Abstract

Tulisan ini merupakan analisis atas pertimbangan hukum yang dilakukan oleh hakim dalam kasus Wanprestasi yang mengandung unsur hukum adat yaitu azas terang dan tunai. Penelitian ini adalah penelitian yuridis-normatif dengan pendekatan kualitatif. rumusan masalah dalam penelitian ini adalah bagaimana penerapan konsep adat te-rang dan tunai dalam praktek peradilan perdata berdasarkan Putusan Nomor :23/Pdt.G/2013/Pn.Bj. Hasil penelitian menunjukkan bahwa Hukum Positif dan hu-kum adat dapat digunakan bersama dalam hukum Indonesia karena memiliki tujuan yang sama yaitu untuk tercapainya keadilan. Dalam tulisan ini terdapat dissending opinion diantara majelis hakim yang memutuskan apakah ada unsur adat atau positif di dalam fakta hukum. hukum positif mungkin saja tidak sempurna dan terbatas da-lam mengartikan sesuatu dan hukum adat boleh saja digunakan dalam tujuan untuk tercapainya keadilan, kepastian dan kemanfaatan hukum untuk masyarakat.

Abstract

Earthquake and tsunami that occurred on December 26, 2004 has brought heavy casualties and one of them are children who lost parents. One of the efforts undertaken to protect them is by appointment or a trust either by others or close relatives. In this study known a few years after the Tsunami occurred, determining application rates of adoption / guardianship quite a lot of happenned in Banda Aceh and Aceh Besar, and motivation to perform the average because of economic interests related to money wages, pension or insurance held by children. The process of removal/custody of children is predominantly used by indigenous peoples in the community, and formal legal principle was used when dealing with law. In the field can be found that property management should a supervision from geuchik,tuha peut and Imum Meunasah, Tuha peut which is the Baitul Mal Village officials to prevent misuse. Keywords: Child, Victim, earthquake, Aceh

Abstract

Children are part of the younger generation as one of the human resources as potential successors inthe future. Violation of law that occurs in the community not only done by adults but also by children,the implementation of the sentence would have been very different from adults. In children should morebe rehabilitation rather than punitive. The results showed that judge who examine and rule on cases ofchildren in conflict with the law in District Court Lhokseumawe still think positivistic/legalistic wheredecisions are decided by the judges commonly used approach based on the criminal justice system.

Abstract

During the Covid pandemic from 2019 until 2022, coffee prices in Gayo Highland have experienced multiple drops and high volatility. This study aims to investigate the role of the local government in maintaining the volatility of coffee prices in the Bener Meriah district of the Gayo Highland area. This study used data on coffee prices at the producer level, the planters and the reseller. o examine the local government policy and practice, we use the theory of Tas'ir al-Jabari. The results show that the local government has issued several policies to protect the planters' coffee prices, including activating the Warehouse Receipt System (WRS), conducting training and socialization on coffee management, and conducting coffee rehabilitation and rejuvenation programs. However, the local government's effort has yet to be maximized due to the lack of power of the local government to intervene over the price volatility. The prices are heavily influenced by supply and demand, as are the prices of other commodities. Therefore, the local government's policies for securing coffee prices have yet to be able to reflect the principles of at-Tas'ir Aljabari, in which the ruler has absolute authority to control and manage the market price of coffee beans in the Gayo Highland region. Abstrak: Selama pandemi Covid dari tahun 2019 hingga 2022, harga Kopi di dataran tinggi Gayo penurunan dan berfluktuasi. Penelitian ini bertujuan untuk mengetahui kebijakan pemerintah daerah dalam menjaga volatilitas harga di pasar lokal di wilayah Gayo. Penelitian ini menggunakan data harga kopi di tingkat produsen, pekebun dan reseller. Untuk mengkaji kebijakan dan praktik pemerintah daerah, kami menggunakan teori Tas’ir al-Jabari. Hasil penelitian menunjukkan bahwa pemerintah daerah telah mengeluarkan beberapa kebijakan dalam melindungi harga kopi pekebun, antara lain dengan mengaktifkan Sistem Resi Gudang (SRG), melakukan pelatihan dan sosialisasi pengelolaan kopi, melakukan program rehabilitasi dan peremajaan kopi. Namun, upaya pemerintah daerah belum maksimal karena kurangnya kekuatan pemerintah daerah untuk melakukan intervensi atas anjloknya harga biji kopi di pasar. Semua harga sangat dipengaruhi oleh penawaran dan permintaan. Oleh karena itu, kebijakan pemerintah daerah untuk mengamankan harga kopi belum mampu mencerminkan prinsip at-Tas’ir Aljabari, yang mana pemerintah mempunyai hak absolut untuk mengontrol harga pasar terhadap komoditas biji kopi diwilayah dataran tinggi Gayo. Abstract

