Abstract

One of the crimes that is always in the spotlight in Indonesia is the problem of corruption. Corruption is no longer a foreign thing in this country. Indonesian corruption is even classified as an extraordinary crime because it has damaged not only state finances and the country's economic potential, but has also destroyed the pillars of socio-cultural, moral, political and legal security of Indonesia. As happened in the decision Number 3038 K / Pid.Sus / 2021, which stated that there had been a criminal act of corruption in the grant activity budget of the East Java Provincial Animal Husbandry Service in 2016, which was carried out by the Defendant IMAM HANAFI, SE bin MUCHAMAD HABIB. The empirical normative method is the method applied in this research where this method is carried out through research activities on reading materials and directly reviewing the objects being studied. The application of Article 2 Paragraph 1 of the Corruption Eradication Law in Decision Number 3038 K/Pid.Sus/2021 to the Defendant IMAM HANAFI, Se is in accordance with the fact that the defendant is a person assigned by the East Java Provincial Animal Husbandry Service to coordinate 5 Groups that will receive grant funds to buy livestock. That the judge in deciding the case considered that the defendant's actions had fulfilled the elements of a crime in Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Corruption.

Abstract

Penelitian ini dilaksanakan untuk melihat bagaimana penegakan hukum yang dilaksanakan oleh Pihak berwajib Polsek Sunggal dalam menanggani kasus judi online yang ada di wilayah Sunggal. Penelitian ini mengunakan metode kualitatif. Data yang digunakan bukan berupa angka-angka melainkan data tersebut bersumber dari data wawancara, catatan lapangan, catatan pribadi dan dokumen resmi lainnya sehingga yang menjadi tujuan penelitian kualitatif ini ingin menggambarkan kejadian yang sebenarnya yang ada diwilayah polsek medan sunggal. Hasil dari penelitian ini dilatarbelakangi dengan dasar hukum mengenai perjudian online yang diatur dalam Undang-Undang Nomor 7 Tahun 1974 mengenai penertiban perjudian. Hasil dari penelitian ini adalah pihak berwajib Polsek Sunggal telah memusnahkan 30 mesin judi online dan 4 orang tersangka pengguna narkoba dengan landasan hukum Pasal 303 KUHP memberikan sanksi pidana bagi penyelenggara perjudian online, sementara Pasal 310 KUHP menargetkan penyedia alat atau benda untuk perjudian

Abstract

Indonesia is a country with a contribution of 60% coming from MSMEs. So in Indonesia itself, MSMEs are business units that play a big role in the national economy to increase the country's foreign exchange. For this reason, it is necessary to study the development of MSMEs to increase Indonesia's economic growth and the concept of protecting MSMEs based on an economic justice approach. The type of research used in this writing is normative juridical which is descriptive analysis. The data collection technique used is documentation of data. The development of MSMEs is one of the government's efforts as ruler to increase investment and create job opportunities. These efforts are contained in Law no. 11 of 2020 concerning Job Creation and Government Regulation Number 7 of 2021 concerning the Development, Protection and Strengthening of Small Cooperatives and Businesses. The concept of a fair legal protection mechanism to ensure the inequality of the free market economic system which creates a gap between large entrepreneurs and small entrepreneurs, especially MSMEs.

Abstract

This study examines the enforcement of laws against the illegal cultivation of cannabis within the conservation area of Bromo Tengger Semeru National Park (TNBTS), viewed through the lens of Law No. 32 of 2009 on Environmental Protection and Management, and Law No. 35 of 2009 on Narcotics. Despite TNBTS being a highly protected area, 59 cannabis plots were discovered in its wilderness zone, resulting in significant ecological damage, including disruption of endemic plant habitats. This illegal cultivation constitutes dual violations: a narcotics crime and environmental destruction, both carrying severe criminal penalties. The findings highlight weak supervision by TNBTS management and insufficient legal outreach to local communities as contributing factors. Meanwhile, efforts to restore the ecosystem face challenges related to funding and inter-agency coordination. Employing a normative juridical approach, this study emphasizes the importance of collaboration among law enforcement, conservation authorities, and public education in preventing similar crimes and ensuring environmental sustainability
