Abstract

This study aims to find out Extra Judicial Killing in the perspective of Positive Law and Islamic Criminal Law.  Extra Judicial Killing is a crime that until now has become a byword among the public which can be interpreted as an act of any kind that causes a person to die without going through a legal process and trial, and is carried out by State Apparatus.  This is not in accordance with the Indonesian criminal justice system, especially in the investigation process or in other words not paying attention to the principle of fair trial.  Extra Judicial Killing in the perspective of Positive Law has fulfilled the elements of a material offense. Articles that fulfill are primary Article 338 of the Juncto Criminal Code Article 55 paragraph (1) of the 1st Criminal Code and a subsidiary Article 351 paragraph (3) of the Juncto Criminal Code Article 55 paragraph (1) of the 1st Criminal Code and are acts of any form causing a person to die without going through a process.  Laws and courts are legally carried out by State Apparatus. Meanwhile, from the perspective of Islamic Criminal Law, Extra Judicial Killing is included in the Jarimah Qatlu al-'amd. Abstrak Penelitian ini bertujuan untuk dapat mengetahui Extra Judicial Killing dalam perspektif Hukum Positif dan Hukum Pidana Islam. Extra Judicial Killing merupakan kejahatan yang sampai detik ini menjadi buah bibir di kalangan masyarakat yang dapat diartikan suatu tindakan apapun bentuknya yang menyebabkan seorang mati tanpa melalui proses hukum dan pengadilan yang sah, serta dilakukan oleh Aparat Negara. Hal ini tidak sesuai dengan sistem peradilan pidana Indonesia, terutama dalam proses penyelidikan atau dengan kata lain tidak memperhatikan prinsip fair trial. Extra Judicial Killing dalam perspektif Hukum Positif sudah memenuhi unsur-unsur delik materil. Pasal yang memenuhi yaitu Primair Pasal 338 KUHP Juncto Pasal 55 ayat (1) ke-1 KUHP dan subsidair Pasal 351 ayat (3) KUHP Juncto Pasal 55 ayat (1) ke-1 KUHP dan merupakan tindakan apapun bentuknya menyebabkan seorang mati tanpa melalui proses hukum dan pengadilan secara sah yang dilakukan oleh Aparat Negara. Sedangkan dalam perspektif Hukum Pidana Islam, Extra Judicial Killing termasuk dalam jarimah Qatlu al-‘amd.

Abstract

Many cases with a small percentange of losses tend to be processed till imprisonment. Limited prison capacity with an excessive number of inmates will become a consequence namely over capacity of inmates in correctiona institutions in. With the occurrence of over capacity in correctional institutions, the costs incurred by the state for convits will also be even greater. This research was conducted to examine whether the implementation of Restorative Justice at the Surakarta Prosecutor’s Office was in accordance with the Attorney General’s Regulation Number 15 of 2020. The research method used qualitative and the type research was field research. The research location was at the Surakarta State Prosecutor’s Ofice. The data analysis tecniques in this research used analysis according to Miles and Huberman. The result of this research explain that the termination of prosecution carried out by the Surakarta Prosecutor’s Office is in accordance with the Attorney General’s Regulation Number15 of 2020. The application of Restorative Justice in Islamic criminal law can also be seen in the imposition of sanctions for jarimah qisas and diyat. Forgiveness given by the victims or his families can abort the qisas sentence. Through the concept of diyat, compensation for the consequences of crime can be felt directly by victims or their families.

Abstract

Decision number 03/Pid.sus-Anak/2018/PN.Skt regarding child offenders who abuse narcotics even though the child has been legally and convincingly proven guilty in article 127 paragraph 1 letter a of law number 35 of 2009, but the child is only given a lenient criminal sentence. The research was conducted to examine the criminal liability of children as drug users. The research method used is qualitative research with normative research. The data analysis techniques used is content analyis. The result of this research explain that the criminal responsibility of children who abuse drugs in verdict number 03/Pid.sus-Anak/2018/PN.Skt is because children have fulfilled the theory of criminal responsibility and based on law number 11 of 2012 children can be held accountable for their actions, the sentence given is to undergo treatment at the SINAI Sukoharjo Mental and Drug Rehabilitation Foundation for 6 (six) months, the decision is also based on the judge’s consideration. Meanwhile, in Islamic criminal law, children as perpetrators of criminal acts will not be subject to punishment in the form of hudud, qishas/diyat, or ta’zir. Children will only be subject to ta’dibi which is coaching that provides lessons but does not affect their psycholog.