This research aims to study the feminist concept as an entity in the process of forming a view of law and justice. With a normative -sociological approach, where data is obtained from the study of legal texts, expert opinions, and various other sources related to this topic. The results of the study show that the birth of male dominance in the thought process of legal formation, because male groups have misunderstood or biased in constructing the concept of man. According to feminists, legal structures are created by men and reinforce male values. By stating that the male group is the norm. Conversely, women are deviations from the norm and this is hegemony in the concept and reinforcement of patriarchal law and power. Feminists challenge and dismantle the belief or myth that men and women are so different, that certain behaviours can be distinguished on the basis of gender differences. Gender according to feminists is socially created or moulded not biologically. Sex determines physical appearance, reproductive capacity, but does not determine psychological, moral or social traits. Feminist legal theory or Feminist jurisprudence is a legal philosophy based on gender equality in the political, economic and social field

Abstract

This paper examines the critical need to integrate the Global Protection Cluster (GPC) approach with local knowledge to improve the effectiveness of refugee aid programs. It analyses the foundational principles of the GPC method in conjunction with the valuable insights provided by indigenous knowledge systems, proposing a comprehensive model to align global strategies with local realities. The study highlights the multifaceted advantages of this integrated approach through an extensive literature review and illustrative case studies from various contexts, including Afghanistan, Jordan, Uganda, Ethiopia, and Indonesia. Particular emphasis is placed on the Rohingya refugee situation in Aceh, which serves as a pivotal case study demonstrating the transformative potential of incorporating local wisdom into program design. The paper advocates for a participatory model that prioritizes the active involvement of displaced communities in decision-making processes, ensuring that aid programs are culturally competent and responsive to refugees' specific needs. Key recommendations are provided for a wide range of stakeholders—policymakers, practitioners, organizations, and donors—emphasizing the importance of collaborative partnerships, adaptive program design, and community-led initiatives. The findings suggest that by embracing local knowledge and fostering inclusive participation, refugee aid programs can achieve greater sustainability and effectiveness, ultimately contributing to more resilient and empowered displaced populations.

Abstract

Corruption is an act of deviation that is contrary to the principle of justice (al `adalah). Corruption with all its negative impacts produces various distortions to the life of the state and society can be categorized including fasad actions and cursed by Allah SWT. This research uses a normative approach. The results of this study indicate that in the aspect of Islamic law, there are several types of corruption regulated in Islamic law such as Risywah, Ghulul, Betrayal of trust, Ghasab and Al-Maks or acts of illegal levies. The type of punishment that can be applied to the perpetrators of corruption is ta'zir punishment where the type of punishment is determined by the government (ulil amri) because the sanctions are not explicitly mentioned in the Qur'an and Sunnah. However, in ta'zir punishment, corruptors can be sentenced to death, if the government wants it according to the negative impact of the crime committed.

Abstract

The migration of foreign workers (TKA) is a global phenomenon, not exclusive to Indonesia. Since the prophetic era, the role of foreign workers has been documented. In Indonesia, opposition to foreign workers persists because of the perceived threats to domestic employment. This study aimed to discuss the legal status and protection of foreign workers' rights in Indonesia based on Indonesian and Islamic laws. This study used a juridical-normative approach with a comparative law methodology. The findings revealed that Laws 13 of 2013 and 6 of 2023 acknowledge and protect foreign workers' employment in Indonesia, considering necessity, expertise, competence, and scientific advancements. The employment of foreign workers in Islamic jurisprudence is a novel legal challenge. The legal argument used was the Maslahah mursalah, which considers higher Islamic law principles. Islamic law permits foreign workers' employment, based on universal brotherhood, when benefiting from humanity. The recognition of foreign workers in Indonesia has implications for legally protecting their rights, which are aligned with human rights principles in labor law, including rights to facilities, wages, health care, religious freedom, political participation, and sociocultural engagement
