Abstract

The indigenous populations of Indonesia have experienced the deprivation of their rights to their ancestral lands since the era of Dutch colonialism. This article seeks to analyse the occurrence of the rights of indigenous peoples to their ancestral territories, and the state’s right claim over indigenous customary lands. This study is a qualitative method with a socio-legal research approach, focussing on theoretical and empirical work, combining doctrinal and non-doctrinal analysis for data interpretation. The findings indicate that the transfer of collective rights from indigenous communities to state authorities is rationalised through the omission of acknowledgement of unwritten customary law and the imposition of a positive legal framework centred on individual rights rather than collective rights. In contrast, the state acknowledges indigenous land rights to a restricted and contingent extent, contingent upon indigenous communities substantiating their rights within the framework of the state's legal system, maintaining occupation of their ancestral lands, and ensuring that such rights do not impede the state's business and economic interests.

Abstract

This paper examines the critical need to integrate the Global Protection Cluster (GPC) approach with local knowledge to improve the effectiveness of refugee aid programs. It analyses the foundational principles of the GPC method in conjunction with the valuable insights provided by indigenous knowledge systems, proposing a comprehensive model to align global strategies with local realities. The study highlights the multifaceted advantages of this integrated approach through an extensive literature review and illustrative case studies from various contexts, including Afghanistan, Jordan, Uganda, Ethiopia, and Indonesia. Particular emphasis is placed on the Rohingya refugee situation in Aceh, which serves as a pivotal case study demonstrating the transformative potential of incorporating local wisdom into program design. The paper advocates for a participatory model that prioritizes the active involvement of displaced communities in decision-making processes, ensuring that aid programs are culturally competent and responsive to refugees' specific needs. Key recommendations are provided for a wide range of stakeholders—policymakers, practitioners, organizations, and donors—emphasizing the importance of collaborative partnerships, adaptive program design, and community-led initiatives. The findings suggest that by embracing local knowledge and fostering inclusive participation, refugee aid programs can achieve greater sustainability and effectiveness, ultimately contributing to more resilient and empowered displaced populations.

Abstract

Studi ini untuk menganalisis wewenang dan peran BNN Aceh dalam merehabilitasi pengguna narkoba dan mengidentifikasi hambatan dan upaya yang dilakukan BNN Aceh dalam memberikan rehabilitasi. Kewenangan Badan Narkotika Nasional yaitu melakukan penyelidikan dan penyidikan penyalahgunaaan dan peredaran gelap Narkotika dan Prekursor Narkotika, sebagaimana dijelaskan dalam Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. Penelitian ini menggunakan metode yuridis empiris, pengumpulan data yang diperoleh secara kualitatif, data diperoleh dari data primer dan data sekunder serta data tersebut akan di analisis, kemudian hasil dari penelitian tersebut disusun secara sistematis untuk memperoleh kejelasan dari permasalahan yang hendak diteliti. Berdasarkan hasil penelitian, BNN Aceh memiliki peran penting dalam melakukan rehabilitasi terhadap penyalahgunaan narkotika di Aceh, termasuk memberikan rehabilitasi, tahapan rehabilitasi adalah rehabilitasi medis, rehabilitasi non medis, dan tahap pembinaan lanjutan. Hambatan dan kendala dalam   menanggulangi penyalahgunaan narkotika di Aceh, mulai dari kurangnya peran serta masyarakat, hingga anggaran yang tidak memadai untuk rehabilitasi. Upaya yang dilakukan adalah upaya pencegahan dengan tiga pendekatan, yaitu pendekatan sosial, situasional, dan pencegahan berdasarkan komunitas masyarakat.