Abstract

Religious moderation is very important because the tendency of excessive or excessive religious experiences often leaves one-sided claims of truth and considers themselves the most right while others are wrong. Based on the above background, the researcher is interested in studying the extent of understanding of religious moderation among Surakarta students and how efforts are made to increase awareness of religious moderation among students. This type of research is field research with a qualitative approach that aims to describe the data obtained in the field regarding students' understanding related to religious moderation. The data sources used in this study are primary and secondary. The data collection techniques used were interviews and documentation. Students' understanding of religious moderation varied greatly from the results of several interviews conducted with 30 students in the Islamic Criminal Law Study Program, 20 students explained that moderation is tolerance and mutual respect between religious people.  This is not wrong, because one of the indicators of religion is tolerance. Meanwhile, the other 10 students have understood that moderation is our perspective or attitude in religion in moderation, understanding and practicing religious teachings that are not extreme. Meanwhile, 30 students of the Law Study Program at the Batik University of Surakarta most of them do not understand what religious moderation is in terms of terminology, but once they are given an understanding and indicators related to religious moderation, they understand. Most of them have been taught in Pancasila and Civic Education courses. Religious moderation can be used as a learning approach so that students can think critically and analyze the courses they are taught, which of course remains based on the principles of religious moderation.

Abstract

This community service aims to investigate the role of digital academics in strengthening the values of religious moderation as a response to the potential for identity politics in the community of Kadokan Village, Sukoharjo Regency. Identity politics is often a source of tension and conflict in various communities, especially in religious contexts. A qualitative approach was used in this research by collecting data through in-depth interviews, participant observation, and content analysis of digital platforms used by academics and local communities. The results of UIN Raden Mas Said's Community Service (PKM) regarding "Digital Academics as Strengthening the Values of Religious Moderation in Countering the Potential for Identity Politics in the Kadokan Village Community, Sukoharjo Regency" in terms of activities have run smoothly, on target, and in accordance with PKM planning. This activity also provides a positive and real influence by indicating openness in the way the community views the meaning of difference and plurality. The next step is an evaluation to see whether the level of tolerance in the PKM location area is increasing and whether moderate attitudes are also growing

Abstract

This socio-legal research investigates the accountability of criminal offenders and explores the implementation of restorative justice as an alternative framework for resolving criminal cases. Restorative justice, an emerging paradigm in the legal domain, prioritizes reconciliation and resolution over traditional punitive approaches. Law enforcement agencies, particularly the police and prosecutors, are pivotal to its application. This study aims to evaluate the practice of restorative justice in criminal case resolutions at the Sukoharjo Police Department and the Sukoharjo Prosecutor's Office. Adopting an empirical legal research methodology, data collection involved primary and secondary sources through interviews and document analysis. The qualitative data were analyzed using an interactive model to identify patterns and derive insights. The findings reveal that both the Sukoharjo Police and the Prosecutor's Office have incorporated restorative justice within their legal frameworks, albeit with notable differences in legal foundations and procedural approaches. The Sukoharjo Police exhibited a higher frequency of employing restorative justice compared to the Prosecutor's Office, indicating variability in institutional adoption and execution. These findings illuminate the diverse practices and challenges associated with integrating restorative justice into Indonesia's legal system. The study underscores the approach’s potential to enhance justice administration while identifying critical areas for institutional improvement and policy refinement.

