FKPT East Java in policy formulation, however, FKPT East Java has considerable discretion in determining cooperation networks in implementing terrorism prevention policies when directly involved on the ground. Abstract

Tujuan dari penelitian ini adalah untuk mengetahui rekam jejak politik Burhanuddin Rabbani, salah satu tokoh politik di Afghanistan yang ikut berjuang melawan invasi Soviet ke Afganistan dan menjadi pimpinan negara tersebut pada tahun 1992-1996. Penelitian ini menggunakan literature review yang menelisik sumber dari artikel jurnal, laporan, maupun buku yang memuat perjalanan politik Rabbani mulai dari karir akademisnya hingga wafat pada tahun 2011. Penelitian ini difokuskan pada figur Rabbani dalam panggung politik Afganistan dan situasi di sekitarnya yang membentuk kepribadian dan karir politiknya. Dengan penelitian ini, dapat disingkap bahwa Burhanuddin Rabbani adalah figure politik yang kuat dalam percaturan politik di Afghanistan hingga menjadi sasaran pembunuhan oleh Taliban.

Abstract

Politics as a vital role in policy formulation has an influence on waste management in Indonesia. Ethical and normative violations regarding waste imports often occur. This is because there are gaps in legislative products and positive law in the same field. As stated in Law no. 18 of 2008 concerning Waste Processing shows that the import of waste is an activity that is prohibited in any form. However, there was an overlap in regulations, namely in Minister of Trade Regulation No. 30 of 2021 which notes that it is permissible to import waste for industrial activities except for Toxic and Hazardous Materials (B3). This writing aims to analyze various overlapping realities and possibilities regarding the implementation of these regulations. The political interest perspective also shows the dynamics of its formulation. It turns out that politicians tend to have different standing positions even though they are still in the same commission group. It cannot be denied that there is differentiation of views which are then grouped into camps based on several possible influences, namely variations in the background of politicians and interest groups or political parties. Therefore, it is classified in this research that the group that supports waste imports is Go Economy, and vice versa, those who reject waste imports are classified as Go Green. The meaning of this term shows a contradiction in attitudes and implementation which has resulted in a polemic during waste import regulations in Indonesia.

Abstract

Abstract Corporate crime has been a concern in the development of criminal law for a long time and the Indonesian society has concern regarding the implementation of the legal system. This research paper examines corporate crime in the context of environmental law in Indonesia, providing a legal-philosophical analysis of the responsibilities of corporations and the implications for victims of environmental crimes. The study highlights the philosophical underpinnings of the rule of law in Indonesia, emphasizing the collective will of the people and the limitations of state power. It investigates the intersection of criminal law, corporate law, and environmental law, particularly focusing on the Lapindo Mud Case in Sidoarjo, East Java as a significant example of corporate environmental malpractice. The paper discusses the principles of legality in criminal law, the complexities of corporate criminal liability, and the evolving definitions of victims in environmental crimes. It argues that environmental crimes perpetrated by corporations not only harm individuals but also have broader impacts on communities, ecosystems, and the state. Ultimately, the research calls for a more robust legal framework to hold corporations accountable and protect victims, advocating for an integrated approach that recognizes the rights of both individuals and the environment. Abstract

Penelitian ini bertujuan untuk mengkaji kekosongan materi terkait sejarah masuk dan berkembangnya agama Khonghucu di Indonesia dalam mata pelajaran sejarah di Sekolah Menengah Atas. Metode penelitian yang digunakan adalah studi pustaka (library research), yang melibatkan pengumpulan dan analisis sumber-sumber tertulis seperti buku, jurnal, artikel ilmiah, dan dokumen resmi. Hasil penelitian menunjukkan bahwa sejarah agama Khonghucu di Indonesia cenderung kurang dibahas secara mendalam dalam kurikulum mata pelajaran sejarah di sekolah menengah atas di Indonesia, meskipun memiliki kontribusi penting dalam pembentukan budaya dan keberagaman masyarakat Indonesia. Agama Khonghucu, yang diperkenalkan oleh komunitas Tionghoa sejak abad ke-3 Masehi, berkembang melalui asimilasi budaya dan berbagai tantangan, termasuk marginalisasi pada masa kolonial dan pasca-kemerdekaan. Penelitian ini menyoroti pentingnya memasukkan sejarah agama Khonghucu sebagai bagian integral dari materi pembelajaran sejarah untuk memperkaya wawasan siswa tentang pluralisme agama dan budaya di Indonesia. Dengan demikian, penelitian ini diharapkan dapat memberikan kontribusi terhadap pengembangan kurikulum yang lebih inklusif dan beragam.

