Abstract

Dalam pembelajaran ilmu hukum diketahui bahwa masyarakat memiliki perspesi yang berbeda-beda akan hukum. Pemahaman akan ilmu hukum cenderung diikuti dengan pengalaman apa yang dialaminya. Hukum dan ilmu hukum merupakan hal yang berbeda, namun memiliki keterkaitan yang saling berhubungan. Ilmu hukum tidak identik dengan hukum karena tidak setiap hasil penelitian dan perkembangan ilmu hukum dapat menjadi hukum. Agar dapat menjadi hukum, hasil dari penelitian, kajian maupun pengembangan ilmu hukum harus dituangkan dalam bentuk undang-undang. Dalam perkembangan masyarakat yang semakin modern, maka negara harus menjadikan permasalahan hukum apapun harus diselesaikan dengan baik serta cara pencegahannya. Untuk saat ini, isu hukum yang sering terjadi adalah perundungan. Pemecahan masalah dalam pengabdian ini diawali dengan melakukan analisa dan penandatanganan kesiapan untuk menjadi mitra Universitas 17 Agustus 1945 Surabaya. Kemudian persetujuan akan diserahkan pada POS PAUD Ananda Surabaya dan kegiatan pengabdian dilakukan pada Juli – Desember 2023. Pemilihan POS PAUD Ananda Surabaya dikarenakan kesesuaian jarak dari Universitas 17 Agustus 1945 Surabaya dan telah adanya tercipta hubungan kolega dengan sekolah tersebut sebelumnya. Dalam kegiatan pengabdian mendapatkan jawaban bahwa ada kekhawatiran ketika mengetahui perundungan akan hal yang dilakukan. Terjadi perbedaan pendapat antara ucapan yang bersifat guyon, serius dan penghinaan. Dalam hal demikian guru dan siswa POS Paud Ananda Surabaya menjadi lebih peduli akan hal-hal kecil

Abstract

The aim of this research is to elucidate the interpretation of Article 22, paragraph (2) of the 1945 Constitution of the Republic of Indonesia, particularly focusing on the phrases "obtain approval from the House of Representatives" and "in the following trial." Employing a normative legal research approach, the study utilizes a statutory regulatory approach, a conceptual approach, and a case approach. The legal materials encompass both primary and secondary legal sources. The research findings delineate that the phrase "obtain approval from the People's Representative Council" in Article 22, paragraph (2) of the 1945 Constitution of the Republic of Indonesia signifies: (i) the requirement for the President to submit the Perppu to the DPR for approval; and (ii) the discretion of the DPR to either approve or disapprove the Perppu. Meanwhile, the interpretation of the phrase "in the following trial" entails: (i) the period during which the Perppu is submitted to the DPR by the President; (ii) the initial session of the DPR following the submission of the Perppu; and (iii) the initial session period after the expiration of the maximum time limit for the President to submit the Perppu to the DPR.

Abstract

Constitutional Court Decision Number 85/PUU-XX/2022 explicitly states that there is no longer any difference between the Election regime and the Regional Election regime. This decision, in addition to providing legal certainty regarding which institution is authorized to resolve disputes over the results of the Regional Election, on the one hand also creates legal uncertainty itself. The legal uncertainty is regarding the extent to which the Regional Election regime is merged into the Election regime as stated in the decision, whether it is only limited to the principles of implementation and institutions authorized to resolve disputes over results or all of them. On that basis, this study aims to examine and analyze the urgency of forming an omnibus Election law in order to realize legal certainty for Elections in Indonesia. This research is a legal research using a statutory approach, conceptual approach, and case approach. The results of this study indicate that the meaning of merging the Regional Election regime into the Election regime must be interpreted as a whole. Starting from the organizing institution, the principles of implementation, to the institution authorized to resolve disputes over results. So, it is important to form what is called an omnibus Election law. This is because to realize legal certainty; To implement Constitutional Court Decision Number 85/PUU-XX/2022; and To realize a meaningful election.

Abstract

Article 28H Paragraph (1) of the Indonesian constitution expresses that the government is responsible for the availability of housing. In line with that, the government launched solution by holding the People's Housing Savings (Tapera). This study aims to examine and analyze the appropriateness of the amount of Tapera participant savings reviewed from the perspective of good governance and the mechanism for suing the government. The method used is the legislative and conceptual approach. The results of this study indicate that the amount of Tapera participant savings in Article 15 of Government Regulation No. 21 of 2024 is not by the principles of good governance. This is because the high amount of participant savings is considered to burden the lower class, lose the opportunity to participate in the Tapera program, and favor the middle to upper class. Therefore, the community can sue the government through the civil law or Ombudsman.

Abstract

Efforts to disrupt the independence of state officials elected by the DPR did not stop at the time of the removal of the Constitutional Judge some time ago, rather the practice was again carried out undemocratically and then legitimized by law, commonly known as autocratic legalism, through the issuance of a revision of the DPR Regulation on Rules of Procedure. Therefore, the purpose of this study is to examine and analyze supervision from the perspective of administrative law and the constitutionality of DPR RI Regulation No. 1 of 2025. This research is a legal research using a statutory, conceptual, and case approach. This research is important to be carried out so that the implementation of judicial power, especially the Constitutional Court, remains an independent power and can uphold law and justice without intervention from any party. The results of this study indicate that the regulation of recall of state officials elected by the DPR from the perspective of administrative law supervision cannot be justified. In addition, DPR RI Regulation No. 1 of 2025 has the potential to violate the provisions of higher laws and regulations, the theory of the hierarchy of laws and regulations, the theory of independence, the theory of authority, the theory of separation of power, and the Constitutional Court Decision Number 103/PUU-XX/2022.

Abstract

This study aims to analyze and find the legal reform of the division of authority for mineral and coal mining affairs between the Central Government and Regional Governments, so that a regulatory model can balance the principle of regional autonomy and national interests. This research is a normative legal research with a statute, conceptual, and case approach. This study found that after Law No. 3 of 2020 and Law No. 6 of 2023, there was a centralization of mineral and coal mining affairs, which led to the creation of injustice and legal uncertainty for autonomous regions. These regulations, from the perspective of balancing the principle of regional autonomy and the principle of national interests, need to be reformed trough the division of mineral and mining affairs between the Central Government and the autonomous regions based on the principle of justice by using the principles of externality, accountability, and efficiency. Meanwhile, the Central Government can use the principle of national strategic interests for several mineral and coal mining sub-affairs. In Addition, the delegation authority model should be removed and Article 18 paragraph (5) of the 1945 Constitution of the Republic of Indonesia needs to be amended, so that the division of government affairs provides justice and legal certainty for autonomous regions.

Abstract

The Constitutional Court in its various decisions has not granted a petition on the grounds of open legal policy. Open legal policy is always identical to numbers, for example, term of office, parliamentary threshold, etc. Therefore, the purpose of this study is to examine and analyze the practice of testing legal norms that are open legal policy by the Constitutional Court and to examine and analyze the limitations of testing legal norms that are open legal policy by the Constitutional Court. The research method used in this study is legal research with a statutory, conceptual, and case approach. The results of this study indicate that the practice of testing legal norms that are open legal policy has been going on since the Constitutional Court was established. The provisions of legal norms that are open legal policy are essentially the absolute domain of the legislators so that other state institutions cannot change these provisions. However, under certain conditions the Constitutional Court can change these provisions as long as the norms clearly violate morality, rationality, and intolerable injustice; exceed the authority of the legislators; are part of the abuse of authority; cause institutional problems and lead to legal deadlock; are contrary to political rights; and are contrary to the principle of people's sovereignty.