Abstract

Traditional law enforcement often focuses on punishing perpetrators without regard to restoring victims and damaged social relationships. Restorative Justice (RJ) has emerged as an alternative that emphasizes restoring victim harm, offender responsibility, and repairing social relationships. Sukoharjo Regency implemented RJ to resolve criminal cases more humanistically and efficiently. This study aims to analyze the implementation of RJ in handling criminal cases at Sukoharjo Police, evaluate its compliance with Standard Operating Procedures (SOPs), and assess public views on this approach. This research used a qualitative method type empirical juridical. Data were collected through in-depth interviews with police officers, victims, perpetrators, and community leaders, as well as analysis of official documents such as police reports and related regulations. The results showed that the implementation of RJ at Sukoharjo Regency was largely in accordance with the established SOPs. The mediation process is conducted transparently and involves all relevant parties. The community generally has a positive view of RJ, considering it a fairer and more efficient way to resolve criminal cases. However, there are several obstacles, such as limited trained human resources and a lack of public understanding of the RJ concept. RJ implementation at Sukoharjo District Police has successfully achieved the goals of recovery and restorative justice, although there is still room for improvement. Increased education and socialization to the community is needed, as well as additional training for police personnel to become more effective mediators. Sukoharjo Police are advised to increase RJ socialization programs, provide ongoing training for officers, and strengthen coordination with community leaders to support more optimal RJ implementation. Penegakan hukum tradisional seringkali berfokus pada penghukuman pelaku tanpa memperhatikan pemulihan korban dan hubungan sosial yang rusak. Restorative Justice (RJ) muncul sebagai alternatif yang menekankan pada pemulihan kerugian korban, tanggung jawab pelaku, dan perbaikan hubungan sosial. Di Kabupaten Sukoharjo sudah banyak pengimplementasian Restorative Justice untuk menyelesaikan perkara pidana secara lebih humanis dan efisien. Penelitian ini bertujuan untuk menganalisis implementasi RJ dalam penanganan perkara pidana di Sukoharjo, mengevaluasi kepatuhannya terhadap Standar Operasional Prosedur (SOP), serta menilai pandangan masyarakat terhadap pendekatan ini. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kasus. Data dikumpulkan melalui wawancara mendalam dengan aparat kepolisian, korban, pelaku, dan tokoh masyarakat, serta analisis dokumen resmi seperti laporan kepolisian dan regulasi terkait. Hasil penelitian menunjukkan bahwa implementasi RJ di Sukoharjo sebagian besar sudah sesuai dengan SOP yang ditetapkan. Proses mediasi dilakukan dengan transparan dan melibatkan semua pihak terkait. Masyarakat secara umum memiliki pandangan positif terhadap RJ, menganggapnya sebagai cara yang lebih adil dan efisien dalam menyelesaikan perkara pidana. Namun, terdapat beberapa kendala, seperti keterbatasan sumber daya manusia terlatih dan kurangnya pemahaman masyarakat tentang konsep RJ. Implementasi RJ di Sukoharjo berhasil mencapai tujuan pemulihan dan keadilan restoratif, meskipun masih ada ruang untuk perbaikan. Diperlukan peningkatan edukasi dan sosialisasi kepada masyarakat, serta pelatihan tambahan bagi personel kepolisian untuk menjadi mediator yang lebih efektif.  Sukoharjo disarankan untuk meningkatkan program sosialisasi RJ, menyediakan pelatihan berkelanjutan bagi petugas, dan memperkuat koordinasi dengan tokoh masyarakat untuk mendukung pelaksanaan RJ yang lebih optimal.

Abstract

In the development of legal systems, law is not merely a set of normative instruments but also a human-centered construct that must be interpreted through ethical and philosophical lenses. This article explores the integration of restorative justice into non-litigation arbitration as a reflection of the progressive law paradigm, which emphasizes the humanization of legal processes. Specifically, the study seeks to reconceptualize arbitration not only as a procedural mechanism but also as a transformative approach rooted in genealogical, historical, and philosophical dimensions. Employing a qualitative descriptive methodology, the research combines normative legal analysis with socio-legal perspectives. Literature and content analyses are used to trace the historical and theoretical development of both arbitration and restorative justice, with the aim of offering a framework for their convergence. This approach challenges the conventional boundary that restricts restorative justice to criminal law, extending its application to civil and commercial disputes through arbitration mechanisms. Findings suggest that integrating restorative justice into non-litigation arbitration provides a more inclusive, dialogic, and equitable path to dispute resolution. It allows for reconciliation and mutual agreement outside courtrooms, aligning with the ideals of justice as envisioned by progressive legal theorists such as Satjipto Rahardjo. This synthesis not only expands the functional scope of restorative justice but also revitalizes arbitration as a humane and socially responsive legal alternative in Indonesia.