Abstract

The Constitutional Court in its various decisions has not granted a petition on the grounds of open legal policy. Open legal policy is always identical to numbers, for example, term of office, parliamentary threshold, etc. Therefore, the purpose of this study is to examine and analyze the practice of testing legal norms that are open legal policy by the Constitutional Court and to examine and analyze the limitations of testing legal norms that are open legal policy by the Constitutional Court. The research method used in this study is legal research with a statutory, conceptual, and case approach. The results of this study indicate that the practice of testing legal norms that are open legal policy has been going on since the Constitutional Court was established. The provisions of legal norms that are open legal policy are essentially the absolute domain of the legislators so that other state institutions cannot change these provisions. However, under certain conditions the Constitutional Court can change these provisions as long as the norms clearly violate morality, rationality, and intolerable injustice; exceed the authority of the legislators; are part of the abuse of authority; cause institutional problems and lead to legal deadlock; are contrary to political rights; and are contrary to the principle of people's sovereignty.

Abstract

This article constitutes an examination of the legal protection of the rights and obligations of political party members, focusing on the crucial role of political party members in maintaining the health and dynamics of the political process. Additionally, this article comprehensively outlines the rights and obligations that govern the behavior of political party members. This research was conducted using the normative legal research method by analyzing primary and secondary legal materials, and applying normative or prescriptive analysis techniques. The analysis results indicate that the rights of political party members include the right to associate, assemble, express opinions, engage in politics, and obtain public office. Meanwhile, the obligations of political party members encompass concrete actions such as practicing Pancasila, upholding state integrity, participating in national development, upholding the supremacy of law, conducting political education, ensuring the success of general elections, and ensuring financial transparency. Furthermore, this article proposes improvements to Law No. 8/2008 in conjunction with Law No. 2/2011 to enhance the protection of the rights and obligations of political party members. This includes the important role of supervisory institutions and law enforcement agencies in safeguarding the rights and obligations of political party members, as well as ensuring compliance with the principles of democracy and the supremacy of law within the scope of political parties. In conclusion, this article provides a significant contribution to understanding the participation, rights, and obligations of political party members in the legal and democratic context of Indonesia.

Abstract

Presidential Regulation No. 83 of 2024 was enacted under the pretext of addressing the critical issue of national nutrition. However, beneath the technocratic narrative and the sterile legal language, there are strong indications that this regulation conceals a deeper political-economic agenda. This study aims to examine whether the establishment of the National Nutrition Agency is a purely administrative response or a covert instrument of power hegemony. The contribution of this study lies in uncovering how a seemingly neutral policy on nutrition governance operates as a mechanism of executive aggrandisement. By applying a Critical Legal Studies framework, this research advances the understanding of how legal instruments can embed and normalise political centralisation under the guise of public health policy. This area remains underexplored in Indonesian legal scholarship. The methodology employed is a juridical-critical approach based on Critical Legal Studies, which involves a normative analysis of the regulation's content and its relationship to relevant laws and regulations. The study's findings reveal that the BGN has an expansive authority structure directly under the President, creating a potential for vertical control over the distribution of national nutrition resources. Furthermore, there is a potential overlap with other agencies (such as Bapanas, the Ministry of Health, and the Ministry of Social Affairs), weak oversight mechanisms, and the potential normalisation of power expansion through administrative law. In this context, the law is no longer an instrument of justice, but rather a tool of political legitimisation within a technocratic framework. This study recommends an institutional evaluation of the BGN and strengthening of legislative control over the expansion of executive bodies.

Abstract

Abstract: In fighting terrorism, countries such as the Republic of Indonesia adopted legal measures and instruments to implement the policy lawfully. In the creations of such measures and instruments, the Indonesian government try to define terrorist and terrorism via legal approach. Anything that was to be considered terrorist or terrorism must fulfill the categories mentioned in the legal instruments, either government regulation or law. In the process, what defined terrorism was not just an act, even the financing of terrorism can be considered into account so that it can be brought to the court. The articles seek to elaborate the change and dynamics of defining terrorist and terrorism in Indonesian legal instruments since the first regulations about counterterrorism in 2002 until 2018. The process of making such legal instruments is met with critique and amendment that will be discussed further on the subtopics of the articles. Purpose: This article aims to elaborate the evolution, dynamics and change of the definition of terrorism with historical perspectives from 2002 to 2018. Design/Methodology/Approach: Literature review, reviewing several literatures that have related topics and selecting several parts of the book to be quoted in the articles that served as the foundation and analysis of the articles. Findings: This study shows that since the differences between Government Regulation Number 1 of 2002, Law Number 15 of 2003, Law Number 6 of 2006, Law Number 9 of 2013 and Law Number 5 of 2018 have almost the exact definition of terrorism, that was focusing on “sowing terror” into Indonesian society, but there are several additional changes each time related to what became the interest of the regime. All the aforementioned regulation for countering terrorism has derivates sanctions on those who support the acts that can be included as terrorist. These dynamics and changes from 2002 to 2018 points into one direction, that terrorism is a means to an end. Originality/Value: The article differs from the usual legal studies article because of the historical approach that was used to oversee the pattern of change in the definition of terrorism in Indonesian counterterrorism legal instruments.
